This course examines the contracts and specifications used in the industry in Ireland, specifically examining the Public Works Contracts and their structure. The module also will examine in detail the roles, responsibiltiesand powers of roads authorities as set out under the Roads Acts and defined by relevant case law. Learners will be introduced to the Law of Negligence and how it relates to roadworks including potential Liabilities. Outcomes On completion of this module the learner will/should be able to 1. Demonstate knowledge and applied understanding of the law relating to easements, rights of way and profit a prendre 2. Critically analyse and evaluate the key provisions of Irish Road Legislation and relevent case law. Demostrate the ability to interpret and give reasoned advice on the same. 3. Evaluate the impact of the law of negligence and the imposition liabilities with respect to roadworks and health and safety 4. Critically assess varying forms of contract and contrast with the Public Works Contract in relation to the incorporation ofterms and conditionsrelating to theexposure, transfer and mitigation of risk. 5. Demonstrate knowledge and applied understanding of issues that underpin and influence both contract and procurement of Roads Networks. Critically analyse the key conceptsthat may arise fromparticular procurement options. 6. Critically evaluate the standard dosuments in use in the preperation of Contract Documentation and specifications

3 Teaching and Strategies This module will be delivered through online learning. Students will be required to undertake self directed learning to complement class learning. Two offsite workshops will be held during the semester Page 2 of 6 Assessment Strategies Continuous Assessment will conribute 40% of the overall mark. Students will be given projects, essays and assignments that will relate to their chosen elective thus increasing their overall depth of knowledge within that particular strand. Students will be required to pass both the Continuous Assessment and Final Examination elements of the module Repeat Assessment Procedures Repeat assessments will be assigned where required Assessment Facilities All material will be available through Moodle. Additional material comprising of case studies, Articles and Case Law will be provided.
