You notified us that you need this leave beginning on (insert date) and that you expect leave to continue until on or about. insert date) Except as explained below, you have a right under the FMLA for up to 12 weeks of unpaid leave in a 12-momth period for the reasons listed above. Also, your health benefits must be maintained during any period of unpaid leave under the same conditions as if you continued to work, and you must be reinstated to the same or an equivalent job with the same pay, benefits, and terms and conditions of employment on your return from leave. If you do not return to work following FMLA for a reason other than (1) the continuation, reoccurrence, or onset of a serious health condition which would entitle you to FMLA leave; or (2) other circumstances beyond your control, you may be required to reimburse us for our share of health insurance premiums paid on your behalf during your FMLA leave. The requested leave will /will not be counted against your annual FMLA leave entitlement. 3. You will / will not be required to furnish medical certification of a serious health condition. If required, you must furnish certification by (insert date) (must be at least 15 days after you are notified of this requirement) or we may delay the commencement of your leave until the certification is submitted 4. You may elect to substitute accrued paid leave for unpaid FMLA leave. We will not require that you substitute accrued paid leave for unpaid FMLA. If paid leave will be used the following conditions will apply. (explain) 5a. If you normally pay a portion of the premiums for your health insurance, these payments will continue the period of FMLA leave. Arrangements for payment have been discussed with you and it is agreed that you will make premium payments as follows: (set forth dates, e.g. the 10th of each month, or pay periods that specifically cover the agreement with the employee.)

If payment is not made timely, your group health insurance may be canceled, provided we notify you in writing at least 15 days before the date that your health coverage will lapse, or, at our option, we may pay your share of the premiums during FMLA leave, and recover these payments from you upon your return to work. We? will? will not pay your share of health insurance premiums while you are on leave. 5c. We will/ will not do the same with other benefits (e.g., life instance, disability, Insurance, etc.) while you are on FMLA leave. If we do pay your premiums for other benefits, when you return from leave you will/ will not be expected to reimburse us for the payments made on your behalf. 6. You will / will not be required to present a fitness-for-duty certificate prior to being restored to employment. If such certification is required but not received your return to work may be delayed until the certification is provided. 7a. You are / are not a "key employee" as described in of the FMLA regulations. If you are a "key employee," restoration to employment may he denied following FMLA leave on the grounds that such restoration will cause substantial and grievous economic injury to us. 7b. We have / have not determined that restoring you to employment at the conclusion of FMLA leave will cause substantial and grievous economic harm to us (Explain (a) and/or (b) below, See of the FMLA regulations). 8. While on leave, you? will? will not be required to furnish us with periodic reports every. (Indicate interval of periodic reports, as appropriate for the particular leave situation.) of your status and intent to return to work (see of the FMLA regulations). If the circumstances of your leave change and your are able to return to work earlier than the date indicated on the reverse side of this form, you? will? will not be required to notify us at least two work days prior to the date you intend to report for work. 9. You will / will not be required to furnish recertification to us relating to a serious health condition. (Explain below, if necessary, including the interval between certifications as prescribed in of the FMLA regulations.) FMLA Definitions of Serious Health Conditions Federal Register / Vol. 60, No. 4 / Friday, January 6, 1995 Rules and Regulations 2273 A "Serious Health Condition" means an illness injury, impairment, or physical or mental condition that involves one of the following: 1. Hospital Care In patient care (i.e., an overnight stay) in a hospital, hospice, or residential medial facility, including any period of incapacity 2 or subsequent treatment in connection with or consequent to such inpatient care. 2. Absence Plus Treatment a. A period of incapacity 2 of more than three consecutive calendar days (including any subsequent treatment or period of incapacity 3 relating to the same condition), that also involves:

Treatment 3 two or more times by a health care provider, by a nurse of physician's assistant under direct supervision of a health care provider, or by a provider of health cam foes (e.g. physical therapist) under orders of, or on referral by, a health care provider; or 2. Treatment by a health care provider on at least one occasion which results in a regimen of continuing treatment 4 under the supervision of the health care provider. 3. Pregnancy Any period of incapacity due to pregnancy, or for prenatal care. 4. Chronic Condition Requiring Treatments A chronic condition which 1. Requires periodic visits for treatment by a health provider, or by a nurse or physician's assistant under direct supervision of a health care provider 2. Continues over an extended period of time (including recurring episodes of a single underlying condition); and 3. May cause episodic rather than a continuing period of incapacity 2 (e.g., asthma, diabetes, epilepsy, etc.) 5. Permanent/Long-term Condition Requiring Supervision A period of incapacity 3 which is permanent or long-term due to a condition for which treatment may not be effective. The employee or family must be under the continuing supervision of, but need not be 4 receiving active treatment by, a health care provider. Examples include Alzheimer's, a severe stroke, or the terminal stages of a disease. 6. Multiple Treatments (Non-Chronic Conditions) Any period of absence to receive multiple treatments (including any period of recovery therefrom (by a health care provider or a provider of health care services under orders of, or on referral by, a health care provider, either for restorative surgery after an accident or other injury, or for a condition that would likely result in a period of incapacity 3 of more than three consecutive calendar days In the absence of medical intervention or treatment, such as cancer (chemotherapy, radiation, etc., severe arthritis (physical therapy), kidney disease (dialysis). 3 Treatment includes examinations to determine if a serious health condition exists and evaluations of the condition. Treatment does not include routine physical examinations, eye examinations or dental examinations. 4 A regimen of continuing treatment includes, for example, a course of prescription medication (e.g. antibiotic) or therapy requiring special equipment to resolve or alleviate the health condition. A regimen of treatment does not include the taking of over-thecounter medications such as aspirin, antihistamine, or salves, or bed rest, drinking fluids, exercise, and other similar activities that can be initiated without a visit to a health care provider. ' Here and elsewhere on this form, the information sought relates only to the condition for which the employee is taking FMLA leave. 2 "Incapacity," for purposes of FMLA, is defined to mean inability to work, attend school or perform other regular daily activities due to the serious health condition, treatment therefore, or recovery therefrom. If a regiment of continuing treatment by the patient is required under your supervision, provide a general description of such regimen (e.g., prescription drugs, physical therapy requiring special equipment): 7a. (Employee Signature) (Date) Labor Department Issues Opinion Letters on FMLA The U.S. Department of Labor (DOL) has issued a number of opinion letters to help clarify various situations that have arisen in the interpretation of the Family and Medical Leave Act (FMLA). Among the points discussed in the opinion letters are the following: Designating Time Off as FMLA Leave. A FMLA-covered employer may designate and count an absence for sickness or injury against the employee's 12-week FMLA entitlement (and so advise the employee) even if the employee has not requested that it be counted as such, so long as the employee is an eligible employee and the reason for the absence is a "serious health condition" under the FMLA. Unmarried Couples -Leave for Birth of Child. Under the FMLA, a husband and wife working for the same employer are only entitled to 12 workweeks of FMLA leave during any 12 month period if the leave is taken for

6 the birth and care of a newborn child. However, this restriction does not apply to unmarried couples. The FMLA provision was intended only to eliminate any employer incentive to refuse to hire married couples. No FMLA Leave To Care For Sibling. The FMLA does not cover absences to care for a sibling (brother or sister.) No Compensation For Providing Medical Certifications. The FMLA does not require health care providers to complete the medical certification form, and there is no provision in the FMLA for providing compensation to health care providers for completing the certificates. However, failure of an employee to provide a medical certification to substantiate the need for FMLA leave for a serious health condition may jeopardize the employee's job and group health insurance coverage, as FMLA benefits and protection does not apply to a leave of absence where the employee is unable to provide the requested certificate. Repayment of Health Care Premium. If an employer and an employee cannot agree on how much to deduct from the employee's wages to repay the employer for paying the employee's portion of the health care premium, when the employee returns to work from a FMLA leave, then an additional deduction equal to a regular group health plan premium would be reasonable. FMLA Guidance Source: Department of Labor, Employment Equal Opportunity Commission Family Medical Leave Act Administration of the Family Medical Leave Act has been the most common subject of litigation in the courts for the last three years running. Because adhering to FMLA means granting only unpaid leave for specific health-related issues, it s likely that the primary reason for this is simply a lack of knowledge pertaining to the FMLA employers requirements for adhering to the Act. *FMLA must be observed by employers with at least 50 employees within a 75-mile radius. For example, if you operate three salons within 75-miles of each other, and each salon maintains a staff of 25, you are required to observe FMLA laws, an overview of which are as follows. Any employee that has been with you for one year or more, and works at least 25 hours per week is eligible for FMLA. A good rule of thumb is that if an employee is just shy of the weekly hours requirement, grant him/her FMLA. FMLA requires the employer to grant up to 12 weeks of unpaid leave to an employee for the birth of a child, or care of self, spouse or child if a serious health condition exists. FMLA grants leave to care for a parent if the employee is the primary care giver, or if a

7 physician deems the employee s presence to be beneficial to the health/recovery of the parent. FMLA can be taken in one leave, or in several smaller leaves. In the case of child birth, the FMLA clock begins to tick as soon as the employee is absent from work, regardless of whether other benefits are offered. For example, if 6-weeks of paid maternity leave are provided as a benefit, the employee is entitled to 6-weeks paid leave and 6-weeks FMLA unpaid leave, not 6-weeks paid and another 12-weeks of FMLA. FMLA requires the employer to guarantee the employee s position, pay and seniority during his/her time off. FMLA also requires the employer to provide the employee with FMLA information within 24 hours of when employee communicated the health issue. Meaning, when an employee states that she is pregnant, the employer must provide the employee with the FMLA Employer Response Form within 24 hours of her making her pregnancy known. This law holds fast with all FMLA issues. *Employers that are not required to observe FMLA, are still required to abide by other Title 7 laws, including making accommodations for pregnancy and the Americans with Disabilities Act.
