Please also give me a figure for the total wage bill for each division. Please could you further break down the figures to show the number of staff in each grade, in each division, whose salary is in excess of the maximum salary set down by the BBC in its standard pay bands, and the number with salaries of 100,000 or more. Please could you provide this information in the same format as your response RFI We are providing information relating to staff employed on permanent or fixed-term contracts as at 31 March Please note, due to small numbers in some of the divisions, we have grouped Director Generals Office, Editorial Standards & Policy and Policy into Deputy Director General Group in the tables below to prevent individuals from being identified. Please also note that this is a Headcount figure and will differ from the ETF count in the BBC Annual Review. 2 Table 1.2 below shows the total wage bill by division for the 12 months to 31 March The wage bill figures include pension and national insurance costs as well as overtime payments, continuing allowances such as unpredictability allowance and any other payments made in addition to basic salary. These figures are for staff on grades 2-11, regardless of their conditions of service. They also include staff who are on buy-out conditions and, therefore, sit outside the salary ranges. Buy-out salaries are used where it is operationally more efficient to replace separate elements of pay (salary, unpredictability allowances, overtime and additional days payments) with an all-inclusive payment.

3 Grade Number above salary roof (s.40) 07L (s.40) The BBC recognises that there are individuals paid above the salary roof in each of the bands. These individuals are long serving members of staff or those who possess a skillset that commands a higher market premium and those on buy out salaries. We are withholding this information broken down by division under section 40(2) (personal information) of the Act. As breaking the information down in this way would result in small numbers for many categories, it could lead to individuals being identified. Under section 40(2) of the Act, personal information about identifiable living individuals is exempt if disclosure to a third party would breach one or more principles in the Data Protection Act The individuals concerned would not expect their salary details to be disclosed to a third party. To do so would be unfair; therefore, disclosure would breach the First Data Protection Principle (fair and lawful processing). We are withholding salaries in excess of 100K under section 22 (1) of the Freedom of Information Act 2000 ( the Act ) because it is intended for future publication / because this information will be published in the BBC s Annual Report later this year. Section 22 states that information is exempt if it is held by a public authority with a view to its publication, by the authority or any other person, at a future date (whether determined or not). As section 22 is a qualified exemption, we are required under s 2(2) of the Act to assess whether the public interest in maintaining the exemption outweighs the public interest in disclosing the information ahead of the planned schedule. In favour of release we considered that there is generally a public interest in increasing the accountability and transparency of publicly-funded organisations. However, we do not consider that there is a particular public interest in the early release of this information. The factors in favour of disclosing this information in line with the planned schedule include:

4 The information, when published, will be presented in the context of helpful background information and context. There is a public interest in ensuring efficient use of BBC resource and in the general public receiving information in a way that enables them to understand and interpret it It is in the public interest that this information should be disclosed to all licence-fee payers at the same time, rather than provided in advance to one individual. I am therefore satisfied, in terms of section 2 of the Act, that in all the circumstances of the case, the public interest in maintaining the exemption outweighs the public interest in disclosing the information ahead of schedule and that it is reasonable in all the circumstances to withhold this information from disclosure the publication of the Annual Report later in the year.
