4 Lakehead Forest 2009 Independent Forest Audit Action Plan INTRODUCTION ArborVitae Environmental Services Ltd. conducted an Independent Forest Audit (IFA) on Lakehead Forest SFL # for the period April 1, 2004 to March 31, The final audit report was received by Greenmantle Forest Inc. (GFI) and the MNR on January 21, The Independent Forest Audit Process and Protocol, MNR February 2008 (Updated in January 2009 for use with 2009 audits), requires that an action plan in response to the audit report be prepared jointly by GFI and MNR and approved by MNR. The draft action plan was submitted for regional review July 13, 2010 which incorporated all district and company input as well as regional and corporate input to date. Comments from the regional review were provided July 16, Following revisions, corporate and regional review the action plan was finalized. The action plan addresses the 19 recommendations directed to the SFL and MNR Districts by providing a description of actions required, details on who is responsible and timelines for each of the action items, as well as methods of tracking progress. The other 3 recommendations and the licence extension recommendation have been addressed in the separate 2009 Annual Provincial Action Plan. Since receipt of the final audit report activities were being undertaken to address the audit recommendations as evidenced by audit action plan actions shown as being completed. 4

5 RECOMMENDATIONS R#2: In consultation with the Lakehead Area LCC, MNR Thunder Bay District shall develop and implement a training / orientation program for new LCC members and provide training to existing LCC members to improve committee functionality and effectiveness and provide an overview of the provincial forest management system. 1. Develop an orientation training program in consultation with LCC members to improve committee functionality and effectiveness; training will include the role of the LCC, the scope of the LCC, an overview of the provincial forest management and licensing system, and committee skills; to be delivered to new LCC members annually, while existing and alternate members are encouraged to attend. 2. Provide training and information, (electronic and/or paper) on related and timely topics of interest to the LCC. A standard LCC agenda item exists which allows the LCC to identify topics of interest where they would like additional training. 6 R#3: MNR Thunder Bay shall initiate discussions with Fort William First Nation to develop long-term approaches to working with and consulting with that community, and Nipigon and Thunder Bay MNR shall jointly, as per the cross-district protocol, seek to initiate similar discussions with Red Rock Indian Band. 1. MNR Thunder Bay will attempt to meet quarterly with Fort William First Nation to develop a good working relationship and discuss issues and topics of interest, as well as work towards developing long-term approaches to working with and consulting with Fort William First Nation. 2. MNR Thunder Bay will continue to seek a LCC representative from Fort William First Nation. Discussions have occurred whereby Fort William First Nation has designated a representative, but to date has not yet attended a meeting. MNR will send Fort William First Nation copies of LCC minutes. 3. MNR Thunder Bay will seek a FMP planning team representative from Fort William First Nation. Discussions have been initiated as of May 17, MNR Nipigon will attempt to meet quarterly with Red Rock Indian Band to maintain the good working relationship and discuss issues and topics of interest, as well as work towards developing long-term approaches to working with and consulting with Red Rock Indian Band. 7 R#4: GFI shall initiate efforts to develop separate communications protocols with the two local Aboriginal communities as a first step in improving communication. 1. GFI will contact the Chief of Fort William First Nation and the Chief of Red Rock Indian Band by phone or by at least once every quarter. 2. 9 R#6: Thunder Bay and Nipigon District MNR and GFI shall ensure that appropriate steps are taken (e.g. allocate additional resources, provide additional training) to minimize delays in delivering the next major planning product for the Lakehead Forest (anticipated to be the operating plan). 10 R#7: Thunder Bay and Nipigon District MNR shall work with GFI and affected overlapping licensees to develop approaches to minimize the potential for administrative delays to BBP winter operations. 1. GFI to plan sufficiently in advance of operations to allow additional time for any amendments and revisions (e.g. identification of new values such as streams). 2. GFI to develop an operations plan for the BBP that includes a forecast of what will be done on BBP, who the licensee will be, where harvesting will occur, when harvesting will occur, and how wood will move (are contracts for wood sales in place, concentration points off BBP to allow for movement of wood throughout the year etc.). 3. GFI, MNR Nipigon and MNR Thunder Bay will meet annually in October for GFI to present the operations plan for the BBP, and to discuss prioritization of licenses on the BBP, and FMP and AOC interpretation. The intent of this meeting will be to have all parties on board and avoid any delays of activities. 4. GFI will submit requests for BBP FRLs in a timely manner. 5. 11 R#8: The MNR and GFI shall identify opportunities to undertake harvesting in riparian zones in the second five-year period of the 2007 FMP. 1. During Phase II planning, the feasibility of implementing harvest in riparian areas using provisions contained in the Forest Management Guide for Conserving Biodiversity at the Stand and Site Scales (as well as utilizing information generated from the Water Classification Tool) on select water bodies will be assessed. 2. Competing values such as cottages and recreational activities, as well as public perception will significantly influence the choice of water body and feasibility of implementation. In such cases, cottage associations will be contacted to provide input into the Phase II planning. Viewsheds, timing restrictions, fire fuels, etc. will be considered during planning. 1. 12 R#9: GFI shall use its local knowledge and experience and information from scientific research and silvicultural assessments to develop detailed prescriptions for conversion activities for all appropriate forest units. An FMP amendment shall be prepared to add any necessary and appropriate SGR s which are based on these prescriptions into the 2007 FMP in time for the preparation for the 2011/2012 AWS, especially for mixedwood sites. 1. Evaluate and confirm existing SGRs particularly for ecosites which are predominately clay or rich sites, using local knowledge and experience, and information from scientific research and silvicultural assessments, to ensure appropriate conversion methods are available for planned activities. The achievement of silvicultural success by ecosite will be assessed. The evaluation and assessment will be in a written report by January 31, 2011 and the information from this report will also be included in the Year 4 Annual Report. 2. Following completion of review of the report in action 1 above, the 2007 FMP SGRs will be amended if required to reflect appropriate planned conversion silviculture treatments. Available time does not permit this being done before the AWS is prepared, however, the treatments in the AWS will be updated if necessary consistent with the amended SGRs prior to AWS approval. 1. 13 R#10: GFI shall develop and implement a slash / chipper waste management system to reduce the amount of productive area lost on the Forest. 1. GFI shall develop a procedure to address the issues outlined in the audit report that outlines the slash / chipper waste management system to be implemented to reduce the loss of productive area on the Forest. The procedure will include methods of tracking progress (e.g. locations of slash / chipper waste, reductions made, silviculture treatments) including use of annual reports. The procedure will be amended to the FMP to address the issues identified in the audit report. 2. The procedure will be implemented annually. 1. 14 R#11: GFI shall develop quality control measures for the reporting, identification and mapping of natural regeneration areas on both normal harvest and natural disturbance areas. These measures shall be implemented in time for the preparation of the 2009/2010 Annual Report. In addition, GFI shall develop and implement a procedure to ensure that all harvest areas have either received renewal treatments, or are carried over to the next five-year FMP operating term. This procedure shall be completed in the final year of each five-year period during Annual Report preparation. 1. GFI has established and implemented a procedure for identifying, mapping and reporting natural regeneration in Annual Reports. GFI internal records no longer include a two-year delay ensuring that each harvested stand is identified as either naturally or artificially treated the year it is depleted. Changes from natural to artificial treatment will be reported as supplemental in the Annual Report in the year the artificial treatment is applied, therefore a procedure is not needed for the final year of the FMP. As of the Annual Report, all outstanding natural regeneration has been reported. 2. In addition, GFI has developed a strategy to identify any potential silviculture tracking shortfalls in time for Year 3, 7 and 10 Annual Reports. Any shortfalls will be identified in the text of the Annual Report. The procedure will involve spatially comparing all relevant harvest depletions with renewal areas currently being tracked in the event that areas are missed in Action #1. 1. 15 R#12: GFI shall review the level and type of training provided to overlapping licensees on construction of culverts and revise as necessary to ensure that all culverts are installed to appropriate standards. 1. GFI will arrange for training programs regarding the techniques of culvert installation to appropriate standards required to meet the laws and regulations, including the CFSA, and approved activities of the FMP and AWS, the applicable forest management guidelines, as well as their Sustainable Forest Initiative Certification Program for Superior North Loggers Inc. (SNLI) operators responsible for installing culverts. This training will be mandatory for all SNLI members. 1. GFI General Manager 1. 16 R#13: MNR Thunder Bay and Nipigon Districts shall actively pursue opportunities to meet trilaterally with GFI to further improve working relationships and provide more consistent direction. (also refer to R#16 regarding compliance meetings) 1. MNR Thunder Bay, MNR Nipigon, and GFI will meet annually to discuss Annual Work Schedules prior to approval. 2. In addition to scheduled planning team meetings, MNR Thunder Bay, MNR Nipigon, and GFI will meet as needed to ensure the production of Phase II Operations Plan is completed. 3. 17 R#14: GFI shall develop and implement a comprehensive training plan and program for staff and maintain records of training that has been received. 1. 18 R#15: The MNR Nipigon District Manager shall take appropriate steps to assess the reasons for the ACOP preparation and reporting / approval issues and develop a remedy, and ensure that all outstanding obligations identified in this audit (closing non-compliances, approving BBP monitoring reports) are completed. 1. While ACOPs were not prepared for the Lake Nipigon West area of Nipigon District for a number of years, the practice of completing these plans was resumed for the year. ACOPs will be completed each year, individually for each area within the district. 2. Nipigon District Summaries of the area ACOPs will be produced each year. 3. Priority will be given to resolving issues in FOIP. Non-compliance reports will be followed through with and appropriately addressed. 4. There is no requirement under the EMA Strategy for BBP monitoring results to be approved. It is a requirement of the EMA Strategy for the MNR and the SFL holder to assess the results of the monitoring plan annually. This has been completed for , and It is also required that these results and any observations and recommendations be presented to the LCC for information and comment, and then submitted to the Nipigon District Manager and the Northwest Regional Director for consideration. Monitoring plan results will be presented to the LCC and submitted to the District Manager and Regional Director annually. 1. MNR Nipigon Area Supervisors. 2. MNR Nipigon District Manager. 3. 19 R#16: MNR Thunder Bay, MNR Nipigon, and GFI shall conduct joint annual meetings to discuss compliance monitoring matters in order to facilitate consistent delivery of the compliance monitoring program on the Lakehead Forest. 1. MNR Thunder Bay, MNR Nipigon, and GFI will meet annually for a compliance meeting to discuss forest compliance issues on the forest and to provide consistent messages on compliance matters. Issues will then be dealt with as per the Forest Compliance Handbook, 2010 to ensure consistent compliance application across the forest. Additional meetings will be held if compliance issues arise throughout the year. 1. 20 R#17: GFI shall establish and implement a mechanism for reviewing how well the overlapping licensees deliver environmental and compliance awareness training to their frontline staff and document the results of such reviews. 1. GFI will provide the overlapping licensees and their employees environmental and compliance awareness courses to ensure they are current with applicable laws, regulations, standards, forest management guidelines, and approved activities in the FMP and AWS, as well as the requirements to meet their Sustainable Forest Initiative Certification program; GFI will provide the frontline staff with documentation that proves that they have taken the course. 1. 21 R#18: Beginning in 2010, Nipigon District, in partnership with Thunder Bay District, shall lead regular five-year reviews of the BBP EMA Strategy, which will include GFI and other stakeholders as participants. The review shall include a determination of how the Strategy is impacting wood supply on the Lakehead Forest and all review recommendations and conclusions shall be supported by both Districts. 1. The BBP Monitoring Plan will be implemented including assessing the effectiveness of implementing various forest management activities to achieve objectives and strategic direction in the EMA Strategy and as reflected in the FMP. Annual BBP monitoring reports will be prepared based on this monitoring. 2. To assess the extent to which forest operations are meeting long term wildlife and ecological objectives the Year 3, 7, and 10 Annual Reports, prepared by Greenmantle Forest Inc., will include a section assessing/evaluating/summarizing the content of the intervening years of Annual BBP Monitoring Reports. The Year 3 Annual Report coincides with the recommendation to conduct a review in year As well there will be 3 Annual Reports with this section in a 10-year period. Both Nipigon and Thunder Bay MNR Districts will be involved in reviewing the Annual Reports. 3. As required of the BBP Monitoring Plan in 2012 the results from the previous five years of monitoring will be reviewed by Nipigon and Thunder Bay MNR Districts, Greenmantle Forest Inc., and the LCC to determine if changes to the monitoring plan process are required. 4. As per section of the EMA Strategy, At the end of the monitoring period [2012] established in the monitoring plan, a comprehensive summary will be prepared by the monitoring team which may include recommendations for modifying the direction contained in the EMA Strategy, if deemed necessary. The summary will provide a comparison between the levels of activities scheduled within the FMP and levels actually achieved which will include a discussion of access to wood supply. The monitoring team includes MNR Nipigon, and GFI. MNR Thunder Bay will be consulted, as appropriate, in the review of the EMA Strategy and the comprehensive summaries. The monitoring plan will be presented to the LCC for information and comment. 5. The Black Bay Peninsula EMA Strategy is a higher level planning document that must be considered during forest management planning. How the BBP EMA Strategy may impact wood supply on the Lakehead Forest is relevant to production of a forest management plan and this was evaluated during development of the FMP which incorporated implementation of the EMA Strategy. Production of the next 2017 FMP will also incorporate implementation of the EMA strategy and will consider the results of the monitoring above, particularly whether any modifications to the EMA Strategy have been made or whether the results of the monitoring showed any impacts on available wood supply. 21
