11 Legislative Context Public Procurement is heavily regulated Public Contracts Regulations 2015 Social Value Act 2012 Modern Slavery Act 2015

12 Public Contracts Regulations 2015 Public Sector: Directive 2014/24/EU 164,176 goods and services 4,104,394 works Apply to all contracts awarded by public bodies for supplies, services and works Tensions between local aspirations and European policy Openness, Transparency and Equality

13 Public Contract Regulations 2015 New 2015 Regulations - there are a number provisions which open up opportunities and remove barriers to SMEs: removing the PQQ requirement for contracts below the applicable threshold, 30 day payment terms are passed down the supply chain The University is encouraged to consider dividing contracts into lots. Where they choose not to do so they must explain their reasons.

14 Social Value Act 2012 a process whereby organisations meet their needs for goods, services, works and utilities in a way that achieves value for money on a whole life basis in terms of generating benefits to society and the economy, whilst minimising damage to the environment. If 1 is spent on delivery of services, can that same 1 be used to also produce a wider benefit to the community? Forms part of the University s KPI model and assessment of contractor performance

15 Social Value Act 2012 The sorts of benefits that can be delivered through the use of social value requirements include:- a) Creating supply chain opportunities for SMEs and social enterprises b) Wider community benefits such as staff volunteering days, sponsoring local sports teams, mentoring in local schools and making donations to community events c) Creating employment opportunities for the long-term unemployed or NEETs (those not in education, employment or training) d) Support for existing apprentices and/or recruitment of new apprentices e) Offering work placements to school children and young adults f) Providing career advice and information for young people on specific careers, such as construction, architecture or engineering g) Providing additional opportunities for individuals or groups facing greater social or economic barriers h) Improving market diversity

16 Modern Slavery Act 2015 The Act requires businesses to be transparent with regard to the slavery and human trafficking implications of their supply chains. Specifically, certain businesses will be required to produce an annual Slavery and Human Trafficking Statement. 31 March 2016 Turnover above 36 Million annually Operates in the UK The Statement is required to Map of supply chains Policies and procedures Risk assessment
