2 I. BACKGROUND The role of public procurement is becoming increasingly important for sustainable economic development. Governments in developing economies are remarkable purchasers of goods and services, and public procurement generally accounts for 12 percent of gross domestic product (GDP) in OECD countries. 1 At the same time, Indonesia has been increasing its public expenditures up to 36 percent or $22.16 billion of the state budget to bolster the economy. 2 Given that a large amount of government resources is spent on procuring goods and services, Indonesia could further leverage public procurement to promote economic growth by ensuring an open, transparent, and effective public procurement system. In 2007, the GOI established the National Public Procurement Agency (LKPP) as the central independent agency mandated to reform public procurement in the country. Responsible for formulating public procurement policy and oversight in their implementation, the National Public Procurement Agency has provided technical guidance through regulating detailed provisions. Recently in 2018, the GOI issued Presidential Regulation 16/2018, which provides guidelines in public procurement processes that are more in accordance with international standards. It facilitates harmonization with other regulations such as those issued by the National Public Procurement Agency. The regulation has further simplified public procurement procedures to create a more enabling environment for businesses to participate and increase competition in the public procurement bidding process. In addition to procurement laws, the National Strategy on Anti-Corruption as stipulated under Presidential Regulation 54/2018 has focused on corruption issues in 1) licensing and business administration, 2) state budget, 3) bureaucratic reform. It also has a specific target on preventing corruption in public procurement system. Despite these progresses, challenges remain for Indonesia in taking forward public procurement reform. Firstly, there is an absence of strategic planning that takes consideration new development in public procurement reform policies and initiatives. Indonesia has made progress towards public procurement reform with the enactment of new laws but should further utilize public procurement as a tool for sustainable economic development. Secondly, although the National Public Procurement Agency has continued to increase its capacity building efforts across the country, there is a lack of common understanding on regulatory principles of public procurement between the government and suppliers. The National Public Procurement Agency has been conducting capacity building workshops for suppliers since 2016, and yet could do more to ensure the supplier capacity building efforts are strategic. To respond to these challenges, the United Nations Development Programme (UNDP) opened discussions with key players in the government and private sector as well as identified areas of engagement in pursuing public procurement reform in Indonesia. UNDP in Indonesia has been supporting the GOI in promoting transparency, accountability, and efficiency in public service delivery. Through this new initiative, Promoting Integrity in Indonesia s Public Procurement, UNDP aims to support the GOI through 1) the strengthening of public procurement system by developing a strategy on public procurement reform and 2) the enhancement of supplier performance in public procurement and service delivery through capacity building

SCOPE OF WORK, ACTIVITIES, AND DELIVERABLES Scope of Work The main objective of this assignment is to conduct an analysis to identify training and development needs as well as to develop a strategy, including recommendations on curriculum/tool and an M&E framework for supplier performance in public procurement; contributing to their enhanced capacity in participating in public procurement and service delivery. The main outputs of this assignment will be: a. Training needs analysis (TNA) report on supplier performance in public procurement, including: results from the rapid TNA; strategic and operational recommendations of the training programme, training programme concept. b. Developed curriculum framework for the capacity building programme. Based on the training needs analysis, a curriculum should be developed to support the capacity building programme for suppliers. The curriculum should take into considerations of the use of technology; blended-learning methods; and appropriate national and international standards. c. Recommendations on M&E framework to measure supplier performance, including criteria, indicators, and methods. The consultant will work closely with the Directorate of Business Climate and International Cooperation at the National Public Procurement Agency (LKPP) as well as with UNDP s Democratic, and perform the following tasks: 1. Conduct a situation analysis on the current public procurement system and the management of supplier risk and performance, including having consultations with key stakeholders. 2. Assess and analyze training needs required to improve supplier performance in public procurement and reduce service issues related to quality and delivery; through focus group discussions and consultation sessions. 3. Based on the training needs analysis for supplier performance and consultations with key stakeholders, develop a capacity building strategy for supplier performance improvements with concrete recommendations, milestones, curriculum and M&E frameworks, as well as resource requirements. WORKING ARRANGEMENTS Institutional Arrangement The consultant will report to Deputy Director of Business Climate and International Cooperation, and Head of UNDP s Democratic. All deliverables submitted by the consultant should be approved by Head of UNDP s Democratic Reduction Unit. Duration of the Work 25 days within 3 months. Duty Station The assignment is both field and home-based. The duty station of the work while in Indonesia will be Jakarta. Travel Plan Below is an indicative travel plan for the duration of the assignment. Upon agreement, the consultant will be required to travel to the below indicated destinations. Applicants should include the relevant costs into the proposal. There may be also unforeseen travel that will come up during the execution of the contract which will be agreed on ad-hoc basis. Taking inputs and refining the training needs analysis report (2 days). Drafting a capacity development strategy, a curriculum framework, and recommendations for M&E framework (2 days). Presenting preliminary findings and a capacity development strategy to government officials at the technical level. REQUIREMENTS FOR EXPERIENCE AND QUALIFICATIONS Academic Qualifications: Advance degree in Economics, Laws, Business Administration, or related fields in social science Years of experience: At least 15 years for Master s Degree and 6 years for PhD of experience in public finance, public procurement, supply chains, and or international development; Expertise and experience in a) service delivery, particularly public procurement, supplier performance management, auditing, and anti-corruption; and b) institutional development for stakeholders involvement and coalition-building for reforms; A strong track record of experiences in advising governments and capacity building in public procurement systems; experience and knowledge of public procurement systems in South East Asia, particularly in Indonesia, is an advantage. III. Competencies and special skills requirement: Functional Competencies: Strong, proven capacity in research, data collection and analysis; Excellent public speaking and communication skills;

6 Experience in curriculum or capacity building programme development; Ability to plan for and produce quality results in meeting established goals; Fluency in English with excellent written communication skills, and strong experience in writing reports. Knowledge of rules and regulations, policies, procedures, institutional structures, performance measurement, professional and career development, and good practices of national and international public procurement systems. V. EVALUATION METHOD AND CRITERIA Individual consultants will be evaluated based on the following methodology: Cumulative analysis When using this weighted scoring method, the award of the contract should be made to the individual consultant whose offer has been evaluated and determined as: a) responsive/compliant/acceptable, and b) Having received the highest score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation. * Technical Criteria weight; [70% of total evaluation, max. 70 points] * Financial Criteria weight; [30% of total evaluation, max. 30 points] Only candidates obtaining a minimum of 49 point (70%) would be considered for the Financial Evaluation Criteria Weight Maximum Point Technical 70% 0 Technical Criteria A: qualification requirements as per TOR: 1.
