The Commission s core roles include reviewing and assessing applications for industry activity, consulting with First Nations, ensuring industry complies with provincial legislation and cooperating with partner agencies. The public interest is protected through the objectives of ensuring public safety, protecting the environment, conserving petroleum resources and ensuring equitable participation in production. PURPOSE OF POSITION The Oil & Gas Operations Officer conducts inspections and investigations of all oil and gas industry operations to monitor for compliance and initiate enforcement of the Oil and Gas Activities Act and specified enactments and associated regulations, the Petroleum and Natural Gas Act, Mines Act, the Environmental Assessment Act, and other applicable legislation. NATURE OF WORK AND POSITION LINKS The position works closely with compliance and enforcement officials within other government ministries and agencies such as the Ministry of Forest, Lands & Natural Resource Operations, Ministry of Agriculture, Ministry of Environment, Worksafe BC, Environmental Assessment Office, Fisheries and Oceans Canada, National Energy Board, Environment Canada, or Natural Resource Canada SPECIFIC ACCOUNTABILITIES / DELIVERABLES 1. Inspections and Audits Conducts inspections pertaining to Oil & Gas sector activities regulated by the Oil & Gas Commission, which may include but is not limited to inspection or audit of all phases, required records, tests, equipment and operating practices of the following for compliance with their associated legislation, permits, standards, and other requirements: MAILING 6534 Airport Road Fort St John BC V1J 4M6 T F

3 Well Operations: (a) drilling, completion and servicing (b) construction, maintenance, and deactivation of leases and access roads (c) drilling sump waste liquids sampling and disposal systems (d) flow test operations (e) liquid storage (f) issuance of remedial orders and/stop work orders if non-compliance, safety or environmental issues are noted. Pipeline operations: (a) Construction, maintenance, transmission, operation, and deactivation activities. Production Facility operations: (a) Construction, maintenance, operation, and deactivation activities. Roads and associated drainage and engineered structures: (a) Construction, maintenance and deactivation activities Other activities permitted by the Commission, or for other agencies through cooperative efforts. 2. Records, organization, and data management: (a) Analyzes submitted information to ensure that it meets the administrative requirements of applicable legislative acts and regulations (b) Prepares documents for hearings and court action; (c) Maintains inspection reports and summary documents; (d) Maintains compliance and/or enforcement data management system; (e) Generates reports, analyses data, monitors trends and recommends operational improvements. 3. Media/Public/First Nations: (a) Provides information to Commission media contact on sensitive issues regarding enforcement of legislation; (b) participates in public and First Nation meetings: (c) in cooperation with First Nations Liaison Officer, develops job exposure/shadowing programs for First Nations participants. (d) Participates in formal discussions involving industry, government agencies (e.g., provincial, federal, local), First Nations and other public interest groups and stakeholders to identify and resolve real and potential conflicts and improve/enhance industry practice in regard to operational activity. (e) Shares information regarding the C&E program and ensures concerns and issues are mutually understood and addressed. 4. Investigations and Enforcement: (a) Conducts investigations into suspected non-compliance to related legislation by the oil and gas industry (including environmental audits/enforcement work such as stream crossings, waste, transportation of hazardous waste etc.); (b) Obtains and assesses information and physical evidence from various sources, including observations, complaints, statements, field samples, photographs, reports, expert opinion; (c) Assesses information derived from investigations and determines and recommends an appropriate course of action including warnings,, tickets, administrative actions and penalties, contraventions, equipment seizure, cancellation of permits, or recommend prosecution,, Page 2 of 6

4 (d) Obtains and ensures security and continuity of evidence, (e) Takes field samples, provides expert testimony in court and administrative proceedings and acts as prosecutor for disputed violation tickets. (f) Compiles investigative information and writes enforcement reports for use in court or administrative enforcement proceedings. (g) Drafts and issues orders requiring shut-in, technical, environmental or safety requirements, or the submission of documents, plans or reports. (h) Monitors order requirements and deadlines. (i) Recommend or impose punitive enforcement actions. Plans, coordinates, participates and leads investigative teams in the conduct of provincial, inter-provincial, inter-regional or international investigation and enforcement projects: (j) provides team leadership to seconded or attached staff; (k) maintains and reviews case files and counsels other program staff on improved investigative/enforcement actions or options; (l) participates in staff recruitment and ensures recruit orientation and training are completed (m)liaises with other program staff to resolve any competing demands for technical support. (n) maintains comprehensive information regarding industry practices as related to enforcement and compliance needs; drafts minister s letters, briefing notes, reports, press releases etc. 5. Working Conditions: (a) May be required to work in adverse weather conditions and under hazardous working conditions which may require the use of specialized equipment. (b) May work under disagreeable conditions with members of the public, stakeholders, industry personnel, and/or First Nations who may be anti-government, anti-enforcement or hostile in nature. Must be able to exercise tact, diplomacy, and discretion to diffuse potentially confrontational or highly charged situations. 6. May be designated as Special Conservation Officers under the Environmental Management Act, Mines Inspectors (Health & Safety) under the Mines Act, as Inspectors under the Environmental Assessment Act, as Officials under the Agricultural Land Commission Act, and/or other designations. 7. Emergency Management: (a) Attends complaints, incidents, and other emergencies (b) Assumes roles within the OGC emergency response team or represent the OGC on site during incidents as per OGC emergency response procedures. (c) Conducts or evaluates root cause investigations. (d) May participate in provincial-level emergencies such as fires and floods. 8. Other duties as assigned. Directly Related Experience Includes: Experience in a position specializing in the compliance & enforcement of a broad legislative mandate, such as regulatory law enforcement. Knowledge: Thorough knowledge of all Provincial and Federal enforcement legislation. Knowledge of the criminal and administrative justice systems and procedures, case law and preparation of cases for those venues. Knowledge of Oil and Gas Commission policies, procedures and practices. Sound knowledge and application of investigative techniques Technical understanding of environmental protection management (e.g. water use, waste management, stream classification), and oil and gas industry impact on the environment. Knowledge of geology and its relation to the production of oil and gas. Knowledge of oil and gas industry operational practices Thorough knowledge of the safe operation and maintenance of equipment including firearms, vehicles, ATV s, boats, wilderness survival, first aid and handling of dangerous substances. Skills And Abilities: Excellent written and oral communication skills with the ability to represent the Commission in public meetings and through the media. Good interpersonal skills with the ability to deal effectively with the public in enforcement situations; in answering complaints and inquiries and explaining legislation to the public and industry; liaising with other ministries and enforcement agencies and testifying in court or other legal proceedings. Skill and ability to work with program staff with differing views and arrive at sound and appropriate solutions to complex enforcement issues. Developed skills in conducting investigations including exhaustive research and case preparation; interpreting the law as it applies to applicable legislation and interpreting policies, regulations and procedures.
