11 9.1 MASTER AGREEMENT BASS Preface Ths agreement s entered nto ths 1st day of July 1997 by and between the BOARD OF EDUCATON of the Warren Woods Publc Schools, herenafter called the "BOARD" and the Specal Educaton Paraprofessonals of Warren Woods, MFT/AFT, AFL-CO, Local #4706, herenafter called the "UNON". WTNESSETH WHEREAS, the BOARD has a statutory oblgaton pursuant to Act 379 of the Mchgan Publc Acts of 1965, to bargan wth the recognzed organzaton as the representatve of ts Specal Educaton Paraprofessonal personnel wth respect to hours, wages, and terms and condtons of employment. n consderaton of the followng mutual covenants, t s hereby agreed as follows: Recognton Clause The BOARD of the Warren Woods Publc Schools hereby recognzes the Specal Educaton Paraprofessonals of Warren Woods, MFT/AFT, AFL-CO, Local Number 4706 as the exclusve barganng representatve as defned n Act 379, Publc Acts of 1965, for the followng barganng unt: All Specal Educaton Paraprofessonals ncludng those n SL, POH, CRC, PP, EM, LD, One-on-One, Resource Room, ncluson and other Specal Educaton Paraprofessonals workng n the specal educaton program, but excludng: Regular educaton teacher ades, locker room, hall and study hall ades, elementary lbrary assstants, vocatonal educaton paraprofessonals, elementary lunchroom montors, communty educaton chld-care and latch key nstructors and ades, substtutes and all other employees. All personnel represented by the UNON n the above-defned unt shall, unless otherwse ndcated, hereafter be referred to as "paraprofessonals" or "employees", and reference to female shall nclude male personnel Contract Prntng Copes of ths Agreement shall be prnted at the expense of the BOARD wthn sxty (60) days after the Agreement s sgned and presented to all paraprofessonals now employed or herenafter employed, by the BOARD. Further, that the BOARD shall furnsh twenty (20) copes of ths Agreement to the UNON for ts use.

12 9.2 SPECAL EDUCATON PARAPROFESS1ONAL AND UNON RGHTS Use of Faclty The UNON and ts members shall have the rght to use school buldng facltes at all reasonable hours for meetngs under the same polces as other organzatons n the dstrct. Reasonable use of bulletn boards, malboxes, and the nter-school mal shall be made avalable to the UNON and ts members for notces and news of UNON busness Use of Equpment The UNON shall have the rght to use the typewrters and computers n the school buldngs when not n use and other school equpment ncludng audovsual, mmeograph, duplcatng equpment, at other than a Specal Educaton Paraprofessonals 1 workng hours when such equpment s not otherwse n use. The UNON shall pay for the reasonable cost of all materals and supples ncdent to the use of ths equpment. The UNON shall be lable for any damages or breakage to sad equpment caused by the neglgence of ts representatves To nformaton The BOARD agrees to furnsh to the UNON n response to reasonable requests, all requested avalable nformaton concernng the fnancal resources of the dstrct, salares, tentatve budgetary requrements and allocatons and such other nformaton as wll assst the UNON n conductng UNON busness. ^ ^ Agency Shop * Every employee n the representatve unt, as a condton of contnued employment, must ether jon the UNON or pay a servce fee equal to the dues of the UNON, and have sgned a payroll deducton request for same, wthn thrty (30) days of ratfcaton of ths Agreement or of ther date of hre, whchever s later. f at any tme an employee s over thrty (30) days n arrears n payment of dues or servce fee, the BOARD agrees to dsmss that employee wthn the next thrty (30) days and such dsmssal wll be deemed to be for just cause and not subject to the grevance procedure. m J m A. The MFT/AFT wll defend any acton or complant brought aganst the BOARD and/or m the Warren Woods School Dstrct under state or federal law as a result of the mplementaton of the above paragraph, and the MFT/AFT wll further ndemnfy the BOARD and/or Warren Woods School Dstrct n the event an adverse judgment s entered aganst the BOARD and/or Warren Woods School Dstrct under state or federal law as a result of the mplementaton of the above paragraph.

13 Dues Deducton Any employee may sgn a payroll authorzaton form for the deducton of dues from ther regular salary for the local, state and/or natonal UNON. Such deductons shall be made by the Payroll Department and remtted promptly to the UNON. The UNON agrees to make all rembursements to employees for any amount of dues or fees deducted by the BOARD and pad to the UNON by error n excess of the proper deducton and agrees to hold the BOARD harmless from any clams of excessve deductons. The deductons shall commence on the second pay of the month after the employee sgns the Warren Woods Publc Schools payroll nformaton form and the UNON enrollment card. The deducton shall contnue from the second pay of every month thereafter excludng July and August. Deductons for any calendar month shall be remtted to the desgnated fnancal offcer of Local 4706 along wth a lst of names from whom dues have been deducted. Ths lst shall be submtted no later than two (2) weeks after the frst of the month or one (1) week after the frst pay Other Deductons Allowed The BOARD shall also make payroll deducton upon wrtten authorzaton from employees for annutes, credt unon, Unted Foundaton, or any other programs jontly approved by the UNON and the BOARD Prvate Lfe The prvate and personal lfe of any employee s not wthn the concern of the BOARD except as t mpnges upon hs/her ablty to do hs/her job or upon the reputaton of the dstrct Non-Dscrmnaton The provsons of ths Agreement shall be appled by both the UNON and the BOARD wthout regard to race, creed, relgon, color, natonal orgn, age, sex, or martal status or membershp n or assocaton wth the actvtes of any employee UNON Probaton and Senorty A. New employees hred nto the unt shall be consdered as probatonary employees for the frst sxty (60) calendar days, excludng vacaton and recess tme. When an employee completes the probatonary perod he/she shall be entered on the senorty lst usng hs/her frst workng date, after beng hred, as hs/her senorty date. The senorty lst as presently consttuted shall govern for ndvduals employed at present. f two or more employees begn work the same day, ther senorty wll be determned by lot. The UNON shall represent probatonary employees for the purposes of collectve

14 9.2.9 Probaton and Senorty - Contnued barganng wth respect to salary, and condtons of employment except for dscplne and dscharge of the employee for other than UNON actvty. An employee whle on probaton shall not be elgble for benefts. B. The senorty lst on the date of ths Agreement wll show the name and frst work date m of employees of the unt. C. The employer wll keep the senorty lst up-to-date and wll provde the Local UNON m wth up-to-date copes upon request, or at thrty (30) day ntervals f changes have been made. D. Part tme Specal Educaton Paraprofessonals hred after September 1,1991 wll accumulate senorty on a pro rated bass. An ndvdual workng 3 hours or more per day wll accumulate full senorty. Someone workng less than 3 hours wll have ther senorty prorated accordng to the followng formula. f an employee works 1 hour per day they wll accumulate.33 years of senorty, 2 hours per day yelds.67 years of senorty and f employed 3 hours per day they earn 1 year of senorty. M Contract Admnstraton Perodcally throughout the school year, tme shall be set asde for meetngs of _ representatves of the BOARD and the UNON to dscuss matters of mutual concern, ncludng admnstraton of the contract. These meetngs wll be held at mutually satsfactory * tmes. These meetngs are not ntended to by-pass the grevance procedure. ^ New Postons Should the BOARD wsh to establsh any new paraprofessonal postons not specfcally mentoned n ths contract, the UNON wll be notfed pror to ts effectve date of operaton Savngs Clause f any provsons of ths Agreement or any applcaton of the Agreement to an employee or m group of employees shall be found contrary to law, then such provson or applcaton shall not be deemed vald and subsstng except to the extent permtted by law. f such occurs, the partes agree to meet wthn 30 days UNON Busness Days The UNON may authorze the use of UNON busness days by ts membershp by submttng a wrtten notce of such leave to the Personnel Offce at least by 1:30 p.m. pror to the day of absence.

15 UNON Busness Days - Contnued Safety The UNON presdent shall approve the use of each UNON busness day and so ndcate wth hs/her sgnature. There wll not be more than three (3) days absence for any one employee annually and there wll not be more than THREE (3) employees absent on UNON busness on any one day. The use of UNON busness days shall be drectly related to the busness of the UNON. The UNON presdent may authorze more than three (3) days absence per person as needed for Warren Woods arbtraton, fact-fndng, or unfar labor practce hearngs. The UNON presdent shall not utlze more than ten (10) days for UNON busness days annually. The BOARD recognzes the mportance of safe workng condtons. To that end the BOARD agrees to establsh a dstrct wde Safety Commttee. Barganng unt members shall be offered representaton on the commttee n proporton to ther percentage of the total number of dstrct employees. The commttee shall make recommendatons to the Drector of Mantenance and Operatons Professonal/Paraprofessonal Relatonshp A paraprofessonal wll not be left wthout supervson of a professonal for a lengthy perod of tme. 9.3 GREVANCE Defnton A clam by an employee, or the UNON that there has been a volaton, msnterpretaton or msapplcaton of any provson of ths Agreement and/or wrtten employee personnel polces drectly applcable to wages, hours or condtons of employment adopted by the BOARD may be processed as a grevance hereafter provded. Any Specal Educaton Paraprofessonal must be represented at all meetngs, all hearngs, and all steps of the grevance and/or arbtraton process by the UNON. The term "Days" when used n ths secton shall, except where otherwse ndcated, mean workng days of ths unt. The term "Days" shall mean calendar days f the grevance s fled on or after May 15. The tme lmts shall be reduced n order to affect a soluton by the end of the school year or as soon thereafter as s practcable.

16 9.3.2 Grevance Procedure Step 1: Wthn fve (5) workng days of the tme a grevance arses, an employee shall take m the matter up wth a Supervsor n an effort to resolve the matter nformally. n the event the 8 matter s not resolved nformally, may proceed to Step 2. Step 2: f the grevance s not resolved n Step 1, t shall, wthn fve (5) workng days of the meetng at Step 1, be reduced to wrtng on a grevance form and presented to a Supervsor. The wrtten grevance shall be fled wthn ten (10) days of the alleged volaton. The wrtten grevance shall name the employee(s) nvolved, shall state the facts gvng rse to the grevance, shall dentfy all provsons of ths Agreement alleged to be volated by approprate reference, shall state the contenton of the employee and of the UNON wth respect to these provsons, shall ndcate the relef requested. The BOARD shall gve the employee an answer n wrtng, no later than fve (5) workng days after recept of the wrtten grevance, wth a copy to the UNON representatve. Step 3: f the grevance s not resolved n Step 2, the UNON, wthn fve (5) workng days after recept of the answer n Step 2, may appeal the grevance to the Superntendent or a desgnee for a wrtten answer. The appeal should be n wrtng and shall contan the reasons for the appeal and a copy of the Supervsor's decson n Step 2. Wthn seven (7) workng days the Superntendent or a desgnee shall meet wth the UNON on the grevance and shall ndcate dsposton of the grevance n wrtng wthn fve (5) workng days after such * meetng wth a copy to the UNON. Step 4: Wthn ffteen (15) workng days after delvery of the decson of the Superntendent * or hs desgnee on any grevance as defned heren, ether party may at ts opton submt the grevance, f not settled, to arbtraton by wrtten notce delvered to the other party. n ths event, f the partes are not able to agree upon a mutually acceptable arbtrator wthn ten (10) workng days after the recept of such notce, ether party may wthn fve (5) workng days after the wrtten notce, request that the Amercan Arbtraton ASSOCATON select an arbtrator under ts rules whch lkewse govern the arbtraton proceedng. The BOARD and the UNON shall not be permtted to assert n such arbtraton proceedng any ground or to rely on any evdence not prevously dsclosed to the other party. The arbtrator shall have no power to alter, add to or subtract from the terms of ths Agreement, m or BOARD rule, order, polcy or regulaton. Both partes agree to be bound by the award of the arbtrator and agree that judgment thereon may be entered n any court of competent jursdcton. m ft &

17 9.3.2 Grevance Procedure - Contnued f ether party dsputes the arbtrablty of any grevance under the terms of ths Agreement, the arbtrator shall frst determne the queston of arbtrablty unless the party dsputng arbtrablty agrees otherwse. n the event that a case s appealed to an arbtrator on whch he/she has no power to rule, t shall be referred back to the partes wthout decson or recommendaton on ts merts. The arbtrator's fees and the expenses of arbtraton shall be shared equally by the BOARD and the UNON. The expense and compensaton of any person called as a wtness or otherwse partcpatng n the arbtraton shall be pad by the party callng such wtness or requestng such partcpaton Tme Lmts Any appeals not properly processed wthn the applcable tme perods shall be consdered settled on the bass of the last answer gven by the respectve school authorty. Tme lmts may be extended by wrtten agreement of the partes. n the event a grevance s fled after May 15 of any year and strct adherence to the tme lmts may result n hardshp to any party, the partes shall use ther best efforts to process such grevances pror to the end of the school term or as soon thereafter as possble Clam for Back Wages No clam for back wages shall exceed the amount of wages the employee would otherwse have earned at the regular rate. Any settlement of back pay clam shall be lmted to the amount of wages the employee would otherwse have earned from the employment of the BOARD, less any wages earned durng the tme he/she s off work Bndng Clause Any agreement reached between the BOARD and the UNON s bndng on all employees affected and cannot be changed by any ndvdual BULDNG REPRESENTATVES Representatves There shall be a grevance charperson, buldng representatve and alternate buldng representatve elected by the UNON. The UNON shall wthn thrty (30) days of the date of sgnng ths Agreement provde the BOARD wth a lst of ther UNON'S representatves,

18 9.4. Representatves - Contnued employed by the BOARD, who are authorzed to make commtments for the UNON. The UNON shall notfy the BOARD n wrtng of any changes of ther representatves durng the term of ths Agreement. m 9.5 NSURANCE nsurance benefts shall be provded for all full tme Specal Educaton Paraprofessonals (thrty [30] hours or more per week) Hosptalzaton For Specal Educaton Paraprofessonals employed before November 1, 1987, the BOARD wll pay the followng amounts toward the cost of the Mchgan Employee Beneft Servces (MEBS) opton. Ths amount becomes the maxmum amount that the BOARD wll pay for * hosptalzaton for the duraton of ths agreement. ^ 1 Person 2 Persons Famly 97/98 $330 $603 $677 98/99 $338 $618 $694 99/2000 $345 $630 $708 f the rate for the plan, or any other plan chosen by the employee, exceeds the amount that J the BOARD wll pay, the employee may have the addtonal cost deducted through payroll deducton. Avalable to the employee are: Blue Cross-Blue Sheld Mandatory Second m Opnon, Health Allance Plan or other plans that may become avalable. An employee may select one of the plans based upon meetng the mnmum enrollment elgblty requrements of the carrer. f the employee chooses a plan that costs the same, or less than the above amount, the BOARD wll pay for hosptalzaton; however, the employee wll not be rembursed for any dfference for a plan that costs less. Specal Educaton Paraprofessonals hred after November 1, 1987 wll be allowed $330 per month n 97/98, $338 per month n 98/99 and $345 per month n 99/2000 for hosptalzaton medcal nsurance to be appled to ther choce of nsurance plans from those lsted above. Any cost n excess of ths amount per month wll be deducted through payroll deducton f a plan s selected by the employee. Specal Educaton Paraprofessonals who choose not to take any hosptalzaton plan wll receve $1000 a year pad n two lump sums of $500, payable n December and June. m B ft 8

19 9.5.2 Lfe nsurance The BOARD shall provde group lfe nsurance protecton n the amount of $25,000 that wll be pad to the Specal Educaton Paraprofessonal's desgnated benefcary. The nsurance wll pay double the specfed amount n the event of accdental death and wll pay specfc benefts as desgnated n the polcy for dsmemberment Dental nsurance The BOARD wll pay the premum for the MEBS Dental nsurance Plan for each Specal Educaton Paraprofessonal and hs/her elgble dependents. Ths coverage shall nclude: Class 75% beneft pad for: 1. Basc servces, ncludng x-ray 2. Preventatve Servces 3. Restoratve 4. Oral Surgery 5. Endodontc 6. Perodontc Class beneft also ncludes an ncentve ncrement plan; the beneft pad for wll be 80% the frst succeedng beneft year and 10% more each beneft year thereafter not to exceed 100% benefts pad. However, ths ncentve plan s applcable provded that the covered ndvdual vsts a dentst for examnaton and dagnoss at least once durng the precedng beneft year, and all basc servces whch were recommended by the dentst as a result of the frst of such vsts were completed durng the beneft year. Class 80% beneft pad for Prosthodontc servces Class 80% beneft pad for Orthodontc servces to age 19, lfetme maxmum $1,200. Wth $1,000 maxmum per year per person Long-Term Dsablty nsurance The BOARD wll pay the premum for an nsurance polcy whch wll provde payment of twothrds (2/3's) of a Specal Educaton Paraprofessonal's monthly salary f he/she s off work because of accdent, njury or llness, provded the Specal Educaton Paraprofessonal normally works thrty (30) hours or more per week, wth payments to begn after sxty (60) days and contnung as requred to age 65. Ths coverage shall apply to all senorty Specal Educaton Paraprofessonals.

20 9.5.5 Optcal nsurance The BOARD wll pay the premum for optcal nsurance protecton for each Specal Educaton Paraprofessonal and hs/her elgble dependents. The plan wll be the Vson Care Program offered by Blue Cross-Blue Sheld of Mchgan. The plan wll provde for exam, lens and frames every year TB Tests A test for TB s requred for all new employees at the expense of the BOARD at a locaton desgnated by the BOARD. Test results must be submtted to the Personnel Offce as j requred. Those employees for whom the TB skn test produced nadequate test results " must take the skn test or provde test results at ther own expense. Employees who can produce satsfactory evdence that the TB skn test does not produce adequate test results for them, must have a chest x-ray at the expense of the BOARD at a locaton for whch the BOARD shall provde. 9.6 LEAVES Leave Allowance Temporary Leaves ^ A. Sckness One (1) day per month of employment, accumulatons wthout lmt, shall be allowed each Specal Educaton Paraprofessonal for personal llness. Fve (5) days of ths _ accumulaton may be used each year for llness n the mmedate famly and three (3) days may be used for busness. Ths leave, up to the full amount for the current year plus pror accumulatons, shall be avalable to the Specal Educaton Paraprofessonal at _ the begnnng of the work year or begnnng of employment. Should a Specal Educaton Paraprofessonal cease to be employed because of m resgnaton, dscharge, suspenson, layoff or leave, and have used more days than the total pror accumulaton plus the monthly allowance to date of cessaton, the excess days used wll be deducted from the last paycheck due the Specal Educaton m Paraprofessonal. B. Any Specal Educaton Paraprofessonal who resgns or retres shall receve a sum equal to hs/her accumulated full tme leave days tmes twelve ($12) dollars. A pro-rated amount wll be pad to part-tme Specal Educaton Paraprofessonals. Ths sum shall also be pad to the benefcary of any Specal Educaton Paraprofessonal who des whle an actve employee of the Warren Woods Publc Schools. Any Specal Educaton Paraprofessonal on layoff who s to be removed from the actve layoff lst shall receve a sum equal to the above lsted formula. ft 10

21 No Charge Leaves A Specal Educaton Paraprofessonal may be absent wthout loss of compensaton or charge aganst leave days for the followng reasons: A. When called and servng jury duty, and/or respondng to a summons or subpoena. B. Funeral Leave - When a death occurs n an employee's mmedate famly as defned below, the employee, on request, wll be excused from workng up to three work days. The employee shall receve ther regular straght-tme pay for up to three days. The mmedate famly s defned as ncludng the employees' spouse, parent, step-parent, sblng, natural or adopted chld, grandparent, grandchld, mother-n-law or father-n-law, daughter-n-law, son-n-law, brother-n-law, sster-n-law, and an ndvdual lvng n your home. Two addtonal days of leave wthout pay may be granted upon request Contagous Dsease An employee who contracted measles, mumps, scarlet fever, pnk eye, lce or chcken pox as a result of performng hs/her employment dutes and s absent from work as a result shall suffer no loss of compensaton, nor loss of sck leave days up to the maxmum of fve (5) days per year. These absences must be supported by a doctors note Mnor njury An employee who s njured on duty, and who, wth the agreement of hs/her superor, ncurs a loss of work tme because of the njury shall not suffer a loss of pay or a loss of a sck day for the tme lost on the day of the njury Leave of Absence A. Reasons for Leave Applcaton for leave wthout pay or benefts (except llness/dsablty) wll be consdered by the BOARD for up to one year for the followng reasons: 1. llness/dsablty (Mental or Physcal-Not ncurred on the job) 2. Chld care 3. Personal 4. Educaton 11

22 9.6.5 Leave of Absence -contnued B. Personal llness/dsablty Leave - (under care of physcan) Mandatory - no ncrement - wth senorty frst year 1 1. A leave for llness or dsablty wll have hosptalzaton and lfe nsurance protecton contnued for the duraton of the llness or dsablty for up to but no more than one (1) year. Other nsurances wll be dropped the frst of the month A followng the begnnng of the leave. nsurance wll be resumed on the frst of the month followng return from leave Vacances created by a person on leave of absence shall not be posted unless the sad leave shall be for at least forty-fve (45) workng days. Such vacances wll then be posted as temporary vacances for up to one calendar year. The temporary vacancy wll be reposted as a permanent vacancy at the end of one (1) year. C. Personal Leave Not mandatory - no ncrement - wth senorty frst year Upon an employee's wrtten applcaton, the BOARD may grant a personal leave of up to one (1) year. Applcatons wll be n wrtng and wll ndcate the reasons for the leave, and the begnnng and endng dates of the leave requested. Requests for leave, must» be submtted at least two (2) weeks before the leave wll begn, except n case of an emergency. Upon return from such leave, the employee shall be placed at the same poston on the salary schedule commensurate wth hs/her pror experence and shall accumulate senorty. m t s understood that such leave shall not count toward longevty servce credt. Employees on personal leave of absence shall not be elgble for BOARD pad frnge 1 benefts. Employees on unpad leaves shall have the rght to contnue frnge benefts f they forward tmely premum payments to the Employer. D. Durng an authorzed leave of one calendar year or less, an employee's poston wll be regarded as frozen, exempt from transfer and postngs. Upon return from an authorzed leave of one calendar year or less an employee shall return to hs/her former poston provded that the tme of return corresponds to the begnnng of a new semester. Any employee who s absent because of an njury, llness or dsease compensable under the Mchgan Workers' Compensaton Act wll follow these gudelnes to receve payment whle absent: 1. Once an employee s elgble to receve Worker's Compensaton checks, the check wll be maled drectly to the school dstrct, nstead of gong to the employee. Ths s to satsfy the RS requrements so that MP contrbutons can be tax-deferred. 2. The employee wll then receve two checks from the dstrct. One for the exact amount of the weekly Worker's Compensaton check (there can be no taxes charged on Worker's compensaton benefts and no MP contrbutons taken out). The employee wll receve a second check, as long as they have accumulated sck days, for the dfference needed to equal the regular pay amount. The MP contrbuton wll be taken out of the second check. Sck leave would be deducted at a proportonal rate untl such tme as all of the employee's accumulated sck leave has been exhausted. The accumulated sck days shall be charged only for that porton n excess of the compensaton payment. f the employee uses up all ther sck days, they wll then be responsble for ther own MP contrbutons. 3. f the employee chooses not to use accumulated sck days whle on Worker's Compensaton, they must notfy the dstrct of ther ntent. f the employee does not use sck days, they wll then be responsble for ther own MP contrbuton. Such tme shall not receve longevty credt. B. ncome protecton under the Mchgan Workers' Compensaton Act wll not commence untl the employee s off duty for seven (7) consecutve calendar days. Up untl that tme, sck leave days wll be deducted. f an employee s off for fourteen (14) consecutve days as the result of the alleged njury or sckness, all deducted sck leave days wll be deducted at a proportonal rate untl such tme as all of the employee's accumulated sck leave has been exhausted. The accumulated sck days shall be charged only for that porton n excess of the compensaton payment. 13

Employees wll lose no tme or pay and wll not be charged any sck leave for any requred vsts or return vsts to the employer's medcal clnc or employee's treatng physcan. 9.7 EVALUATONS Evaluaton Report tt Specal Educaton Paraprofessonals wll be evaluated at least once every three (3) years. The evaluaton wll be done by admnstraton wth nput from the assgned professonal. The wrtten evaluaton wll be gven to the employee and he/she may choose to wrte an attachment to clarfy any dfference of percepton n the evaluaton. f areas of serous concern are noted n the evaluaton, a wrtten plan of mprovement wll be wrtten and shared wth the employee. The employee wll be gven a reasonable tme to correct these areas. m Dscplne Constructve crtcsm shall be utlzed to attempt to correct the defcency before dscplnary - acton s taken. No employee shall be dscplned, or dscharged or deprved of any advantage wthout just cause. All dscplnary acton shall be n prvate. Any dscplne, dscharge or advantage asserted by the BOARD or any agent or representatve thereof shall be subject to the grevance procedure set forth. ^ Dscharge or Suspenson ^ A. Reprmands - All reprmands, oral or wrtten, shall be documented and dstrbuted, one copy to the employee, one copy to the UNON, and one copy to the employee's» personnel fle. J B. The UNON may consult wth the admnstrator who wrote the reprmand and may attach to the fle copy a wrtten statement made by the employee Personnel Fle m 14 Each employee shall have the rght upon request to revew the contents of hs/her own personnel fle n regard to evaluaton reports and anecdotal records except pre-employment evaluatons. A representatve of the UNON may accompany the employee n ths revew. Each employee wll be notfed upon the ncluson of any evaluaton reports or anecdotal records n hs/her own personnel fle. The sgnng by the employee of any tem placed n the fle merely acknowledges recept and does not mean they agree or approve of ts content.

The employee shall receve another $.25 per hour ncrease at the completon often (10) years of servce, sad amount to be non-cumulatve. Another $.25 per hour wll be added to the base salary at the completon of ffteen (15) years of servce, sad amount to be noncumulatve. Specal Educaton Paraprofessonals wll be pad ther regular daly rate, provded they report for work the work day before and the work day mmedately followng the holday, for the followng holdays: Labor Day, Thanksgvng, Thanksgvng Frday, Chrstmas Eve, Chrstmas, New Year's Eve, New Year's, Good Frday, Easter Monday, Memoral Day. f the school year begns after Labor Day, those Paraprofessonals contnung employment from the prevous school year wll receve pay for the holday, provded they report for work m on ther frst scheduled day. Part-tme Specal Educaton Paraprofessonals hred after November 1, 1987, wll not receve ths beneft. Such damage must occur wthn a school buldng or be drectly related wth the executon of the employee's assgned responsbltes. Such damage or destructon must not ^ be occasoned by carelessness or neglgence on the part of the employee. The BOARD shall not pay for damage or destructon of an employee's personal property f sad property s rembursable under the provsons of some polcy of nsurance other than that namng the _ school dstrct as assured. Automoble clams wll only be consdered and honored upon submsson of an offcal wrtten rejecton of a clam by the employee's nsurance carrer. An employee must fle a clam for damaged or destroyed personal property n wrtng no later than the end of the work day such damage or destructon occurred. f the damage or destructon occurs after the employee's normal work day whle they are workng n the m assgned stpend poston, such reportng wll occur at the begnnng of the next work day. The wrtten clams wll nclude what was damaged, the amount of damage, how t was damaged, the locaton of the employee's actvty at the tme, names of partes nvolved, and any other pertnent facts whch wll help expedte the clam Excess and Compensatory Tme The BOARD agrees to pay tme and one-half for any tme n excess of eght (8) hours per day or forty (40) hours per scheduled week, except f provson for compensatory tme s agreed to by the employee and the admnstraton.

27 Conferences When the dstrct sends a Specal Educaton Paraprofessonal to a conference, and sad conference s scheduled on a day or part of a day the Specal Educaton Paraprofessonal s not scheduled to work, he/she wll be pad a full school day's pay or actual tme spent at conference, whchever s greater Retrement Benefts The BOARD shall pay to the Mchgan Publc School Employees Retrement Fund the percentage of gross wage of each employee for retrement purposes that s requred by law nservce Tranng Any Specal Educaton Paraprofessonal who completes one of the three approved nservce tranng courses offered through MSD wll receve an amount of $400 by separate check. The amount wll be pad only once upon completon of a course, although ndvduals are encouraged to take addtonal courses. Approved courses are n the area of: Severance Pay 1. Basc nservce 2. Health care tranng 3. Communty based nstructon Upon retrement, death, or severance of employment, the school dstrct shall pay the followng amounts per year for each year of servce credt up to 30 years of servce provded the paraprofessonal works for the dstrct a perod of tme n whch he/she accumulates a mnmum often (10) servce credt years as recorded by the Mchgan Publc School Employees Retrement System (MPSERS). The amount wll be $50 for the 1997/98 school year, $60 for 1998/99, and $70 for 1999/2000. Should the paraprofessonal be employed by the dstrct at the tme of hs/her death, hs/her estate shall be elgble for such pay. 9.9 VACANCES. REDUCTONS. RECALLS & ASSGNMENTS VACANCES Postng Procedure A. Whenever a new poston s created or any vacancy n any Specal Educaton Paraprofessonal poston n the dstrct shall occur, the BOARD shall publcze the same by gvng wrtten notce of such vacancy to the UNON, notfyng those on lay off, and 17

B. n the perod between school closng n June and reopenng n September, the BOARD shall publcze vacances by: 1) postng as above n all buldngs n whch Specal Educaton Paraprofessonals are workng, 2) gvng wrtten notce to the UNON and 3) B malng an announcement to every Specal Educaton Paraprofessonal not then employed who has, before leavng employment n June, fled wth the Personnel Offce wrtten notce of hs/her nterest n recevng announcements together wth an address 8 to whch the announcements should be maled. All postngs wll also be maled to any 8 employee on the layoff lst. No vacancy shall be flled durng ths tme except n case of emergency on a temporary bass, untl such vacancy shall have been posted for at least 8 ffteen (15) calendar days. C. Vacances created by a person on leave of absence shall not be posted unless the sad leave shall be for at least forty-fve (45) workng days. C. n the event that a member of the Unon apples for a posted temporary poston, he/she wll return to hs/her former assgnment at the end of the temporary poston Reductons n Work Force Postons A. Reductons - Layoff 8 Whenever t becomes necessary to elmnate or reduce one or more postons wthn the Specal Educaton Paraprofessonal unt, then there shall be a meetng of the Specal Educaton Paraprofessonals to slot them nto an assgnment to a professonal. 29 Postons - Contnued from the top of the lst, each Specal Educaton Paraprofessonal wll be slotted nto hs/her assgnment f t stll exsts. The Specal Educaton Paraprofessonal whose assgnment s elmnated shall then select from any assgnment not already slotted. Any employee who s bumped nto a dfferent poston shall later have the rght of revertng to hs/her former poston f t becomes avalable. Ths rght to revert does not apply once the opportunty to revert s not accepted. B. Dsagreement Any dsagreement regardng reducton of work hours for a poston, whether permanent or temporary, wll be subject to grevance. C. Slottng Procedure When postons are beng reduced resultng n employee layoffs, a slottng meetng wll be held nvolvng any employees who have the potental to be affected by such reductons. However, f postons are beng changed and/or swtched, the representatves from the BOARD wll st down wth the Unon Executve Board and determne a procedure for accomplshng ths Voluntary Layoff f ths cannot be worked out among the representatves, then a slottng meetng wll be scheduled. An employee may volunteer for layoff provded that the followng are understood as condton of the layoff: A. The duraton of the layoff could be any perod of tme from a week to a year. B. The employee on voluntary layoff may exercse qualfcatons and senorty to bd on any posted poston. C. The employee on voluntary layoff may choose not to accept a recall as long as there are other lad off employees qualfed for recall. f there are none, or none accept, then the employee on voluntary layoff must accept the recall or resgn. However, f the poston avalable s not comparable n hours and benefts, the employee may contnue the layoff for up to one (1) calendar year (regardless of tme n the barganng unt pror to layoff). D. n the event that the voluntary layoff lasts all year, then the employee shall be reassgned to hs/her former poston. f that assgnment no longer exsts, then he/she shall exercse senorty to select an assgnment. The employee wll receve a letter at the tme of layoff from the Personnel Offce statng the date by whch he/she must choose an assgnment or resgn. 19

30 Substtute when Lad-Off Recall The BOARD shall assgn and utlze lad-off employees as substtutes. A. Whenever a poston s created or vacated, the postng process wll be satsfed. The resultng vacancy wll be offered to those Specal Educaton Paraprofessonals on layoff n senorty order. Such offer shall be by certfed mal, return recept requested, to the address of record. No response wthn fve (5) work days of recept of the offer shall be consdered a qut. However, where there s an offer of a poston of less than full tme or less hours than prevously worked, the Specal Educaton Paraprofessonal may refuse recall wthout loss of future recall rghts. B. Falure to respond wthn the above named perod shall termnate the employee's senorty rghts, except an employee on layoff who s sck or otherwse ncapactated shall notfy the BOARD of hs/her ntent to return as soon as possble. And from the date of such notfcaton, such employee shall be deemed to be on unpad sck leave. A substtute poston of ths nature shall be offered by senorty to any remanng employees who are on layoff. C. However, an employee shall reman on the layoff lst and subject to recall for as long as 1 the perod of tme as such employee has been employed by the dstrct pror to layoff or a maxmum of two (2) years, whchever s less. Senorty shall accrue for up to one (1) year and then be frozen Job Sharng The BOARD and the UNON agree that the sharng of assgnments wll be done under the condtons lsted below. These barganng unt members agree to these condtons by ther sgnatures. A. Two employees agreeng to share a poston wll submt a wrtten request for job sharng _ to the Personnel Drector. A job may be shared by semesters or by days, and s a full year commtment by the employees nvolved. A job share wll begn at the start of the school year or at the begnnng of a semester. B. Job sharers may substtute at ther regular rate of pay to cover each other's days of absence Assgnment " By June 1, the BOARD wll notfy each employee of ther work assgnment for the next school year. Upon notfcaton to the employees, no changes wll be made n the assgnment unless for reasons of economc necessty, nsuffcent enrollment or fundng changes n a program whch requres staffng adjustments. After assgnment to a poston and satsfactory performance theren, an employee shall expect to reman n such assgnment unless moved under the provsons of ths contract. M 9.10 HOURS OF WORK Hours Per Day The hours of a normal work day shall be establshed by the Superntendent and shall not exceed eght (8) hours per day for any assgnment. The HC Para shall be supervsed by a Regstered Nurse who s legally responsble for provdng approprate medcal servces to students. The Regstered Nurse decdes whch procedures may be delegated, prepares a health plan, and then provdes approprate tranng. The HC Para also dspenses medcaton at the drecton of the Regstered Nurse wth another staff person wtnessng dspensaton. DEFNTONS: SUPERVSON: HC Paras shall be drectly supervsed by a School Regstered Nurse who s contnuously avalable n person or by cellular phone. Phones shall be readly accessble to HC Paras. DELEGATON: HC Paras shall perform medcal procedures only when procedures are delegated by a Regstered Nurse who wll supervse the paras. TRANNG: Preservce and nservce tranng shall be provded to HC Paras. t shall be on-gong, perodc, and updated as changes occur.
