3 100 Introductory Statement Policy Statement - The following addendum has been developed for employees whose work location is based in Florida. This addendum should be read in conjunction with the Employee Handbook. For ease of use, policy numbers used in this addendum correspond with the applicable policy found in the Employee Handbook. The policies listed here contain additional information as applicable to employees based in this state. 306 Separation from Employment Final Paycheck - An employee's final paycheck after separation from employment will be provided within a reasonable time frame, but in no event more than 30 days after the employee's last working day. 501 Equal Employment Opportunity Florida employees are protected under both the Federal EEOC regulations and the Florida Civil Rights Act. In accordance with Florida state regulations, the Restaurant does not discriminate against an applicant or employee based on AIDS/HIV and Sickle-cell anemia. 603 Meal/Break Periods Adults - Florida does not require meal or rest breaks for adult employees. Minors - Minors who work 4 consecutive hours or more must be provided with a 30-minute meal period. This break requirement does not apply to minors at least 16 years old who have graduated from high school or received a high school equivalency diploma, minors enrolled in public school who qualify for a hardship, and minors working in domestic service or for their parents. 605 Lactation Breaks Female employees will receive a reasonable amount of break time during the workday to express milk for up to one year after the birth of the employee's child. When possible, break time will run concurrently with any rest period already provided to the employee. In compliance with the Fair Labor Standards Act, any break period of less than 30 minutes will be paid. Lactation breaks are not required if it would seriously disrupt the Restaurant s operations. The Restaurant will make a reasonable effort to provide employees with a private room or other location, other than a toilet stall, in close proximity to the work area to express milk in private. 702 Jury and Witness Duty Leave Policy Statement - Employers in Florida cannot discharge or threaten to discharge an employee for taking jury leave. Compensation for Exempt Team Members - In accordance with federal regulations, an exempt employee is paid his or her regular salary for working any partial workweeks but is not paid for any workweeks in which no work is performed for the Restaurant. An employee is entitled to any stipend paid by the court. Compensation for Non-Exempt Team Members Delmonico s Italian Steakhouse will comply with any applicable law or County ordinance requiring the payment of wages to employees who are called to jury service. If none applies, then Delmonico s Italian Steakhouse s stated policy will be followed.

4 707 Time Off to Vote Policy Statement - Employers in Florida are not required to provide their employees with time off to vote but cannot discharge or threaten to discharge an employee for voting or not voting. 709 Authorized Time Off Under Florida Regulations Policy Statement The Restaurant will grant employees time off in compliance with Florida state regulations as described below. Victims of Domestic or Sexual Violence The Restaurant will grant employees up to 3 working days of unpaid leave from work in any 12-month period if the employee or a family or household member of an employee is the victim of domestic violence or sexual violence. Disaster Service/Volunteer Firefighters - An employee of a state agency who is a certified disaster service volunteer of the American Red Cross may be granted a leave of absence with pay for not more than 15 working days in any 12-month period to participate in specialized disaster relief services for the American Red Cross. Such leave of absence may be granted upon the request of the American Red Cross and upon the approval of the employee's employing agency. An employee granted leave under this section shall not be deemed to be an employee of the state for purposes of workers' compensation. Leave under this act may be granted only for services related to a disaster occurring within the boundaries of the State of Florida, except that, with the approval of the Governor and Cabinet, leave may be granted for services in response to a disaster occurring within the boundaries of the United States. 801 Pay Rates and Pay Increases Call-Back/Reporting Pay - When an employee is called back to work beyond the employee's scheduled hours of work for that day, the employee shall be credited with actual time worked or a minimum of two hours of work, whichever is greater. Time not worked of the minimum of two hours is not counted as hours worked for the purposes of computing overtime compensation. 904 Continuation of Insurance Benefits (COBRA) Maximum Continuation Period - Each qualified beneficiary has the option of electing health insurance continuation coverage for up to 18 or 36 months, depending on the specific qualifying event. 905 Holidays Observed Holidays The Florida Restaurants are closed for business to observe the following holidays: Oviedo Location Thanksgiving Day Christmas Day Orlando Location Christmas Day Policy Statement- Due to the nature of the business, the organization does not offer paid holidays. Therefore, the Thanksgiving Day and Christmas Day Holiday are considered a regular day off for employees. Holidays Not Designated by the Restaurant - An employee may request time off for Sabbath observance or to observe any other particular holy day in accordance with his or her religion. An employee may also request time off to participate in a religious practice of his or her religion. Requests must be submitted in accordance with the Restaurant s attendance policy (See the Attendance policy for additional information). An employee will not be denied time off solely because it has been requested for religious reasons. Time off is generally granted so long as it does not create an undue hardship on the Restaurant.

5 1205 Workplace Violence Under the Florida Preservation and Protection of the Right to Keep and Bear Arms in Motor Vehicles Act of 2008, an employee is permitted to keep a legally owned firearm locked inside a private motor vehicle on the employer's premises.
