Background Kenya continues to experience the impacts of climate change such as drought and floods, which are felt across all sectors such as agriculture, energy, transport, etc. consequently threatening the country s socio-economic development. The country has little historical or current responsibility for global climate change with the country s GHG emissions being less than 0.1% of total global emissions. While adaptation is the priority for Kenya, action is needed to reduce GHG emissions that are projected to increase due to population and economic growth with 75% being from the land use, land-use change and forestry (LULUCF) and agriculture sector. Kenya is a Party to the UNFCCC and its Kyoto Protocol and Paris Agreement and is taking measures to implement relevant decisions. The country s Nationally Determined Contributions (NDC) under the Paris Agreement includes mitigation and adaptation contributions. On adaptation, Kenya plans to ensure enhanced resilience to climate change towards the attainment of Vision 2030 by mainstreaming climate change into the Medium- Term Plans (MTPs) and implementing adaptation actions. In mitigation, Kenya seeks to abate its GHG emissions by 30% by 2030 relative to the BAU scenario of 143 MtCO2eq. Achievement of the NDC will require both international support and investment in the form of finance, investment, technology development and transfer and capacity development as well as domestic implementation efforts. A robust MRV system is important for national policy decisions and is a key requirement under UNFCCC and the Paris Agreement. Kenya is expected to participate in existing MRV arrangements of the UNFCCC including preparation and submission of National GHG inventory reports, National Communications and biennial update reports as well international consultation and analysis processes. Further, Kenya will be required to participate in the 1

2 enhanced transparency framework established under the Paris Agreement, which builds on the existing arrangements. Kenya enacted the Climate Change Act in 2016, which provides an enhanced response to climate change action and provides mechanisms and measures to achieve low carbon and climate resilient development. The Act has key provisions on measurement, reporting and verification related provisions. Section 9 of the Act provides for the coordination of Measurement, Reporting and Verification processes by the Climate Change Directorate. The Directorate is required to coordinate adherence to the country's international obligations including reporting requirements. In addition, section 15 and 16 establishes climate change duties for the public and private entities and requires all entities to regularly report on climate change actions including on sectoral greenhouse gas emissions for the national inventory. Further, Section 22 of the Act requires the Cabinet Secretary in charge of climate change matters to make regulations to guide the reporting and verification of climate change actions. The Cabinet secretary is also required to biennially report to parliament on status of implementation of international and national obligations to respond to climate change, and progress towards attainment of low carbon climate resilient development. The Act also provides for the development of the National Climate Change Action Plans (NCCAP) as a five-year iterative tool for the mainstreaming of adaptation and mitigation actions into sector functions at the National and County Government levels. The country is finalizing the development of its National Climate Change Action Plan (NCCAP) for the period The NCCAP forms the framework under which Kenya is implementing its NDC. The NCCAP defines Kenya s MRV framework as an integrated framework for measuring, monitoring, evaluating, verifying and reporting results of mitigation actions, adaptation actions and the synergies between them; and support. The MRV+ system generates information for national and international reporting requirements. The Low Emission and Climate Resilient Development (LECRD) project supported the development of the second NCCAP. The project through an additional funding window under the UNDP NDC Support Programme will facilitate implementation of the NDC and Climate Change Act, Through this window of funding a gender lens will be applied to enable a more gender-responsive approach to the NDC planning and implementation processes thereby enriching national and county level outcomes. To support the operationalisation of relevant MRV provisions of Climate Change Act, and thus establish a robust MRV system to report on climate actions including NDC implementation, the NDC support programme is supporting the Ministry of Environment and Forestry to update the design of the national MRV system as well as develop regulations for the same. The Ministry is thus seeking the services of a short-term consultancy to design and develop a National MRV system. This assignment will provide a good basis for the development of the Regulations on the same under the Act. 2. Objective the assignment The main objective of the assignment is to design and develop an effective, implementable and robust National MRV system for Kenya. The designed MRV system will facilitate operationalisation of specific provisions in Climate Change Act and support Kenya implement MRV provisions under the UNFCCC and Paris Agreement. 2

3 3. Scope of Work The consultancy will design and develop a national MRV system. The assignment will cover the following: 1. An analysis of MRV processes in Kenya including under the National Climate Change Action Plan (NCCAP) I & II, ongoing related efforts including climate action and support tracking and registry. 2. Identify challenges, gaps, barriers and opportunities for effective MRV system, and recommend ways to address the identified challenges, gaps and barriers. 3. Undertake thorough review of international best practices in developed and developing countries, to inform the updating of the design of Kenya s MRV system 4. Based on the analysis of the National MRV processes and international best practice, design an updated robust, simple and comprehensive MRV system in the form of a manual and database. The MRV system should at minimum cover the following: o Key elements of Kenya s MRV system, that is, MRV of GHG emissions and cobenefits, MRV of mitigation actions and MRV of adaptation actions and MRV of support; o Methods for generating, recording, storing, aggregating, collating and reporting data on monitored parameters; o Sources of data, measurement methods and procedures, and data sharing protocols; including the frequency of monitoring/recording; and procedures for reporting by both public institutions (national and county levels) and private entities. o QA/QC procedures to be applied; o Gender responsive indicators to be mainstreamed in the MRV system o Linkages to SDG MRV system o Reporting templates for sectors and other institutions. o o MRV Institutional coordination structures, responsibilities and competencies. Opportunities to expand and improve the MRV system over time, as capacity is built within the implementing institutions; 5. Undertake initial pilot test run on the system to assess its practical application 6. Prepare a work plan for the implementation of the proposed MRV system. The work plan should include: Actions and activities including on capacity, that need to be undertaken to implement the system Implementation arrangements in relation to the institutional arrangements identified in 4 (above). Realistic timelines for the deployment of the MRV system. An objective budget with the estimated costs for implementing the system and identifying opportunities for support. 7. Provide recommendations on the regulatory frameworks necessary for the implementation of the MRV system The consultancy is expected to work closely with the Climate Change Directorate as the lead technical entity on climate change and hold regular briefing meetings. Any output of the consultancy should of essence seek the technical endorsement of the CCD before it is subjected to wider stakeholder validation. 3

4 Consultations with key sector climate change units, Council of Governors, civil society organisations (CSO) and private sector through series of meetings and workshops will also be a critical part of the consultancy. The consultant will also present the findings to stakeholders meeting at a national validation workshop, through the coordination of the Climate Change Directorate. 4. Expected Deliverables The consultancy should deliver the following: Inception report should include, but not limited to, a detailed methodology and work plan for the MRV consultancy, with clear delivery timelines and the required resources. Analysis report of MRV systems in Kenya, including the proposed arrangements under the National Climate Change Action Plans, on-going related projects, challenges, gaps and barriers Conduct interviews, surveys, working session as part of a multi-stakeholder consultative process to key Government actors (key ministries, parliament, Council of Governments) and other stakeholder groups (civil society, academia, private sector) involved in the relevant climate and MRV process to ensure inclusion of board views and interests in the system Manual and data base with updated simplified and robust design of MRV system for Kenya to be considered and approved by stakeholders. 5. Proposed Timeframe, Payment Schedule and reporting The assignment will be for a duration of 60 working days within a period of five months Deliverables Timelines Payments Inception Report Analysis report and report on consultations Draft manual and data base with updated design of MRV framework System and reports of consultations Final manual and data base including technical report on updated design of MRV system including annexes and templates, approved as validated by stakeholders. 5 6. Duty Station, Travel and Institutional Arrangement: Duty station: Home based with at least two missions to Kenya if contracted consultant is based out of Kenya. The consultant will be given access to relevant information necessary for execution of the tasks under this assignment; The consultant will be responsible for providing her/his own working station (i.e. secretariat, laptop, internet, phone, scanner/printer, etc.) and must have access to reliable internet connection; The consultant is expected to be available for consultations and be in reliable contact for a set number of hours that align with Government/UNDP business hours; The consultant will carry out his/her tasks under the overall guidance of the LECRD/NDC Project Coordinator, Climate Change Directorate of the Ministry of Environment and Forestry and UNDP; The consultant will report via , Skype calls to the Task Manager; Payments will be made based on the agreed financial proposal (contract is based on daily fee) and released upon submission of a certificate of payment request, indicating deliverables achieved and days worked to be verified and cleared for payment by the LECRD/NDC Project Coordinator. 7. Minimum required qualifications and competencies for the consultancy 1. A consultant with proven extensive international experience preferably in developing countries in designing and developing MRV system. 2. At least MSc. level academic qualifications in relevant fields of Environmental sciences, natural resources management, social sciences or related fields 3. Understanding of Kenyan strategic policy processes, including the Constitution, Vision 2030, Climate Change Act, National Climate Change Framework Policy, National Climate Change Action Plan (NCCAP), National Adaptation Plan, and Nationally Determined Contributions, among others. 4. Experience of at least two assignments of a similar nature in developing countries. 5. Experience working with government stakeholders and development partners on climate change policy and environmental policies in particular on MRV of climate actions. 6. Excellent communication skills with ability to express ideas clearly, concisely and effectively, both orally and in writing. 8. The technical evaluation will be based on the following criteria with the corresponding points (out of a total 70 points): Criteria 1: Criteria 2: Criteria 3: Criteria 4: Understanding of the Scope of Work (SoW); comprehensiveness of the methodology/approach; and organization and completeness of the proposal (25 points) At least a Master s degree At least MSc. level academic qualifications in relevant fields of Environmental sciences, natural resources management, social sciences or related fields (15 Points) Minimum of 10 years experience in MRV related work (15 Points). Proven understanding of Kenyan strategic policy processes, including the Constitution, Vision 2030, Climate Change Act, National Climate Change 5

6 Framework Policy, National Climate Change Action Plan (NCCAP), National Adaptation Plan, and Nationally Determined Contributions, among others (20 points). Criteria 5: Criteria 6: Experience of at least two assignments of a similar nature in developing countries. (10 Points). Experience working with government stakeholders and development partners on climate change policy and environmental policies in particular on MRV of climate actions (15points). Only candidates obtaining a minimum (70%) on technical evaluation will be considered for the Financial Evaluation. Financial evaluation (maximum 30 points): The following formula will be used to evaluate financial proposal: p = y (μ/z), where p = points for the financial proposal being evaluated y = maximum number of points for the financial proposal μ = price of the lowest priced proposal z = price of the proposal being evaluated Submission of the Financial Proposal Applicants are instructed to submit their daily rate financial proposals in USD. using the financial proposal template provided (Offerors letter to UNDP) The financial proposal should be all-inclusive and include a breakdown. The term allinclusive implies that all costs (professional fees, travel related expenses, communications, utilities, consumables, insurance, etc.) that could possibly be incurred by the Contractor are already factored into the financial proposal. 9.
