1 Position Title: Position Number: 3032 Division: Planning and Regulation Job Grade: JG4A Unit: Building and Environmental Health Award base: 35 Hours Unit Leader: Manager Building and Environmental Health Reports to: Team Leader - Building Surveying (North) Supervises: Nil Date Created /Revised: March 2015 Primary Objectives To assist in the implementation of the Tweed Shire Council Swimming Pool Fencing Compliance Strategy by conducting pool fencing inspections, ensuring compliance with legislation and issuing certificates. External Environment Tweed Shire is one of the fastest growing areas in New South Wales. The Shire also has the second highest biological diversity of any area on the Australian Eastern seaboard. Organisational Environment PLANNING AND REGULATION DIVISION The Planning and Regulation Division provides services related to planning and development control, building control, regulatory control, public health and safety issues, environment and health management throughout the Tweed Shire. Building and Environmental Health Unit: The Building and Environmental Health Unit is responsible for the regulatory control and certification of buildings and approval of development applications for dwelling houses and associated structures within the shire, to provide environmental health services to Council to meet statutory requirements and community needs and to ensure public health, safety and ComplianceOfficer_Pools_APN_G4A Page 1 of 6
2 amenity. The unit must conform to the stringent statutory requirements of relevant acts including the Work Health and Safety Act The unit is also responsible for pursuing many of Council s legislative responsibilities, which include the protection of public domain, public health, public safety by virtue of essential services, plumbing and drainage, onsite waste management, food regulation, certification of buildings and other structures, fire safety upgrades of existing buildings, licensing of caravan parks the Swimming Pools Act, Public Health Act and the Protection of Environment Operations Act. The work environment is busy, responsive to customer demands and requires regular adjustment of priorities and activities. Council is committed to the principles of ecological sustainability in all operations and responsibilities. The Position The Team: The position is located in the Building & Environmental Health Unit and reports to the Team Leader - Building Surveying. The position: The position's primary function is to assist with the implementation of the Tweed Shire Council Swimming Pool Fencing Compliance Strategy. The position will assist with Swimming Pool Fencing Compliance promotion, education, assessment, inspection, enforcement, and administration and advice provision. As an employee of Council and within the responsibility level of the position the incumbent is required to work in a safe manner and with minimal supervision having regard for self and others and to also contribute to the implementation of Council's workplace safety policies, procedures and practices. The position must possess skills in problem solving, conflict resolution and the ability to interpret legislation and will assist in the preparation of correspondence and reports associated with work within the Council area. Training: The position is required to undertake all relevant training and courses to ensure relevant knowledge is acquired and up to date with the latest technologies. In particular: 1. Completion of a course approved by the Building Professionals Board necessary to obtain Category E1- Swimming Pool Certification. This will be a one week intensive course held in Sydney or within the region. 2. On the job training will also be provided in relation to the approval processes at Council, the use of mobile inspection devices, generating and recording Council correspondence and the overall Swimming Pool Barrier Inspection Program. 3. Competent use of a Mobile Inspections Device (Apple ipad or similar windows device). NB: Council will organise and fund the required training and it must be completed during the 3 month probation period, subject to course availability. The employment contract will be ComplianceOfficer_Pools_APN_G4A Page 2 of 6
3 terminated if the course is not completed satisfactorily in the required timeframe unless there are extenuating circumstances. The work of the position includes, but is not limited to, the following: Key responsibility areas Associated key duties 1. Administration Administrative work associated with Swimming Pool Certificate of Compliance applications, complaints and the issuing of Notices and Orders. Perform electronic data entry in relation to Swimming Pool Fencing Compliance assessments. Utilise Council's Computer based data recording and information processing systems. Collate information. Assist Council's Building Surveyors in general issues associated with the Unit's administration. 2. Evaluation Determine swimming pool certificate applications. Interpret relevant legislation and Council's policies. Inspect, identify and document matters of non-compliance Identify and evaluate areas of hazard or risk within the private or public domain as related t swimming pools. Issue Infringement Notices for areas of non-compliance 3. Inspections Audit Swimming Pool Fencing Compliance. Carry out inspections relating to complaints. Enforce conditions of Development Consent and Complying Development Certificate. Enforce the Swimming Pool Act and Regulation. Investigate and prepare prosecution briefs of evidence. Prepare and follow up Orders and Notices issued under the Swimming Pool Act and Regulation, Protection of Environment Operations Act; Local Government Act and Environmental Planning and Assessment Act. Ensure that Council meets its legislative obligations under the Swimming Pools Act with respect to swimming pools within the local government area. 4. Communication Participate in the development and distribution of education materials and assist with seminars and public forums. Assist the community on site to understand the importance of pool safety and pool fencing compliance. Prepare correspondence relating to complaint and enquiries Provide advice and conduct site meetings. Educate the community on site, on the importance of pool safety. 5. Customer Service Participate in team meetings Provide information to external clients with an educational approach. ComplianceOfficer_Pools_APN_G4A Page 3 of 6
4 Interact with other staff members and the public to respond to enquiries. Respond to customer complaints and requests within set customer service standards. Ensure levels of service meet Council's service level protocols. Influence others in the achievement of set objectives. As a member of the Building and Environment Health Unit, the position requires attention to detail, flexibility, and the ability to contribute to the provision of client services across the work of the Unit, the capacity to respond to a busy work environment and provide other team members with assistance in times of high demand. The position will apply Council s Enterprise Risk Management Policy and Protocol objectives as they relate to the position. Health Safety and Environmental System (HSES) Responsibilities: In accordance with Council's Work Health and Safety Responsibility, Authority and Accountability Protocol this position has been deemed to fall within the following categories: Category 8 All Employees All employees are required to perform their duties in accordance with their relevant position description, WHS Risk Assessments, Safe Work Methods Statements, Standard Operating Procedures and site specific requirements and instructions. For a complete list of the WHS Responsibilities, Authority and Accountabilities of this position staff are to refer to the Protocol located on Council's intranet site: and External Relationships: Organisational relationships Across the Units as required External Relationships Public and general community, developers, contractors, Swimming Pool Fencing Compliance consultants/engineers, Local Government Organisations and Officers. Within the context of the position, the incumbent is also responsible for: maintaining work standard quality continuous improvement of procedures and systems provision of quality customer service. Location of Position: The position will be required to work out of any of Council's administrative offices, Depots or any other location within the Shire as directed by the supervisor. 5 Probationary Period: The position incumbent will undergo a 3 months probationary period. Where deemed appropriate, the probationary period can be extended by the relevant Director for no more than a further 3 month period. Successful completion of the probationary period will result in confirmation of the appointment. Verification of Qualifications: Guidelines All original certificates or certified (by the institution) academic transcripts must be sighted by Council. Cost of providing documentation is to be borne by applicant. To facilitate the verification of qualifications written permission must be given to the Tweed Shire Council for the relevant educational institution to be contacted. Falsely claiming qualifications will lead to dismissal and/or prosecution for any relevant offence. Applicants to sign a certificate declaring that qualifications are genuine and that if falsely claimed can lead to dismissal. A current NSW Drivers Licence Class C or equivalent. Desirable: 10.
