2 At the beginning Establishment of the Agency The first proposal for establishment of the European Railway Agency was made by the Commission on 23 January 2002 in the framework of the Second Railway Package, and on 29 April 2004 Regulation (EC) No 881/2004 establishing the European Railway Agency was adopted. The Agency has the mission of reinforcing safety and interoperability of railways throughout Europe. This involves the development and implementation of Technical Specifications for Interoperability, and a common approach to questions concerning railway safety, according to the Safety Directive (2004/49) and Interoperability Directives (96/48 and 2001/16, both amended by 2004/50). The Agency's main task is to manage the preparation of these measures.

4 1 What is the duty of the Agency? Railway Safety On the basis of the Safety Directive, development of Common Safety Methods (CSM), Common Safety Targets (CST) and Common Safety Indicators (CSI) Facilitate cooperation among national safety authorities Facilitate cooperation among national investigating bodies Harmonise issuing and assessment procedures of Safety Certificates and Safety Authorisations Upon request by the Commission assessment of new national safety rules Monitoring of safety performances and reporting to the Commission every 2 years Technical opinion on specific cases in the field of railway safety

Drafting the third group of TSIs for Conventional Rail Revise existing TSIs Organise and facilitate the cooperation of Notified Bodies Address recommendations relating to the working conditions of staff executing safety-critical tasks Monitor progress of interoperability in the Railway System, report every 2 years At the request of the Commission, examine railway infrastructure projects with EC-funding from the point of view of interoperability Draft recommendations for the determination of criteria for vocational competences and the assessment of the staff involved in operation and maintenance (priority : drivers & their trainers)

Develop a European certification system for maintenance workshops Propose format of national vehicle registers while taking care of transverse tasks : Coordination with European Standards System-wide coordination under TSIs Coordination with Common Safety Targets Clarify conformity assessment And integrate relevant economic assessment

Interoperability documents EC declarations of conformity, authorisation of putting in service, national vehicle registers, infrastructure and rolling stock registers, etc Safety database licences, safety certificates, national rules, investigation reports, statistics

8 1 What is the duty of the Agency? 1.4 ERTMS The Agency is the system authority for ERTMS, responsible for: Evolution of the specifications (ie ie. SRS/FRS) according the Change Control Management procedures, Technical support of the European Coordinator, Cooperation with ERTMS sub-group of NB Rail (Coordination group of Notified Bodies), Cooperation with National Safety Authorities (Focus Group), Harmonization of Operation procedures.

Economic Evaluation For Safety Evaluation of safety methods and safety targets according to Directive 2004/49 Art. 7(3) and Regulation 881/2004 Art. 6 For Interoperability according to Directive 2004/50 Art. 1(5) with Directive 96/48 Art. 6 and Directive 2004/50 Art. 2(5) with Directive 2001/16 Art. 6 Economical justification for some basic parameters CBA for new TSIs, or for TSI revisions For ERTMS CBA of future ETCS baselines (e.g. SRS 3.0) CBA of derogations according guideline 96/48 DV63 Art. 2 and Regulation 881/2004 Art. 1 Economic Evaluation of projects financed by EU according to Regulation 881/2004 Art. 14 and 15
