6 Legal Landscape Civil Law vs. Criminal Law A Cause of Action Civil Law Torts Torts include all negligence cases as well as intentional wrongs which result in harm. Therefore tort law is one of the major areas of law (along with contract, real property and criminal law) and results in more civil litigation than any other category. (dictionary.law.com) 6
7 Civil Law Contracts Legal Landscape Breach of Contract failing to perform any term of a contract, written or oral, without a legitimate legal excuse. This may include not completing a job, not paying in full or on time, failure to deliver all the goods, substituting inferior or significantly different goods being late without excuse, or any act which shows the party will not complete the work ( anticipatory breach ). Breach of contract is one of the most common causes of law suits for damages and/or court-ordered specific performance of the contract. (dictionary.law.com) 7
