1 Job Description Job title Group Section Responsible to Responsibility for employees Bay of Plenty Harbourmaster/Manager Environmental Management Maritime Operations General Manager Environmental Management Maritime Staff (7) Date March 2014 Job purpose This job exists to ensure compliance with the relative provisions of the Maritime Transport Act 1994, Bay of Plenty Regional Navigation & Safety Bylaws, the Port and Harbour Safety Code, Local Government Act 2002 and Resource Management Act This job also exists to provide leadership to a team coordinating maritime operations for the Bay of Plenty Regional Council. It is a third tier management role in the Bay of Plenty Regional Council management structure. The role is responsible for implementing the Maritime Operations programme in the Bay of Plenty Regional Council Ten Year Plan, while giving effect to the relevant provisions of: the Local Government Act 2002, Resource Management Act 1991, Maritime Transport Act 1994, Bay of Plenty Navigation & Safety Bylaws 2010, Port and Harbour Safety Code, and General Harbour Regulations. The BOP Regional Harbourmaster/Manager is expected to identify and develop opportunities to increase efficiency and effectiveness of the Maritime Operations service delivery in the region, particularly through joining or shared services with other agencies or organisations. Functional relationships (relating to others) External Maritime New Zealand (MNZ). Purpose and frequency of contact Enact delegated responsibilities from MNZ. Daily Ensure compliance with legislation. Daily Coastguard (including Coastguard Boating Education). Water Safety NZ. Collaboration and promote safety awareness. Weekly Coordination on Maritime safety. Weekly Tauranga Port Company. Development and enforcement of port safety management systems, response to incidents A

3 Key accountabilities Key accountabilities (jobholder is responsible for) 1 Operational management Prepare and manage Maritime Operations section and project budgets ensuring timely high quality completion of key goals according to the Council Ten Year Plan. Manage navigation and safety, and marine oil pollution response on all the waters in the Bay of Plenty region. Responsible for education and enforcement of the Bay of Plenty Navigation Safety bylaw and various relevant Acts. Provide management, leadership and direction to all Maritime Operations projects. Ensure all project managers know expectations of their individual projects. Utilising the technical expertise of the Maritime Team, provide advice to the organisation about all matters for which Council has responsibility. Prepare and present material to Council as required. Undertake other relevant duties as directed by the General Manager. Manage the navigation and safety maintenance, contract works, contractors and projects. Manage commercial shipping safety. Responsible for the compliance of the Council s fleet of vessels with national rules and requirements for safe ship management or its successor. Responsible for Council s Part 35 exemption programme for vessel skippers across the organisation. Required to contribute to the management of Port Security. Provide input into strategy development and resource consents impacting on marine areas. 2 Project management Promote the implementation of the Corporate Culture Statement, Leadership Model and Health and Safety Systems. Promote individual responsibility for Workplace Health and Safety under the Health and Safety in Employment Act Meet the statutory responsibilities detailed in the Information Management Policy & Procedures standard. Assist with Bay of Plenty Regional Council s statutory responsibilities for civil defence and Key accountability measures (jobholder is successful when) The management of navigation safety is conducted effectively. Internal policy requirements and Council s statutory obligations are met. Technical and strategic advice provided is based on a comprehensive analysis of key issues and is provided in a timely and professional manner. Reports and information provided are accurate and on time. Safety Management Systems across the region are up-to-date and enforced. All audits undertaken of the section s performance are passed (including SSM and Part 35). Project contributors understand project objectives, projects are effectively managed and work is completed on time and within budget. Corporate responsibilities are undertaken and completed accurately, meeting specified standards and within agreed timeframes. Hazards are identified and all incidents and accidents are reported. Participate in any wellness programmes, such as stress management training and health monitoring. Council records are created and maintained in corporate information systems, meeting specified information management standards. A

4 Key accountabilities (jobholder is responsible for) emergency management once Harbour Master responsibilities have been met. Fulfils the statutory role of Harbourmaster for the Region and manages council liability for navigation safety. 3 People management Provide supportive leadership, motivating and directing employees as they work. Effectively communicating current activities and policies. Conducting the performance management process working with employees to develop, monitor, and review employees work performance. Managing external contractors, consultants, projects, project teams, and managing the quality and timeliness of outputs. Manage Maritime staff ensuring adequate staff resources with appropriate skills at different levels to meet the needs of the Regional Council. Ensure and promote the professional development and training of Maritime staff to ensure staff are current with best Maritime practice. Key accountability measures (jobholder is successful when) Participate in any civil defence and emergency management training initiatives and assist with any civil defence emergencies, as part of Bay of Plenty Regional Council s responsibilities for civil defence and emergency management. Staff feel supported and are motivated and productive with minimal staff turnover. 4 Relationship management Establish, enhance and maintain close working relationships with internal and external contacts including local authorities, iwi and hapū, recreational water users, ratepayers, shipping agents, port staff, mooring owners, suppliers, consultants and contractors. Effective, professional relationships and partnerships are developed and maintained with internal and external contacts. Legal counsel and the General Manager are available to the jobholder to provide guidance. Work complexity Most challenging duties typically undertaken: Manage Maritime Operations Section work flow including budgets, commitments to completion of key goals according to Annual and Ten Year Plans, balancing these commitments with on-going daily/weekly requests from other agencies and the public. Managing commercial shipping with Tauranga Port Company including: pilotage, shipping movements, and shipping safety. Managing the involvement of the Bay of Plenty Regional Council in the NZ Port and Harbour Safety Code (NZPHSC) development and its application to the region s ports. This includes updating the risk assessments and safety management systems. Manage navigation and safety activities throughout the region and ensure compliance with relevant legislation. Respond to maritime emergencies such as groundings, collisions, near misses, tsunami warnings and loss of life within specified timeframes. Operating within a changing landscape in relation to local government and treaty settlements and co-governance/ownership models. Handling difficult confrontational situations when dealing with the public, regarding marine pollution complaints and non-compliance of navigation safety bylaws and maritime regulations. Occasionally required to act as a mediator between various maritime groups and other authorities (such as the Ministry of Fisheries), which can involve conflict with disaffected people. A

6 Other aspects No other aspects identified. Person specification Minimum academic qualifications and experience required: Essential Foreign Going Master Certificate of Competency. Marine Engineering Endorsement or similar to permit operation of council vessels. A valid driver s licence required* 1 Desirable (for recruitment purposes only) Be trained by Maritime NZ as an On-Scene Commander. Harbour Master Diploma. Knowledge/experience (indicate years of experience required as appropriate) Essential Minimum of 10 years relevant post-qualification experience. Experience gained in a local government environment or within port operations. Expert understanding and working knowledge of Maritime Transport Act 1994 and associated maritime law. Proven managerial and leadership experience supervising staff. Ability to effectively manage complex projects. Well-developed facilitation and effective negotiation ability. Community, cultural and political awareness. Desirable (for recruitment purposes only) Working knowledge of Bay of Plenty Regional Navigation & Safety Bylaws, Local Government Act 2002 and Resource Management Act Knowledge of environmental practices, particularly within the marine area. Knowledge of international rules for the prevention of collision at sea. Port operations such as cargo handling practices and refuelling.
