1 United Nations Children s Fund (UNICEF) Phnom Penh, Cambodia Individual Consultancy - Development of Identification Tools for People with Disability (PwD) including children with disability (CwD) International Consultant Terms of Reference 1. Background The Royal Government of Cambodia issued a sub-decree No. 137 dated 27 June 2011 on community-based pension support scheme for poor PwD. Since then the Ministry of Social Affairs, Veterans and Youth Rehabilitation (MoSVY) together with Ministry of Health have issued two inter-ministerial Prakas 1 to implement the sub-decree. Building on the two prakas, MoSVY developed identification tools to register poor PwD using ID poor household card issued by Ministry of Planning and their existing mechanism. The selection process used the existing structure of the sub-national administration: province, districts and communes. The procedures for granting the cards were determined by the Prakas of the Minister of Social Affairs, Veterans and Youth Rehabilitation. In 2016, around 3,133 poor persons with disabilities including children were identified and registered by four 2 provincial Community-based Allowance Support Scheme Management Committee for PwD and by MoSVY through the Prakas 3. Pailin was selected as the first province to implement the scheme and identification process. Although some forms and procedures have been put in place for the registration of beneficiaries for the allowance, there remains significant scope for improvement of those procedures and forms to improve efficiency and effectiveness of the identification process. Following the implementation of the classification and identification tools for PwD in the four provinces, the Department of Welfare for PwD 4 acknowledged that it is difficult to apply the medical-based classification due to the limited capacity at the local level particularly at the communes and that the PwD identification mechanism (registration) process needs to be revised to fit the current Cambodian context in order for the programme to be implemented at large scale as anticipated by the recently drafted Social Protection Policy Framework by the Ministry of Economy and Finance. With regard to poverty identification, Ministry of Planning (MoP) is the only ministry responsible for identification of poor households at the village level based on sub-decree #291 dated 27 December 2011 on identification of poor household. The experience in implementation of the disability grant in Pailin province, however, revealed low level of inclusion of PwD in ID Poor despite their apparently poor living standard 5. To make the ID Poor more inclusive, the MoP has revised its tool and has launched for its implementation in the urban area. Its introduction in the rural area is yet to be determined. Moreover, this sub-decree was issued after the sub-decree on community-based pension support scheme for poor PwD which raises the questions over the jurisdiction of one over another. 1
2 challenges of the ID Poor as a targeting tool of PwD grant scheme is its frequency of update. The ID Poor list is updated only every three years. This terms of reference is to provide technical support to MoSVY in developing an identification tools that is applicable in Cambodian context for implementing the scheme in other provinces. The tools will then be integrated into the operational manual for the disability grant scheme being developed by another consultant for MoSVY. 2. Purpose The purpose of this assignment is to support MoSVY to more effectively implement the Community-based Allowance Support Scheme Management Committee for PwD with revised and applicable identification tool for PwD. Specifically, the consultant is expected to deliver the following two objectives: Develop and test identification tools for Community-based Allowance Support Scheme for People with Disabilities applicable to Cambodian context; Provide recommendations on next steps to revise the two inter-ministerial Prakas, for implementing the sub-decree No. 137 and relevant regulations issued by MoSVY. 3. Work Assignments To achieve the above purpose, this exercise has two main tasks: Review the existing identification tools, process, regulations, procedures and forms building on international good practices of identification tools and mechanism of people with disabilities, draft a new PwD identification tool that fits to Cambodian context. Conduct field testing of the new tools and facilitate consultation on the new institutional setup at national and subnational levels. Finalize the PwD identification tools and mechanism by drafting a chapter on PwD identification/registration of the Operational Manual of the disability grant programme. Draft inter-ministerial Prakas based on the new PwD identification tools and mechanism. Detailed tasks will include: 1. Identify and contract national consultant to support the in-country work. The expectations of the national consultant should include: relevant knowledge and experience, translation and interpretation support, to provide contextual guidance and advice, etc. 2. Development of an inception report based on literature review. The inception report will include a detail work plan (including local travels) and data collection tools, list of stakeholders to be consulted, among others. 3. Present on international good practices of PwD identification mechanism in countries with similar socio-economic context to Cambodia at the initial stakeholder workshop, and facilitate the discussion to gather input for the revision of the identification mechanism for persons with disabilities who may benefit from the allowance. 4. Data collection through interviews and consultations with relevant stakeholders at national, sub-national and community levels, including DPOs. This task requires travel to at least three provinces, representing domain, geographic and socio-economic 2
3 characteristics of Cambodia 6. Field data collection will collect information on the current process and practice of the identification tools and allow consultant to contextualize the livelihoods, capacity, structure, mechanism and challenges on the ground which will inform the development of the new identification tools and mechanism. 5. Develop a draft identification tools and mechanism to support implementation of the disability grant 7 for national and subnational level. The revision of the identification mechanism should be framed within social models of disability, implementation in the Cambodia context and to optimize coverage of the CBASS. 6. Validation of the draft identification tools and mechanism with MoSVY, and other relevant ministries (MoH and MoP in particular) as well as sub-national administration, and other key stakeholders (UNICEF and other DPs/DPOs). The validation will be conducted both at the national and subnational levels. Consultant will conduct field testing of the draft tools and mechanism on the ground with support from MoSVY team. The feedback from field testing of the tools and mechanism shall inform the finalization of the tools. 7. Draft the identification/registration chapter of the Disability Grant Operational Manual based on the validated identification tools and mechanism. 8. Draft the two inter-ministerial Prakas based on the validated and approved PwD identification and registration tools and mechanism. Activities Finalise the identification and subcontracting of a national consultant to support the work. For geographic selection of other provinces, it should be discussed and agreed by consultant and MoSVY. 7 The tools may serve other purposes under MoSVY mandate. 3

The revision of the identification tools shall be done in consultation with Ministry of Planning particularly for the post-id poor process. The identification tools and mechanism shall cover the process at both national and sub-national level. 4. Qualifications or Specialized Knowledge/Experience Required This consultancy is expected to be carried out and led by an individual international consultant. It is expected that the international consultant will sub-contract a national consultant to support the delivery of the tasks as outlined in the ToR. Qualifications and required experiences include: International consultant 4
5 Advanced University degree (Master s degree or equivalent, or PhD) preferably relevant to disability sector or other related fields (economics, public policy, social policy, international development) Minimum of 8 years professional experience on disability and social protection. Similar experiences in development of PwD identification mechanism in low or middle income countries, preferably in countries with similar socio-economic context with Cambodia Excellent interpersonal and communication skills Understanding of social model of disability Experiences in facilitation of workshops and training on disability agenda with government stakeholders IT literacy (Use of MS Word, Excel, PowerPoint) Fluency in English 5. Location Location(s) and schedule of the assignment: Consultant shall be based at MoSVY. For use of UNICEF Phnom Penh office, advance request shall be made by the consultant. Depends on availability of office space and other resources, approval to work from UNICEF office will be granted. 6. Duration Starting period: 4 th week of April 2017 Foreseen duration: 4 months between 24 April and 30 August Deliverables The international consultant is expected to work for 60 working days over a four month period from the date of signing the contract. The payments shall be made according to the following deliverables. The deliverables can be changed based on formal agreement between MoSVY, UNICEF and the consultant. Deliverables Inception report with a detail work plan and methodology for development of an identification tools and mechanism together with consultation workshop with stakeholders Draft identification tools and mechanism for implementation of the disability grant (national and sub-national level.) Draft the identification/registration chapter of the Operational Manual of PwD grant scheme Final identification and registration tools and mechanism chapter and interministerial prakas based on the comments from stakeholders Estimated Number of Working Days 10 days 30 days 10 days 23 days The fees shall be calculated based on the days estimated to complete the assignment in the Terms of Reference and shall be considered the maximum compensation as part of a lump sum contract and agreed on a work plan for submission of deliverables. No additional fees shall be paid to 5
6 complete the assignment. Payment will be made upon delivery of all final products and full and satisfactory completion of the assignment. 8. Reporting Requirements The reports required for this assignment are: Inception report in English and key process in Khmer: describe review result of relevant documents. The inception report should be submitted within 3 weeks after signing the contract Draft identification tools and mechanism for implementation of the disability grant in English and Presentation in English and Khmer: within 10 weeks after signing the contract Final identification and registration tools and mechanism and inter-ministerial prakas and Presentation in English and Khmer: within 16 weeks after signing the contract The inception report, identification tools and mechanism and chapter must be submitted electronically in Ms. Word file and slide presentation in Ms. PowerPoint file. The identification tools and mechanism shall have but not limited to the following basic content: 1- Introduction 2- Review of the current Identification tools 3- Proposed Revision of the two prakas and identification tools 4- Roles and responsibilities of stakeholders at national and subnational level for identification of PwD 5- Methods and Steps in Identification of PwD including templates, questionnaire and detailed steps of each process in the identification and registration process a. Identification of PwD including children and defining their poor status taking into account ID Poor process b. Screening of eligibility criteria and qualifications c. Registration and certification of beneficiaries d. Complaint mechanism e. Monitoring and reporting 9. Payment Schedule linked to deliverables The payment is made in 3 installments: Deliverables Inception Report Draft identification tools and mechanism Payment (including business travel fee) be directly linked with satisfactory deliverables 30% of the total consultancy fees 40% of total consultancy fees, inclusive of travel cost for 3 trips for data collection (northwest, northeast, central-south, totalling 12 days Reporting Requirements for each deliverable shall be paid upon submission of the final draft inception report shall be paid upon submission of draft identification tools and mechanism, and draft revised inter-ministerial prakas 6
7 Final identification tools and mechanism chapter 30% of total consultancy fees, inclusive of travel cost for 3 trips for field testing of the tools (northwest, northeast, central-south, totalling 8 days) shall be paid upon submission of final validated identification tools and mechanism and draft inter-ministerial prakas Each payment shall be done based on satisfactory assessment report approved by UNICEF (Chief of Social Policy). * The fees shall be calculated based on the days estimated to complete the assignment in the Terms of Reference and shall be considered the maximum compensation as part of a lump sum contract and agreed on a work plan for submission of deliverables. No additional fees shall be paid to complete the assignment. Payment will be made upon delivery of all final products and full and satisfactory completion of the assignment. 10. Administrative Issues The Consultant will work with the director of the department of PwD welfare in coordination UNICEF community development specialist and social policy specialist for daily business and for administrative support. Any travel cost relating to meeting with relevant stakeholders under the scope of this consultant will be responsibility of the consultant. UNICEF will provide working space, access to printer and internet connection for the consultant if requested in advance and resources are available. The assignment will require at least 3 field trips (one each to northwest, northeast, and centralsouth) for field testing of the tools (stakeholder interviews at local level) for preparation of the draft identification. Another maximum 3 trips (same locations where data collection was conducted) will be carried out for validation of the draft identification tools. In total, it is anticipated to have maximum 20 days of travel. Consultants are required to include the cost of travel in the financial proposal. Costs for accommodation, meals and incidentals shall not exceed applicable daily subsistence allowance (DSA) rates, as promulgated by the International Civil Service Commission (ICSC). 11. Contract supervisor This consultancy will be supervised by Chief of Social Policy of UNICEF in collaboration with H.E. Sem Sokha, Secretary of State of MoSVY of Royal Government of Cambodia. 12. Penalties for Underperformance Payment of fees to the Contractor under this contractor, including each instalment or periodic payment (if any), is subject to the Contractor s full and complete performance of his or her obligations under this contract with regard to such payment to UNICEF s satisfaction, and UNICEF s certification to that effect. Performance indicators: Consultants performance will be evaluated against the following criteria: timeliness, quality, and relevance/feasibility of recommendations for UNICEF Cambodia. 7
8 13. Termination of Contract This contract may be terminated by either party before its specified termination date by giving notice in writing to the other party. The period of notice shall be five (5) business days (in the UNICEF office engaging the Contractor) in the case of contracts for a total period of less than two (2) months and fourteen (14) business days (in the UNICEF office engaging the Contractor) in the case of contracts for a longer period; provided however that in the event of termination on the grounds of impropriety or other misconduct by the Contractor (including but not limited to breach by the Contractor of relevant UNICEF policies, procedures, and administrative instructions), UNICEF shall be entitled to terminate the contract without notice. 14.
