JOINT MINUTES 1.1 Confirmed, with amendments as follows: The minutes of the meeting of 22 November 2012.

2 13.1 UNISON said that they were not making a statement, they were asking a question. The Master said that he was happy to add Where the union could discuss it Delete Higher from the term Higher Education institutions. 2. JOINT ACTIONS AND MATTERS ARISING 2.1 Outstanding items Union Office TUs reported that this was still under discussion Pay A proposal was received from UCU for observer status on the Remuneration Committee, this will be passed on to the Committee for consideration. 2.2 ACTION: Proposal to be passed to the Remuneration Committee 2.3 Marking (item 2.1 of meeting): UCU said that the issue of departments not providing paper copies for marking was not as widespread as first reported. The Master reported that at Kings College London, online marking is compulsory and acknowledged that there were advantages and disadvantages to online marking. 2.4 Teaching & Scholarship staff (item 2.6 of meeting): the Master had re-iterated to the Executive Deans that Teaching & Scholarship staff be included in team meetings. UCU invited the college to review the communication channels in relation to Teaching & Scholarship staff as some information was still not getting through. 2.5 Job evaluation (item 2.9 of meeting): the Director of HR met with UNISON to discuss the role of observers on job evaluation panels. UCU are to contact the Director of HR with their availability. 2.6 Colleges fees (item 3.2 of meeting): there was a Fees, Bursaries and Scholarship Committee (FBSC) meeting on 9 January 2013, the fee increase was between 0 and 5% except for the lowest CertHE tier, which increased from 650 to 800 per 30 credits. 2.7 HR Policy review (item 5.3 of meeting): the Director of HR met with UNISON and discussed the framework for policy review and development. UCU are to contact the Director of HR with their availability. 2.8 ACTION: UCU to contact the Director of HR with their availability for a meeting to discuss job evaluation and HR policy review.

3 2.9 Uploading minutes on to the website (item 8.2 of meeting): HR will upload the minutes from the meeting on to the website and advise the unions of the location. HR will also aim to circulate the minutes and action sheet as soon as possible. The Director of HR thanked the TUs for their agenda items and pointed out that the nature of some of the agenda items did not have to wait until the meeting they could be raised at any time ACTION: HR to upload minutes onto website 2.11 London Living Wage (item 11.2 of meeting): the Head of HR Services said that UNISON were informed in December that the 2012 London Living Wage would be applied from December In relation to action 11.4, the unions said that Queen Mary s student union runs an agency that pays London Living Wage (LLW). The unions suggested that for short-term staff, the College recruit directly. The Head of HR Services said that the College recruited agency staff through the LUPC agreement. Agencies inform us of an overall rate including their fee. However, in future we can request that we want staff placed with Birkbeck to receive the LLW. The Head of HR Services said she was happy to discuss this further outside of the meeting The Director of HR said that the Study Assistance Scheme for 2013/14 was due to be advertised again shortly. Last year, there were 28 supported applications, compared with 15 applications the previous year. All schools and departments had supported the maximum amount of 45% and no negative feedback had been received about individuals paying 5%. UNISON asked if we could consider non-employees working on Birkbeck premises applying for the study assistance scheme (including the 50% contribution). The Director of HR said that this would need to be thought through carefully as Ocean and Sodexho staff are not College employees. She also stated that the Learning & Development budget had been set with Birkbeck staffing numbers in mind. The Master advised that if any external contractor came to us with a proposal, we could look at it. The Vice-Master commented that Union Learn was extremely successful and Birkbeck was now the leading college for union staff with 700 applicants. He said that individual unions are also now approaching the college. 3. COLLEGE S FINANCIAL POSITION 3.1 The Master stated the college had a surplus of 6m, which would tide the college over in more difficult times. He stated that the number of 4-year applications was down this year and the college was expected to break-even or have a small surplus.

4 The Master commented that there were large cohorts in years 2 and 3, but when they finish, there will be smaller cohorts after them. The Master said that the college is capped by HEFCE on the number of 3-year students; currently at 420 students. The College had over-recruited and had been fined. However, following an appeal, HEFCE removed the fine. The college had requested an increase in numbers for next year and had received notification that we were able to increase our fulltime student numbers for 2013/14. We were still waiting for the official letter, but we have been told that we are able to recruit 700 full-time students. UCU asked how the substantial numbers of full-time students would affect the college. The Master said that although there may be a change in student profile, the mission would not change. UCU asked about the increase in certificate fees and how these courses would survive. The Master stated that the cost had been looked at carefully by the Fees Committee, and the view was that these are currently under-priced. 4. HR POLICY REVIEW 4.1 The Director of HR reported that the FTC and redeployment policies had been agreed with HRSPC and the unions. The Redundancy Policy had been agreed with the TUs except for the redundancy payment level. The HR Director reported that the HRSPC had carefully considered the views of the TUs on this and agreed the payment level could remain at the current level if the TUs agreed not to support any member who challenged the payment level and the College reserved the right to review this element of the policy if it was no longer affordable or it was legally challenged. UNISON had confirmed they agreed to these terms. UCU confirmed their agreement at the meeting. Unite said that they were waiting to hear from their members. The Director of HR reminded Unite that the policy was going to Finance and General Purposes Committee on 5 March and any feedback was needed before then. The Director of HR said the unions would be sent the following policies: - Market Supplements - Social Networking - Code of Practice on consultancy - Disclosure and Barring (which is changing from 1 April) UCU asked if the Market Supplement policy would include Teaching and Scholarship staff and the Director of HR confirmed this. UCU questioned the need to have policies reviewed every 3 years and said that they felt policies should be reviewed every 5-6 years. The Director of HR said that if at the three year point, the policy was still fit for purpose, it would not be amended. However, if there had been legislative changes or the policy was not operating effectively, it would be amended.

5 4.2 ACTION: Policies to be sent to the unions. 5. REF UPDATE 5.1 The Head of HR Services said that there were several strands to the REF and HR were currently supporting the equality strand. Approximately 550 academics were contacted and 530 have responded over 9 months by completing the Individual Circumstances Form. Staff would be written to shortly informing them of any reductions to output. UCU asked if it could be reiterated that there would be no detriment to any individuals not selected for the REF. They also asked about the link between REF submission and promotion. The Master said that it was very clear that they are separate. 6. STAFF SURVEY 6.1 The Director of HR said that the next staff survey was currently being considered by the steering group, but would be shared with the unions for feedback. It was then due to be piloted in April and go live in May. The Director of HR said she hoped the unions would encourage their members to complete it, as it would provide valuable information about what staff felt about working at Birkbeck. UCU said that they had conducted a stress survey and would forward the results to management. UNISON said that the Student Centre recently conducted a staff customer satisfaction survey and were happy to share the results. UCU asked how staff with 2 posts or who were also Teaching and Scholarship staff would receive the survey. The Vice-Master said that all major groups of staff would get the survey and the steering group would be looking at the easiest way to address the issue of staff with 2 posts. 7. UKBA REVIEW The Head of HR Services informed the Committee that we had been visited by the UK Border Agency. She said we had not been sent the report yet, but that we had retained our A-rating until November This means that our Certificate of Sponsorship has been confirmed. She also said that we argued that the college s charitable status should be considered and were refunded 1, SINGLE JOINT PROCEDURAL AGREEMENT 8.1 Discussions had taken place with UCU about updating their procedural agreement, and as part of this, the UNISON and Unite agreement had also been looked at, and the view formed that it may be helpful to have one joint procedural agreement. UCU had been supportive of this approach and therefore a draft would be sent to all three unions for their views.

6 8.2 ACTION: 2013 draft agreement to be sent to Unions, along with a copy of the current agreement. 9. ESTATE MATTERS 9.1 The Unions were encouraged to approach the Estates team on general issues rather than wait to raise these items at the termly SJC meetings. 9.2 CCTV In response to a question on CCTV, the Director of Estates said that the CCTV was used to uphold the security of staff and students and not to monitor staff. The cameras have a wide scope and are also helpful in supporting staff who have false accusations made against them. The CCTV policy is available on the College website. There was no intention to specifically monitor the behaviour of the attendants (as suggested to UNISON by members); the College accepted that as the CCTV is situated at building entrances, which is generally where the attendants are based, it was likely they would naturally appear on the tapes whilst carrying out daily duties. 9.3 Cycle lockers The Unions expressed concern at plans to remove these. The Director of Estates said that this request had been supported by students and the removal of the bike sheds, which are largely unused, would allow parking for up to 60 cycles; the intention was for the area to be better lit and monitored by CCTV. He was happy to discuss this issue further outside of the meeting. The Director of Estates confirmed that secure cycle racks had been installed in the garage at Egmont House. New secure cycle racks had also been installed at Gordon Square. 10.
