The report is based on information provides by the Central Statistical Office (GUS).. 2
3 RODO REGULATORY CHANGES WHAT AWAITS US IN THE FUTURE IN RELATION TO THE PROTECTION OF PERSONAL DATA On 25 May 2018, the harmonised Union rules based on the General EU Data Protection Regulation (RODO) come into force. In order to best prepare for changes resulting from the new legislation, Adecco Poland had a comprehensive audit related to this topic at the beginning of the current year. One of its effects was the employment of an expert in charge of the RODO issues. As a result Jędrzej Sokół, a lawyer working in one of the largest law firms in Warsaw specialised in the area of personal data protection joined the Adecco team in July The main responsibility of Jędrzej, supported by the whole Adecco team, will be to prepare the Company to significant changes in the RODO regulation, which will have a major impact on the internal Adecco processes and on the areas of cooperation between the temporary work agencies and their clients. In order to explain the main changes in the area of RODO, we present below an outline of the most important aspects. In the subsequent issues of "Radar Rynku Pracy" (labour market radar), we present more details about the changes brought about by the General Data Protection Regulation and their impact on the temporary work agencies and their customers. The changes brought about by the General Data Protection Regulation. Area covered The Regulation applies to all the entities established in the territory of the EU and non-eu entities, if they offer services or products in the non-eu Member States; it applies, for example, to an EU entity, which offers an on-line service and is collecting data on servers that are located outside of the EEA. Thus, it applies not only to the processing of data by technical means located in the territory of the Republic of Poland (as it previously was). Privacy by Design (data protection by design) Commitment of the entrepreneur to consider data protection in the development of business processes and new systems for services, systems and applications by design. In respect of the solution referred to above, data protection becomes a continuous process, which cannot be arranged only once and left without further intervention. Privacy by default Requirement of maximum privacy of persons whose data are processed The right to be forgotten The right to apply in certain circumstances to personal data administrators to delete any personal data without undue delay, including the data available on-line. The right to data portability If individuals have provided personal data to a service provider, they can then request that the service provider transfers these data to another service provider in a popular electronic format, as far as is technically feasible. 3
4 RODO REGULATORY CHANGES WHAT AWAITS US IN THE FUTURE IN RELATION TO THE PROTECTION OF PERSONAL DATA The changes brought about by the General Data Protection Regulation Co-administrators Responsibility, rights and obligations under the provisions on protection of personal data may be shared between several administrators (defined as co-administrators). Consent to the processing of personal data The administrator is explicitly required to demonstrate that it has a consent to the processing of data in accordance with the applicable law. The data subjects must be informed of possibility to withdraw the consent, and the content of the consent must be formulated clearly. Sanctions RODO distinguishes two types of infringements: light and severe each of them is punishable: EUR or 2% of the total annual global turnover; and EUR or 4% of the total annual global turnover (respectively). The notification obligation The organisation must notify the supervisory authority of any infringement of the regulations or privacy of personal data within 72 hours of detection, unless the infringement is not likely to constitute a danger to individuals. In the event of a significant risk for individuals, they also should be advised of the incident. The appointment of a Data Protection Officer In the doctrine it is referred to as the legal successor of the ABI (the Information Security Administrator); the designation is mandatory for the company, in which the data processing consist of processing operations which by their nature, scope or purpose require regular and systematic monitoring of the data subject on a large scale; and if core activity of the administrator or the processor is processing sensitive data on a large scale. Privacy impact assessment With regard to the means of data processing connected with risks related to the rights and freedoms of data subjects, the RODO provides for privacy impact assessment, which may depend on approval of a specific data processing tool or recommendation to resign from it. 4
5 RODO REGULATORY CHANGES WHAT AWAITS US IN THE FUTURE IN RELATION TO THE PROTECTION OF PERSONAL DATA Jędrzej Sokół Lawyer/ Personal Data Protection Specialist Through expert eyes Although the RODO regulation does not fundamentally alter the basic elements of the present regulation of the Personal Data Protection Act, it will affect the nature of the data processing due to the new obligations imposed on the company. The unique nature of the RODO regulations is based on their legislative assumptions, which take into account the development of new technologies used all the time in different areas of life or business. Personal data processed using innovative methods are most often obtained in areas such as consumer behaviour monitoring, video monitoring, performance measurement, vehicle location tracking, internet user profiling. For this reason current legal solutions precisely defining f.e. safeguards will most probably prove to be insufficient in new realities within 5-10 years from now. The RODO regulation, i.e. the so-called "Intelligent Act", was designed to take into account the growing importance of technological innovations and virtual tools, which we use in our routine personal and professional activities. It is impossible to describe in one word how the reality of a company will change due to the RODO regulation. It is certain that the collective awareness of the organisation related to the obligations and prohibitions of the RODO regulation will be more important. The implementation of and compliance with the RODO rules will be the responsibility of both the top management and the executive in the organisation. I am convinced that the increased awareness of threats, obligations and data processing principles, mentioned above, will be enforced not only by the need to adopt appropriate procedures, but also (and perhaps especially) by additional powers to control the data being processed the society will be vested in. We are aware that the entire personnel consultancy, temporary work and eternal HR services are based entirely on the processing of personal data, so we want to be and we will be fully prepared for the new solutions and regulations together with our Clients. 5
