1 PENNSAFE PENNSYLVANIA WORKER & COMMUNITY RIGHT TO KNOW PRESENTERS: Barb Dychala Eric Hoffman THE ACT Purpose of the Act To ensure that communication of information regarding the specific hazards of chemicals in the workplace is transmitted to employees To increase awareness of the hazards of these chemicals so employees know how to properly protect themselves and work safely with chemicals Conduct an inventory of chemicals in the workplace and annually complete the Hazardous Substance Survey Form () by April 1 Collect and maintain Material Safety Data Sheets (MSDS) for hazardous substances Post the Employee Workplace Notice Post the in the workplace Make MSDSs accessible to employees in their work areas Maintain Work Area Lists of chemicals Ensure proper labeling of chemical containers in the workplace Conduct and document Right to Know training (Initial and Annual) Provide access to Health and Exposure Records (same as OSHA ) You have a right to know: 1. Your rights under the Act Review the Employee Workplace Notice 2. The identity of hazardous substances Review the Check product labels 3. Specific information about the substances with which you work Review MSDSs 1

2 You have a right to : 1. Refuse to work with a specific hazardous substance under the following conditions: a. When you have requested a MSDS that is in your employer s possession but has not been provided to you within 5 working days of your written request OR b. You have requested a MSDS that your employer does not have and your employer has not taken the proper steps to obtain the requested MSDS You have a right to : 1. Training in the workplace At least once a year if you use, handle or are exposed to hazardous substances Additional training if: you are exposed to new hazards you are reassigned to another work area with different hazards your employer receives new information about hazardous substances in your work area You have a right to: 1. Protection of your rights under the Act The Law protects you from being disciplined, discharged or discriminated against if you: Request information under the Act File a complaint Assist with an inspection by Labor & Industry Properly refuse to work with a hazardous substance Exercise your rights under this Act MSDS Documents prepared by chemical manufacturers, suppliers, distributors that contain specific information about the product including: Specific Chemical Ingredients (CAS#) Physical Hazards Health Hazards Routes of Exposure Precautions for safe handling and use Emergency and First Aid procedures MSDS LABELING Labels All containers of chemicals must be properly labeled with the following: Identity of Substance Hazard Warning Name, Address and Phone Number of Manufacturer, Supplier or Distributor Must be able to cross reference labels to product MSDS 2

Must be posted in the workplace Special Hazardous Substance Designated by the Department because of its toxicity, tumorigenicity, mutagenicity, reproductive toxicity, flammability, explosiveness, corrosivity or reactivity poses a special hazard to health and safety BENZENE Environmental Hazard Substance, emission or discharge determined by the Department to be hazardous and because of its particular or extreme properties, poses a danger if released into the environment LEAD Health & Exposure Records Cross reference product MSDSs with Department s Hazardous Substance Check CAS Numbers checks CAS numbers will only allow reporting of PA regulated hazardous substances Employees must be informed annually on the Health and Exposure Records Policy Policy must include: Information regarding the existence, location and availability of any pertinent health and exposure records related to your employment The person responsible for maintaining and providing access to these records Each employee s right of access to these records 3
