1 1. Professional Staff Salary Schedules 1.1. Generally, the Fauquier County School Board desires to adopt annually a Teacher Pay Plan that will attract outstanding teachers and will retain those teachers who have met the standards of excellence required by the School Board. The compensation schedule should be based upon a reasonable base salary and should take into consideration years of experience, degree of educational training, level of certification, job performance, and such other criteria as the School Board may deem appropriate The School Board shall annually approve salaries for administrators and for certificated employees Pay for Extended Work Year Licensed personnel employed for additional duties after the school year has ended (excluding summer school and workshops) may be paid extra compensation Licensed Personnel: Extra Pay for Extra Duty The School Board authorizes extra pay for licensed personnel for the supervision of activities that require at least some special training or experience by one or more professional employees and that are of such a nature that, although the school program includes these activities, they cannot feasibly be included in the school day in the opinion of the school administration. The School Board annually shall establish categories and shall determine compensation for extra pay for extra duty A separate contract in the form prescribed by the Virginia Board of Education shall be executed by the School Board with an employee who is receiving a monetary supplement for any athletic coaching assignment or extracurricular activity sponsorship assignment. This contract shall be separate and apart from the contract for teaching. For purposes of this policy, extracurricular activity sponsorship means an assignment for which a monetary supplement is received requiring responsibility for any student organizations, clubs or groups except those activities that are conducted in conjunction with regular classroom, curriculum, or instructional programs No full time administrator shall be permitted to serve in a capacity for which he/she shall be paid a supplement to work as a coach or advisor for a student activity. 2. Classified Licensed and Non-licensed Personnel: Wage and Salary Schedule 2.1. Generally, the School Board desires to adopt annually a Classified Salary Compensation Schedule that will attract outstanding classified/support staff and will retain those staff members who have met the standards of excellence required by the School Board. Normally the salary schedule should be based upon a reasonable base salary and should take into consideration years of experience, degree of educational training, level of certification, job performance, and other such criteria as the School Board may deem appropriate The School Board shall annually approve a salary schedule for classified/support staff. Initial placement of new classified personnel shall be determined on a case-by-case basis for each employee based upon his or her years of comparable experience, degree of educational training, and other established criteria by the School Board. Salaries shall be calculated on an hourly basis depending on the length of the employee s service to the School Board Annual salary increases are dependent upon availability of funding and employee performance. An employee on a Performance Improvement Plan will not be eligible for any salary increase during the period for which the plan is effective. Employees on a performance improvement plan will receive an increase on the next fiscal year after they successfully complete the plan, which will not be retroactive. 1
2 2.4. The School Board may authorize extra pay for the performance of duties which require some training or experience that cannot be performed during the regular workday. Annually, the School Board shall establish categories and determine compensation for supplements. Non-exempt employees who work in supplemental capacities shall earn compensatory time or be paid overtime as appropriate Supplements shall be awarded on an annual basis. An employee does not have any right to the renewal of a supplementary assignment. 3. Pay Days 3.1. Employees will be paid in accordance with the Fauquier County School Division pay schedule. Employees who work less than twelve (12) months will be given a copy of the form entitled Notice of How Employees who work less than Twelve (12) Months are to be Paid. See Regulation (A). 4. Payroll Deductions 4.1. Generally Payroll deductions will be made for those purposes required by law. Optional deductions may be made for insurance, investments, charity or other purposes that the School Board has approved, which the employee has authorized in writing, and that are in compliance with the rules and regulations of the payroll system Deductions for Insurance Plans For the purposes of this policy and accompanying regulations, insurance plan means tax sheltered annuities, life insurance, automobile, homeowner, disability and cancer coverage Only insurance plans that are authorized by the School Board may be marketed in the school system. All full-time employees may participate in approved insurance plans for payroll deduction There shall be no more than ten (10) companies allowed to offer insurance plans to full-time employees in the Fauquier County Public Schools A company must enroll ten (10) participants by September 10 of each year before having authorized payroll deductions. All companies are responsible for notifying participants that no deductions can be made until the companies are approved. Companies presently approved for writing contracts may continue but are subject to review annually All companies shall maintain at least ten (10) participants in their insurance plan. A company, which fails to carry ten (10) participants by the end of the enrollment period of each school year, will be declared ineligible to write additional contracts. All existing contracts will be honored and continued All companies shall be rated, when applicable, by the AM best rating company as EXCELLENT - A or above A+. A copy of the best rating shall be provided to the Human Resources Department The company shall maintain a local office in the Richmond/Washington/ Baltimore area to serve the needs of the School Division The Division superintendent shall be authorized to develop procedures to effectively regulate this policy. 2
3 4.3. Deductions for Absences School Board employees who are absent from their assignments without appropriate authorization or who do not have leave coverage shall have their next paycheck decreased at a rate equal to the per diem salary payment for each day of absence Garnishments and Tax Liens Any employee of the School Board who is court ordered or permits his wages to be garnished or attached or enters into voluntary bankruptcy shall be called by the executive director of business and finance. All employees are strongly advised to pay all indebtedness promptly and before the respective deadlines. 4 REGULATION 5-7.1(A) SUPPLEMENTS 1. Establishment of Supplements 1.1. On an annual basis, the division superintendent shall forward to the School Board for consideration information regarding supplements to be offered for the upcoming school year The information submitted to the School Board shall include supplemental position descriptions. 2. Compensation 2.1. On an annual basis, the division superintendent shall forward to the School Board for consideration: The proposed compensation for each supplement category The proposed compensation for supplemental experience factor differentials Compensation for experience factor differentials shall be determined based upon years of supplemental experience in Fauquier County only Compensation for a single supplemental position may be divided between two (2) or more individuals jointly performing the duties of the supplemental position In cases where the duties of a single supplemental position are divided between two (2) or more individuals, the experience factor differential dollar amount shall be prorated accordingly An individual may be granted more than one (1) supplement during a school year but may not receive both a head and assistant supplement for the same activity, at the same school location, in the same season (i.e., an individual may not serve as both the head and assistant football coach for the same school, in the same season) Supplemental compensation for full or part-time employees of the School Division shall be divided into equal installments and pro-rated when necessary Supplemental compensation for individuals who (except for the supplement) are not employees of the School Division shall be made in a lump sum payment at the completion of the supplemental assignment No individual shall be paid in a supplemental capacity unless the supplemental position he/she occupies has been approved by the School Board. 3. Recruitment 3.1. General Guidelines The filling of vacant supplemental positions shall be accomplished through competitive recruitment processes The administrator/supervisor of a vacant supplemental position shall initiate the recruitment process by informing the Human Resources Department of the need to advertise The Human Resources Department shall confirm that the supplement is valid as approved by the School Board and, upon positive confirmation, generate a supplemental position advertisement. 4
5 3.2. Announcing/Advertising a Vacant Supplemental Position The Human Resources Department shall ensure that the announcement of a supplemental position vacancy for recruitment is conducted through one (1) of the following methods: Open (General Public) announcement of the vacant supplement as an employment opportunity for any eligible individual within or outside of the School Division School/Work Site Specific announcement of the vacant supplement as an employment opportunity for any eligible employee within a specific school/work site only Division Wide announcement of the vacant supplement as an employment opportunity for any eligible employee within the School Division A supplemental vacancy shall be advertised for a minimum of five (5) workdays An Open or Division Wide supplement vacancy announcement shall be posted at all schools and School Division work sites in a common area that is readily accessible by employees A School/Work Site Specific supplement vacancy announcement shall be posted at the respective school/work site location Individuals may obtain copies of supplement vacancy announcements and associated information from the Human Resources Department Applying for a Vacant Supplement Position Individuals interested in applying for a vacant supplemental position must forward a letter of interest to the Human Resources Department by the announcement closing date. It is the responsibility of the applicant to ensure that his/her letter of interest is received in the Human Resources Department by the closing date of the advertised supplement Selection Schools and school work sites shall select employees to fill supplements in a manner that ensures that applicants who best meet the requirements of the supplement and the specific needs of School Division are hired Supplemental Contract A separate contract in a form prescribed by the Board of Education shall be executed by the School Board with employees who receive supplements. This contract shall be separate and apart from the contract for teaching Termination of Supplemental Contracts Termination of a supplemental contract by either party thereto shall not constitute cause for termination of the employee s teaching contract All supplemental contracts shall require the party intending to terminate the contract to give reasonable notice to the other party before termination thereof shall become effective. 5
6 4. Responsibility 4.1. School principals and work site administrators, and their designees, are responsible for the consistent application of procedures governing supplements as applicable to their school/work site. 5. Interpretation 5.1. The Human Resources Director shall be responsible for the official interpretation of procedures relating to supplements. Questions regarding the application of such procedures should be directed to the Human Resources Department. 6
7 Regulation (B) NOTICE OF HOW EMPLOYEES WHO WORK LESS THAN TWELVE (12) MONTHS ARE TO BE PAID 1. Notice 1.1. The following notice will be provided to all employees who work less than twelve (12) months: This notifies [name of employee] that Fauquier County School Division requires him or her to be paid over twelve (12) months regardless of the fact that he or she will actually work over a shorter time period. Specifically [name of employee] will receive twelve (12) equal monthly payments of [dollar amounts of each payment] beginning on [date]. In the event that a separation from service occurs before the end of the twelve (12)-month payment period, [name of employee] will be entitled to an additional payment for the amount actually earned from the beginning of the twelve (12)-month pay period until the date of separation from service which has not yet been paid. This additional payment will be included in the employee s final paycheck. For this purpose, separation from service has the same meaning as that term is defined in section 1.409A-1(h) of the Treasury Regulations. 7
