3 REQUEST FOR PROPOSAL One-Stop Operator for South Central PA Works and PA CareerLink sites SECTION I: OVERVIEW PURPOSE The Workforce Innovation and Opportunity Act of 2014 (WIOA) requires each Local Workforce Development Board to have a one-stop service operator for their system that provides services to employers and jobseekers. Furthermore, WIOA requires that a One-Stop Operator must be competitively procured and in place by July 1, This requirement has led the South Central PA Works (SCPa Works), which is the Local Workforce Development Board under WIOA, to issue this request for proposals for a One-Stop Operator, hereafter referred to as the Operator, for the PA CareerLink sites located in the South Central Pennsylvania Area. BACKGROUND WIOA became law on July 22, 2014 and replaces the Workforce Investment Act of 1998 (WIA) which had been the primary federal workforce development law for the past 16 years. Inherent in the new legislation is improved and seamless service delivery to employers and jobseekers through greater alignment of education, economic development and workforce systems and resources. WIOA calls for the continuation of the existing service delivery structure, the nation s network of one-stop career centers, and in Pennsylvania they are known as PA CareerLink sites. WIOA and its implementing regulations require Local Workforce Development Boards, such as SCPa Works, to use a competitive process for the selection of a one-stop operator for the system, and to support continuous improvement through the evaluation of one-stop operator performance and the re-competition of operators every four years. Competition is intended to promote the efficiency and effectiveness of one-stop operators by providing a mechanism for the SCPa Works to regularly examine performance and costs against original expectations. The SCPa Works is pleased to issue this request for proposals to identify an entity to serve as the Operator (as defined by WIOA) for management of the SCPa Works six (6) comprehensive PA CareerLink sites. The Operator role will be distinct from the roles of the direct providers at PA CareerLink sites. Those partner organizations that contribute to the operations of the area s PA CareerLink sites through the Resource Sharing Agreement and Budget (RSAB) and Memorandum of Understanding (MOU) will come under the direction of the Operator. The contract with the Operator selected under this solicitation will begin on July 1,

4 OVERVIEW OF SCPA WORKS The Commonwealth of Pennsylvania designated 8 counties (Adams, Cumberland, Dauphin, Franklin, Juniata, Lebanon, Perry, and York) in Southcentral Pennsylvania as a Local Workforce Development Area under the Workforce Innovation and Opportunity Act (WIOA) of 2014 and its implementing regulations. The South Central Workforce Development Board (SCPa Works) is authorized under the same act to set policy for the portion of the workforce development system within the local area. As such, SCPa Works is the grant recipient for WIOA funds and is the Fiscal Agent of these and other employment and training funds received locally for programs operated throughout the Workforce Development area. SCPa Works envisions a region where opportunity for prosperity and growth exist for all. Our mission is to unlock the human talent that drives the development of businesses and individuals. SCPa Works accomplishes this by: Building a productive network of business, economic development, and community partners to create a demand driven opportunity engine for our region; Connecting youth and adults to a path stretching from education to job opportunities and beyond; Integrating education, training programs, and community partners with the needs of industry and our regional economy; Investing in and evaluating what works as entrusted stewards of public resources. SCPa Works coordinates, develops, and maintains an effective and responsive system of programs and services that integrates the needs of employers for an ample and productive workforce with the needs of SCPa Works residents for meaningful work that enhances their quality of life. SCPa Works also promotes local training programs, private-public partnerships, joint ventures and linkages designed to improve the economic health of our region. SECTION II: ONE-STOP OPERATOR QUALIFICATIONS ONE-STOP OPERATOR MODEL In accordance with the Commonwealth of Pennsylvania s guidance, SCPa Works has elected to bid the services of the One-Stop Operator separately from Title I services. After a contract is signed and MOU is agreed upon between SCPa Works, the Local Elected Officials (LEOs) and the winning bidder from this RFP, the Operator will begin duties on July 1, The Workforce Delivery System Committee will provide policy guidance, strategic direction, evaluation of core performance outcomes and ongoing monitoring of the Operator. The Operator will meet with SCPa Works staff on a monthly basis, in addition to meeting quarterly with the Workforce Delivery System Committee. (These meeting dates will be established upon contract award.) The Committee will evaluate the Operator s performance after the first six months, and every six months after that, per WIOA regulations. 4

5 The successful applicant must: REQUIRED APPLICANT QUALIFICATIONS Be an eligible applicant (see Eligible Applicants section). Present a proposal for a four (4) year period, consisting of an initial contractual period beginning on July 1, 2017 through June 30, 2018, with an option, based on successful performance, to renew the contract annually thereafter for a total of four years. Retain the current Site Administrator(s) for the PA CareerLink sites. The Site Administrator shall remain an employee of their respective employer. All conditions, approvals and requirements applicable to the Site Administrator set forth in WIOA, this paragraph and the RFP shall remain in full force and effect. The Site Administrator shall report directly to SCPa Works, and when necessary, their employer. The successful candidate shall be authorized to inform the Site Administrator s employer of any and all complaints or concerns. In the event of death, disability, resignation or retirement of a SCPa Works employed Site Administrator, SCPa Works and the operator will collectively agree on the individual selected to serve as the new Site Administrator, who shall be the employee of SCPa Works. Modification of the Site Administrator s duties, whether by the request of the successful applicant or the requirement of SCPa Works, may only be finalized after review by the Workforce Delivery System Committee and approval of SCPa Works. The selected Operator will have a proven record of performance in selecting, managing and developing staff and partnerships. Knowledge and understanding of WIOA, applicable federal and state regulations, and PA Department of Labor and Industry policies, and the area s Local and Regional Plan is expected. The SCPa Works envisions the Area s PA CareerLink sites as the go to resource for employers looking for skilled employees and jobseekers looking to enter or re-enter the workforce. ELIGIBLE APPLICANTS Entities eligible to apply under this solicitation are as follows: Institutions of Higher Education; Community-based Organizations; Non-profit Organizations; Workforce Intermediaries; Government Agencies; For-profit Entities; Non-traditional Public Secondary Schools; Any interested organization that has the ability to carry out the duties of the operator. The Operator will be accountable to the SCPa Works and the Chief Local Elected Officials of the South Central Pennsylvania Area. 5

6 ESTIMATED FINANCIAL SUPPORT The SCPa Works shall allocate funding support to the Operator. The amount allocated for supporting the one-stop operations will be dependent on the total amount of WIOA funding allocated to SCPa Works for the next budget year. For the purposes of the RFP, the expected funding available to support the one-stop operations will be a range between $40,000 - $65,000 annually. This funding may change annually dependent on SCPa Works federal funding allotment. If funds are not fully expended by the end of a contract year (June 30), unexpended funds may revert back to SCPa Works and may not be available for subsequent, if any, contract year expenditures. It should also be noted that delays in federal funding awards may result in situations where the award of operating funds is delayed and the operator may need to utilize non award funds to support operations until the award is made and funds are available. It is expected that the Operator will leverage other funding in order to support its activities and ultimately improve the public workforce system for job seekers and employers. During year one, an analysis of true costs associated with the provision of Operator services will be evaluated. The possibility of financial support through the RSAB will be considered in subsequent years. Funding to cover the cost of the PA CareerLink site administrators, along with facility operations costs will be covered through the partner-approved RSAB. SECTION III: SCOPE OF WORK OPERATOR ROLES AND SCOPE OF WORK The success of the One-Stop Operator will be its ability to work cooperatively with the Local Workforce Development Board and its Workforce Delivery System Committee, comprised of the major investor Partners from the SCPa Works Board and Commonwealth of Pennsylvania agencies involved in workforce development. This includes all required Commonwealth of Pennsylvania WIOA-required partners, Adult Education and Literacy, Office of Vocational Rehabilitation (OVR) and Unemployment Compensation (UC), Department of Human (DHS) services and Wagner-Peyser Programs. All members of this Committee must be decision-making level representatives. The One- Stop Operator will need to work closely with this Committee in order to implement service delivery that fosters an integrated service model. Under the leadership of the SCPa Works, and with guidance from the Board s Workforce Delivery System Committee, the selected Operator will be tasked with the coordination of service delivery with one-stop partners and related service providers in the area s multi-center, one-stop public workforce system. It is expected that the Operator will utilize the PA CareerLink Site Administrators to carry out many of the required duties of the Operator outlined below. To that degree, the Operator will oversee and manage the day-to-day operations of the PA CareerLink sites via the Site Administrators. A job description of the Site Administrators may be found in Appendix A. 6

7 Duties of the one-stop operator shall include: Seamless integration and coordination of services by PA CareerLink partners, ensuring equitable accessibility to all services are provided to all customers; Coordination of one stop PA CareerLink partners; Assistance in fiscal management and oversight in concert with the PA CareerLink site administrators and the SCPa Works, as fiscal agent. This includes assistance in the preparation and maintenance of the Resource Sharing Agreement (RSA); Evaluation of customer needs and satisfaction, including continuous improvement through responding to assessment of customer needs; Preparation for SCPa Works quality reviews and compliance with PA Department of Labor and Industry and SCPa Works one-stop certification criteria; Liaison with the SCPa Works to include participation in SCPa Works and pertinent Workforce Delivery System Committee meetings; Establish strong partnerships among partners; Recruitment of additional PA CareerLink partners; Tracks and implements the negotiated one-stop partner MOUs. Adjustments to the aforementioned duties may be made following input from the Board s Workforce Delivery System Committee and consideration by the SCPa Works. The selected Operator must disclose any potential conflicts of interest arising from the relationships of the Operator with training service providers. The Operator will refrain from establishing practices that create disincentives to providing services to individuals with barriers to employment who may require longer-term services. RELATIONSHIP OF OPERATOR TO SCPa Works AND PA CAREERLINK PARTNERS SCPa Works will maintain a contractual relationship with the selected Operator and will provide ongoing policy guidance and strategic direction to ensure that the board s vision and performance expectations remain in the forefront and are addressed. The Workforce Delivery System Committee is responsible for performance monitoring and will perform periodic quantitative, qualitative and on-site reviews of Operator performance to ensure that expectations are being met. PERFORMANCE AND ACCOUNTABILITY The Workforce Delivery System Committee will evaluate the Operator every six months to ensure high-quality performance and accountability. The Committee s assessment of performance will include, but is not limited to: contract provisions; participating partner surveys, other performance measures developed by SCPa Works, and be consistent with PA CareerLink certification requirements. 7

8 SECTION IV: APPLICATION ORGANIZATIONAL PROFILE AND REQUIRED INFORMATION The proposal to this request must contain the following: Description of the proposer s organization Proposer s identification number (EIN) Proposer s name Corporate address Telephone numbers Contact person(s), including address PROPOSAL NARRATIVE Address the following in the proposal response: Mission and goals of applicant; knowledge and understanding of WIOA, applicable federal and state regulations, and PA Department of Labor and Industry policies, and the area s Local and Regional Plan; strategy for ensuring coordination and seamless integration of services in the PA CareerLink sites; your evaluation and management of Site Administrators performance; and strategy for recruitment of additional PA CareerLink partners; Experience in assisting individuals to enter the workforce and relationship with the area s PA CareerLink sites; Why applicant is well-positioned to serve in the capacity as the one-stop operator; Identify any in-kind resources or support for work that is requested in the budget including all committed or proposed sources of funding and the amount of this funding. Proposed budget and justification for the costs associated with the required duties of the Operator for Program Year (July 1, 2017 through June 30, 2018). PROPOSAL BUDGET Address the following in the proposal budget: Applicants must justify, in detail and by line item: the costs proposed in each object class category/cost classification category; the general categories of supplies and amount for each category; and any other information you wish to support your budget. Costs included in the budget must be actual costs incurred in delivering the proposed services, and these funds cannot supplant funds already received by the proposing organization. Give details of the organizations cost allocation method or indirect cost rate if one is used. I.e. Prorating the cost of supplies based on total FTE s, or the cost of salaries based 8

9 on time spent on this contract. See Financial Support for more information about available funding. PROPOSAL FORMAT AND INSTRUCTIONS Proposals will include the following information arranged in the order shown: Title Page: identifying the proposer s name, address, telephone number, contact person and . Organizational Profile: information found under the Organizational Profile & Required Information Section Proposal Narrative: identify succinctly how the proposer will help the SCPa Works realize its vision for workforce development including expanded outreach to those with barriers to employment. Include concise responses to the bullet points identified under Proposal Narrative. This section will not exceed 10 pages. Proposal Budget: justify budget request with proposed costs for each category of expenses. This section will not exceed 2 pages. PROPOSAL EVALUATION Once proposals are received, SCPa Works staff will review and evaluate proposals to ensure responsiveness to the RFP and confirm that proposers are not suspended or debarred. SCPa Works staff will be held to the provisions in their signed Conflict of Interest policy and the Statement of Financial Interests, completed by the SCPa Works CEO. The proposals will then be presented to a subcommittee of SCPa Works for review. In determining membership on the review subcommittee, staff will ensure that those participating in the proposal review are free from a conflict of interest. For this RFP, the following criteria will be evaluated: Proposer s understanding of the requirements of the Operator and the public workforce system in the South Central Pennsylvania Area and demonstrated capabilities to carry out the duties of the Operator as outlined in this RFP; Strategies for ensuring coordination and seamless integration of services in the PA CareerLink sites, as well as the proposed strategies for continuous improvement of customer experience; Proposed budget and leveraged resources the proposer brings to the role of Operator. 9

10 The subcommittee will rank the proposals independently and then meet in person to discuss the rankings and prepare their recommendations. These recommendations must be approved by the full SCPa Works Board for review and action. The Board s recommendations will then be presented to the Area s Chief Local Elected Officials (LEOs), for final review and contracting consideration. 11 APPENDIX A - SITE ADMINISTRATOR JOB DESCRIPTION JOB SUMMARY: The Site Administrator is responsible for directing and coordinating all functions and operations of the PA CareerLink site in alignment with the State Workforce Investment Board s strategic plan, the SouthCentral Workforce Investment Board s plan and the PA CareerLink site plan. DUTIES AND RESPONSIBILITIES: Organizes and directs activities of job seeker and business customers; implements a service delivery system and maintains current enhancement plan. Develops a systematic and sustained process to assess and respond to the workforce and economic development needs and expectations of local businesses and the community. Develop and/or maintain a means of receiving internal and external customer feedback and addressing customer complaints in an efficient and timely manner. Develops and oversees a cross-partner business services team comprised of staff from partner organizations to conduct employer outreach to reduce and eliminate duplication of services. Implements SCPa Works high-growth, high-demand industry sectors and occupations strategy in the local labor market area. Establishes and communicates specific and measurable PA CareerLink performance standards in conjunction with the SCPa Works, the Operator and input from site staff. Implements an action plan that is developed in conjunction with the Operator that supports SCPa Works strategic plan to meet the needs and expectations of all key stakeholders. Develops continuous improvement processes to respond to immediate operational needs while ensuring that short-term actions support long-term objectives. Establishes and/or enforces PA CareerLink policies and procedures that define operations such as hours of operation, data confidentiality, service delivery, proper equipment use, health and safety, office closings, and emergencies. Maintains knowledge of partner program policies and procedures that affect service delivery in order to ensure programmatic and statutory compliance. Develops and maintains effective relationships with local entities such as elected officials, business partners, economic developers, educators and other community leaders that enhance PA CareerLink services. Establishes appropriate community outreach and marketing efforts to attract new customers. Provides day-to-day functional supervision over all PA CareerLink staff to fulfill operational functions and service delivery within funding streams, collective bargaining agreements and governmental regulations. Assigns staff to work stations; refers customers to staff. Organizes PA CareerLink site by function/service (i.e. outreach, assessment, training, etc. as opposed to agency or program), develops functional and cross-functional teams. Assesses, provides and tracks PA CareerLink staff development to ensure staff have appropriate skills and knowledge. Assesses the service delivery needs of the PA CareerLink to determine workforce requirements; Coordinates with the Operator to address identified staffing needs. Responds to requests from external and internal customers, the media and the general public for labor market or workforce related information. Arranges and/or participates in presentations for civic and community organizations. Analyzes the PA CareerLink fiscal needs and collaborates with the Operator, partners, and fiscal agent to develop and maintain the Resource Sharing Agreement (RSA). 11

12 Explores other sources of funding for additional revenue to reduce partner costs and/or expand PA CareerLink services. Coordinates agency participation in PA CareerLink service delivery. Assess and ensures adequate inventory of equipment, tools, materials and supplies; Ensures accountability for expenditures made with federal, state and local funds. Ensures that all equipment, etc. is installed properly, is operational and is maintained in a manner that meets appropriate safety and regulatory standards (EEO, ADA, OSHA, etc.); contacts the State and/or Title 1 Provider for assistance with mechanical issues. 12

13 Attachment A CERTIFICATION REGARDING DRUG-FREE WORKPLACE REQUIREMENTS A. Contractor certifies that it will or will continue to provide a drug-free workplace by: (1) Publishing a statement notifying employees that the unlawful manufacture, distribution, possession, or use of a controlled substance is prohibited in the Contractor s workplace and specifying the actions that will be taken against employees for violation of such prohibition; (2) Establishing an ongoing drug-free awareness program to inform employees about - (a) (b) (c) (d) The dangers of drug abuse in the workplace; The grantee s policy of maintaining a drug-free workplace; Any available drug counseling, rehabilitation, and employee assistance programs; and The penalties that may imposed upon employees for drug abuse violations occurring in the workplace; (3) Making it a requirement that each employee to be engaged in the performance of the grant be given a copy of the statement required by paragraph (1); (4) Notifying the employee in the statement required by paragraph (1) that, as a condition of employment under the grant, the employee will-- (a) Abide by the terms of the statement; and (b) Notify the employer in writing of his or her conviction for a violation of criminal drug statute occurring in the workplace no later than five calendar days after such conviction; (5) Notifying the agency in writing, within ten calendar days after receiving notice under subparagraph (4)(b) from an employee or otherwise receiving actual notice of such conviction. Employers of convicted employees must provide notice, including position title, to every grant officer or other designee on whose contract activity the convicted employee was working, unless the Federal agency has designated a central point for the receipt of such notices. Notice shall include the identification number(s) of each affected grant. (6) Taking one of the following actions, within 30 calendar days of receiving notice under subparagraph (4)(b), with respect to any employee who is so convicted (a) Taking appropriate personnel action against such an employee, up to and including termination, consistent with the requirements of the Rehabilitation Act of 1973, as amended; or (b) Requiring such employee to participate satisfactorily in a drug abuse assistance or rehabilitation program approved for such purposes by Federal, State or Local health, law enforcement, or other appropriate agency; (7) Making a good faith effort to continue to maintain a drug-free workplace through implementation of paragraphs (1), (2), (3), (4), (5) and (6). The Contractor, in operating programs funded under the Workforce Innovation and Opportunity Act, (WIOA) assures that it will administer its programs under its contract agreement: 1.
