5 FMLA & LEAVE USAGE FMLA FMLA provides job protection under federal regulations. FMLA does not provide a provision for pay. Leave Use of leave doesn t provide job protection under federal regulations. Use of Leave may be used to generate pay. Leave available for use: Paid Medical Leave (PML) Paid Personal Leave (PPL) Compensatory Time Balance
6 ELIGIBILITY FOR FMLA Employed by the City for at least 12-months (need not be consecutive). If an employee is maintained on the payroll for any part of a week, including any periods of paid or unpaid leave (sick, vacation) during which other benefits or compensation are provided by the employer (e.g., workers' compensation, group health plan benefits, etc.), the week counts as a week of employment. AND Has worked at least 1,250 hours during the 12-month period immediately preceding the commencement of leave.
7 FMLA 12- MONTH PERIOD The City uses a calendar year period: January 1 December 31st Exception: Military Caregiver leave or Service Member leave. Measured from the first day of the FMLA event and ends 12 months after that date.
8 BASIC PROVISIONS FMLA provides for up to 12 work weeks in a 12-month period for the following qualifying reasons: Birth and care for a newborn Placement for adoption or foster care Care for employee s spouse, son, daughter or parent with a serious health condition. Parent means a biological, adoptive, step or foster father or mother, or any other individual who stood in loco parentis to the employee when the employee was a son or daughter. Parent does not include parents in law or grandparents. Serious health condition of the employee that renders them unable to perform the essential functions of job
9 DEFINITION OF CHILD A child is defined as a son or daughter who is: 1) under the age of 18; or 2) age 18 or older and incapable of self-care because of a mental or physical disability at the time that FMLA leave is to commence. Under the regulations, the adult child must require active assistance or supervision to provide daily self-care in three or more activities of daily living or instrumental activities of daily living.
10 LOCO PARENTIS Under the FMLA, persons who are in loco parentis include those with dayto-day responsibilities to care for or financially support a child. Courts have indicated some factors to be considered in determining in loco parentis status include: the age of the child; the degree to which the child is dependent on the person; the amount of financial support, if any, provided; and the extent to which duties commonly associated with parenthood are exercised. The fact that a child has a biological parent in the home, or has both a mother and a father, does not prevent an employee from standing in loco parentis to that child. The FMLA does not restrict the number of parents a child may have. The specific facts of each situation will determine whether an employee stands in loco parentis to a child.
11 SERIOUS HEALTH CONDITION Defined as an illness, injury, impairment, or physical or mental condition that involves either an overnight stay in a medical care facility or continuing treatment by a health care provider Treatment includes, but not limited to, examinations to determine if a serious health condition exists and evaluations of the condition. Does not include routine treatment such as dental, eye, physical exams, or cosmetic surgery.
12 CONTINUING TREATMENT A serious health condition involving continuing treatment by a health care provider includes any one or more of the following: Incapacity and Treatment minimum of three (3) consecutive days Treatment two or more times within 30 days of the first day of incapacity Treatment by a health care provider on at least one occasion, which results in regiment of continuous care Pregnancy or prenatal care Chronic conditions (conditions that continue over an extended period of time and requires periodic visits- min. 2x per year) Conditions that may cause episodic rather than a continuing period of incapacity (asthma, diabetes, epilepsy, etc.)

14 BASIC PROVISIONS: MILITARY FAMILY LEAVE Enacted in January 2008 updated in 2013 Qualifying Exigency Leave 12-workweeks of FMLA Types of Exigency Leave Short-notice deployment Military Events and related Activities Childcare and school activities Financial and legal arrangements Counseling (non-medical) Rest and recuperation (up to five days each) Post-deployment activities
15 BASIC PROVISIONS: SERVICE MEMBER LEAVE Military Caregiver Leave FMLA provides for up to 26 weeks of leave in a single 12-month period for the following situations: To care for a spouse, son, daughter, parent or next of kin covered service member with a serious illness or injury incurred in the line of duty on active duty. Next of kin is defined as the closest blood relative of the injured or recovering service member.

17 BLOCK LEAVE Employee is going to be out for FMLA covered leave for a continuous period of time. Example: Nancy Newport is going to be out on FMLA from September 14 th October 15 th for a surgical procedure Easiest type of leave to manage
18 INTERMITTENT LEAVE Intermittent Leave Leave taken in separate periods of time due to a single illness or injury. Medical Treatments, Physical Therapy, etc. May have more than 1 intermittent leave going at a time due to separate illnesses/injuries. Employee Obligation: To make a reasonable effort to schedule leave for planned medical treatment so that it doesn t unduly disrupt City operations
19 FMLA ADMINISTRATION
20 EMPLOYEE RESPONSIBILITIES Provide 30 days advance notice of the need to take FMLA or as soon as possible Must comply with Department s call-in procedures Must provide sufficient information for the City to determine if the leave qualifies. Certifications/Recertification must be returned within 15-calendar days Failure to supply certification may result in denial of leave
21 EMPLOYER RESPONSIBILITIES Inform employees requesting leave whether they are eligible under FMLA within (5) business days. If additional information is required, an employee must be informed in writing what information is still needed and given seven (7) calendar days to obtain. If ineligible, notice must provide at least one (1) reason for the ineligibility. Provide a FMLA-Designation Notice to employees and inform them of any requirement regarding a Return to Duty form; include job description. Along with Notification of Eligibility, employees must receive a Notice of their Rights and Responsibilities
22 MEDICAL CERTIFICATIONS Four (4) Different Certification of Health Care Providers: Employee s Serious Health Condition Family Member s Serious Health Condition Service Member Qualifying Exigency Leave Service Member Ill or Injured Note: Medical Recertification may be required, but no more than once every 30 days.
23 MEDICAL RE-CERTIFICATIONS Re-certifications may be requested for the following reasons: Annual recertification The employee requests an extension of leave The circumstances described by the previous certification have changed significantly, or The employer receives information that causes it to doubt the employee s stated reason for the absence or the continuing validity of the existing medical certification.
24 DESIGNATION OF LEAVE Upon receipt of the Certification of Health Care Provider Form: Five (5) Business days to make a determination and notify the employee that leave is FMLA qualifying Must indicate the length of time (hours, days, or weeks) that FMLA will be designated If a Return to Duty Certification is needed, the form must be provided at the time FMLA leave is designated, along with a list of the essential job functions
25 CALL-IN POLICIES If an employee, who has a medical certification under FMLA, fails to follow established call-in policies, the employee may be subject to discipline in accordance with the City s Standards of Conduct. Exceptions for extraordinary circumstances
26 CONFIDENTIALITY Managers may not request additional information from a health care provider. All records or documentation relating to a medical condition are strictly confidential. No one shall be informed or shall have access to medical information unless there is a need to know, such as when the supervisor may need to be informed of an employee s work restrictions or accommodations.
27 TIMEKEEPING When an employee has been approved for FMLA leave, a Personnel Action must be entered into Munis, using the appropriate Reason/Auth code. This action will record the beginning of the employee s approved leave. In addition, an FMLA Time and Attendance entry is necessary for each absence (full or partial days) that are associated with FMLA. Employees must exhaust all accrued leave or use the allowable maximum before going on unpaid status.
28 RETURN FROM FMLA When/if the employee returns from FMLA leave, a Personnel Action entry is required. This action will record the end date of the approved leave. If the employee has also been in a continuous unpaid status during their FMLA approved leave, a second action is necessary to make all pay types active for the employee.

30 CONSEQUENCES FOR FAILING TO PROVIDE NOTICE If the employee can show individualized harm as a result of the employer s failure to provide Notice of Eligibility or Designation of FMLA leave Employee is entitled to the remedies provided by the statute: Lost Compensation and Benefits Monetary losses sustained as a direct result of violation Appropriate equitable relief to include employment, reinstatement, promotion or other relief tailored to the harm suffered
31 UNLAWFUL ACTS FMLA makes it unlawful for any employer to: Interfere with, restrain, or deny the exercise of any right provided under FMLA; Discharge or discriminate against any person for opposing any practice made unlawful by FMLA or for involvement proceeding under or relating to FMLA.
