1 Southern Africa TERMS OF REFERENCE INDIVIDUAL CONSULTANT An assessment of the Namibian Correctional Systems compliance with the United Nations Standard Minimum Rules for the Treatment of Prisoners The Nelson Mandela Rules (NMRs). Background More than million men, women and children are held in prisons globally; these include pre-trial detainees/remand prisoners and those who have been convicted and sentenced 1. Prisoners are vulnerable populations, and are often subjected to inhumane treatment. On 17 December 2015, the General Assembly (GA) adopted the revised United Nations Standard Minimum Rules for the Treatment of Prisoners (The Nelson Mandela Rules) which sets out the minimum standards for the treatment of prisoners. UNODC is the custodian of the Nelson Mandela Rules (NMRs), and assists member states in developing and strengthening penitentiary legislations, procedures, policies and practices that are in line with the rules. The Namibian Correctional Service (NCS) has a legal mandate to provide safe and humane custody; therefore in line with the revised NMRs rules NCS plans to implement rules as related to prisons regular monitoring and inspection, in order to establish the current status of compliance to the NMRS. It is against this background that UNODC seeks to recruit a national consultant to support NCS in conducting an assessment for compliance with the NMRs. Purpose of the Consultancy Under the overall supervision of the Regional Programme Coordinator, direct supervision of the National Project Coordinator and working closely with NCS focal person, the consultant will conduct an assessment of the Namibian Correctional Service s compliance with the NMRs. Upon completion of the assessment, the consultant will convene a meeting with NCS to share the findings and recommendation; and further support NCS with the development of the action plans to address any identified compliance gaps. Duties and Responsibilities In close consultation with NCS and UNODC the consultant will be expected to: i. 2 out, the methodological approach (as per UNODC Assessing compliance with NMRs a checklist for internal inspection mechanisms ) including work plan and time frames. ii. Undertake a desk review of international and national laws, correctional act, regulations, related policies, guidelines and other relevant documents as related to the treatment of inmates. iii. Review and adapt the assessment instruments as per UNODC NMRs compliance checklist. iv. Convene a planning meeting with NCS senior management to discuss and reach consensus on the methodological approach and the proposed instruments. v. Conduct the assessment specific-training for the identified NCS support team prior to field work. vi. Conducts one day assessments of NCS management at headquarter. vii. Conduct a two days assessment per facility for all thirteen Correctional Facilities. viii. Analyze data and compile the assessment report, with clearly formulated recommendations on how gaps can be addressed by the Correctional authority. ix. Convene a meeting with NCS to share the assessment findings, and further support NCS with the development of the action plans to address identified compliance gaps. x. Finalize and submit an edited final assessment report to NCS/UNODC for approval. Deliverables and timeline(s) Implementation of activities as set out in this contract will be as proposed in the table below: Product Deliverable Draft, submit and present the consultancy inception report, with a comprehensive budget and costed work plan to NCS and UNODC. Convene a meeting with NCS to share the assessment findings, and further support NCS with the development of the action plans to address identified compliance gaps. Finalize and submit an edited final assessment report to NCS/UNODC for approval. TOTAL DAYS TO COMPLETE THE ASSIGNMENT 26 working days 7 working days 5 working days 50 working days Qualifications, Skills, Attributes and Experiences A successful candidate must meet the following criteria: Education University Degree in criminology, law, social sciences, or related discipline. Working Experience At least five years of work experience in criminal justice related areas, preferably in prison and correctional reforms. Work experience in research in criminal justice or related issues Knowledge and skills Good domain and understanding of UN standards and Norms. Good domain and understanding of NMRs. Knowledge of national laws, and policies on the treatment of inmates. Knowledge of the Namibian Correctional act, Excellent report writing skills are required. Languages and Computer Skills Proficiency in written and spoken English, including the ability to write reports at a professional level, is required. Advanced knowledge of MS Office package (MS Word, MS Excel, MS PowerPoint and MS Access) are be required. Remuneration The consultant will receive remuneration in lump-sum relevant to his/her qualification Page 3 of 5

4 and in line with UN financial rules and regulations. Remuneration will be released in two separate installments subsequent to receipt and approval of deliverables by UNODC. i. The first instalment, amounting to 20% of the total cost of the contract will be released upon signature of the contract and UNODC receipt and approval of the detailed inception report with a comprehensive budget and costed work plan. ii. Another instalment amounting to 80% of the total cost of the contract will be released following UNODC receipt and approval of the final comprehensive edited assessment report. Note: Payment is subject to approval of UNODC on all deliverables. Approval will only be granted based on quality assessment of deliverables submitted. A turn-around time of 5 working days should be factored in, for comments from NCS and UNODC. Evaluation of Proposals Individual consultants will be evaluated based on a cumulative analysis: Offers will be evaluated using the combined scoring method. The Technical Proposal is weighted 70% of the assessment and the Financial Proposal 30%. Technical Proposals will be evaluated based on, but not limited to: The degree to which the proposal indicates thorough understanding of the task. Have the important aspects of the task been addressed in sufficient detail? Are the different components of the project adequately weighted relative to one another? Is the proposal based on a survey of the project environment and was this data input properly used in the preparation of the proposal? Is the conceptual framework adopted appropriate for the task? Is the scope of task well defined and does it correspond to the TOR? Is the presentation clear and is the sequence of activities and the planning logical, realistic and promise efficient implementation to the project?
