1 Transitional Jobs Program Paid Work Experience Agreement This Agreement is between Action Management, Employer and the Participant. Phone: Hours: Training Start End Date: General Conditions: This Transitional Jobs Paid Work Experience Agreement (Agreement) is entered into as part of the Genesee Shiawassee Thumb Michigan Works! (GST) Adult/DW Programs funded by the Federal Workforce Innovation and Opportunity Act (WIOA) and/or Special funding through the TIA/Workforce Development Agency, State of Michigan. The primary function of the Transitional Jobs Paid Work Experience Program is to provide participants the opportunity to develop marketable skills and develop a work history in the work environment. This Agreement may be terminated by the GST Contractor, the Employer or the Participant at any time for any reason, with or without cause. This Participant is hired by the employer and they are designated as the employer of record. The Transitional Jobs Paid Work Experience Program provides % of the hourly rate for the timeframe listed above. The Employer may opt to retain the Participant's employment but is not under obligation to do so. The Employer shall hold harmless, defend, and indemnify the GST Contractor and their employees, agents and representatives from any and all losses, claims, damages, costs and attorney fees whatsoever, caused in whole or in part by acts and/or omissions of the Employer, its employees, agents and/or representatives concerning the Participant. 2 Transitional Jobs Program Paid Work Experience Agreement The GST Contractor Agrees to: Perform a Pre-Assignment Inspection of the Employer's Worksite. Monitor the worksite for safety and adherence to rules. Provide job coaching and problem resolution to the Participant. Ensure the Employer is reimbursed for the Participant's wages in a timely manner. Ensure hourly reimbursement does not exceed 40 hours per week, no overtime will be covered. Ensure the reimbursement pay does not include sick, vacation or holiday pay. Ensures reimbursement will not be given prior to the start of this agreement. The Employer Agrees to: Provide all necessary and reasonable safety and work training. Review and evaluate the Participant s work habits and task accomplishments. Provide all reasonable and appropriate supervision of the Participant. Account for the Participant s time and attendance, to support the reimbursement costs and make available upon request for a period of 5 years. Provide the Participant with up to 40 hours of work each week. Provide the Participant with minimum breaks as required by law. Provide the GST Contractor with an original, signed Labor Union Concurrence Form. Provide the GST Contractor with a written job description for the Participant. Ensure the Participant receives the same wages and working condition s as others employees Provide the GST Provider time and attendance in a timely manner. Comply with all applicable laws regarding displacement of currently employed workers, and refrain from involving Participant in any lobbying, political, religious or union activities. Provide sufficient tools and equipment to safely complete tasks at no expense to the Participant. Comply with all applicable federal, state and local laws including, without limitation, all safety, environmental, labor and equal employment opportunity laws concerning the Participant. The Participant Agrees to: Show up for work on time and provide work for daily wages. Display acceptable work habits. Acquire and apply basic work skills. Not be paid for unexcused absences, lunch or hours not worked. Follow all rules set forth by this Employer and the Transitional Jobs Program. This Agreement and its terms, covenants and conditions cannot be waived or modified except by a written agreement entitled Modification to The Transitional Jobs Paid Work Experience Agreement, which must be signed by an authorized representative of the GST Contractor, and the Employer. The Employer agrees to follow GST Michigan Works! Grievance and Complaint procedures for participants. The Employer has been advised of the MWA s Grievance and Complaint policy and is aware that the complete policy can be found at gstmiworks.org. By signing this contract the employer acknowledges that they have received information regarding the content of the local policy, how to access the entire policy and agrees to follow the policy.
