2 Principles in the Optus Contractor WHS management process CONTRACTOR MANAGEMENT STAGES PRINCIPLES THIS STANDARD REQUISITION Requisition WHS hazard areas are a key consideration in the selection of the appropriate procurement channel. PROCUREMENT CHANNEL SELECTION SPECIFICATION EVALUATION APPROVAL AND RELEASE Specification Hazard areas and Optus expectations in relation to these are communicated to potential providers in relevant project / task requirements (e.g. tenders, statement of works, purchase orders). Appropriate WHS specifications are included in the tender / statement of work conditions / purchase order (if required) and are reflective of Optus role (e.g. principal contractor). Evaluation The contractor submission suggests they are competent to manage the task and WHS risks of their workplace. ENGAGEMENT Engagement All parties have a consistent understanding of their mutual accountabilities as they relate to WHS risk management. Appropriate WHS specifications and obligations are included in the relevant contracts negotiated and signed by Optus. MONITORING Monitoring Relevant WHS controls are implemented and monitored at the workplace to manage the specific conditions and WHS risks of that workplace. SATISFACTORY PERFORMANCE? HANDOVER CLOSE AND REVIEW Handover Customers (internal and external) are made aware of potential risk areas and legislative expectations at handover. Close and review Contractor WHS performance is assessed and considered when using the contractor in future. Project feedback is captured and used to enhance the contractor WHS management process.
3 IMPORTANT NOTE THIS CONTRACTOR WORKPLACE HEALTH SAFETY (WHS) STANDARD HAS BEEN DEVELOPED TO ASSIST OPTUS CONTRACTORS IN THE EXECUTION OF OPTUS CONTRACTED WORKS. THE STANDARD MUST BE ENACTED IN CONJUNCTION WITH OTHER APPLICABLE OPTUS CONTRACT CONDITIONS REGARDING WHS AND THE GOVERNING LEGAL REQUIREMENTS. WHILE THIS STANDARD HAS BEEN DEVELOPED IN CONSIDERATION OF THE LEGAL REQUIREMENTS IT IS NOTED THAT WHERE ANY LEGAL REQUIREMENT EXCEEDS THIS STANDARD THE LEGAL REQUIREMENT SHALL TAKE PRECEDENCE. Purpose and scope This Contractor WHS Standard (Standard) Work in the Vicinity of Underground Assets aims to ensure minimum WHS requirements are met by Optus Contractors when undertaking work in the vicinity of underground assets. In addition, this Standard supports the Commonwealth WHS Act 2011 (Act) where a duty is imposed (under the Act) on a person to ensure health and safety, it requires the person to eliminate so far as is reasonably practicable, and if it is not reasonably practicable to eliminate risks to health and safety, to minimise those risks so far as is reasonably practicable to workers. The Commonwealth WHS Regulations (Regulations) 2011, Part 4.7 Division requires that a person conducting a business or undertaking (PCBU) must ensure, so far as is reasonably practicable, that no person, plant or thing at the workplace comes within an unsafe distance of an underground electric line and if this is not reasonably practicable, the person must ensure that a risk assessment is conducted in relation to the proposed work and control measures implemented are consistent with the risk assessment and, if an electricity supply authority is responsible for the electric line, any requirements of the authority. Regulations Chapter 6 Division 3 Excavation Work establishes provisions for the mandatory identification of underground essential services and defines underground essential services that use pipes, cables or other associated plant located underground. Safe Work Australia Guidance Material on Working in the Vicinity of Overhead and Underground Electric Lines also provides requirements for underground assets. This Standard applies to entities contracted by Optus where work in the vicinity of underground assets is a part of their scope of works. Roles and responsibilities Optus Contractors are, so far as is reasonably practicable, responsible for: Complying with all contractual obligations for WHS including Optus and legislative requirements. Reviewing Optus risk management processes such as Risk Register(s) and this Standard and to factor this information into their safe systems of work. Establishing accountability and authorities for the safe management of work in the vicinity of underground assets. Securing and verification of accreditation, certification, licencing, training and competencies for supervisors, workers and plant operators. Conducting a risk assessment and documenting the outcome as a Safe Work Method Statement or similar, and in accordance with applicable legislative requirements. Providing communication and consultation to workers and their representatives for work in the vicinity of underground assets. Conducting inspections of their works to ensure compliance with safe systems of work and making such reviews / records available to Optus where and as requested.
4 Keeping and maintaining a SWMS after the completion of work or where a notifiable incident occurs, a copy of the SWMS for a period of 2 years. Establishing emergency preparedness and response, including plans and procedures, communications and hardware. Investigating and reporting events such as incidents, accidents, dangerous occurrences and serious illness, within the required contractual period to Optus and where required, to the applicable Regulator. In addition to the above, Optus Contractors, so far as is reasonably practicable, are specifically responsible for: Identification and assessment of underground assets information and appropriate permits. Ensuring underground assets information such as Dial Before You Dig has been secured. Consulting with Asset Owners on how to protect the asset when conducting the works. Ensuring underground assets have been positively identified, assessed, marked and controlled. Ensuring all plant and equipment used for work in the vicinity of underground asset work is installed, inspected and maintained to manufacturers and legal requirements. Ensuring personal protective equipment selected is, suitable, used and maintained. Work planning Work planning includes, but is not limited to: Securing the required information and compliance conditions (Dial Before You Dig type of services, location, depth and conditions, Geographical Information Systems, etc.) from, and notifications are provided to, the supply authority / asset owner / local supply authorities and any other affected party such as water, gas, sewage and communication authorities and private owners / occupiers. Identifying underground assets within the works zone. Consulting with Asset Owner(s) on how to protect and identify underground assets prior to working on the assets. Identifying a risk management process in order to manage the hazards and risks associated with undertaking work in the vicinity of underground assets including the provision for approach distances. Ensuring the risk management process is carried out by a competent person(s). Identifying the required accreditations, licences, certification, training and/or competencies to supervise and perform work in the vicinity of underground assets. Identifying all Commonwealth, State, Territory and local statutory requirements for work in the vicinity of underground assets. Planning for emergency preparedness and response for the given situation such as striking an asset, evacuation (local and public), bush fire, plant and equipment incident etc. Document control Uncontrolled when Printed. 5 Implement work planning In order to establish a safe workplace, the implementation of the above Work Planning, may include, but not be limited to the following: No SAMPLE - WORK PLANNING CHECKLIST YES NO NA 1. Communicate and verifying permits such as Dial Before You Dig and Asset Owners requirements for undertaking work in the vicinity of underground assets. 2. Approve, communicate and implement the risk assessment prior to, during operation and decommissioning of work in the vicinity of underground assets. 3. Arrange, as required, for the underground assets to be de-energised or re-routed and securing the necessary written documentation confirming the de-energising or re-routing prior to the commencement of work. 4. Perform an on-site inspection / checks for the presence of underground assets including any ancillary assets and pits. 5. Conduct the appropriate methods of positively identifying and exposing the underground assets (to avoid accidental damage) and mark those assets when operating in close proximately to those assets. 6. Ensure a competent person inspects the works on a daily basis in order to maintain the agreed safety provisions for working in the vicinity of underground assets. 7. Consult with workers regarding, route design, the work in vicinity of underground assets, when new tasks or changes are introduced, when new equipment is selected, when the existing workplace is redesigned and / or when carrying out work in new environments and the risk and controls associated with these areas. 8. Ensure all testing equipment (rated tools, probes and instruments) is suitable, in good condition and calibrated to the required standards. 9. Ensure that any unsafe electrical equipment at the workplace is disconnected or isolated from its electricity supply and once disconnected is not reconnected until it is repaired and / or tested and found to be safe and / or is replaced and / or permanently removed from use. 10. Where an underground service is damaged, immediately report the damage to the asset owner and Optus. 11. Ensure workers are provided with the required electrical safety devices (e.g. insulated tools, underground cable tester / tracer voltage rated installation gloves, locks, proximity tester, danger tags, signs, barricades, insulated hooks, fire extinguishers, high visibility vests, safety helmets / boots etc.). 12. Ensure the risk assessment is verified / audited at specified intervals and records kept. 13. Ensure emergency preparedness and response provisions (i.e. evacuation, contact with power, gas, water etc) and hardware (first aid kit, fire extinguisher, etc.) are in place prior to the commencement of the works and they are scheduled for testing at regular intervals.
