1 United Nations Children s Fund (UNICEF) Phnom Penh, Cambodia Vacancy Nº CP/13/006 Terms of Reference International Consultancy on Development of the Ministry of Social Affairs, Veterans and Youth Rehabilitation Action Platform ( ) Closing Date: Wednesday 4 September Background: While economic opportunities in Cambodia have improved, an entire segment of the population has been lost in the slipstream of success. Levels of inequality have continued to rise. Children from poor families remain most acutely impacted and face daily threats to their health, education, safety and overall development. Children in Cambodia are exposed to violence, exploitation, abuse and neglect on a daily basis. The absence of strong and effective child protection and social welfare system deepens the effect of these adversarial conditions. Due to shame, stigma and trauma, children with disabilities, children affected by HIV and children rescued from abusive and exploitative situations often face tremendous difficulties in being accepted by their families and reintegrating into their communities. Yet services to prevent violence, abuse, exploitation and neglect, as well as rehabilitate vulnerable and victimized children, are fragmented, inadequate, underfunded and understaffed. Cambodia has only three district social workers per 25,000 people, and most lack resources and skills to prevent, assist and refer cases of violence, abuse, exploitation and neglect, significantly compromising quality of case management and support. NGOs fill some gaps but coverage is often limited and heavily concentrated in and around the largest urban areas. Despite these challenges, with support from UNICEF and other development partners, the government has taken preliminary steps to strengthen child welfare, the justice system and child protection services. This includes developing and implementing social welfare policies, plans of action and regulations; adopting and implementing legal and regulatory frameworks for child justice; and enhancing the capacity of law enforcement to prevent trafficking, abuse and exploitation of children. A major step forward was made by the Royal Government of Cambodia in its Decentralization and Deconcentration (D&D) reform process. The adoption of the Organic Law envisions significant restructuring of government on sub-national level with the establishment of provincial and district councils as additional levels of government to the Commune Councils established in Furthermore, the Law entails that the majority of Ministries will have to undertake a functional review process to identify functions for potential devolution to sub-national administrations in accordance with sector priorities and the principles, structures and procedures set out in the Organic Law. Social welfare is a priority sector identified in the Organic Law (Article 215) and, therefore, MoSVY will be among the first ministries to be concerned by the D&D reform process. In preparation of this process, the Ministry of Social Affairs, Veterans and Youth Rehabilitation has established a D&D working group, to oversee the process and the progress on the implementation of the functional review and its implications for social welfare service delivery. The Ministry of Social Affairs, Veterans and Youth Rehabilitation (MoSVY), in its major strategic plan document the Work platform, identifies six priority areas in which it seeks to strengthen and expand: social welfare services for the vulnerable poor; child welfare and youth rehabilitation services; welfare and rehabilitation services for people with disabilities; social security and welfare services, including for the elderly; the social security safety regime and welfare of veterans; and institutional capacity, partnership and fund-raising capacity to increase the effectiveness of social services. The MOSVY Work Platform lays the ground for the Ministry's priorities, budget allocations and structure.

2 In order to enhance the quality of the role of social welfare sector on improving the wellbeing of vulnerable groups including women and children, the Ministry of Social Affairs, Veterans and Youth Rehabilitation has requested UNICEF s technical and financial support to revise the Work Platform and develop the next action plan for the period of , with more emphasis on results and better costing. The MOSVY will submit this Work platform to Ministry of Planning by end of June 2013 as part of the preparation of the new NSDP development. MOSVY aims to influence the direction of NSDP ( ) to address social welfare system strengthening and social protection of vulnerable children and families. UNICEF, therefore, is recruiting an international expert to ensure that the process of the preparation and the development of the Action Platform will address the gaps and the shortfalls of the current Work Platform and ensure when possible that the new strategic plan is results- based, well costed and address prevention and response to all forms of maltreatment of children. Given that the MoSVY has a mandate beyond child protection, UNICEF is looking for an expert who can support this process from a macro perspective, being aware of the full picture of social welfare, but also being able to provide detailed recommendations on how the child protection/welfare related functions can be improved and enhanced within the overall structure of the Ministry. 2. Purposes of the Consultancy: To provide technical advice/guidance and support to the Ministry of Social Affairs, Veterans and Youth Rehabilitation including the D&D Working Group to develop the action platform taking into account the context in Cambodia and lessons learnt from the region. To facilitate consultation and validation activities with key Ministry of Social Affairs, Veterans and Youth Rehabilitation staff including D&D Working Group members as well as key international and national partners. To support the Ministry of Social Affairs, Veterans and Youth Rehabilitation on drafting the Action Platform document. 3. Methodology: The guiding principles and situation analysis documents that will lead the development of the Action Platform will be: Linkages and synergy with the Rectangular Strategy and Vision 2030; Alignment with the Government D&D reform process and decisions on functional assignment; The guidelines of the development of the National Strategic Development Plan NSDP that will set the priorities for the country for the next five years; The administrative and civil servants reform; The Mid-Term Review MTR of the MOSVY Work Platform and the performance re views; The sectoral situation analysis/the outcomes of the studies and assessments of the financial and functional performance, including the review of the public social work practice and education, with emphasis on child welfare; The mapping of the child protection system; An assessment of the evolving internal and external environment; Efforts the government is making to pull the country out of its LDC Status; The ASEAN economic integration-process; The linkage to achieve CMDGs; Putting the country on a path to attain sustainable and inclusive development. 2

Objectives: The objectives of this consultancy will be achieved through: Desk review of relevant documents in the area of child protection, social welfare, D&D and social welfare sector in Cambodia and other the Royal Governments sectoral legal and administrative documents; Consultations with MOSVY senior decision makers and mangers, MOSVY D&D Working Group, other relevant technical departments including planning and finance; Consultation with Ministries of Planning and Finance; Consultation with development partners and NGOs; Working with technical staff from both MOSVY and UNICEF. 5. Work Assignments/TOR: Key tasks: 1. Desk review of relevant documents, studies and assessments in the area of D&D and social welfare sector in Cambodia taking the consideration the above guiding principles; 2. Prepare the methodology and the proposed structure of the Action Platform ( ) taking into the account the six priorities that have been endorsed by the Minister and as stated in the Work Platform and present the proposed format to the Minister of MOSVY and other senior staff in close consultation with MOSVY Planning Department, D&D WG and UNICEF; 3. With assistance of the national consultant and the MOSVY D&D WG facilitate MOSVY internal consultation on the components of the Action Platform; 4. In consultation and support of the MOSVY D&D Working Group and Department of Planning draft the action platform, including the simplified logical framework; 5. In consultation and support of the MOSVY D&D Working Group develop a tentative framework for the M&E for the Action Platform; 6. In consultation and support of MOSVY D&D Working Group and the Department of Planning facilitate initial costing exercise for the Action Platform; 7. Support the MOSAVY D&D working group in conducting a consultative workshop to validate the draft of the Action with development partners and other stakeholders and incorporate comments in final document; 8. Finalise the Action platform document with chapters include at least: Introduction, situation analysis, policy and legal framework, guiding principles, approaches and crosssectoral issues, Strategic areas/focus, risk analysis and result based management framework (logframe). Methods that involve a participatory approach and experiential learning experiences will be employed by the consultant throughout the mentioned tasks in order to ensure broad-based support from MOSVY as well as other key stakeholders. The consultant will use consultative and validation workshops, as well as various meeting as an opportunity to build the capacity of the members of the MOSVY D&D Working Group and the planning department. 6. Qualifications or Specialized Knowledge/Experience Required: Master level academic qualifications related to the tasks (Law, Public Administration, Social Policy) or relevant high level experience; Minimum 10 years experience working with planning, policy formulation, decentralization reform, and especially child protection/social welfare system building; Experience in strategic planning and within the Cambodian context will be an advantage; Experience in similar processes as well as knowledge and experience from advisory roles to Social Welfare Ministries in countries in the region is a strong advantage; Demonstrated capacity to identify and involve stakeholders in participatory policy exercises; Excellent command of written and spoken English. 3

4 7. Estimated Duration of Contract: Estimated 48 working days, from which 33 days the consultant is required in-country. The remaining 15 days shall be remote work (subsistence allowance not included). 8. Work Schedule tentative TBD with consultant and MOSVY: Week 1 Weeks 2 and 3 Early week 4 Weeks 4-6 Week 7 Week 8 -Development of detailed time-plan for the participatory process of Work Plan development (desk review, consultations and consultative workshop); -Introductory meeting with the senior staff MOSVY staff (State Secretaries) together with UNICEF Representative; - Initial desk review of key documents and consultations with the technical working group and relevant development partners. - Desk review of legal and policy documents and literature related to the D&D reform within the Cambodian context; -Desk review of documents related social welfare sector reform and other overall strategic documents; - Compilation of documents on social sector reform, structure, staffing and budgets of relevant countries in the region to share with MOSVY staff. Extracting of options/examples of social welfare system strategic documents from countries in the region, which can support the development of the MOSVY Work Platform; - In collaboration with MOSVY Planning Department and D&D Working Group, development of draft Work Platform, based on all guiding documents, the current context and good examples of social welfare system strategic documents from countries in the region. Presentation of draft framework and the proposed agenda for the consultative workshop to the MOSVY Minister and senior staff. -Additional desk review, data collection and bi-lateral consultations, as required in order to finalize the draft Platform -Development of simplified M&E framework -Facilitation of consultative meeting to present the draft framework and M&E plan to MOSVY staff, development partners and other stakeholders (week 5) - Incorporation of comments and outcomes of the Workshop into the Work Platform-Drafting of the situation analysis, risk analysis and finalization of the full Work Platform document -Meeting with the MOSVY Minister to present the draft Work Platform with the M&E Framework; -Meetings with MOSVY technical departments and senior management to finalize the costing of the Work Platform. - Presentation to MOSVY Minister of the final Work Plan, simplified M&E framework and costing; -Incorporation of any adjustments requested by MOSVY Senior Management and UNICEF; -Final presentation of the Work Plan, M&E Framework and costing to MOSVY, key stakeholders and donors. Meeting to be chaired by the Minister. 9. Deliverables with due date: 1. Presentation of the timetable and methodology for the 2 month consultancy (Week 1) 2. Presentation of draft structure of the new action platform with clear justification and examples from countries in the region with more advanced social welfare systems (week 3) 3. Draft agenda for the consultative workshop (Week 3) 4. Initial situation analysis and risk assessment, including sources (week 6) 4

5 5. Report of the initial consultative meeting with MOSVY on the component of the action platform and the outcomes and agreements (week 6) 6. Draft of the Action Platform with Log frame and outcomes from the consultative workshop included (week 7) 7. Initial draft of the costing exercise (week 7) 8. A final Work Platform, M&E framework and costing presented to the MOSVY Minister and relevant key stakeholders (week 8) 10. Payment Schedule (Please link to deliverables to the extent possible): Final payment will only be made upon satisfactory completion of contract assignment (submission of deliverables), certification and evaluation of the work done by the Contract supervisor following the below payment schedule: 1. Presentation on the methodology and the structure of the new action platform with clear justification (week 2) and the initial situation analysis, including sources - 20% payment. 2. Report of the initial consultative meeting with MOSVY on the component of the action platform and the outcomes and agreements - 20% payment. 3. Draft of the Action Platform with Log frame and initial report on the costing exercise with the report of the consultative workshop presenting the final draft of the Action Platform document 30 % 4. Final Work Platform - 30% payment. 11. Official Travel Involved: No field visits involved. Meetings with relevant stakeholders in Phnom Penh 12. Supervision and Management Arrangements The consultants will work under the supervision of Head of Child Protection Section and in close coordination with the social welfare specialist. Frequent interactions and close working arrangements with D&D WG of MOSVY are required. Consultant will also liaise with the UNICEF Policy Advocacy and Communication section. 13. Type of Supervision that will be Provided: The supervisor will ensure briefing at the beginning of the consultancy and technical guidance for the consultant throughout the consultancy. In addition, compliance with the ToR and timely delivery of the expected outputs/results will be observed. Upon completion of contract assignments, the supervisor will certify relevant documents; evaluate the consultant s work and process/follow-up on the payments. 14. Consultant s Work Place/Any facilities to be provided by office: Consultant will be closely working with the D&D Working Group of MOSVY. The MOSVY will provide a working space with access to the necessary equipment (e.g. computer, printer etc.). If needed, UNICEF may provide a working space at UNICEF office. 15. Nature of Penalty Clause to be Stipulated in Contract: Unsatisfactory performance: In case of unsatisfactory performance the contract will be terminated by notification letter sent 5 days prior to the termination date. In the meantime, UNICEF will initiate another selection in order to identify appropriate candidate. Performance indicators: Consultants performance will be evaluated against the following criteria: timeliness, quality and quantity of reports, and relevance/feasibility of recommendations for Cambodia. 5

6 16. Evaluation Criteria: A two stage procedure shall be utilized in evaluating proposals, with evaluation of the technical proposal being completed prior to any price proposal being compared. Applications shall therefore contain the following required documentation: 1. Technical Proposal: Consultants shall prepare a proposal on the basis of the tasks and deliverables (detailed in the ToR) provide an updated CV and Personal History Form (P11), and copies of 2 relevant reports performed earlier by the consultant. 2. Financial Proposal: Lump-sum offer with cost breakdown: Consultancy fee, travel costs (economy class), Daily Subsistence Allowance (DSA) and other costs related to the consultation process and stakeholders engagements. No financial information should be contained in the Technical Proposal. Travel expenses (if required) shall be based on the most direct route and economy fare. Maximum of two trips to Cambodia will be considered. Quotations for business class fare will not be considered further. The maximum allowed DSA for Phnom Penh is USD 116/day to cover lodging, meals, and any other costs related to the consultant's stay in Cambodia, including transportation inside the cities. Consultants can offer a more competitive DSA rate, but not alter the days proposed. DSA shall be adjusted to actual days upon signature of Contract. DSA shall only be considered for consultants residing outside of Phnom Penh, Cambodia. For evaluation and selection method, the Cumulative Analysis Method (weight combined score method) shall be used for this recruitment: a) Technical Qualification (max. 80 points) 1.1 Overall submission 10 - Understanding of scope, objectives and completeness and coherence of response - Overall match between the ToR requirements and proposal 1.2 Proposed Methodology and Approach 30 Quality of proposed approach/methodology Quality of proposed Implementation Plan, the suggestion on the content and the framework of the Work platform, and how it will be developed 6

Combine experiences in child protection, social welfare, social policy formulation and planning Strong analytical skills and statistical data processing applications Range and depth of experience with similar projects/assessments Excellent commands of written and spoken English b) Financial Proposal (max. 20 points) The maximum number of points shall be allotted to the lowest Financial Proposal that is opened /evaluated and compared among those technical qualified candidates who have attained a minimum 50 points score in the technical evaluation. Other Financial Proposals will receive points in inverse proportion to the lowest price. The Contract shall be awarded to candidate obtaining the highest combined technical and financial scores, subject to the satisfactory result of the verification interview. 7
