It is a peak regional community organisation. The KLC was established in 1978 by Aboriginal people to work for the protection of traditional land and waters and is charged with the responsibility to protect, enhance and gain formal status (legal, social and political) for the customs, laws and traditions of Kimberley Traditional Owners. As the Federal Government recognised native title representative body for the Kimberley region, the KLC has statutory functions under the Native Title Act (Cth) In accordance with these functions, it assists Aboriginal people to obtain recognition of, and fully enjoy, their native title rights and interests. The KLC is conscious of the dynamic change taking place in contemporary Aboriginal society, and emphasises the role of Kimberley Traditional Owners, our members, and communities in managing that change. In this context, it is dedicated to the development of a modern, sophisticated and innovative service to our members and the community. An elected 32 member Board determines the organisation s priorities in all policy and operational matters. The Board, through the position of the Executive Director, monitors the progress of all KLC activities, and oversees the conduct of the organisation s affairs. The Chief Executive Officer has responsibility for the day to day operation and administration of the organisation. The Chief Executive Officer is assisted in discharging this responsibility by a management team and staff with diverse skills and experience. The work associated with the various functions of the organisation is undertaken by teams consisting of native title officers, legal officers, land and sea management staff, administrative support staff and others located in Broome, Derby, Fitzroy Crossing and Kununurra. DUTIES: 1. Provide legal advice to Native Title Prescribed Bodies Corporate, native title holders and native title claimants throughout the Kimberley in relation to: a) corporate structures, governance and compliance; b) commercial contracts, indigenous land use agreements and other agreements as required; c) the preparation and conduct of applications for determinations of native title under the Native Title Act 1993 (Cth); d) future act matters; e) the protection of heritage sites and areas of significance and the environment under the State and Commonwealth Aboriginal heritage law and State and Commonwealth environmental law; f) relationships with external stakeholders; g) other matters of relevance to the aspirations and needs of the Aboriginal people of the Kimberley consistent with the KLC s objectives; h) strategic policy initiatives. 2

3 2. Attend meetings, often in remote locations, to obtain instructions and to provide information and advice to Prescribed Bodies Corporate, native title holders, and claimants; 3. Represent Native Title Claim Groups in proceedings before the National Native Title Tribunal and the Federal Court and in negotiations with regard to proposals for the use, development and acquisition of land; 4. Liaise and coordinate with counsel, anthropologists, historians, linguists and other consultants. 5. Participate in negotiations and review and draft commercial and other contracts; 6. Prepare reviews, submissions, reports and other documents for the KLC and KLC consultants, including in relation to the matters identified in paragraph 1 above; 7. Undertake research on legal and other issues; 8. Prepare briefs for Counsel and briefs / briefing notes for KLC management, staff / consultants, and external stakeholders as required; 9. Maintain an awareness of relevant case law and legislation; in particular, the following legislation and any case law related to this legislation, but not limited to: Native Title Act, 1993 (Cth); Corporations (Aboriginal and Torres Strait Islander) Act 2006 (Cth) Aboriginal Heritage Act, 1972 (WA); Land Act, 1933 (WA); Local Government Act, 1995 (WA); Mining Act, 1978 (WA); Aboriginal and Torres Strait Islander Heritage Protection Act, 1984 (Cth); Land Administration Act, 1997 (WA); Land Acquisition and Public Works Act, 1902 (WA); and Conservation and Land Management Act, 1984 (WA); 10. Participate in conferences with other members of the legal team and provide regular reports to the Principal Legal Officer; 11. Liaise and attend meetings with internal and external stakeholders as required, including to represent and promote clients interests; 12. Participate in KLC Regional Teams Planning & Activities; 13. Undertake such other tasks relevant to this position as directed by the Principal Legal Officer; 14. Adhere to the values and code of conduct of the KLC; 15. Essential: Applicants are required to demonstrate that they: 1. Have experience in company law especially as it relates to the governance and compliance of Aboriginal corporations; 2. Have experience in native title law and related areas such as cultural heritage, environmental law, contract law, mining law; 3. Are admitted, or immediately eligible, for admission as a Barrister or Solicitor in the Supreme Court of Western Australia and the High Court of Australia; 4. Possess good communication skills and the capacity to liaise effectively with Aboriginal people, government departments, regulators, and members of the public including community groups; 5. Have a minimum of five years experience in legal practice; and 6. Are self-motivated and work cooperatively and effectively with a small team. Desirable It is desirable that applicants demonstrate that they: 7. Have experience of the Federal Court and tribunals; 8. Are prepared to travel in the course of work, including by air; and 9. Possess a current driver s licence. District allowance A district allowance is in addition to the above salary figure. The allowance for the Shire of Broome is currently $6,912 no dependants or $10,315 with dependants. Air conditioning subsidy As per the Kimberley Land Council Enterprise Agreement, an employee will be entitles to receive a subsidy for air conditioning at the rate of cents per unit as follows: Dependants No Dependants September 640 units per month 640 units per month October through April 1600 units per month 1120 units per month Residential Accommodation Entitlements Where an employee is renting a house in the Kimberley the Land Council will pay up to 36% rental subsidy up to a maximum claimable rental of $1500 fortnightly upon application and qualification by the employee. Salary Sacrifice Our salary sacrificing options are provided by RACV Salary Solutions. As the Kimberley Land Council is a Public Benevolent Institution (PBI) we can offer flexible packaging of up to $18,450 per year as well as additional Remote Area Benefits which include the ability to salary sacrifice partial mortgage and rent payments. Please visit for more information. Hours of Work: This position is required to work 37.5 hours per week, working on average 7.5 hours per day. Overtime: All overtime must be approved by your manager and will be accrued as TOIL (time off in lieu). Annual Leave: Employees will be entitled to five weeks (25 DAYS) annual leave. In addition you will receive a 17.5% loading. After a minimum of twelve months continuous service an employee located in the Kimberley is entitled to an annual travel reimbursement of $1300 per annum payable on a reimbursement basis on the provision of receipts. Personal Leave: You will be entitled to (15) fifteen personal leave days per year. This is cumulative from year to year but is not paid out on termination of employment. Long Service Leave: Thirteen (13) weeks after seven (7) continuous years of service (excluding any periods of leave without pay). Pro rata long service leave may be taken after five (5) continuous years of service again excluding any periods of leave without pay. Superannuation: Superannuation Guarantee: KLC currently contributes 9.5% of fortnightly salary. Probationary Period: 5

6 A three-month probationary period is applicable to this position. The period of probation can be extended by the manager/supervisor for an additional period of no greater than three months. Performance Reviews: Reviews are undertaken annually by the Manager. They are responsible for advising on and preparing material for the KLC s effective communication with its membership, providing strategic advice on issues management in the media, and for monitoring media coverage of native title issues and other issues relevant to the KLC s work. The Media Coordinator manages media inquiries, prepares media releases and backgrounders, speeches and other public documents, undertakes media campaigns, and provides advice on the planning and preparation of resource material In addition, the Media Coordinator is responsible for internal communications and external presentation of the Kimberley Land Council through newsletters, social media, and other publications. DUTIES: 1. Manage, develop, implement, and evaluate media and communication strategies to ensure the KLC communicates effectively with its membership, Kimberley communities, and the broader public; 2. Research and write material (including regular newsletters, annual reports, video clips, executive speeches, briefing notes, executive reports, powerpoint and other presentations) for publications or activities of the KLC. 15 3. Work with the management group in devising and implementing national, state, regional and local media strategies for the KLC; 4. Develop and maintain effective liaison with national, state, regional, local and Indigenous media. Manage the delivery of responses to media inquiries on the role and work of the KLC and native title, including the preparation of media statements and the organisation of media coverage; 5. Monitor media coverage of native title and other relevant issues and provide strategic advice on the management of public affairs issues; 6. Liaise with Federal, State and Local Government agencies and other organisations with an interest or involvement in native title and conservation & land management in relation to communications and media activities; 7. Coordinate the production of the annual report, quarterly newsletter and e-newsletter; 8. Document, including photographing where appropriate, important events and meetings; 9. Create digital media content and oversee and manage the KLC website and develop a strategy for social media channels; 10. Participate in KLC work units planning & activities; 11. Comply with KLC Policy & Procedures at all times; and 12. Perform any other duties consistent with the above as directed from time to time. Essential: 1. Tertiary qualifications in journalism, public relations or similar field, or alternatively substantial relevant experience in the communications field. 2. Ability to effectively target material to resonate with a variety of audiences. 3. Issues knowledge: an understanding of the political environment in which the KLC operates and knowledge of issues managed by the KLC including native title, conservation and land management, fire management and indigenous affairs 4. Please visit for more information. Hours of Work: This position is required to work 37.5 hours per week, working on average 7.5 hours per day. Overtime: All overtime must be approved by your manager and will be accrued as TOIL (time off in lieu). Annual Leave: Employees will be entitled to five weeks (25 DAYS) annual leave. In addition you will receive a 17.5% loading. After a minimum of twelve months continuous service an employee located in the Kimberley is entitled to an annual travel reimbursement of $1300 per annum payable on a reimbursement basis on the provision of receipts. Personal Leave: You will be entitled to (15) fifteen personal leave days per year. This is cumulative from year to year but is not paid out on termination of employment. Long Service Leave: Thirteen (13) weeks after seven (7) continuous years of service (excluding any periods of leave without pay). Pro rata long service leave may be taken after five (5) continuous years of service again excluding any periods of leave without pay. Superannuation: Superannuation Guarantee: KLC currently contributes 9.5% of fortnightly salary. Probationary Period: A three-month probationary period is applicable to this position. The period of probation can be extended by the manager/supervisor for an additional period of no greater than three months. Performance Reviews: Reviews are undertaken annually by the Manager.
