He co-authored the NEC3 elearning Academy from BuiltIntelligence. John Rayner John Rayner, has been involved in NEC3 contracts for over 15 years. With extensive contractor, consultant and client experience of NEC3 based contracts he has a complete view of tendering, implementing and delivering NEC3 based contracts. Why NEC3 and Why Now? The New Engineering Contract family has been used in the UK and Overseas for over 20 years. From April 2015, all major HK Government Works Contracts will be carried out under NEC3, the latest iteration. The NEC is a major change in both philosophy and practice from the standard Government GCC contract and requires a much more collaborative and pro-active way of working. Those working under NEC3 need to have a detailed understanding of their obligations and the strict timescales for doing them, otherwise the contract sanctions will apply. Why Leading Edge? Day 2 Preparing an NEC3 contract (Focus on Engineering & Construction Contract) The development of a fit for purpose contract strategy is perhaps the most important set of decisions for a successful contract. Following on from the strategy decision, the next action required to turn the strategy into a successful project, is the development of the subsequent contract documentation and the evaluation of contractors tenders. We will use worked examples to illustrate the points made or participants are welcome to bring their own projects in to work on. This course is designed for contract drafters and consultants, who will be developing procurement strategies and preparing contract documentation. Contracting Strategy : > Principles & Process for developing a fit for purpose contract strategy. > Which contract? Discussion / exercise. > Which main payment option? Fine tuning & implementing the contracting strategy : filling out the Employer s Contract Data part 1 covering other aspects of flexibility. I now have a logical method to develop a contract strategy and what main and secondary options to select to arrive at a best fit contract strategy. Previously, I was guessing! Loved being able to work on my real project. While we will now refine it, the 20% of the thinking that makes 80% of the difference has now been done. Day 3 Bidding to Win NEC3 (Engineering & Construction Contract) This course is aimed at those who bid for work under the NEC3 Engineering and Construction Contract. It will give those who attend a competitive advantage in making their bids more attractive at tender, whilst ensuring profitability when won. For contractors it is essential to both understand what the data put forward by the Employer in Contract Data part 1 means and also know the structure of the two Schedule of Cost Components & how Employers evaluate it, so that they can put in competitive percentages and rates in Contract Data Part 2. The main payment options & what they mean for risk allocation & running the contract. Assembling an Activity Schedule. Exercise. Understanding the clauses and what you have to do, whether representing the Employer or the Contractor, both protects your contractual position and, if managed collaboratively, significantly increases the likelihood of contract success. Day 5 Contract Startup (For Better Projects) (Focus on Engineering & Construction Contract) As one of its 3 principal objectives, the NEC3 family of contracts aims to stimulate good project management of contracts, thus increasing the likelihood of meeting it s time, cost and quality objectives. But: (a) what do you actually have to do to achieve this? and (b) what about bettering these objectives? This intensive course, with a focus on implementation, provides the answers and is best delivered at start up of a contract and attended by both employers and contractors. Day 6 NEC Compensation Events (Focus on Engineering & Construction Contract) Compensation event is the NEC3 name for claims and variations. However, compared with other contracts, there are different definitions of compensation events, different processes and timescales (with time-bars cutting off entitlement) and different criteria by which the time and cost are assessed. So any party going into an NEC3 contract thinking they can run it the old way risks being severely hurt. This course is aimed at those who manage and administrate the assessment of compensation events on whichever side of the contractual fence they sit. It will give any organisation attending it a significant commercial advantage over another party who has not attended it.
