3 CANTON POST OFFICE & CANTON PLANT LOCAL AGREEMENT - APWU Recognition 1. The APWU, Canton Ohio Area Local, represents the following crafts which work in the Canton Plant, the Canton Post Office or Canton Operations supervised by the District Office. The Clerk Craft, Building Maintenance Craft and Motor Vehicle Service Craft. All Employees who work within these crafts are covered by these MEMORANDA. 2. lndividual items agreed to in this MEMORANDUM, which apply to certain crafts only, will be so designated. All other items apply to all crafts covered by these MEMORANDA. ITEM ONE Additional or Longer Wash-up Periods ALL CRAFTS Employees shall be entitled to a five (5) minute wash-up time before lunch break and at the finish of their tour. ITEM TWO The Establishment of Regular Work Week of Five Days With Either Fixed or Rotating Days Off 1. Employees occupying FTR duty assignments (traditional and NTFT) in postal installations which have 200 or more man years of employment in the regular work force, career employees in mail processing operations, transportation and vehicle maintenance facility operations will have consecutive days off, unless otherwise agreed to by the parties at the local level. For employees occupying NTFT duty assignments, if the NTFT schedule has 3 or more scheduled days off, at least 2 must be consecutive.

4 2. NTFT employees will normally work the number of hours (daily and/or weekly) identified in their bid assignment, except in an emergency. These employees are entitled to out of schedule premium for hours worked outside their normal schedule. ITEM THREE Guidelines for the Curtailment or Termination of Postal Operations to Conform to Orders of Local Authorities or as Local Conditions Warrant Because of Emergency Conditions The decision for curtailment or termination of Postal Operations to conform to the orders of local authorities or as local conditions warrant, because of emergency conditions shall be made by the District Manager or Designee. When the decision has been reached to curtail Postal Operations, Management will follow the procedures set in place by the Emergency Management Plan. ITEM FOUR Formulation of Local Leave Program, Clerks, Maintenance, VMF 1. One copy of the vacation schedule from each section will be mailed to the President of the Canton, Ohio Area Local APWU 30 days prior to the posting date. A Designated management representative and a representative for the Canton, Ohio Area Local designated by the President will meet and discuss any discrepancies prior to the posting. All changes shall be mutually agreed to. 2. A copy of the vacation roster will be posted on an official bulletin board. 3. No trading of choice vacation periods will be permitted. ITEM FIVE Duration of Choice Vacation Period

5 The choice vacation period will be the first Monday in January through the last Monday in December excluding the second and third full weeks in December. ITEM SIX Determination of the Beginning Day of an Employee's Vacation Period 1. The beginning of an employee's vacation period will be Monday. 2. Normally employees, including those on the overtime desired list that have annual leave immediately preceding and/or following nonscheduled days will not be required to work overtime on their off days. However, employees may advise their supervisor in writing of their availability to work a nonscheduled day that is in conjunction with approved annual leave. ITEM SEVEN Whether Employees, at their Option, May Request Two Selections During Choice Vacation Period, ln Units of Either Five (5) or Ten (10) Days A. Employees selecting vacations during the choice vacation period will do so in accordance with one of the options listed below. Employees earning 13 days annual leave: Option 1. A single selection of up to ten (10) working days, two (2) consecutive weeks. Option 2. Two selections of five (5) working days, one (1) week each. B. Employees earning 20 or 26 days of annual leave may select from one of two options below: Option 1. A single selection of up to fifteen (15) working days, three (3) consecutive weeks. Option 2. Two selections: one of five (5) working days, one (1) week and one (1) of ten (10) working

6 days, two (2) consecutive weeks. C. 1st Bidding: Annual leave bidding for all sections will start on November 1st for the entire Canton Installation. Employees must select without alteration their vacation period within two (2) days from their first opportunity to do so, according to seniority. Failure to exercise their option will result in forfeiture until the second bidding period. Employees that are requesting leave must have the annual leave to cover the request at the time of the request to include the projected advanced leave balance for the new leave year. Selections will be by seniority. D. 2nd Bidding: lmmediately after the completion of the first bidding cycle, the schedules will remain posted and employees must select within two (2) days from their first opportunity to do so providing the employees that are requesting leave must have the annual leave to cover the request at the time of the request to include the advanced leave balance for the new leave year. Failure to exercise their option will result in forfeiture. Selections will be by seniority. E. lf the annual leave bidding process is not completed by April 1st and an employee requests annual leave, the employee requesting annual leave, a Union representative and a Managerial representative will notify the senior employees who have not received the opportunity to make a selection. The senior employees must waive this time verbally and/or in writing prior to granting the junior employee's request. F. Part Time Flexible, PTRs and/or Transitionals will be required to take forty (40) hours of annual leave for each leave week, with the exception of weeks containing holidays. ITEM EIGHT

7 Whether Jury Duty and Attendance at National or State Conventions shall be Charged to the Choice Vacation Period An employee who is called for jury duty during the employee's scheduled choice vacation period or who attends a National State or Regional Convention (Assembly) during the choice vacation period is eligible for another available period provided this does not deprive any other employee of first choice for scheduled vacation. ITEM NINE Determination of the Maximum Number of Employees who shall receive leave each week during the Choice Vacation Period. A. From Monday of the third full week of April, through Friday of the second full week of September, when requested 15% of the employees will be granted leave in accordance with ltem 4 of this Memorandum. During incidental leave after the last bidding. The 15% will include extended OWCP, extended LWOP, extended Sick Leave, Military Leave, Court Leave, leave to attend national conventions and Annual Leave. When applying the 15% requirement, any fraction of 0.50 or more will be rounded to the next higher number. Any fraction less than 0.50 wilt be rounded down to the next lower number. B. From Monday of the third full week of September through Friday of the second full week of April, excluding the 2nd and 3rd full week in December, when requested 10% of the employees will be granted leave in accordance with ltem 4 of this Memorandum. The 10% will include extended OWCP, extended LWOP, extended sick Leave, Military Leave, Court Leave, leave to attend national conventions and Annual Leave. This applies to incidental leave after the last bidding. When applying the 10% requirement, any fraction of 0.50 or more will be rounded to the next higher number. Any fraction less than 0.50 will

8 be rounded down to the next lower number. C. No additional names and/or slots will be added to the vacation list once the list is posted. lf there is an increase in employee complement, leave will be granted until the appropriate percentage is maximized for that section. lf there is a decrease in employee complement, the number of employees that would be permitted off will be reduced. Clerk Craft: Selections Defined for Leave Planning Plant: Tour 1: Automation, FSM, and Manual as one section by Tour, regardless of Pay Location. Tour 2: Automation, FSM, and Manual as one section by Tour, regardless of Pay Location. Tour 3: Automation, FSM, and Manual as one Section by Tour, regardless of Pay Location. Customer Services: The 10% and the 15% guidelines will not be applied to sections identified below. There shall be one (1) vacation list established for all identified sections below. The criteria for the number of employees permitted off by section identified below during prime time vacation as defined in ltem 5 of this agreement is as follows: 1-8 employees per section, 1 employee will be permitted off employees per section, 2 employees will be permitted off employees per section, 3 employees will be permitted off employees per section, 4 employees will be permitted off. 1. Main Office Window Service. One section. 2. East Canton. One section. 3. Country Fair Station. One section.

9 4. Dueber Station & North lndustry. One section. 5. Northeast Waterworks Branch. One section. 6. New Market Station. One section. 7. Jackson-Belden Branch. One section. 8. North Canton Branch. One section. 9. Bulk Mail Acceptance clerks, Mailing Requirements and Mail Classification Clerks. One section. 10. Timekeeping, ODIS clerks, Customer Services Office/ Staff Clerk. One section. 11. Plant Support, Contract Technician and ln-plant Support Clerks. One section. 12. MVS, Postal Vehicle Service, all PVS drivers as one section. Vehicle Maintenance Facility: 13. Office employees (General Clerk, Storekeeper and Garageman). One each week. 14. Auto Technicians Maximum of two (2) each week. Maintenance Craft: 15. Building and Equipment Mechanics by Tour. 16. Maintenance Mechanics by Tour. 17. Electronic Technicians by Tour. 18. Mail Processing Mechanics (MPEs) as one section. 19. Maintenance Clerks as one section. 20. Custodial Laborers and Custodians by Tour within the Canton lnstallation. ITEM TEN The lssuance of Official Notice to Each Employee of the Vacation Schedule Approved for Each Employee As soon as each vacation bid period is finished, each employee shall receive their duplicate copy of the PS Form 3971 submitted at the time they signed the vacation schedule. A copy of the finished vacation roster for each

10 particular tour/section will be posted at that section's official bulletin board. ITEM ELEVEN Determination of the Date and Means of Notifying Employees of the Beginning of the New Leave Year Employees will be notified of the beginning of the new leave year no tater than November 1. Notices will be posted on official bulletin boards. ITEM TWELVE The Procedures for Submission of Application for Annual Leave During Other Than the Choice Vacation Period 1. The application for incidental leave shall be presented to the employee's immediate supervisor on form 3971 in triplicate. One copy will be returned to the employee immediately signed by the supervisor as being received. One copy, signifying approval or disapproval, will be returned to the employee within 48 hours, provided that the application is submitted at least five (5) days and no more than 30 days prior to the first day of approved leave. Employees requesting annual leave will be entitled to an answer within 48 hours from the end of the tour on the date submitted. If no answer is received, the leave request is granted. such leave if approved will be granted on a first come, first served basis. A. The employee, after making their selection for vacation and later wishing to relinquish all or part of their vacation, shall notify the employer at least fourteen (14) days prior to the service week containing the time to be relinquished. Leave may only be relinquished in eight (8) hour increments. Employees may relinquish after the Monday prior if an emergency situation occurs. No relinquishment requests will be accepted until the completion of the AL

11 bidding process B. Other incidental annual leave will be granted on a first come, first served basis. However, when more than one employee requests annual leave on the same date for the same time period, annual leave shall be granted by seniority. No PS 3971 will be accepted more than thirty (30) days in advance of requested annual leave of less than one week. However, one week or more may be submitted in one week increments after the bidding cycle has closed pending ample annual leave balance. ITEM THIRTEEN The Method of Selecting Employees to Work on a Holiday 1. The immediate supervisor shall take a holiday roster sheet and approach each employee and inquire if the employee desires to volunteer to work his/her designated holiday and non-scheduled days. Prior to posting the holiday schedule the President or designee should review the holiday schedule. 2. The following order will be used for Holiday Scheduling: A. All fulltime employees who possess the necessary skills and have volunteered to work on the holiday or their designated holiday. B. All PSE to the extent possible, even if payment of overtime is required. C. Full-time volunteer employees whose N/S day falls on the holiday and possess the necessary skills, even though the payment of overtime is required, by seniority. D. Full-time non-volunteer employees whose N/S day falls on the holiday and possess the necessary skills, even though the payment of overtime is

12 required, by juniority. E. Full-time employees who have not volunteered to work their holiday, by juniority. F. Mandated employees will work as close as possible to their normal schedule. ITEM FOURTEEN Whether Overtime Desired Lists in Article 8 Shall be by Section and/or Tour A. Overtime Desired List will be maintained by sections within the Tour. There shall be 4 Overtime Desired Lists established for each section maintained by sections. 1. Up to 4 hours before Tour 2. Up to 4 hours after Tour 3. Non-Scheduled Days 4. Out of Section (Within their craft) To avoid the payment of Penalty Overtime, employees who desire overtime, that have selected to work out of section may be utilized. Plant Sections and Customer Service Sections are considered separate for the "out of section overtime, except for the Main Office window service employees who may work in Plant Sections. B. A copy of the Overtime Desired List will be posted on the Official Bulletin Board, and a copy will be mailed to the APWU President every quarter. C. Once the overtime Desired List is made up for the quarter, the only additions are as follows: 1. When a part time flexible clerk becomes full time. 2. When a successful bidder goes from one section to a

13 different section. 3. When an employee is not available during the period where the OTDL is circulating, be it for hospitalization, convalescence, training school or annual leave/sick leave. 4. Due to a minor change of bid assignment. 5. Going to and from a temporary bargaining unit detail. D. The employee will contact the supervisor and a union steward within seven (7) days of the above to add their name to the list. E. When an employee removes their name from the OTDL, the supervisor will mail a copy of the employee's request to the APWU president. F. lf it is necessary for non-otdl employees to work an hour or longer overtime, Management will give them at least one hour advance notice. For overtime of less than one hour, Management will make every attempt to give employees as much advance notification as possible. G. A non-otdl employee who works his non-scheduled day shall not be scheduled more than two (2) hours outside their scheduled work hours without their approval. Sections Defined for Overtime Desired Lists: Clerk Craft: Plant: Tour 1 One Section Tour 2 One Section to include Timekeeper, ODIS clerks, ln-plant support Clerks. Tour 3 One Section Hours relinquished will count towards hours worked/

14 opportunities offered for the purpose of equitable overtime opportunities. Management will post and update, not less than weekly, all overtime opportunities worked or relinquished on the official bulletin board. Customer Service Sections: Jackson-Belden Section Dueber Section North Canton Section North lndustry Section Northeast Waterworks Section East Canton Section New Market Section Country Fair Section Main Office Window Service Section Bulk Mail Acceptance Clerks, Mailing Requirements Clerks, and Customer Service Staff Clerks Section Motor Vehicle Service Craft: 1. All PVS drivers as one Section 2. AII VMF employees as one Section Maintenance Craft: 1. Building and Equipment Mechanics by Tour 2. Maintenance Mechanics by Tour 3. Electronic Technicians by Tour 4. Mail Processing Mechanics (MPEs) as one Section 5. Maintenance Clerks as one Section 6. Custodial Laborers and Custodians by Tour within the Main Post office 7. Custodial Laborers and Custodians by Stations to be combined on one list. ITEM FIFTEEN The number of light duty assignments within each craft or occupational group to be reserved for temporary or permanent light duty assignments 1. Any full time employee recuperating from a serious illness or injury, and is temporarily unable to perform their assigned duties may voluntarily submit a written request to the lnstallation Head or their designee for a temporary assignment

15 to light duty. The request shall be supported by medical statement from a licensed physician including the anticipated duration for the convalescence period. 2. An employee that requests a light duty assignment and is unable to perform their regular bid assignment in compliance with documented medical restrictions, that employee will be assigned light duty hours between the hours of 6:00 pm and 6:00 am. The Union President, Postmaster and/or Plant Manager will mutually agree upon non-scheduled days, hours and work to be performed. ITEM SIXTEEN The method to be used in reserving light duty assignment's so that no regularly assigned member of the regular work force will be adversely affected When an employee represented by the memoranda requests a light duty assignment, Management and the Organization shall mutually agree upon the tour and duties of said employee. ITEM SEVENTEEN Any duties within the light duty person's medical restrictions shalt be considered an identified light duty assignment. ITEM EIGHTEEN The identification of assignments comprising a section. when it is proposed to reassign within an installation employees excess to the needs of a section ln the event it becomes necessary to surplus, excess or reassign employees within the Canton installation, sections are defined as follows: 1. Business Mail Entry Unit 2. Country Fair 3. East Canton

16 4. Jackson Belden 5. Main Office Window Service 6. New Market 7. North Canton 8. North lndustry 9. North East Waterworks 10. Plant a. Tour 1, regardless of pay location by Tour b. Management will make reasonable effort to provide adequate parking for all employees. Parking will be allowed on a first come, first served basis with the exception of the reserved parking spots provided below

17 at the Main Post Office. Postmaster, Plant Manager, MDO Tour 1, MDO Tour 3, Customer Relations Coordinator, President APWU, Supervisor Customer Service Support, all Customer parking, all Handicap parking, Postal lnspection (2 spots). ITEM TWENTY Determination as to whether Annual Leave to Attend Union Activities Requested Prior to Determination of the Choice Vacation Schedule is to be Part of the Total Vacation Plan A. Annual Leave approved to attend Union activities prior to the granting of choice vacation period will be counted in the percentage provided for in Item Nine of the memorandum. lncluded are: President, Vice- president, Treasurer, secretary, craft Directors, Business Agent or their designee. Notification of national conventions will be submitted to management prior to the beginning of the bidding cycle. ITEM TWENW-ONE Those other items which are subject to local negotiations as provided in the craft provisions of this agreement 1. Technological and Mechanization Changes A representative from the Organization and the union shall be invited to attend all orientation sessions. As soon as it is known by Management that equipment/automation is being placed into operation in the-canton, Ohio Post Office. The union will be notified. 2. Employee Complement: The Union will be furnished copies of our inner office memo describing all personnel actions in the Canton, Ohio Post Office as available.

18 3. Representation Labor-Management Meetings: A. Labor-Management meetings shall be held quarterly or at a predetermined time and date mutually agreed to by all parties. B. Agenda items will be submitted at least two (2) days prior to the meeting and will be restricted to items of general concern. Minutes will be kept of the meeting with copies to all crafts. Copies of said minutes will be posted on all official bulletin boards. Management will be represented by the lnstallation Head or his designee and such other top management supervisors who are available. ITEM TWENTY-TWO Local implementation of this Agreement relating to seniority. reassignments and posting. 1. Filling Assignments A. Except in the month of December, the successful bidder shall be placed in the new assignment in accordance with the appropriate craft article. B. Any employee who bids from one tour to another and has a conflict in schedule shall be given the option on the use of annual leave or a change of schedule. C. The Union President and a designated Managerial representative will discuss all vacant positions and/or newly established positions prior to posting. All vacancies shall be posted in accordance with the appropriate craft article. D. The Union President wilt receive a printout/ of the results of the bidding process to include pre-awards and awards prior to any exclusion, as soon as available.

19 E. Higher Level details will be accordance with Article 25.4 of the CBA. F. Movement out of section will be by juniority with the exception of a Postal Operation curtailment. G. PS3189 forms must be signed by an APWU steward prior to being submitted to management. Local management will provide a answer within 48 hours. 2. Criteria requiring Reposting A. Any change in essential knowledge requirements (ie change requiring a deferment period). B. Any change in starting time of more than two (2) hours or change in N/S day for the life of the Memoranda. C. Any position affected by a major change shall be posted for bid on the next bidding cycle. Minor Changes 3. Seniority: lf the incumbent declines to accept minor changes, the position with the new requirements shall be posted for bid on the next bid cycle. An up-to-date seniority list will be made available to clerk, vehicle, and maintenance craft employees in accordance with the appropriate craft article. ln addition, an up-todate seniority list for clerk, maintenance, and vehicle craft will be posted on official bulletin boards. copies will be furnished to the Local Union. Additional copes will be provided upon request. 4. Motor Vehicle Service A. Loading Vehicles:

20 Tailgate service for loading motor vehicle service trucks shall be provided. This means that mail scheduled for dispatch shall be presented to the driver at the tailgate of his vehicle. B. Unloading Vehicles: 1. Tailgate service for unloading motor vehicle services trucks shall be provided to assure orderly and efficient unloading operations at the Main Office. 2. Motor Vehicle Drivers will be given assistance to unload mails when necessary. SEPARABILITY AND DURATION Should any part of this memorandum or any provisions contained therein be rendered or declared invalid by reason. or any existing or subsequently enacted legislation a court of competent jurisdiction. such invalidation of such part or provision of the memorandum shall not invalidate the remaining portions of this memorandum. and shall expire at 12:00 midnight May 20, 2015, unless extended by mutual agreement at the national level. This Memorandum of Understanding constitutes the entire agreement between the parties and correctly expresses all the rights and obligations of the parties. This Memorandum of understanding is entered into on Canton, Ohio between the representatives of the US Postal Service and the Canton Division of the Canton Ohio Area Local, American Postal Workers union, AFL-CIO, pursuant to the local implementation provisions of the National Agreement.
