1 TERMS of REFERENCE ASSISTANT LEGAL OFFICER Copyright Law Division Culture and Creative Industries Sector 1. Organizational context The post is located in the Copyright Law Division of the Culture and Creative Industries Sector. This Division is responsible for the implementation of WIPO s strategic goal concerning the balanced evolution of the international normative framework for intellectual property in the area of copyright and related rights, and for providing assistance to Member States in drafting and updating their national legislation in the aforementioned field of intellectual property. The incumbent works as part of a team of lawyers that facilitates normative outcomes for the international law of copyright and related rights at all levels of the normative hierarchy, including new international treaties, the amendment and updating of existing international agreements and soft law instrument. The team also advises Member States in the development of balanced legislative, regulatory and policy frameworks in that area. The main role of the incumbent is to undertake analysis and research on specific legal issues related to copyright and related rights, provide assistance to Member States in drafting and updating their national legislation, and provide secretariat services to the Standing Committee on Copyright and Related Rights (SCCR). The incumbent works under the supervision of and would be mentored by the Director of the Copyright Law Division and the senior legal counsellors in the Division. 2. Duties and responsibilities The incumbent performs the following principal duties: (a) assists in planning and preparing drafts of legal documents related to copyright and related rights, including papers, studies, memoranda, correspondence, and others as requested; (b) assists in drafting legislative advice in English related to international and national copyright and related rights protection, particularly with respect to WIPO administered treaties, and assists in providing requested advice to WIPO Member States on these topics; (c) supports and carries out preparatory arrangements for meetings, conferences, and seminars convened by the Division, and prepares drafts of reports on these events;

2 (d) prepares for and participates in meetings and conferences at an appropriate level, including drafting and/or delivering presentations on international and national copyright and related rights protection for a wide variety of audiences; (e) carries out legal research on subjects related to international and national copyright and related rights; (f) contributes to the preparation of internal WIPO reports and other administrative documents in English for the Division; (g) performs other related duties as required. 3. Requirements Education: First or second level university degree in law that would lead to eligibility to practice law. Specialization in intellectual property law; member of national bar already qualified to practice law. Experience: At least three years of relevant professional experience in the field of intellectual property law and procedures in the public or private sector. Experience conducting legal research in the field of copyright and related rights. Languages: Excellent knowledge of spoken and written English. Knowledge of additional official UN language(s). Knowledge, skills and competencies: Ability to design and conduct research and analyze defined aspects of legal issues. Knowledge of applicable legal principles of copyright and related rights law. Ability to present clearly and logically in English in written and oral form. Organizational skills with the ability to work within strict deadlines.

4 Associate Legal Officer Grade: P2 Legal and Constitutional Affairs Section Office of the Legal Counsel Organizational Context: The position is located in the Legal and Constitutional Affairs Section of the Office of the Legal Counsel. The incumbent is required to support the Head of the Section and the Legal Counsel in providing assistance with respect to the management of the trademarks portfolio and the copyright assets of the Organization. The incumbent works under the supervision of the Head of the Legal and Constitutional Affairs Section. Main duties: The incumbent performs the following tasks: (a) carry out trademark searches using the appropriate tools and preparing reports containing the results thereof, (b) prepare studies on the protection strategy for WIPO s trademarks, name and acronym, (c) carry out the different procedural steps relating to the registration/renewal of WIPO s trademarks worldwide, (d) monitor the reports received as a result of the worldwide watch services; (e) in line with established policy, grant authorizations to third parties to use the copyright-protected materials, and the preparation of studies on the copyright protection of materials developed in WIPO; (f) provide input for the development and drafting of policies for the Organization relating to the various aspects of the protection and management of its intellectual property assets; (g) process requests for permanent observer status in WIPO by intergovernmental and nongovernmental organizations and the preparation of the corresponding documentation for Member States; (h) prepare documents submitted to diplomatic conferences and meetings of Member States including to the Assemblies of the Member States of the Organization; (i) prepare treaty action notifications and other tasks relating to the functions of depositary in relation to WIPO s administered treaties, carried out by the Legal and Constitutional Affairs Section; (j) perform any other duty in the area of competence as required. Qualifications required Education: Advanced university degree in law.

5 Postgraduate diploma in the field of intellectual property. Experience: At least 3 years of relevant professional work experience in the area of law gained in a legal department of an intergovernmental organization or national administration or by working for a law firm. Professional experience in the field of trademarks would be an advantage. Skills: Analytical and legal drafting skills. Organizational skills with the ability to work under pressure and to respect deadlines. Confident user of Microsoft Office applications including Word, Excel, Outlook and PowerPoint and the Internet. Excellent interpersonal skills and ability to maintain effective partnerships and working relations in a multicultural, multi-ethnic environment with sensitivity and respect for diversity. Organizational context The post is located in the Patent Law Section of the Patent Law Division, Innovation and Technology Sector. This Division is responsible for the implementation of WIPO s strategic goals concerning the balanced evolution of the international normative framework for intellectual property in the area of patents, utility models, undisclosed information/trade secrets and layout designs (topographies) of integrated circuits, and for providing assistance to Member States in drafting and updating their national legislation in the aforementioned fields of intellectual property. The incumbent works as part of a team that facilitates normative development of the international law in the aforementioned fields of intellectual property at all levels of the normative hierarchy. Through the provision of comprehensive and reliable information, the team also assists Member States for the development of balanced legislative and policy frameworks and practices. The main role of the incumbent is to conduct legal research and analyses on various legal issues related to patents, utility models, trade secrets and layout designs of integrated circuits, and provide Secretariat services to the Standing Committee on the Law of Patents (SCP). The incumbent works under the supervision of the Head of the Patent Law Section. 2. Duties and responsibilities The incumbent performs the following principal duties: (a) Carry out research works on various topics in the assigned work area; perform comparative analyses of legislation and practice of different Member States; (b) (c) (d) Provide input and prepare initial drafts of working documents for WIPO technical committees and bodies, guides, legal opinions and other documents pertaining to the functions and activities of the work unit; Participate as a member of the Secretariat of WIPO technical committees, in meetings and other bodies, including the drafting of summary minutes; Reply to general correspondence and inquiries and provide advice on general legal questions concerning the law of patents, utility models, undisclosed information/trade secrets and layout designs (topographies) of integrated circuits;

Experience in the field of patent law and practice. Languages: Excellent knowledge of English. Working knowledge of any other official UN languages. Knowledge, skills and competencies: Ability to design and conduct research and analyze defined aspects of legal issues. Knowledge of legal principles of intellectual property law. Ability to draft legal texts in a clear, concise and logical manner. Ability to communicate complex legal issues in written and oral forms. Organizational skills with the ability to work within strict deadlines.
