PURPOSE Comprehensive Land Use Plan Update Request for Proposal (RFP) Town of Ocean View, Delaware The Town of Ocean View, Delaware is soliciting proposals from individuals and firms (Consultant) with the expertise and experience to work with the Town to prepare an updated comprehensive development plan, including texts and maps, as required by Title 22, 702. Proposals must be received no later than 10:00 a.m. on Friday, November 9, Proposals received after this time will not be considered. 2. SUBMITTAL REQUIREMENTS For evaluation purposes, each proposal submitted should include at least the following items in the order listed below with tabs or dividers between each section. If the proposal does not respond to a specific requirement, the Town may eliminate that prospective Consultant from consideration. A. COVER LETTER The cover letter must be signed by a representative authorized to legally bind the Consultant and include: 1. Name, telephone number, and address of a contact person with authority to answer questions regarding the proposal. 2. Identification of the firm as a corporation or other legal entity. 3. Delaware business license. 4. Professional license for members of the project team, if applicable. 5. Certificate of Insurance. B. FIRM EXPERIENCE Outline your firm s experience and other credentials that illustrate qualifications to undertake this project. Provide at least three examples of a Comprehensive Land Use Plan that your firm has completed within the last five years. C. PROJECT TEAM COMPOSITION Provide a description of the team that will be assigned to the project including resumes for all team members. The team must include a certified land planner. Resumes should be kept to a maximum of two pages. Identify the capacity in which the team members will be used and identify the Project Manager for ongoing contact. Only include descriptions and resumes for individuals who will have continuous or substantial involvement in the project. Any work intended to be subcontracted must be disclosed, including the name of the subcontractor and specific subcontracted tasks.

3 D. APPROACH TO THE PROJECT Provide a detailed description of your firm s approach to achieve the Scope of Work. Scope of Work elements may be expanded to provide further detail or modified to capture aspects of the plan that may need to be included. E. UNDERSTANDING OF OCEAN VIEW Provide information that demonstrates your understanding of the Town of Ocean View generally, and the unique land use and planning issues facing the Town specifically. F. COST AND COMPENSATION Provide a detailed outline of project costs for completing the Scope of Work. This should list the phase of the work, the tasks associated with each phase and the estimated material and labor hours and costs to accomplish each task with a not to exceed final figure. G. NUMBER OF PROPOSALS Please submit six (6) copies of the proposal and one (1) flash drive with the presentation in PDF format. The Town of Ocean View reserves the right to reject any and all proposals, and the submission of a proposal is not a guarantee of contract award.

4 3. EVALUATION PROCESS The Town of Ocean View will evaluate a Consultant based upon a thorough review of the merits of the proposals received. The following criteria will be considered in the evaluation of the proposals: Weighting Factor Criterion 35% Expertise, experience, and qualifications of the Consultant Team as related to the Scope of Work, including team member experience. 25% Experience working with municipal governments and municipal projects with emphasis on projects similar in scope to the project as described in the proposal documents. 25% Ability to achieve overall project excellence and the ability to meet the Town s timeline and objectives. 15% Performance on all projects within the last five years including, but not limited to: project success, relevance of projects to Scope of Work contained in the proposal documents, ability to meet deadlines, thoroughness and completeness of submittals. 4. SELECTION PROCESS A. Each vendor will be rated for each criterion on a scale of zero to four as described below: Unacceptable 0 Poor 1 Fair 2 Good 3 Superior 4 B. A Vendor s final grade will be the sum of each criterion s rating multiplied by the weighting factor listed above.

TENTATIVE SCHEDULE The tentative schedule for this request for Proposals is as follows: Release of RFP: October 12, 2018 Deadline for Questions: October 26, 2018 Proposal Submission Deadline: November 9, 2018 Selection Committee Reviews Completed: December 7, 2018 Schedule Consultant Interviews: December 19, 2018 Selection of Consultant: January 7, 2019 Notice to proceed on or before February 1, 2019 Estimated Plan Adoption: December 10, 2019

6 6: SAMPLE CONTRACT NON-COLLUSIVE AFFIDAVIT being first duly sworn, deposes and says that: 1. Neither the said Vendor nor any of its officers, partners, owners, agents, representatives, employees or parties in interest, including this affiant, have in any way colluded, conspired, connived or agreed, directly or indirectly, with any other Vendor, firm, or person to submit a collusive or sham Bid Document in connection with the Work for which the attached Bid Document has been submitted; or to refrain from bidding in connection with such Work; or have in any manner, directly or indirectly, sought by agreement or collusion, or communication, or conference with any Vendor, firm, or person to fix the price or prices in the attached Bid Document or of any other Vendor, or to fix any overhead, profit, or cost elements on the Bid Document price or the Bid Document price of any other Vendor, or to secure through any collusion, conspiracy, connivance, or unlawful agreement any disadvantage against (Recipient), or any person interested in the Work; 5. The price or prices quoted in the attached Bid Document are fair and proper and are not tainted by any collusion, conspiracy, connivance, or unlawful agreement on the part of the Vendor or any other of its agents, representatives, owners, employees or parties in interest, including this affiant. 8 CONTRACT THIS CONTRACT made this day of, 2018, by and between The Town of Ocean View, hereinafter called Town and doing business as (an individual), (a partnership), or (a corporation) hereinafter called 'Successful Vendor'. WITNESSED: That for and in consideration for payment and agreements hereinafter mentioned: 1. Successful Vendor will furnish all the material, supplies, tools, equipment, labor and other services necessary for the construction of the Work described herein. 1. Successful Vendor will commence the Work required by the Contract Documents within ten (10) calendar days after the date of the Notice to Proceed unless the period for commencement is extended otherwise by the Contract Documents. 2. Successful Vendor agrees to perform all the Work described in the Bid Documents and comply with the terms therein. 3. The term 'Contract Documents' means and includes the following: a.
