3 INTRODUCTION The Ontario Film Authority (OFA) is a not-for-profit corporation, responsible for administering the Film Classification Act, 2005 and its associated regulation on behalf of the Ministry of Government and Consumer Services. The OFA was established as a delegated administrative authority (DAA) on October 1, 2015 under the Safety and Consumer Statutes Administration Act, The delegation to the OFA occurred as a result of the mutual desire of the Ontario government and the film industry to enhance professionalism, increase consumer protection and provide an effective, efficient and responsive regulatory framework. The OFA is not a government entity; it is governed by an independent board of directors and is wholly financed by the fees paid by the industry sector it oversees. The Ministry of Government and Consumer Services continues to be responsible for the Film Classification Act, 2005 and the associated regulation, as well as the general oversight of the OFA. MANDATE The OFA s mandate is to administer the Film Classification Act, 2005 ( FCA ) and the associated regulation. The OFA is responsible for: licensing of film distributors, retailers and exhibitors hiring Ontario Film Review Board (OFRB) members and overseeing the OFRB which classifies most mainstream films and approves or refuses to approve adult sex films for public exhibition and distribution promoting and enhancing public information, education, confidence and awareness in the film industry in Ontario through, but not necessarily limited to the following activities: film classification, licensing, inspections, investigations, responding to complaints and public education activities engaging the public, stakeholders and government to enhance consumer protection and foster constructive dialogues The OFA supports the Ministry of Government and Consumer Services mission of protecting the public interest and advancing the principle of ensuring a fair, safe and informed marketplace as it relates to the Film Classification Act, Business Plan (April 1, 2016 March 31, 2019) Page 1

4 STAKEHOLDERS OFA stakeholders are: general public (e.g. consumers of film products) film distributors film exhibitors film retailers Ministry of Government and Consumer Services (MGCS) other sector stakeholders KEY STRATEGIC DIRECTIONS AND BUSINESS ACTIVITIES The OFA is still in its infancy as a delegated administrative authority and in its first year of operations, it prepared the ground work to transition from the interim Board of Directors to a permanent Board of Directors. In addition, the OFA trained and developed new staff to take over regulatory and administrative responsibilities from the Ministry of Government and Consumer Services. Once a newly constituted permanent Board of Directors is in place (which will consist of a majority of elected members and those appointed by government), the OFA will be guided by a more fulsome strategic plan, focused on matters that promote its objectives, and effectively manage its regulatory and operational responsibilities. However, in the meantime, the interim Board is in a position to identify a number of key strategic directions and business activities to support the fulfillment of the OFA s responsibilities from April 1, 2016 March 31, YEAR 1 APRIL 1, 2016 TO MARCH 31, 2017 DEVELOP HUMAN CAPITAL Build staff capacity through training and cross-training of core competencies in all areas of operations to ensure learning from experience as well as to maintain a nimble and responsive organization where staff can support the OFA s mandate across functional lines. Develop and implement a staff performance management process reflective of position requirements and competencies. Review and revise position descriptions as necessary. Encourage professional development whereby staff can achieve their career goals and enhance their contribution to the OFA s mandate. Engage in an annual team building event to further develop employee engagement (including with OFRB staff). 5 Develop legislated employment policies and other human resources/organizational best practices and policies (respectful workplace; privacy and access; expenses; occupational health and safety, etc.). Build and strengthen the Ontario Film Review Board (OFRB) human resources capacity and competencies to review, classify and approve films in accordance with the Film Classification Act, 2005, OFRB guidelines and prevailing community standards. Implement human resources and other employment related policies and provide training where applicable. Develop a comprehensive employee manual. Develop and implement a recruitment strategy to hire employees for the OFRB. On-board, train and mentor new OFRB employees. Develop a recruitment process for a new OFRB chair. Review OFRB guidelines annually to ensure community standards are accurately reflected and conduct on-going training and monitoring of classification decisions. Negotiate OFA/CUPE first collective agreement for OFRB members. Develop a performance management process for OFRB members reflective of position requirements and competencies. GOVERNANCE LEADERSHIP AND REGULATORY OVERSIGHT Implement the nomination process for representation from the designated stakeholder constituencies to be elected to the first permanent Board of Directors. Finalize draft OFA permanent Corporate By-law #3 which will set out how the first permanent Board will manage and supervise the affairs of the OFA. Transition from interim Board of Directors and prepare first permanent Board of Directors to manage the affairs of the OFA in accordance with the Administrative Agreement. Solicit expressions of interest, conduct interviews and select candidates from the designated stakeholder constituencies to put forth to the OFA members for election to the first permanent Board of Directors. Board approves draft Corporate By-law #3 and seeks approval from the Minister on sections of the By-law. 6 Review and revise the OFRB chair and OFA Board of Directors Memorandum of Understanding (MOU) which sets out the accountability framework between the parties. Execute revised MOU between the OFA Board of Directors and a new OFRB chair. CONTINUOUS IMPROVEMENT OF ORGANIZATIONAL EFFECTIVENESS AND EFFICIENCIES Review and amend film classification and licensing forms to make them easier for film industry sector clients to understand and complete. Streamline interactions with OFA clients in order to provide seamless customer service. Develop vision and implementation plan for the OFA s new IT system and e-commerce infrastructure to support the OFA s mandate. Participate in the community of Delegated Administrative Authorities to share best practices. Post new and improved film classification and licensing forms on the OFA website including how to checklists and precedents where appropriate. Fine-tune fillable film classification and licensing application forms whereby clients can prepopulate and save standard information for each form. Provide monthly e-statements to clients with draw-down accounts. Conduct a needs assessment of current and future information management system and e-commerce service requirements. Devise a procurement strategy to tender the design and implementation of a new information management and e-commerce system to an external information technology (IT) vendor. Procure IT vendor and commence business analyses, process mapping and design of information management system. Involve staff in various Delegated Administrative Authorities collaboration committees to identify and implement opportunities to enhance operational efficiencies and work together on common consumer protection objectives. 7 ENHANCE STAKEHOLDER COLLABORATION AND OUTREACH Promote awareness of the OFA and foster open communication with film industry sector and the public. Invite film industry clients who regularly use the film classification services to an OFA meet and greet and present a how to guide on the film classification application process. Continue to fine-tune and update OFA website content including posting more information on classification content advisories, and about the OFA s complaint process. Ensure that OFA staff and the OFRB chair and vicechair are accessible to provide information and assistance in-person, by telephone or . Continue to offer services in French upon request, and provide basic information in French on the OFA website. YEAR 2 - APRIL 1, 2017 to MARCH 31, 2018 CONTINUE TO DEVELOP HUMAN CAPITAL Recruit and hire a chair to lead the OFRB. Integrate OFA s strategic plan with the staff (including OFRB) performance management process. Advertise the OFRB chair position. Hire a qualified individual to assume responsibilities in accordance with a revised Memorandum of Understanding. Communicate strategic plan to all staff. Implement a staff performance process(s) that takes into consideration position requirements and competencies, and sets goals in alignment with the OFA s strategic plan. GOVERNANCE LEADERSHIP AND REGULATORY OVERSIGHT Establish ongoing stability of governance oversight through effective transition to permanent Board. The Board articulates a long-term strategic plan that sets out its mandate, vision and values, and sets regulatory and operational priorities. Develop an annual robust governance work plan. 8 The OFA develops a risk management framework for managing risks it may encounter in meeting its mandate. Review and update April 1, 2016 to March 31, 2019 business plan to align with the newly created strategic plan. Identify risks and develop a risk management plan for implementation when required. Establish an advisory process for direct input to the Board on issues of importance to consumers. Make public, the advisory process s terms of reference, and report on the activities and advice provided by the process in the annual report. Develop informational materials about Ontario s classification system and make them available to the public through various print and electronic media. Conduct public Annual Meeting Participate in a dialogue with other provincial classification bodies on harmonization. Support and contribute to the MGCS consumer protection initiatives. Participate in meetings and consultations with MGCS staff. Develop policy, legislative or regulatory submissions to MGCS to address issues identified through interaction with stakeholders. 9 Expand awareness and understanding of the OFA s regulatory role. Develop a risk-based oversight model/compliance program that provides an appropriate level of consumer protection oversight proportional to the risk. Design a communication/education strategy to inform industry stakeholders about the compliance program. Year 3 - APRIL 1, 2018 to MARCH 31, 2019 CONTINUOUS IMPROVEMENT OF ORGANIZATIONAL EFFECTIVENESS AND EFFICIENCIES IT vendor completes migration of film classification and licensee data and testing of the new information management and e-commerce system. Transfer and testing of all film classification and licensee data from the Ministry s Consumer Affairs Tracking System. Train staff and obtain documentation on the use of the OFA s new information management and e- commerce system. GOVERNANCE LEADERSHIP AND REGULATORY OVERSIGHT Ensure Board and committee structure(s) reflects evolution of the Review and revise, as appropriate, Board s skills and experience matrix. 10 KEY CORPORATE POLICIES The OFA maintains a number of policies and procedures to guide and direct its work. The following are three key policies. Information on other policies is available on the OFA website ( Privacy The OFA maintains a privacy policy and has a Privacy Officer as it is committed to maintaining the accuracy, security and privacy of personal information. Complaints Handling The OFA receives numerous telephone and enquiries on a daily basis from film industry clients, stakeholders and the public. OFA staff provide information on film classification decisions, licensing processes and acceptable regulatory practices. Complaints may be submitted to the OFA by telephone, fax, mail, or by completing and submitting the Service and Accessibility Customer Comments form or the Inquiry, Comment or Complaint form. Where possible, complaints are dealt with at the source and in a timely manner. Complaints that are not resolved to the satisfaction of the complainant can be referred to the Executive Director and Registrar. Information on the complaints handling process is available on the OFA website. French Language Service The OFA can respond to any enquiries received in French, whether oral or written. 11 THREE-YEAR FINANCIAL OUTLOOK The OFA establishes a detailed operating budget in advance of each fiscal year. The following is a financial outlook based on a forecast of anticipated revenues and planned expenditures for the three-year period, 2016 to This outlook will be reviewed annually and updated as required.
