1 MANUAL UNDER RIGHT TO INFORMATION ACT, 2005[ Central Act No.22/2005] CHAPTER 1 Section 4(1) (b) (i) PATICULARS OF ORGANISATION FUNCTIONS AND DUTIES ORGANISATION CHART OF LABOUR DEPARTMENT OFFICE OF THE LABOUR OFFICER SUB DIVISION 1, BIJAPUR. Labour Officer Sub Dn 1, Labour Inspector 1st Circle, Child Labour Inspector, Labour Inspector Sindagi Circle, Sindagi. 1) First Division Asst. 1 1) Second Division Asst. 1 1) Literate Attender 1 2) Second Division Asst. 1 2) Peon 1 3) Typist 1 4) Peon 2 THE MAIN FUNCTIONS OF THE OFFICE ARE TO: A) Maintain Industrial peace and harmony through conciliation machinery; B) Enforce various Central and State Labour Laws and Rules there under; C) Function as Quasi judicial Authorities under Workmen's Compensation, Payment of Gratuity and Minimum Wages Acts; D) Fixation and Periodical revision and enforcement of minimum wages to scheduled establishments under the Minimum Wages Act, 1948 covering the workers in organized and unorganized sectors; E) Ensure payment of equal remuneration to men and women workers for same or similar nature of work; F) Implement State Action Plan on elimination of employment of child labour and their rehabilitation by enrolling them to Special Residential Schools, etc; G) Implement National Child Labour Projects of the Government of India for elimination and rehabilitation of child labour.

2 2 CHAPTER 2 Section 4(1) (b) (ii) POWERS AND DUTIES OF OFFICERS AND EMPLOYEES There are two offices functioning in the District i.e. Labour Office Sub Division 1 and 2. Office of the Labour Officer Sub Division 1 jurisdiction is Ward No.2, 3, 4, 6 and 8 in the Bijapur Municipality and also Indi and Sindagi Taluks. 1) Labour Officer is exercising the powers and performing the duties in the matter relating to administration and accounts as per the powers and duties delegated under the Service Manual, Financial Codes, and Government orders Notifications and delegation of powers. 2) Labour Officer is exercising the powers and performing such functions as defined under Workmen's Compensation Act, 1923 for enforcement of this law and as well as disposing off as a workmen's compensation commissioner. 3) Labour Officer is claims authority under the Minimum Wages Act, 1948, Equal Remuneration Act, 1976 and Maternity Benefit Act, 1976 and deposed off cases as per law. 4) Labour Officer is exercising such powers and performing duties as laid down under the Industrial Disputes Act, 1947 for conciliation and maintaining industrial peace in the jurisdiction. 5) Labour Officer is exercising such powers and performing duties as laid down under the Building and Other Construction Workers' (Regulation of employment and conditions of service) Act, 1996 and rules 2006 for registration of building workers as beneficiaries and distribution their identity cards. 6) Labour Officer is also Inspector under the following various labour laws: i) Karnataka Industrial Establishments (National and Festival Holidays) Act, ii) The Payment of Bonus Act, iii) The Payment of Gratuity Act, iv) The Child Labour (P & R) Act, v) The Karnataka Labour Welfare Fund Act, vi) The Building and Other Construction Workers' (Regulation of employment and conditions of service) Act, 1996.

3 3 Powers and Duties of Labour Inspectors: There are three Labour Inspectors functioning in this office jurisdiction. 1) Labour Inspector 1st Circle, 2) Child Labour Inspector, 3) Labour Inspector, Sindagi Circle, Sindagi. They are ground level enforcing machinery of the dept. and they are exercising such powers and performing such duties as laid down under various labour laws for enforcement of those laws. i) They are exercising powers and performing duties in a manner as laid down under the Karnataka Shops and Commercial Establishments Act, 1961 for registration and renewal of shops and commercial establishments. ii) The Payment Wages Act, iii) The Minimum Wages Act, iv) The Equal Remuneration Act, v) The Maternity Benefit Act, vi) The Child Labour (Prohibition and Regulation) Act, vii) The Karnataka Labour Welfare Fund Act, viii) The Motor Transport Workers Act, ix) The Beedi and Cigar Workers (Conditions of employment) Act, x) The Contract Labour (Regulation and Abolition) Act, xi) The Trade Unions Act, The Child Labour Inspector enforcing the Child Labour (Prohibition and Regulation) Act, 1986 in the jurisdiction. OFFICE EMPLOYEES 1) First Division Assistant His Functions are relating to matter of establishments and accounts as per Service Manual, Financial Code and maintain the records under the Workmen's Compensation Act, ) Second Division Assistant He has to receive all the tappals, entering the register and distribute to the concerned case workers.

4 4 3) Typist Typist attends to typing work and also comparing work. Typist appends their initials with date at the left hand bottom corner of all fare copies typed by him. He is required to attend other work as assigned by the officer. 4) Peons Carries files from section to section, maintain cleanliness in the office, stitching of closed files etc. CHAPTER 3 Section 4(1) (b) (iii) PROCEDURE FOLLOWED IN THE DECISION MAKING PROCESS INCLUDING CHANNELS OF SUPERVISION AND ACCOUNTABILITY. 1) Caseworker A caseworker receives the tappals and maintains the files as per the Handbook of office procedure. He attends the letters either by putting up an existing file or by opening a new file. He has to examine the cases and submit the files to the Labour Officer. 2) Labour Officer He has to examine the file and check the profixity of language and examine the file and ensure the correctness in the light of the relevant rules and disposable at his level as soon as possible. CHAPTER 4 Section 4(1) (b) (iv) THE NORMS SET FOR THE DISCHARGE OF FUNCTIONS. 1) The Department of Labour is a regulatory department regulating various labour laws and exercising quasi judicial functions for disposing off cases under various labour legislations. Therefore, all level officers in the department will have to work according to the statutory norms prescribed under various labour legislations. 2) Various levels of officers of the department will have to dispose off the cases in accordance with the target prescribed by the Labour Commissioner.

5 5 CHAPTER 5 Section 4(1) (b) (v) RULES, REGULATIONS, INSTRUCTIONS, MANUALS AND RECORDS HELD OR UNDER CONTROL OR USED BY EMPLOYEES FOR DISCHARGING FUNCTIONS. The department of Labour functions according to the Service Manual, Financial Code and relevant Government Orders, Notifications etc. Apart from these rules and regulations that are being administrated by the Labour Officer and also functioning the following various Labour laws. 1) Workmen's Compensation Commissioner under Workmen's Compensation Act, ) Conciliation Officer under the Industrial Disputes Act, ) Authority under the Minimum Wages Act, 1948, the Equal Remuneration Act, 1976 and the Maternity Benefit Act, The Labour Officer is also an Inspector under the following various labour laws. i) Karnataka Industrial Establishments (National and Festival Holidays) Act, 1963 ii) The Payment of Bonus Act, iii) The Payment of Gratuity Act, iv) The Child Labour (P & R) Act, v) The Karnataka Labour Welfare Fund Act, vi) The Building and Other Construction Workers (Regulation of employment and conditions of service) Act, Labour Inspector: Labour Inspectors are Registering and Renewal authority under the Shops and Commercial Establishment Act, 1961 in respect of their circles and they have been notified inspectors under the following various labour laws. i) Minimum Wages Act, ii) Payment of Wages Act, iii) The Equal Remuneration Act, iv) The Karnataka Labour Welfare Fund Act, v) The Motor Transport Workers Act, vi) The Beedi and Cigar Workers (Conditions of employment) Act, vii) The Contract Labour (Regulation and Abolition) Act, viii) Karnataka Shops and Commercial Establishments Act, 1961.

6 6 CHAPTER 6 Section 4(1) (b) (vi) A STATEMENT OF CATEGORIES OF DOCUMENTS THAT ARE HELD OR UNDER CONTROL. Labour Officer: All documents pertaining to administration, service and financial matters of the office including office staff. All documents pertaining to Labour laws including case registers, non implementation of awards registers. Labour Inspectors: All registers and files pertaining to their offices including the register of prosecution, statistics and inspection besides maintain 'B' register. CHAPTER 7 Section 4(1) (b) (vii) THE PARTICULARS OF ANY ARRANGEMENT THAT EXISTS FOR No specific arrangement in this office. CHAPTER 8 Section 4(1) (b) (viii) STATEMENT OF BOARDS, COUNCILS, COMMITTEES AND OTHER BODIES CONSISTING OF TWO OR MORE PERSONS CONSTITUTED AS PART OR FOR THE PURPOSE OF ADVICE, AND AS TO WHETHER MEETINGS OF THOSE BOARDS, COUNCILS, COMMITTEES AND OTHER BODIES ARE OPEN TO THE PUBLIC, OR THE MINUTES OF SUCH MEETINGS ARE ACCESSIBLE FOR PUBLIC.
