2 New requirements form 1/1/12 Affects all buildings completed before 1/1/04 New requirements are:- An asbestos survey on all buildings Survey must be done by someone you are satisfied is suitably experienced and qualified Survey will determine if asbestos is or is likely to be contained in elements of the buildings

3 Responsible person(s) - The person with control may be: The owner of the premises; A person, who has, under any contract or lease, an obligation to maintain or repair the premises; A person who is occupying the premises; A person who is able to make decisions and changes to the structure and use of the workplace.

4 Person(s) in control shared responsibilities An employer at the premises. a person with management control over the workplace, for example, a property management group or agent. In most cases there will be more than one person with management or control All share the responsibility & will be drawn into any fines or prosecutions for non compliance

5 Asbestos properties stability when heated strength under tension chemical resistance water resistance or absorbency (depending on type of asbestos) suitability for weaving and reinforcing electrical resistance.

6 General manufactured forms fibrous (limpet asbestos) woven (cloth, tape or sleeving) wound (rope) mixed with a binder, such as calcium silicate (to make asbestos cement or vinyl floor products containing asbestos).

8 Asbestos containing materials Vermiculite ceilings Switch boards backing boards Ceiling tiles Pressure pipes Downpipes and gutters Lagging around pipes Insulation Sprayed asbestos fire retardants

9 Why up until 31/12/2003 Asbestos was not fully banned until 2003 Manufacture of AC 60 % of all asbestos and 90 %asbestos fibre. Crocidolite phased out from But amosite was used until There were also many items that were. recycled into newer buildings Also stock was held for a long time and slowly sold out

10 Do I need a new survey? All pre 2004 buildings with areas that are used as workplaces must comply The need refreshed updated condition report for your building

11 What if asbestos in not found If a competent person finds none then survey and result/report will establish this Survey showing negative result must be kept as a record onsite Must be available to tradespeople, tenants and visitors as and when appropriate and required Suggest a document box with 003 key lock

12 What if Asbestos is or has been found onsite? If Asbestos is found or has been found previously then there needs to be a new compliant asbestos register created it includes details of:- Type of asbestos & Condition of asbestos Location of asbestos floor plan with icons is best practice Signage to identify asbestos

13 ..and an Asbestos Management Plan Required for every building with Asbestos it includes:- The identification of asbestos and ACM, eg, a reference or link to the asbestos register for the workplace, and the locations of signs and labels. Decisions, and reasons for the decisions, about the management of asbestos at the workplace

14 AMP content continued... Incident management system - Procedures for detailing accidents, incidents or emergencies of asbestos at the workplace Information for workers carrying out work involving asbestos, for example, consultation, information and training responsibilities

15 WHAT NEEDS TO BE DONE? Apply a risk assessment to the asbestos hazards identified in the Asbestos survey to determine the correct control measure. Warning Signs and Labels Any areas of the workplace which contain asbestos should be signposted with warning signs to ensure that asbestos is not unknowingly disturbed. Signs should be placed at all of the main entrances to the work areas where asbestos is present.

16 WHAT NEEDS TO BE DONE? cont Employers - Consultation and Communication Consulting with workers can include but not be limited to; Identifying asbestos in the workplace Making decisions about the AMP Ensuring that safety instructions and safe work practices are complied with Consulting, cooperating and coordinating activities with other duty holders

17 WHAT NEEDS TO BE DONE? cont Employers - Consultation & Communication Responsibility to consult with other duty holders as there may be other businesses that are involved in the same activities or share the same workplace, workers and other persons may be exposed to risk

18 WHAT NEEDS TO BE DONE? cont INCIDENTS AND EMERGENCIES Ensure appropriate accident/incident management and reporting system is in place; Ensure system in place accommodates asbestos related incidents Ensure effective training is conducted regularly Ensure appropriate First Aid and PPE is available

19 WHAT NEEDS TO BE DONE? cont INCIDENTS AND EMERGENCIES Emergency Management Ensure workplace Emergency Management procedures are amended to cover the safety of any workers due to the uncovering of asbestos due to human error or to catastrophic events. These made include; flood, fire, failure of an asbestos control (ie. encapsulation).

21 WHAT NEEDS TO BE DONE? cont CONTROLLING RISK Develop and implement appropriate Administration support Workplace Safety Policies Procedures for safe work Contractor compliance strategy Worker and visitor asbestos awareness training

22 Plan needs to PLAN COMPLIANCE be prepared and implemented be reviewed regularly be up to date be assessible on site to all workers and contractors be effectively communicated

23 AMP REVIEW ESTABLISH AN AMP COMMITTEE WITH REPRESENTATION FROM ALL DUTY HOLDERS TO CONDUCT AN ANNUAL AMP PROCESS AUDIT Audit should include Review the implementation of the AMP, including a debrief of any property, equipment or work practice changes that would affect the employees or place at work areas where asbestos has been identified. Review the condition of the asbestos on site and confirm all labels and signs are in place. Review the list of persons with duty of care and ensure their contact details are current. Review the training and communication procedures and effectiveness. Review any incidents or corrective action requests and determine if modification to the AMP is required. Nominate a person responsible to; Update the plan Update Asbestos Register Update Distribution and Document Control Records

24 You must use a competent person Does not have to be licensed or approved by the relevant regulator, however, they must be: trained to handle and take asbestos samples knowledge and experience to identify suspected asbestos, able to determine risk & controls measures

25 A competent person cont... familiar with building & construction practices to determine where asbestos is likely to be present Be able to determine that material may be friable or non-friable asbestos and evaluate its condition. Using a competent person is your responsibility The inspection company takes no risk it remains with the responsible person

26 Approach If previously surveyed:- Keep records of all previous surveys with no ACM onsite For all buildings with ACM re-do onsite asbestos register and AMP

27 Compliance approach Survey all other pre 2004 buildings - result with either be survey to keep onsite If ACM found:- Create new compliant Onsite Asbestos Register & AMP Review yearly to check that ACM is still in stable state and is undamaged
