2 3. BIDDERS QUALIFICATION CRITERIA 1. QUALIFICATION CRITERIA 1.1 Prequalification will be based on meeting all the following minimum pass/fail criteria regarding the Bidder's general and particular experience, personnel and equipment capabilities, and financial position, as demonstrated by the Bidder's responses in the forms attached to the Instructions to Bidders (specific requirements for joint ventures are given under below). The Employers reserves the right to waive minor deviations, if they do not materially affect the capability of a Bidder to perform the Contract. Subcontractors' experience and resources shall be taken into account in determining the Bidder's compliance with the qualifying criteria General Experience. The Bidder shall meet the following minimum criteria successful experience as prime contractor in the execution of projects as defined in the Instructions to bidders Financial Position. The Bidder should demonstrate that he has access to, or has available, liquid assets, unencumbered real assets, lines of credit, and other financial means sufficient to meet the construction cash flow for a period of four months, estimated The audited balance sheets for the last five years should be submitted and must demonstrate the soundness of the Bidder's financial position, showing long-term profitability. Where necessary, the Employer will make inquiries with the Bidder's bankers Litigation history. The bidder should provide accurate information on any litigation or arbitration resulting from contracts completed or under execution by him over the last five years. A consistent history of awards against the bidder or any partner of a Joint Venture may result in failure of the application. 2. ELIGIBILITY AND QUALIFICATION REQUIREMENTS To be eligible for Award of Contract, the Bidder shall provide evidence of its capability and adequacy of resources effectively to carry out the Contract. To this end, in the absence of and supplemental to any previously conducted prequalification of potential Bidders, all Tenders shall include the following information:- (a) (b) Copies of original documents defining the constitution or legal status, place of registration and principal place of business of the company or firm or partnership or, if a joint venture, of each party thereto constituting the Tender; Where the Bidder is a joint venture of two or more firms, a statement signed by all parties to the joint venture of the proposed administrative arrangements for the management and execution of the Contract, the Section VII Forms and Procedures Page 2 of 25

3 duties, responsibilities and share of each party, the authorised representative of the joint venture, and an undertaking that the several parties are jointly and severally liable to the Employers for the performance of the Contract. (c) (d) (e) (f) (g) (h) (i) (j) (k) Details of the experience and past performance of the Bidder (or of each party to a joint venture) on works of a similar nature within the past five years, and details of current work in hand and other contractual commitments; The qualifications and experience of key personnel proposed for administration and execution of the Contract, both on and off site; Major items of constructional plant and equipment proposed for use in carrying out the Contract; Reports on the financial standing of the Bidder (or of each party to a joint venture) including profit and loss statements, balance sheets and auditors reports for the past five years, an estimated financial projection for the next two years, and an authority from the Bidder (or authorised representative of a joint venture) to seek references from the Bidders bankers; Names and addresses of local partners or local sponsors; An official authorised document stating that the signatory of the Bidder possesses the power to represent the Tender for this Tender; A description of each equipment, instrument and device, all necessary technical data as well as pamphlets, pictures and drawings from which the construction and mode of operation can be seen to enable the Employers to determine whether the Tendered equipment conforms to the requirements of the Tender; The technical data sheets shall be filled out without omission and each sheet shall be initialled and stamped. All values inserted by the Bidder and related to capacity, efficiency, current, voltage, insulation, creep path, accuracy, etc. are guaranteed values and any deviation of the characteristic values of the delivered equipment from these guaranteed values may result in the rejection of the equipment concerned. Quality manuals, typical standard quality control plans for main items of equipment electrical work, civil works especially design and other such documents sufficient to indicate the Bidders ability to and intention of controlling the quality of the whole of the goods and services in the event of being awarded the contract. 4 FORM 1 - GENERAL INFORMATION All individual Bidders and each partner of a joint venture or consortium applying for prequalification are requested to complete the information in this form. Nationality information to be provided for all owners or Bidders who are partnerships or individually owned firms. Where the Bidder proposes to use named subcontractors for critical components of the works, or for work contents in excess of 10 percent of the value of the whole works, the following information should also be supplied for the specialist subcontractor(s). 1. 6 FORM 2 - FINANCIAL SITUATION Name of Bidder or partner of a joint venture All individual firms and all partners of a joint venture are requested to complete the information in this form. The information supplied should be the annual turnover of the Bidder (or each member of a joint venture), in terms of the amounts billed to clients for each year for work in progress or completed, converted to U.S. dollars at the rate of exchange at the end of the period reported. Use a separate sheet for each partner of a joint venture. Bidders are not required to enclose testimonials, certificates, and publicity material with their applications; they will not be taken into account in the evaluation of qualifications. 9 FORM 3 - PARTICULAR EXPERIENCE RECORD Name of Bidder or partner of a joint venture To pre-qualify, the Bidder shall be required to pass the specified requirements applicable to this form, as set out in the Instructions to Bidders" and as amplified in this Schedule. On a separate page, using the format of Form (3a), each Bidder or partner of a joint venture is requested to list all contracts of a similar value, nature and complexity to the contract for which the Bidder wishes to qualify, completed during the last five years. The value should be based on the currencies of the contracts converted into U.S. dollars, at the date of substantial completion. The information is to be summarised, using Form (3a) for each contract completed or under execution by the Bidder, by each partner of a joint venture or by the main sub-contractors. Each Bidder or partner of a joint venture must fill in this form. If necessary, use separate sheets to provide complete banker information. A copy of the audited balance sheets and profit and loss accounts should be attached.
