3 BID DETAILS Rural Development Department, Government of Bihar, invites sealed Bids to appoint vendors for carrying out digitization of member records whose data is still in NPR image files, need to be digitised in both in Hindi and English languages. The members details are handwritten in Hindi, stored in image format, are to be entered in both Hindi and English languages at the selected data centres of the selected bidders. 5 BACKGROUND There has been extensive public interest in estimating caste-wise population in the country, and on identifying households living below the poverty line. The last exercise of the Ministry of Rural Development Government of India to identify people living in poverty was conducted in 2011 for both rural and urban India, but had several limitations. The SECC, 2011 has the following three objectives: *Firstly, the SECC, 2011 will rank households based on their socioeconomic status, so that State/Union Territory Governments can objectively prepare a list of families living below the poverty line in rural and urban areas. *Secondly, it will make available authentic information on the caste-wise breakup of population in the country. *Thirdly, it will provide the socio-economic profile of various castes The entire exercise will be paperless, done on a handheld electronic device (tablet PC). Broad Definitions the document which defines procedures for testing the "Acceptance Test Document" above mentioned Tender Ref. No. deliverables against requirements laid down. Shall mean any holding company or subsidiary company of a part to the "Affiliate" Agreement or any company, which is subsidiary of such a holding company. The expressions "holding company" and "subsidiary company" shall have the meaning specified in section 4 of the Companies Act, 1956 (as amended from time to time). means the Agreement to be signed between the successful bidder and "Agreement" Rural Development including all attachments, appendices, all document incorporated by reference thereto together with any subsequent modifications, the RFP, the bid offer, the acceptance and all related correspondences, clarifications, presentations. shall mean any person authorized by either of the parties. "Authorized Representative" mean any firm offering the solution(s), Service(s) and / or materials required in "Bidder" the RFP. The word Bidder when used in the pre award period shall be synonymous with Bidder, and when used after award of the Contract shall mean successful Bidder with whom Rural Development signs the agreement for rendering of services for the above mentioned Ref No: 4

6 "Contract" is used synonymously with Agreement. means the offering, giving, receiving or soliciting of anything of value "Corrupt Practice" or influence the action of an official in the process of Contract execution. "Default Notice" shall mean the written notice of Default of the Agreement issued by one party to the other in terms hereof. "Fraudulent Practice" means of misrepresentation of facts in order to influence a procurement process or the execution of a Contract and includes collusive practice among Bidder (prior to or after Bid submission) designed to establish Bid prices at artificial non-competitive levels and to deprive the Rural Development of the benefits of free and open competition. "GoB" means Government of Bihar. shall mean the exercise of that degree of skill, diligence and "Good Industry Practice" prudence which would reasonably and ordinarily be expected from a reasonably skilled i-ka came nr and experienced Bidder engaged in tne same type la I I I 0 - similar circumstances. "Revenue" means the rate payable to the Bidder under the Agreement for the performance of the Bidder's Contractual obligation. "Law" means any Act, notification, by law, rules regulations, directive, ordinance, order or instruction have the force of law enacted or issued by the Central Government or regulatory authority or political subdivision government agency. "1.01" means issuing of Letter of intent which shall constitute the intention of the Tenderer to place the Purchase Order with the successful bidder. "Period of Agreement" providing human resource. 8 SCOPE OF WORK 1. DIGITIZATION OF MISSING/NON-DIGITIZED IMAGE FORMED DATA After digitization of SECC-2011 surveyed data still 20-30% of data are in imaged form need to be digitized in both in Hindi and English languages at the selected data centres through selected bidders. 2. DIGITIZATION OF MISSING DATA For each un-digitized family member details the following information needs to be entered viewing the image file of the corresponding family member are given below - Name Relationship to Head of Family Sex Date of Birth Marital Status Educational Status Occupation / Activity Father's Name Mother's Name Hindi and English Hindi and English Coded Value (1- Male / 2- Female) dd/mm/yyyy (as per English calendar) Coded Value Hindi and English Hindi and English Hindi and English Hindi and English In order to carry out the work the bidder has to use the existing data entry center for this purpose. Department is looking for bidder whose office is in BIHAR, who are already having the data entry center or having a tie up with existing data centers and having the experience of carrying out digitization of such type of entry work. The un-digitized member's details available in image files and SECC database will be provided by Department at the data center and the same shall be digitized to Hindi and English with the help of data entry operators. The backup of Digitized Data after Quality check would be provided to the department. All the hardware required at the Data entry centre like, PCs, UPS, Backup power, furniture, internet connectivity within the centre etc would be arranged by bidder. The software required for the data entry would be provided by bidder (as per requirement on payment basis) or may be develop by department to carry out the digitization work- /G-

9 i. Data Entry Module ii. Supervisory Module iii. Quality Assurance Module The un-digitized data would be entered in the Hindi and English languages by the qualified data entry operators. After data entries the correctness is verified (supervisory module) by another set of operators know as supervisor. The digitized data (after supervisory module) to be verified for its accuracy by separate QA team (Quality Assurance Module) and only after acceptance of the QA team the backup of data would provided to the district. If any set of data were found incorrect by the QA team it would be send back for supervisory module again. Daily back up of data and storage would be responsibility of the bidder. The storage media will be provided by bidder. Bidder would have make own arrangements for data backup and storage. verification Data centre should have space and tacilivys tor tne a i st rict of the digitized data. Adequate number of operators, QC team and supervisors would be deployed to complete the digitization work within the time schedule. The operators should be qualified with minimum 10+2, should be conversant in Hindi and English typing and good at translation from Hindi to English. Bidder would appoint a separate Nodal Officer for every data entry centre for project management and co-ordination with district official/hq official. Final verified data would be upload on NIC or department hosted data server. Department will handover complete data in.csv format only. Accuracy must be 100% for data digitization. Any loss of original data or any changes in original data company/firm will fully liable for legal action. After completion of digitization, the data will be uploaded by the help of ECIL on NIC server of MoRD. 76-8

10 Local Condition Each Bidder is expected to fully get aware with the local condition and factors, which would have any effect on the performance of the contract and / or the cost. The Bidder is expected to know all conditions and factors, which may have any effect on the execution of the contract after issue of letter of Award as described in the bidding documents. The tenderer shall not entertain any request for clarification from the Bidder regarding such local conditions. It is the Bidder's responsibility that such factors have properly been investigated and considered while submitting the bid proposals and no claim whatsoever including those for financial adjustment to the contract awarded under the bidding documents will be entertained by the tenderer Neither any change in the time schedule of the contract nor any financial adjustments arising thereof shall be permitted by the tenderer on account of failure of the Bidder to know the local laws / conditions QUALIFICATION AND EXPERIENCE S.No Eligibility Criteria The Company/firm must be in registered in at least 5 years. Company/ Firm must be an ISO certified. Must have experience of One project of SECC-2011 survey of fifty lakhs (50) of record from any PSU ECIL, BEL or ITI. Their competition certificate must be 3. attached.(15 marks) One project of Government of Bihar of minimum twenty five lakhs (25) record of data digitization. Their competition certificate must be attached.(10 marks) Self attested Copy of Purchase/Work order or successfully completion 4. certificate or any other documentary evidence required. Average annual turnover not less than Three (3) Crores in each of last three financial years.(audited Balance Sheet being certified by the CA must be 5. enclosed),in last financial year net worth should not be less than one(1) Crore. Company/Firm must have Registration in Bihar ESIC and EPFO. They must have 6. submitted ESIC and EPF of min 250 employees. Company/firm must submit a presentation to demonstrate the complete 7. execution plan. Marks i 9

11 The Bidders scoring 70 marks or above and whose Techno-commercial Bid is substantially responsive to the requirements of the Tender Documents shall only be considered qualified. The Price Bid of such qualified Bidders shall only be opened. BID DOUMENTS Bidder is expected to examine all instructions, forms, terms, and requirements in the bid document. Failure to furnish all information required by the bid document or submit a bid not substantially responsive to the bid document in every respect may result in the rejection of the Bid. The bid should be submitted in two parts as mentioned hereunder:- Technical bid letter on the bidder's letter-head describing the pre-qualifying technical competence 1. A and experience of the bidder. 2. Incorporation certificate issued by the registrar of the company. The Company/ Firm must submit the self attested photo copy of their PAN No., TAN No. 3. and Reg. No. (with supporting paper) & IT returns of past three financial years. They must be registered under Bihar commercial tax department, should have been registration of Service Tax. 4. They must be registered under Bihar Shops and Establishment Act. Bidder is required to provide the details of projects executed/under execution that best 5. explains the bidder's ability to implement the desired scope of work. 6. Bidder need to provide documentary evidences/proof with respect to qualification and experience criteria to support its claim as under:- The Company/ Firm must have their PAN / TAN No. The bidder should have average annual sales turnover of INR Two (3) Crore and above in the last three financial years (Audited Balance Sheet being certified by the CA must be enclosed). The Net-Worth of the bidder should not be less that 1 core in last financial year. Company/ Firm must be an ISO certified The bidder should submit on affidavit (in original) that 'The Company has not been declared blacklisted/suspended by any Statutory Organization in Public Sector Companies / State Government". Any project details without documentary evidence will not be considered for evaluation. 10

12 Commercial bid Commercial Bid must be submitted as per template provided at Annexure I The bid shall remain valid for a period not less than 90 days after the deadline date specified for submission. Cost of Tender Documents A complete set of tender documents can be downloaded by interested person or company. The company / firm will have to pay non refundable from the website: rdd.bih.nic.in Tender fee of Rs. 5000/- only by way of DD payable to The Fund Manager, BRDS, RDD, Bihar. The DD should be payable at Patna Only. Earnest Money Deposit The Bidder must submit an EMD of Rs. 10 lakh (Rupees Ten lakhs only). The EMD shall be in the form of demand draft ara d rawn f rom al 1 y Nationalized / Sc 11CUui c in favour of. bank The Fund Manager,BRDS, RDD,Bihar payable at Patna Only. EMD shall be submitted along with Technical Bid. The EMD of unsuccessful bidder in the Technical bid will be returned within 30 days from the date of bid opening. The EMD of unsuccessful bidders on price bid will be returned after finalization of the price bid. The successful Bidder's bid security will be discharged upon the Bidder executing the Contract and furnishing the performance security. The bid security may be forfeited: A. B. If a Bidder withdraws its tender during the period of Bid validity. or In case of a successful Bidder, if the Bidder fails: To sign the contract in accordance with the terms and conditions To furnish performance security as specified in the terms and conditions. 11

13 Non-Transferable Tender The tender document is not transferable and interested company/firm shall be entitled to quote this Tender in prescribed form. Given in Annexure-1 Completeness of Tender Offer The Bidder is expected to examine all instructions, forms, terms, conditions and specification in the Tender Documents. Failure to furnish all information required by the tender documents or submission of a tender offer not substantially responsive in every respect to the tender documents will be Bidder's risk and may result in rejection of its tender offer. The tender offer is liable to be rejected outright without any intimation to the Bidder, if complete information as called for in the tender document is not given therein, or if particulars asked for in the Forms/ Performa in the tender are not fully furnished. SUBMITION OF PROPOSAL All the proposals will have to be submitted in hard bound form with all pages numbered 1. & signed. It should also have an index giving page wise information of above documents; incomplete proposal will summarily be rejected. 2. No bid will be considered unless and until each page of the bid document is duly signed by the authorized signatory. 3. Prices should not be indicated in the Technical Bid. 4. The proposals shall be submitted in two parts, viz., Technical Proposal super scribed as 'Envelope 1 -Technical Proposal", 5. Envelope 1: - complete with all technical details". In the technical proposal, there should not be any indication about the prices of any of the products offered. Commercial Proposal containing Price Schedule super scribed as "Envelope 6. Envelope-2: Commercial Proposal". The two sealed envelopes should again be placed in a single sealed envelope, to be submitted in the Secretary Rural Development, up to the due date and time mentioned in the Schedule of Events of this document. 12 I

14 Late Bid Any bid received by the Rural Development after the time and date for receipt of bids prescribed in this document will be rejected and returned unopened to the Bidder. Language of Bid The Bid prepared by the Bidder and all the correspondence and documents relating to the Bid exchanged by the Bidder and the Rural Development shall be written in English language only. EVALUATION The evaluation of the Technical bids will be carried out in the following manner: The bidders' technical solution proposed in the bid document is evaluated as per the and adopting the evaluation criteria spelt out in this RFP. The requirements specified in the RFP Bidders are required to submit all required documentation in support of the evaluation criteria specified (e.g. detailed project citations and completion certificates, client contact information for verification, profiles of project resources and all others) as required for technical evaluation. The committee may seek clarifications from the bidders. The primary function of clarifications in the evaluation process is to clarify ambiguities and uncertainties arising out of the evaluation of the bid documents. (A) Evaluation of Technical Bids: detailed evaluation of the technical bids shall be carried out in order to determine A whether the technical aspects are substantially responsive to the requirements set forth in the RFP/Tender Enquiry. This may include physical verification for assessing the capacity of the bidder. I. The Purchaser will evaluate and compare the quotations determined to be substantially responsive i.e. whether bids; a. are properly signed ; b. meet the eligibility requirements specified; c. confirm to the terms and conditions, and specifications; and 13

15 d. Consequent upon the evaluation, each Technical bid will be assigned a Technical Score (T) out of a maximum of 100 points. Bidders who scores 70% or more will qualify for the evaluation of their commercial bid. II. The Rural Development Department reserves the right to ask for a technical elaboration/clarification the form of a technical presentation from the Bidder on the already submitted Technical Proposal at any point of time before opening of the Commercial Proposal. III. No further discussion/interface will be held with the bidder whose bid has been technically disqualified / rejected. (B) Technical evaluation methodology: a) Each Technical Bid will be assigned a technical score out of a maximum of 100 points. b) Only the bidders, who score a total Technical score of 70 (Seventy) or more, will qualify for the evaluation of their commercial bids. c) The commercial bids of bidders who do not qualify technically shall be returned unopened to the bidder's representatives after the completion of the evaluation process. d) The technical scores of the bidders will be announced prior to the opening of the financial bids. e) The technically short listed bidders will be informed of the date and venue of the opening of the commercial bids through an oral/ written (e mail) communication. (C) Evaluation of Commercial Bids: The Commercial Bids of only the technically qualified bidders will be opened for a) evaluation. The bidder with lowest Total Commercial Quote (L1) will be awarded 100% score. b) Commercial Scores for other bidders will be evaluated using the following Formula: 14

16 c) Commercial Score (C) = (Total Commercial Quote of L1/ Total Commercial Quote of the L2, L3 etc Bidder) X 100. (D) Determination of the Best value Bid In determination of the best value bid, the following weightage shall be given for the technical and commercial scores of the bidders in a Quality and Cost Based Selection methodology (QCBS): Technical Score: 70% Commercial Score: 30% For every Bidder the Final Total Score (F) will be calculated using the formula F= 0.7 X T X C The bidder with the best value of F shall be selected as the successful bidder. Notwithstanding the above, the purchaser reserves the right to accept or reject any bids/quotations and to cancel the bidding process and reject all quotations at any time prior to the award of contract. The decision of the Rural Development Department shall be final, and no enquiries or application for review shall be entertained

17 I The quantity/number/volume of work may be increased or decreased (maximum up to 10% of the total project cost) as per the requirements of the Rural Development Department. GENERAL TERMS AND CONDITIONS ACKNOWLEDGEMENT COPY Signing and returning the acknowledgment copy of a contract issued by or beginning work under that contract shall constitute acceptance of a binding agreement between Rural Development Department and the Successful bidder. DELIVERY DATE Delivery Date to be understood as the time the contract work is completed at the location indicated under Delivery Terms. PAYMENT TERMS The Rural Development Department shall, unless otherwise specified in the contract, make a) payment within 15 days of receipt of the successful bidder's invoice which is issued only upon Rural Development Department acceptance of the work specified in the contract. b) Payment against the invoice referred to above will reflect any discount shown under the payment terms provided payment is made within the period shown in the payment terms of the contract. c) The prices shown in the contract cannot be increased except by express written agreement by the department. LIMITATION OF EXPEDITURE No increase in the total liability to The Rural Development or in the price of the work resulting from design changes, modifications, or interpretation of the statement of work will be authorized or paid to the Successful bidder unless such changes have been approved by the contracting authority through an amendment to this contract prior to incorporation in the work. 16

18 LEGAL STATUS The Successful bidder shall be considered as having the legal status of an independent Successful bidder vis-a-vis the Rural Development Department. The Successful bidder's personnel shall not be considered in any respect as being the employees or agents of the Rural Development Department. BIDDER'S RESPONSIBILITY FOR EMPLOYEES SUCCESSFUL The Successful bidder shall be responsible for the professional and technical competence of its employees and will select, for work under this Contract, reliable individuals who will perform effectively in the implementation of the Contract, respect the local customs and conform to a high standard of moral and ethical conduct. SOURCE OF INSTRUCTION The Successful bidder shall neither seek nor accept instructions from any authority external to Rural Development Department in connection with the performance of its services under this Contract. The Successful bidder shall refrain from any action which may adversely affect the Rural Development Department and shall fulfil its commitments with the fullest regard to the interests of the department. TERMINATION If the Successful bidder fails to deliver any or all of the deliverables within the time period(s) specified in the contract, or fails to perform any of the terms, conditions, or obligations of the contract, or should the Successful bidder be adjudged bankrupt, or be liquidated or become insolvent, or should the Successful bidder make an assignment for the benefit of its creditors, or should a Receiver be appointed on account of the insolvency of the Successful bidder, Rural Development Department may, without prejudice to any other right or remedy it may have under the terms of these conditions, terminate the Contract, forthwith, in whole or in part, upon thirty (30) days notice to the Successful bidder. Rural Development Department reserves the right to terminate without cause this Contract at any time upon thirty (30) days prior written notice to the Successful bidder, in which case the

19 Rural Development Department shall reimburse the Successful bidder for all reasonable costs incurred by the Successful bidder prior to receipt of the notice of termination. In the event of any termination no payment shall be due from Rural Development Department to the Successful bidder except for work and services satisfactorily performed in conformity with the express terms of this contract. Upon the giving of such notice, the Successful bidder shall have no claim for any further payment, but shall remain liable to the Rural Development Department for reasonable loss or damage which may be suffered by department for reason of the default. The Successful bidder shall not be liable for any loss or damage if the failure to perform the contract arises out of force majeure. Upon termination of the contract, the Rural Development Department may require the bidder to deliver any finished work which has not been delivered and accepted, prior currecsful r'firallv to this contract. to such termination and any materials or work-in-process Subject to the deduction of any claim Rural Development Department may have arising out of this contract or termination. SPECIFIC TERMS AND CONDITIONS UNETHICAL BEHAVIOUR The Rural Development Department strictly enforces a policy of zero tolerance concerning unethical, unprofessional or fraudulent acts of the bidders. Accordingly, any registered bidder that is found to have undertaken unethical, unprofessional or fraudulent activities will be suspended or forbidden from continuing business relations with the Department. CORRUPT AND FRAUDULENT PRACTICES The Rural Development Department requires that all bidders associated with this Invitation to Bid/Request for Proposal observe the highest standard of ethics during procurement and execution of the work. In pursuance of this policy the Rural Development Department: 1. Defines the purpose of this provision the terms set forth as follows: 18

20 Corrupt practice means the offering, giving, receiving or soliciting of anything of value to influence the action of a public official in the procurement process or in the execution of a contract, and Fraudulent practice means a misrepresentation of facts in order to influence a procurement process or the execution of a contract to the disadvantage of the client and includes collusive practice among bidden (prior to or after bid submission) designed to establish bid prices at artificial non-competitive levels and to deprive the client of the benefits of free and open competition; 2. Will reject a proposal for award if it determines that the sleeted supplier/ Bidder have engaged in any corrupt or fraudulent practices in competing for the contract in question. 3. Will declare a bidder ineligible, either indefinitely or for a stated period of time, to be awarded &finance the contract if at any time it determines that it has engaged in any corrupt or fraudulent practices in competing for, or in executing the financed contract. OTHER TERMS AND CONDITIONS The tender should be submitted in single bid sealed in envelope and clearly marked on them the RFP No., Type of Bid and Due Date. The tender should reach the Rural Development Department by Registered / Speed Post / Representative of the bidders only on or before up to 4:00 PM. Only one tender should be put in one envelope. More than one tender in one envelope are liable to be ignored. The tenders received after due date or time or by hand shall not be considered. The technical bid will be opened on at 4:00 PM. by the authorized committee. Incomplete/conditional/telegraphically/fax/e- mall tenders will not be considered. 21 MIL The Bidder is at liberty to present himself & the tune of opening of the tender or may detail the authorized representative on the date and time specified in the schedule. The name and address of the representative who would be attending the opening of the tender should be indicated in the tender form.
