Jobs/73/ Dated the TENDER NOTICE NIESBUD invites tender for Distemper, Painting, Polishing etc. Jobs at NIESBUD, NOIDA Office (A-23, Sector-62, Institutional Area, NOIDA ). A. Scope of Work: Scope of the work is described in tender specifications B. Terms & Conditions: All Terms and conditions described in all the paras of tender specification. C. Tender/ Bid: The Tender/ Bid is to be submitted in two bids systems i.e. Technical Bid and Financial Bid as per the forms at Annexure-1 and Annexure-2 respectively. The Technical Bid should have all the details about the bidders and documents as required to verify the eligibility criteria. Bidders must ensure that all requisite documents for verifying the eligibility criteria are provided/uploaded in the Technical Bid in the Tender. The Financial Bids of only technically qualified bidders will be opened. Earnest Money Deposit (EMD) of Rs. 15,000/- (Fifteen Thousand Only) in the form of Bank Draft/ Pay order drawn in the favor of "NIESBUD, NOIDA" should essentially be submitted to this office before the closing date. The EMD amount will be refunded to all the un-successful bidder and for successful bidder at the time of releasing of payment for the assigned job(s). Last Date of Submission of Tender: Date and Time of Opening of Bid: at 5 PM at 3 PM Authorized representative of the bidders may be present during the opening of Bid. A. SCOPEOF WORK: Sl. Particular No. 01. Providing and applying two rounds of Asian distemper paint of required shades over two rounds of primer on old wall/ceiling, including required surface preparations by means of cleaning, scrapping, crack repairing with putty etc. complete job including the cost of materials, labor charges and scaffolding (approx. 39,000 sq ft) 02. Providing and applying two rounds of synthetic enamel paint of required shades over two rounds of primer on old wooden surface of door net, pipes etc. including required surface preparation by scrapping to remove old paint, complete job by work including the cost of materials, labor charges and scaffolding. 03. Finishing with spirit polish on wooden surface of door, windows, wardrobe, etc. including appropriate surface preparation by scrapping to remove the old polish, complete job with materials, labour and scaffolding. ( approx sq ft) *for all the above jobs, parties are requested to survey the area on between 9.30 AM to 6 PM.

2 B. TERMS & CONDITIONS AND ELIGIBILITY CRITERIA,: (i) GENERAL TERMS & CONDITIONS:- a. The tenders should be submitted in sealed cover marked Tender for Distemper, Painting, Polishing etc. Jobs. b. The tender is to be submitted with complete information/ document etc. to avoid unwanted correspondence after opening the quotations. c. Tenderers must note that the tender once submitted will not be altered for whatsoever reasons and should not have any scope of ambiguity, cutting or overwriting. d. Price quoted in the tender should be as per standard norms like per sq. ft., particular of items with the rates & labour charges etc.. It should also be clearly quote taxes etc., if any. e. The tender should remain valid for a period of at least One year from the date of acceptance. f. The authorized representative with proper authority letter from the Firms will only be allowed to attend the Tender Opening on (1500 hrs.) in the office of Joint Director (Administration) g. The Tenderer is required to perform the jobs within 15 working days after awarding the Order by the Institute, failing which the order may be cancelled without being prejudice to the expenditure incurred by the firm. h. Competent Authority has reserve the right to cancel the tender without giving any clarifications and may deduct 10% to 15% of cost if unable to perform the job within prescribed time. i. Payment will be made within 21 days from the date of final inspection. j. TDS will be deducted as per rule. k. As per the instructions of the Ministry of Finance, Govt. of India, New Delhi, Govt. Companies / PSUs have been directed to adopt e-payments as the preferred mode of payment w.e.f For the purpose, tenderers are required to compulsorily furnish the following information to enable them receive payments in time:- Sl. All related documentary proof of meeting eligibility criteria must be submitted with the Technical Bid. m. The bidders shall submit their offers in two parts namely, "Technical Bid" and "Financial Bid", marked as such along with the bidder s name, strictly in the format given in this document. Both should be submitted in Tender method clearly mentioned as Tender for Miscellaneous Jobs.

3 n. The bids must submitted by Post only, no other ways i.e. courier/fax/ will be entertained on this matter. NIESBUD shall not be responsible for any postal delay or non-receipt/non-delivery of the documents. No further correspondence on the subject will be entertained. o. Any proposal received by NIESBUD after the date and time specified in the tender shall be rejected. p. Any default by the bidder in respect of the tender terms & conditions will lead to rejection of the bid. (ii) ELIGIBILITY CRITERIA: a. The bidder should have relevant experience of more than three years in the field of providing such services in Govt./PSU/Corporate organizations etc.. b. The Bidders should be a Company registered under the Companies Act, 1956 or Partnership registered under the Indian Partnership Act, 1932 or Proprietorship c. It should have offered similar services for Govt/PSU/Corporate organization of India, as such 5 copy of PO must be enclosed for ready reference. d. Minimum average turnover should be Rs. 15 lakh during the last three years. e. A copy of audited Book of Accounts for the year , & f. The bidder must be a single entity. Consortiums will not be allowed to participate in the process. The bidder should not have been blacklisted debarred from participating in tendering by the Central Government/State Government/other Govt. Bodies or under a declaration of ineligibility for corrupt or fraudulent practices. (iii) Evaluation Procedure:- The evaluation of technical bids shall be undertaken by committee of the officers duly constituted for this purpose. The Technical evaluation would be based on the following: The assessment of bidders meeting the eligibility criteria. The assessment of technical capability of bidder to carry out desired scope of work. The assessment of the capability of bidder to carry out desired scope of work in stipulated time as assessed on the basis of carrying out past works in preceding atleast three years. The Financial Bids of only those bidders will be opened whose bids have been technically found suitable. From the time the technical bids are opened to the time the Contract is Awarded, the bidder should not contact NIESBUD on any matter related to its Technical and/or Financial Proposal. Any effort by a bidder to influence NIESBUD in the evaluation, and recommendation for award of Contract may result in the rejection of its bid. On the basis of technical evaluation the eligible entities shall be identified and their financial bids shall be opened. The lowest bidder giving cost-effective solution will be awarded the work subject to meeting all terms & conditions and criteria. Evaluators of Technical Proposals shall have no access to the Financial Proposals until the technical evaluation is concluded. (iv) Payment Terms: (v) Arbitration:- Bidders should strictly quote the prices as per price bid format {Annexure-II}. Payment will be made after the inspection of jobs. o No advance payment will be made. Arbitrator: Any dispute between NIESBUD and the Bidder arising from the agreement executed between them pursuant to this tender shall be referred to arbitration by a sole Arbitrator to be appointed by DG: NIESBUD. The place of Arbitration shall be New Delhi. All the arbitration proceedings shall be conducted in English and in accordance with the Arbitration and Conciliation Act, 1996 as amended from time to time. Each party shall bear its own costs and equally share the fees of the Arbitrator unless Arbitrator decides otherwise.

4 Jurisdiction: All disputes arising from the contract shall be subject to the exclusive jurisdiction of the courts of Delhi. Governing law: The Agreement will be governed in all respect by the laws of India. Force Majeure: If at any time, during the continuance of the contract, the performance in whole or in part by either party of any obligation under the contract is prevented or delayed by reasons of any war, hostility, acts of public enemy, civil commotion, sabotage, fires, floods, explosions, epidemics, quarantine restrictions, strikes, lockouts or acts of God (hereinafter referred to as "events"), neither party shall, by reason of such event, be entitled to terminate the contract, nor shall either party have any claim for damages against the other in respect of such non-performance or delay, provided the performance and/or delivery is resumed as soon as practicable after such event has come to an end or ceased to exist. The decision of NIESBUD as to whether the performance or delivery has so resumed or not, shall be final and conclusive provided further, that if the performance whole or part or nay obligation under the contract is prevented or delayed by reason of any such event for a period exceeding 30 days, NIESBUD may at its option, terminate the contract without any obligation to compensate the Bidder. Termination of Contract: NIESBUD may, in its sole discretion, decide to terminate the contract at any stage without assigning any reason. No NIESBUD Resources to be used: The successful Bidder shall not be allowed to use the NIESBUD staff/resources/space for carrying out its contractual obligations (vi) Miscellaneous:- The bidder should ensure the feasibility of works/jobs at their own cost before submitting their bids for this tender. The offers/emd should be valid for 180 days from the date of opening of the technical bid. DG: NIESBUD reserves all the rights to reject any or all the bids without assigning any reason, whatsoever. The evaluation of the bid shall be at the complete discretion of DG: NIESBUD and all its decisions in this respect shall be binding on the bidders. In particular, DG: NIESBUD does not bind itself to accept the lowest bid and reserves the right to accept a particular bid in whole or in part on merits. Terms and conditions of the bidders will not be considered as forming part of their bids. Therefore, conditional bids shall not be accepted.
