1 In-Principle Agreement with VAHPA for New Health Professionals Enterprise Agreement - Summary of Key Changes Length of Agreement The Nominal Expiry Date is 30 June Pay Increases and uplifts Wage Increases From the first full pay period commencing on or after: - 4 August % - 1 November % - 1 November % - 1 November % Uplifts Uplifts of $17.50 per week applied post increase wage rates as follows: - FFPPOA 4 August 2016 $ FFPPOA 1 November 2017 $17.50 For the top increments of grades 1, 2 and 3 or equivalent grades in the non UG1 classifications. Note Radiation Engineers do not receive any benefit to an uplift payment. Other Changes The overlap in the Grade 1, Year 7 wage rate and the Grade 2, Year 1 wage rate has been removed by replacing the Grade 2, Year 1 wage rate with the Grade 2, Year 2 wage rates with the relevant flow on effect to the other year levels in Grade 2 as a result Grade 2 Year 5 will no longer exist. 4 yearly increments for Grade 4 (this will also affect Chief/Deputy Chief pay rates). New Grade 2 Year 5 increment for Biomedical Technologists. New Class 3, Year 4 increment for Community Development Workers. Other wage related changes as a result of the new classification structure. Other new or changed payments 1 CPD Allowance to be rolled into base rate. Lump sum payment of $1561 for full-time

2 employees (pro-rata for part time employees) who were employed as at 1 January 2016 and those employed after 1 January 2016 and before the Enterprise Agreement commences receive a pro-rata payment of the $1561 for the time period. Introduction of a new meal allowance where four hours of overtime is worked. Revised higher duties allowance clause. Change of shift to not apply where at least two weeks of continuous leave occurs between the relevant shifts or where an employee requests a change to the roster. Inclusion of a working away from home allowance for those that have to be absent overnight from their usual place of residence for work purposes. Payment of superannuation on paid employer parental leave payments. Other matters as drafted in the enterprise agreement Higher qualification allowance to be paid during all periods of leave except sick leave beyond 21 days and long service leave. Re-drafting Comprehensive re-drafting of the agreement. Revision of clauses to ensure compliance with NES. Insertion of a service delivery partnership plan in line with government policy. Standardised clauses Insertion of a revised Consultation, Dispute Resolution and Discipline clause. Insertion of a Fitness for Work, Union Matters and Redundancy and related entitlements. 2

3 Insertion of a letter of offer. Insertion of a casual conversion clause. Insertion of a transition to retirement clause. Insertion of a flexible working arrangements clause Inclusion of Victorian Government Family Violence Leave clause. Some minor amendments have been made to these clauses to take into account VAHPA feedback. Leave Clauses Professional Development leave available to part-time employees. Revised annual leave clause including: - Inclusion of payment for leave loading or shift penalties (whichever is the greater in line with other agreements) - Excess annual leave notice has been reduced to 10 weeks and a statement that the 304 hours is pro-rata for part time employees. Revised long service leave clause including: - Pro-rata leave available at 10 years subject to employer s operational requirements but will not be unreasonably withheld. - Clause regarding the payment for parttime employees where their hours fluctuate. Revised personal leave clause including: - Ability to take up to 38 hours of personal leave to attend appointments with a registered heath practitioner on account of a disability (as per other agreements). - Where employees are sick on additional shifts medical certificate to be provided. 3

4 Revised overtime clause including: - Clarified definition of overtime. - Time in lieu at overtime rates. - Rest period after overtime does is not required where employee has already had 10 consecutive hours off between their rostered period of ordinary duty, the period of recall is continuous with their next period of ordinary hours and the employee does not work more than 2 hours recall. Classifications Insertion of a classification and reclassification clause. Revised classification structure including: - Simplification of the UG1 structure (including the previous chief/deputy chief structure into the grade 3 and grade 4 classifications), - Updating of terminology, - For grade 3 and grade 4 the insertion of a base definition and then areas of expertise an employee may work within or across such as clinical, managerial, education or research, - Advanced Practice structure, - Insertion of a new Allied Health Manager (formerly known as a chief) Grade 6 - Insertion of a Deputy Director of Allied Health, - Inclusion of Biomedical Technologist and Youth Work classifications definitions. Reserved matter parties to agree to an appropriate Health Promotion structure. Employers to write to employees confirming their classification within 6 months of the agreement coming into operation. 4

5 Other Clauses Revised fixed term employment clause including: - Clarifying genuine fixed term arrangements, - Ability to contract beyond the current 2 year limit. Insertion of a clause regarding ending employment during parental leave. Insertion of a performance management clause. Insertion of a safe staffing and workloads clause. Revised backfill of leave clause. Revised advertising of vacancies. 5
