1 TENDER SPECIFICATIONS FOR SUBCONTRACTING EXTERNAL EXPERTISE: 1 ICT expert ECMIN 3.0 Workers information and portal website on applicable working conditions VS/2017/0354 Tender Specifications Background of the project The construction sector is by nature characterized by a highly mobile workforce. Therefore temporary migration and in particular posting of workers is of vital importance for the sector. Lack of accessibility and transparency of the applicable working conditions has always been an important reason for reticence on workers side to work in an EU Member State other than their home one. It is often the case that workers end up being trapped in jobs where they face substandard conditions which are below the legal minimum. In such cases, the generally acknowledged rule of same wage for the same work at the same workplace is violated on each building site at the detriment of the posted workers. For some years now, discussions on temporary mobility of workers have a prominent role in the EC policy making, amongst social partners and within the trade union movement. In 2014 the Enforcement Directive 2014/67/EC of the Posting of Workers directive came into force pointing out the importance of improved access to and transparency on the terms and conditions of employment within the different EU Member States in order to ensure the right application of the Directive 96/71/EC and thereby protecting the rights of posted workers. The Directive demands terms and conditions of employment to be made available in accessible format on a single official national website in a clear, transparent, comprehensive and easily accessible way. 1 / 7

2 In order to address these issues the EFBWW launched in April 2017 the ECMIN 2.0 website Construction workers, Wages and Rights in Europe - and an APP to be downloaded on all mobile devices. This website - and APP, produced with the financial support of the EaSi funds of the European Commission - DG Employment, aims at providing concise and easily accessible information on working conditions for construction workers in every Member State. Available in all the 24 official languages of the European Union, the website is a simple tool which offers mobile workers the possibility to not only get standardized information on working conditions in every country in her/his native language, but also useful contact details of trade unions and labour inspectors. In case of need for clarification or support, a worker can therefore easily get in contact with support persons who speak her/his language. In a sector where generally workers do not understand complicated information in a foreign language, abating the language barrier is a very important added value which will ensure long lasting interest in the tool. In order for workers to be properly informed about their rights and protected against exploitation, the scope of the project must be as wide as possible. The goal of this new project is therefore to increase the number of mapped countries, adding to the 28 EU Member States EEA and accessing countries: FYROM, Albania, Montenegro, Serbia, Turkey, Iceland and Norway. As a consequence the website and the APP will be translated into 7 additional languages. The increase of the languages and the countries already available on the website, will cater for an important amount of construction workers in the European continent. The affiliates of the EFBWW are the key actors in the maintenance and the promotion of the ECMIN website and App. The information is updated at national level in a timely manner by national responsible actors within trade unions (and labour inspectorates in some cases) thus contributing to the Enforcement of the Directive 96/71/EC by making the conditions and terms of employment in their country (for the construction sector) transparent and easily accessible. But some additional work is needed to improve the accuracy, usability and reachability of the website and APP as well as its promotion. General objective of the project The ECMIN 3.0 project objectives are to: 1. further improve transnational administrative cooperation between national competent bodies and social partners involved in the monitoring and correct application of the Posting of Workers Directive and its Enforcement Directive through exchanges and cooperation within the ECMIN network. 2 / 7

3 2. Increase mutual trust among stakeholders, including promoting common actions between social partners. The specific objectives of the project are to increase the accessibility, transparency and quality of the information concerning the terms and conditions of employment to be respected and the existing practices in the Member states to monitor and enforce the provisions of the Posting of workers directive by: including in the existing website information on terms and condition of employment of candidate countries (Albania, FYROM, Montenegro, Serbia and Turkey) and EEA countries (Iceland and Norway); adding 7 additional languages to cater for the workers of the new countries involved: Albanian, Macedonian, Montenegrin, Serbian, Turkish, Icelandic and Norwegian. adapting the information provided on the website to the new provisions foreseen by the Revision of the Posting of workers directive (i.e. specific elements of remuneration, etc. 1 ) and upgrading the existing one where necessary; improving the reachability of the website in all the languages; further developing and structuring synergies and cooperation with existing networks working with/for protection of posted workers and respect of workers rights; further disseminating the website among workers and authorities. Subject matter of the contract The subject matter of the contract between EFBWW and the ICT expert will be to: 1) act as ICT expert in the Grant Agreement VS/2017/0354; 2) ensure direct contact with the project manager; 3) participate in the Steering Group meetings and project related events; 4) liaise and cooperate with the campaign expert; 5) Specific ICT tasks: a. Project ICT management b. Technical analysis c. Testing d. Completing the existing website with 7 new languages and adding info on 7 new countries in 31 languages e. Further development and upgrade of the APP (including a software to automatically update the information on the APP in all languages once updating the website) 6) Perform other tasks as requested by the Project Manager and/or the Steering Group. Guidance regarding performance of the tasks and regarding the methodology Performance of the tasks will have to be carried out within the contract period specified in the contract European Commission-EFBWW and with due regard to the order indicated in the description of the above-mentioned tasks and the schedule of the project activities enclosed. Methods of work The general supervision and evaluation of the project will be carried out by the steering group, co-ordinated by the project manager. The steering group will be composed of representatives from the EFBWW. The ICT expert will also assist the meetings of the steering group together with the campaign expert. During the project the steering group will meet 4 times. Additional meetings could be foreseen. Time schedule and reporting The schedule of activities is laid down in the project description, which could be modified by the steering group. The expert shall finalize the project within a maximum period in line with Commission instructions. 4 / 7

5 Contract The Contract between EFBWW and the ICT expert will be based on a standard contract taking into consideration the financial regulations of the European Commission and obliging the consultant to respect the obligations laid down in the contract European Commission-EFBWW. The successful consultant will submit to the EFBWW a draft contract EFBWW-ICT expert which includes back to back obligations from the contract European Commission-EFBWW also in the relationships consultant-subcontractors. Payment Payment shall be made on the basis of invoices, once the tasks have been performed and the results of the work have been accepted by the steering group. Selection criteria The consultant will be selected on the basis of the following criteria (as mentioned in the public procurement directive 2004/18, Articles 45, 47 and 48): a) personal situation of the tenderer b) economic and financial standing c) technical and/or professional ability Tenders failing to satisfy all the criteria will be excluded from the further procedure. Award criteria The contract will be awarded to the bidder whose bid represents the economically most advantageous tender taking into account the following criteria: 1. Expertise on ICT matters (50%) 2. Project management and organizational capabilities (20%) 3. previous working experiences with stakeholders/partners (15%) 4. language and communication skills (15%) 5 / 7

6 Content of the tenders Interested parties are invited to present their: a) comments and solutions on the proposed structure of the project; b) comments on the proposed list of tasks for the ICT expert, shortly describing the main issues and solutions; c) a detailed offer/prices for the ICT expertise The content of the tender presented by the consultant must correspond to the specifications indicated in the previous points Evaluation procedure The economically most advantageous tender will be identified by the evaluation of each award criterion on a scale between 0 and 10. These results will be counted using the relative ponderation indicated in % behind the award criteria. Submission of tenders The tender must be sent or delivered in duplicate, under a sealed cover. The envelope should be marked appel d offres à ne pas ouvrir par le service du courrier. If self-adhesive envelopes are used, they must be sealed with adhesive tape and the sender must sign across the tape. 9 I. Introduction and executive summary 1. Please give a brief overview (max V2 page) of your project proposal. The overview should list 1) the type of action; 2) its geographical scope; 3) the participant organisations and their roles/responsibilities; 4) the general and specific objectives; 5) expected results and 7) the expected costs of the action and the main expenditure items. The overview should also demonstrate the applicant's understanding of the overall objectives and purpose of the call. The EFBWW, together with its affiliated organisations and the support of the DG Employment, Social Affairs and Inclusion, created a website where construction workers can find practical information on minimum rates of pay, working time, premiums, holidays, wage deductions and sickness and injuries applicable in all 28 EU member states in all 24 official languages of the EU. The website is accompanied by an application for mobile devices with similar features. This follow-up project will aim to include in the existing website and application information on terms and condition of employment of candidate countries (Albania, FYROM, Montenegro, Serbia and Turkey) and EEA countries (Iceland and Norway) also adding 7 additional languages to cater for the workers of the new countries involved; to adapt the information provided on the website to the new provisions foreseen by the European Court of Justice and the revision of the Posting of workers directive ( i.e. specific elements of remuneration, etc.1) and upgrading the existing one where necessary; improving the reachability of the website in all the languages; further developing and structuring synergies and cooperation with existing networks working with/for protection of posted workers and respect of workers' rights; further disseminating the website among workers and authorities. This will be done in cooperation with and with the support of the EFBWW affiliated organisations and where necessary with other actors (labour inspectors) - which will provide the necessary information to be uploaded on the website and participate in the ECMIN network - and under the supervision of the steering group (Applicant, 3 co-applicants, 2 experts and 4 representatives of the countries ECMIN network). The ECMIN 3.0 project responds to the general objective 1 and 2 of the call for proposals (see below) and to the specific objective b) to increase the accessibility, transparency and quality of the information concerning the terms and conditions of employment to be respected and the existing practices in the Member states to monitor and enforce the provisions of the Posting of workers directive. Main costs consist of travel and accommodation expenses for 4 steering groups, one dissemination event, one evaluation seminar and one training seminar; costs for translation of information on newly added countries into 30 languages and translation of modified information into 23 languages; Costs for campaign expert and IT expert; interpretation at dissemination, evaluation and training events. 1 If applicable, depending on the outcome of the Revision of the Posting of Workers Directive; in case the proposed Directive is not adapted the project will focus on changes as mentioned in the EUCJ case 396/13 Sähköalojen ammattiliitto. 2

10 II. Relevance of the proposal 1. What are the strategic and specific objectives of the proposed action? The ECMIN 3.0 project fits in with the general objective of the Call for Proposals under the EaSi budget line as it: 1. Further improves transnational administrative cooperation between national competent bodies and social partners involved in the monitoring and correct application of the Posting of Workers Directive and its Enforcement Directive through exchanges and cooperation within the ECMIN network. 2. 11 - INFORMATION: the project alms at upgrading and broaden the existing online platform ( and mobile devices' application collecting information on wages and working conditions for construction workers in Europe. Please see III.2 for detailed information 3. Describe and motivate the geographical scope of the action and the choice of the countries in the light of the objectives of the call. The construction sector is by nature characterized by a highly mobile workforce. Therefore temporary migration and in particular posting of workers is of vital importance for the sector. Lack of accessibility and transparency of the applicable working conditions has always been an important reason for reticence on workers' side to work in an ELI Member State other than their home one. It is often the case that workers end up being trapped in jobs where they face sub-standard conditions which are below the legal minimum. In such cases, the generally acknowledged rule of "same wage for the same work at the same workplace" is violated on each building site at the detriment of the posted workers. Describe the nature of the consortium, and justify the choice of the stakeholders with respect to a) the contribution of each co-applicant in carrying out the action in terms of expertise and results expected; b) the geographical scope of the planned activities; c) the overall objectives of the project. The European Federation of Building and Woodworkers (EFBWW)- a European representative social partner for the construction industry- will manage the project. Co-applicants of the project will be the three organizations who took part in the steering group of the ECMIN 2.0 project and were therefore involved in the development of the new tools, namely: Fillea-CGIL from Italy, FNSCBA CGT from France and FCIW PODKREPA from Bulgaria. As with ECMIN 2.0, these organizations will help in organizing the different activities, facilitate exchanges within the network, support the project manager in reaching out to relevant 4

12 organizations in different countries where, for different reasons, it is more difficult to collect information. The consortium will be therefore composed of 4 members. But all the affiliated trade unions of the EFBWW (75 trade unions in 34 countries) will provide necessary help, support, information and advice during all the stages of the project, ensuring therefore a complete geographical coverage as described in the previous point A particular feature of this project is that it will interconnect with existing, ongoing projects, such as: - EURODETACHEMENT, INTEFP - FAIRE MOBILITÄT - DGB Germany - REDER, CGT France - others These interconnections will complement the scope of the ECMIN, widening the network with relevant stakeholders (local authorities, labour inspectors, civil society organizations, etc.) and providing a more articulated and comprehensive support to the workers. 5. Describe the target groups (if any, e.g. social partners, SME's, administrations etc.) of the chosen activities and the logic behind the choice. The ECMIN targets potential posted workers. It aims to provide them with the most important information on the terms and conditions of employment in the 28 EU Member states, EEA and accessing countries. Equipping these workers with information on terms and conditions of employment as well as with contact references in each country, will contribute to avoid exploitation and precariousness. The special feature about ECMIN is that it provides this information in a precise, easily accessible and of course free of charge way to its target group. But even beyond the important target group of potential posted workers, all workers can profit from the information that ECMIN 3.0 will provide. Even when they do not plan to go to another EU member state, workers can inform themselves about the applicable standards in their countries and if these standards are not respected by their employer, they can challenge them to do so by for example reporting to the responsible national trade unions. 6. Please provide any additional information highlighting the relevance of the proposal, if not covered by the questions above. The ECMIN website is an important instrument to inform (potential) posted workers about sector-specific, precise, concise, free of charge and easily accessible information on the terms and conditions of employment in other EU Member States. It can become an important sector specific complement to the existing websites of the national competent bodies and the EU such as Eures and Your Europe, which provide less sector-specific information. Furthermore, it complements the existing posting-workers website, which is designed to be a reference tool for companies and trade unions. The inclusion of EEA and accessing countries will help increase the number of users and the relevance for the sector. 5 *3^

13 The ECMIN website generates more transparency on the existing terms and conditions of employment in the construction sector and thus a better functioning EU labour market. It integrates the national trade unions in the communication of existing legislations and circumstances and enhances transnational cooperation (Trade Unions and labour inspectors). Through the part dedicated to "Contacts", the website goes further than simply providing information and serves a as gateway (portal function) between the workers, who are looking for information, and the existing national trade unions, who are able to provide additional information (brochures, leaflets,...), answer specific questions (over the phone, by and even in person) or direct the worker to the relevant authority. Recital (15) of the recently adopted Directive 2014/67/EC highlights that the social partners in the EU Member states should communicate and inform about the specific terms and conditions of the employment in their sectors. Through this website the EFBWW and its affiliates contribute to inform about and assist regarding those conditions, not only to public authorities and other competent bodies, but also to the potential migrant and posted workers directly. Since its launch, the website has been presented at different official occasions: a seminar for the construction sector organized by the European Platform Tackling Undeclared Work; in the framework of European projects dealing with Posting of Workers issues (i.e. Promo: Protecting Mobility through Improving Labour Rights Enforcement in Europe) and in front of the members of the EMPL committee of the European Parliament. In all occasions the website has received very positive feedback and has been praised for its goals, content and usability. The difficult tasks of standardizing and simplifying the information provided has been necessary in order to make the tool usable and readable, but it has not diminished its appeal and importance. On the contrary, the added value of the establishment of a network, of the availability of direct contact details has increased the interest. 6

14 III. Quality of the methodology and of the activities proposed 1. Please describe the deliverables and results of the planned activities as well as the instruments which you plan to use for attaining these results. The project will be divided in three wide areas: 1) upgrading the existing online platform and APP 2) further enhancement of the cooperation within the network and among different networks 3) further promotional and dissemination activities. In order to perform these activities an experienced policy staff of the EFBWW will act as project coordinator, supported by the members of the steering group. External expertise, such as IT experts, campaigns experts and translators will be subcontracted (for details, please see the item on "outsourcing"). Members of the EFBWW affiliated organizations as well as labour inspectors, if necessary, will be involved to provide and revise the data and information uploaded on the website in their respective countries. 2. Please give an overall description of the main tasks, responsibilities, resources and management tools of the applicant organisation and each of the coapplicants to implement the action. 1) Upgrading the existing online platform and APP (information activity) The project will build upon the experience of the ECMIN 2.0 project concerning the collection of information for the additional countries and translations. The country fiche with standardized questions, which was created to collect information for the existing website, will be updated to reflect the changes in the revised Posting of Workers directive. It will be distributed to partners in the new target countries (Albania, FYROM, Montenegro, Serbia, Turkey, Iceland and Norway). The co-applicant organizations will assist in this task by providing contacts in the relevant countries and follow-up in case of delays or problems linked to the collection of the relevant information. The new information provided will be revised and analysed, before being uploaded to the website, by the EFBWW project coordinator and the IT experts. The information will be translated in 7 new languages, which will be the languages of the new countries involved. Similarly, the revised country fiche will be distributed to the already mapped countries in order to collect the missing information deriving from the Directive revision, if applicable. Also an analysis of the existing content will be made in order to assess and perform, if necessary, some revision/upgrade of the existing information with the support of the co-applicant organizations and the steering group members. In order to improve the language used in the website and to increase the clarity and usability of the information, also taking into consideration the participation of new countries, a complete revision of the different translations will be necessary in order to correct existing mistakes and to standardize as much as possible the terms and the sentences used for the different countries in the same language. In order to achieve a good result, a revision of the automatic translation system (when data is changed in one language/country it is 7

15 automatically translated in all the other languages) will be performed. This revision will allow the content managers (people updating the information in their countries) to have more flexibility in phrasing the country information content. This task will be done by the IT experts, with the help of the translators and the support of the project partners which provided the data for their countries. This work will also be accompanied by the development and integration of a communication platform for content managers which will be added to the website's functionalities. This platform will be used to analyse the website traffic, receive tips on how to use the content management system, be reminded to update information and communicate among the members of the networks (exchange and transnational requests of support received, etc.). Also, an important part of the website upgrade will be dedicated to improving the Search Engine Optimization. It has been noted by users in different countries that it is difficult to find the website, when typing key words, in languages other than English To make sure that the website capacity is used to the full, it is necessary for it to be reachable in all the languages when typing key words (e.g. construction, wages, etc.). The Steering Group together with the project manager will discuss with the IT experts on how to improve the results of the Internet search. In addition the functionalities and the usability of the APP will be assessed and the necessary measures taken to improve and upgrade the APP. As in the first project, an evaluation seminar will be organized, with the support of the coapplicants, once the information on the new countries has been uploaded and the translations made. This seminar will have as main goals to evaluate the new features of the website; evaluate the new translation system and the already uploaded translations; assess the functionalities and the upgrade of the APP; assess the effectiveness of the promotional campaign and share best practices and feedback from workers who used the website. This seminar will also be an opportunity to introduce the new members to the network and asses how the network is working and how to improve internal cooperation (see next point). Also, a final training seminar for the new countries and organizations involved will be organized with the support of co-applicants. The training seminar will have the goal of providing the new network partners with the tools necessary to manage the content of the website, update the information and use the APP. The use of the new communication system will also be explained. It is foreseen therefore that also old members of the network will take part in the seminar. This will also provide an opportunity to discuss and further develop the cooperation among the members in informing and supporting potential posted workers. The training seminar, which will be organized in the second year of project, will also be an opportunity to assess the entire work of upgrading functionalities and translation features of the website. 2) Further enhancement of the cooperation within the network and among different networks (cooperation activity) One of the main goals of the creation of this website is that construction workers to be posted in other countries can not only look for information on working conditions and wages, but contact directly Trade Unions to receive additional information and support. This can be done through the contact details available on the website as well as through the APP where a specific feature allows to send 8

16 direct messages to contacts. This support net can only work if there is a smooth cooperation between the different partners. The advantage is that the partners are all members of the EFBWW and therefore the communication is easier. But some modus operandi and procedures should be in place to make sure that the requests that need transnational support are adequately followed. It will therefore be important to verify that all the contact persons are informed on how to proceed on the different requests and that the "response" system actually works. Also the additional contact persons in the new countries will need to be involved in the network. At the moment, for some countries, labour inspectors are the contact points in the ECMIN website. More labour inspectorate contacts should be added to provide workers with a wider range of support. Evaluation, dissemination (see later) and training seminars will be used to this effect and the introduction of the new communication platform, which will be embedded in the website, will also help. The establishment of connections with other networks working on issues related to the posting of workers, such as EURODETACHMENT, REDER, Faire Mobilität, etc. will also contribute to enlarge the network. The establishment of these connections will be done with the support of the co-applicant organizations as well. In these networks labour inspectors, trade unions and civil society organizations work together. To achieve this project goal, a dissemination event will be organized. This two - day event will take place in France. There will be up to 70 participants from the ECMIN network (trade unions and labour inspectors), public authorities, members of civil society and of existing networks (Reder, Eurodetachement, Faire Mobilität, etc.). All the participants will work on issues related to the posting of workers and the Enforcement Directive. Translation will be provided in 7 languages. The main goals of this event will be to: disseminate information on the ECMIN website; receive information on the work of the other networks; share information on the compliance with and enforcement of the applicable rules in relation to posted workers; establish and/or reinforce existing links with relevant stakeholders; develop structured initiatives to exchange information and establish mutual support. In addition, the EFBWW will use the different opportunities provided by its participation to EURODETACHMENT and REDER projects and network to further tighten and enhance cooperation. 3) Further promotional and dissemination activities. The website was launched Europe-wide on 17 April The partners of the project simultaneously launched the website at national level through the publishing of a press release on their websites and national press. This momentum needs to be maintained and more people have to be reached and informed about the ECMIN tools. A campaign expert will be subcontracted as part of the project to prepare a campaign and dissemination strategy. Attractive promotional gadgets and leaflets will be produced to be distributed at national levels during events, fairs, etc. The use of these traditional dissemination tools will be accompanied by a social media/digital campaign which will reach a wider public. The campaign will have to be organized at European and national level with the support of the co-applicant organizations and the members of the steering group 9

17 3. Please describe the core project team proposed for implementation of the activities and identify the main tasks of each member of the team. The Project will be guided and supervised by a steering committee, composed of 10 participants: the EFBWW project manager, 2 external experts, the 3 coapplicant organizations, as well as 4 trade union representatives from other countries. At least one trade union representative will come from one of the additional countries. The steering committee will have the tasks to: - supervise and contribute to the overall implementation of the project; - contribute to the preparation of the seminars and meetings; - support and facilitate contacts with existing networks working on posting of worker related issues - support the campaigning and dissemination of the project. The steering group will meet 4 times. The experience of the co-applicant organizations acquired during the ECMIN 2.0 project and the network of contacts they have available will be of utmost importance for the achievement of the projects goals. 4. Within the consortium, describe how the activities of the work of the different coapplicants and affiliated entities (if any) will be coordinated and followed-up. How does the proposal ensure the consistency of the activities of the consortium, bearing in mind in particular the way the different co-applicants and affiliated entities (if any) will cooperate and complement each other? The co-applicants have been selected as they were already the members of the steering group of the ECMIN 2.0 project. As per their letters of commitment, the co-applicant will have the same tasks and will contribute with their expertise and contacts to the successful implementation of the project. The organizations are also members of other networks (REDER, etc.) and this will facilitate external contacts. This means also that the consortium is already used to working together. The work will be coordinated by the EFBWW project manager, who will involve the co-applicants in every step of the project, request specific support if needed (especially in the organizations of events and steering group meetings) and the decisions will be taken together. The co-applicant organizations will also be part of the steering group of the project. 10

Describe to what extent the proposal is innovative in terms of methodology, involvement of different type of stakeholders, use of resources, services delivered or any other aspect that you consider innovative in the proposal. If you are aware of any similar project carried out in the past by other organisations, describe the differences with your proposal. The lack of knowledge about the terms and conditions of employment across Europe has long been an essential obstacle for the workers in the construction sector to make use of their right of free movement or to fight against exploitation and dumping. The innovative action of the ECMIN is to provide the potential posted workers directly with precise, concise, easily accessible, and free of charge information about the terms and conditions of employment in other European states. It is an excellent complement to the existing websites, which are more technical, national or general. It complements EURES, Your Europe, the EFBWW-FIEC website and database posting-workers.eu with more sector-specific information on the terms and conditions of employment directly from the trade unions that negotiate these standards. While posting-workers.eu is a reference tool for trade unions and employer organisations containing technical information, ECMIN is focussing directly on the potential posted workers with easily accessible, precise, concise information. Compared to successful projects like Faire Mobilität that are implemented on a national level, ECMIN is designed for a European level and includes all EU Member States, EEA and accessing countries. Additionally it gives the workers the possibility of getting in contact with trade unions or labour inspectors if in need of support. All of this can be done in their native language, abating therefore language barriers that often prevent workers to look for help and to trust people who could help. It also provides useful links to national authorities, social security, pension funds, etc... brochures which contain practical additional information from different sources. The ECMIN website can also be considered a complement to the national website on working conditions that were created as per the art.5 of the Enforcement Directive 2014/67. Every European Member State should have created a national website: the respective links will be added in each country. 11 'S\ÃT

19 6. Which project activities will be outsourced and why? Please justify. The following activities will be outsourced as the consortium does not have any in-house experience or capacity to carry out these services. A. Translation: - info on 35 countries into 7 new languages - info on 7 new countries into 24 languages - final revision of 31 languages for 35 countries - translation of small texts in the gadgets B. Interpretation: Simultaneous interpretation from and into: - 7 languages during the training session, - 4 languages during the evaluation seminar, - 5 languages during the dissemination event. C. Campaigning expert: - Prepare a Europe-wide dissemination campaign for the ECMIN website; - Advise on how to reach as many posted workers as possible - Liaise and support national partners in the campaign D. ICT experts: - Project ICT management - Technical analysis - Testing - Development website for the additional 7 languages and 7 countries in 24 languages - Content management - Website upgrade - Creation of communication platform - Revision of translation system - Search engine optimization - Further development of the APP 7. What are the risks that might be encountered during the implementation of the project and what are the corresponding corrective or mitigating measures? As with the ECMIN 2.0 project, the main risks are the lack of responsiveness from the national contacts on questions regarding working conditions in their respective countries (collection of information) and the lack of available contact in a specific country. For the first problem, the project manager will invest enough time to contact directly persons in each country and make sure that the information is collected in a timely and as complete as possible manner. If contacts are not available in a specific country at EFBWW level, the co-applicant organizations will use their networks to find suitable persons ready to provide the necessary information and participate in the project. 12 «fr

20 Another problem is to maintain the information updated. We need to make sure that the persons in charge in each country will be reminded to do it. The IT experts will put in place a system of automatic regular reminders for each country. Problems which will occur with translation in all the languages will be solved by involving national partners in the revision of the information provided for the different countries in their mother tongue languages. 8. Please describe the necessary resources and tools used by the lead applicant and co-applicants to ensure adequate monitoring and evaluation of the project activities. There will be 4 steering group meeting organized within the 2 years of the project. During the meetings, the different project activities and steps will be planned, their implementation monitored and evaluated. If necessary corrective measures will be put in place. Also, as one of the project activities, an evaluation seminar on the 18th month of the project will be organized. This seminar will have as main goals: to evaluate the new features of the website; evaluate the new translation system and the already uploaded translations; assess the functionalities and the upgrade of the APP; assess the effectiveness of the promotional campaign and share best practices and feedback from workers who used the website. It will be therefore an important monitoring tool which will involve more than the sole members of the steering group and will provide an opportunity to assess if corrective measures/further steps/changes that need to be put in place. In addition to this the final training seminar, which will be the closing activity of the project, will be used as an opportunity to provide a final evaluation of the project activities and of the deliverables. 9. Please provide any additional information on measures to ensure the quality of the action, if not covered by the questions above. In addition to what was described previously, the quality of the final products will be constantly checked by the participating countries and organizations as they have a direct interest to receive quality products that they can use with their "end users". To this end constant communication and requests for feedback will work between the network members and the project coordinator as well as with co-applicant organizations. Presentations of the ECMIN tools to external stakeholders will be also used to collect feedback and improve the final products. 13 Ήit

21 IV. Impact of the proposal 1. Explain the added value of the proposal in the wider context of the implementation of the Posting of Workers Directive and/or the Enforcement Directive. Motivate how the proposal will innovatively contribute to a better understanding of challenges and/or better implementation in the field of posting of workers in the EU with respect to existing programmes, facilities, tools or studies. For some years now, discussions on temporary mobility of workers have a prominent role in the EC policy making, amongst social partners and within the trade union movement. In 2014 the Enforcement Directive 2014/67/EC of the Posting of Workers directive came into force and by 18 June 2016 all Member States should have implemented it. The directive points out the importance of improved access to and transparency on the terms and conditions of employment within the different EU Member States in order to ensure the right application of the Directive 96/71/EC and thereby protecting the rights of posted workers. It stresses that "difficulties in accessing information on terms and conditions of employment are very often the reason why existing rules are not applied by services providers" and that " effective access to it" has to be "provided [...] also to posted workers concerned". These conditions should be made available in accessible format on a single official national website in a clear, transparent, comprehensive and easily accessible way. At the same time, since the election of its President in 2014, the EC has committed to a fairer and more social Europe. Part of this commitment translated in a proposal for a revision of the Posting of Workers Directive EC 96/71 whose discussion, at the time of writing, is coming to an end. Part of the revision concentrates on redefining terms and conditions of employment for posted workers to achieve fairer and more comprehensive working conditions. Pending the analysis of the single official national websites from the EC's side and the end of the legislative procedures for the revision of the 96/71 Directive, the EFBWW launched in April 2017 the ECMIN 2.0 website - Construction workers, Wages and Rights in Europe. This website - produced with the financial support of the EaSi funds of the European Commission - DG Employment, aims at providing concise and easily accessible information on working conditions for construction workers in every Member State. Available in all the 24 official languages of the European Union, the website is a simple tool which offers mobile workers the possibility to not only get standardized information on working conditions in every country in her/his native language, but also useful contact details of trade unions and labour inspectors. In case of need for clarification or support, a worker can therefore easily get in contact with support persons who speak her/his language. In a sector where generally workers do not understand complicated information in a foreign language, abating the language barrier is a very important added value which will ensure long lasting interest in the tool. It is recognized that this is a very specific and unique feature which provides an added value to the website. Other innovative measures, such as the creation of an app for mobile devices has also been put in place to facilitate offline access to information and the possibility to send requests to contact persons directly. 14

22 2. Describe how the proposal is likely to have a tangible impact on the target groups or target countries mentioned in section II above by giving concrete examples. Also emphasise if and what kind of output will remain available beyond the end of the project. The ECMIN 3.0 tools are a simple and user friendly means to inform construction workers on wages and working conditions around Europe and to look and ask for support to relevant people if necessary in every country in Europe and in the native languages of the workers. Considering the high level mobility of construction workers, these tools will become therefore a point of reference for construction workers in Europe. The creation of an APP will enhance the use and the durability: once the app has been downloaded on the mobile phone of the workers it will remain and it will be possible to consult it whenever necessary in an easy manner. Therefore workers will always be able to check for information, but also to directly get in touch with relevant contacts in the home or host country. After the end of the project, both the website and the app will remain available for the workers. The update which will be done at national level will enhance the ownership of the tools by national trade unions which will therefore have an incentive to continue working and promoting it to workers. 3. Please describe briefly if and how the project can create synergies with other projects carried out in the past in the field of posting of workers and/or labour mobility financed by EU or national means. The ECMIN tools have been already presented during different event linked to EU projects (PROMO, EURODETACHMENT, Platform against undeclared work, etc.) which the EFBWW is part in. All the stakeholders expressed interest in linking the different initiatives with exchanges of experiences and linking their websites to the ECMIN one. During these presentations, national initiatives such as Faire Mobilität and Arbeit und Leben got in contact with the project manager and project coordinator to explore possibilities of cooperation. One of the co-applicants of the ECMIN 3.0, CGT, is also the leading partner in another network working with posted workers called REDER. The other two coapplicants are also members of this network thus facilitating exchanges and synergies between the two initiatives. 4. Please provide any additional information emphasizing the impact of the proposal, if not covered by the questions above. The impact will be wider thanks to the innovative features described above: - EU 28, EEA and accessing countries covered - translation in all the relevant languages - update at national level to ensure proper and timely amendments and boost the project's ownership - Search Engine optimization to find the website when typing in all the languages - mobile device APP - contacts which can be reached in all the countries mentioned in all the languages 15

A campaign expert will be subcontracted to run a dissemination Europe wide campaign which will be run through and in cooperation with the affiliated member organizations of the EFBWW. The use of traditional dissemination tools (such as gadgets and leaflets) will be accompanied by a social media/digital campaign which will reach a wider public. The link to the ECMIN website will appear on all the EFBWW national affiliates' websites. 3. Please provide any additional information on the visibility of the action and the dissemination of results, if not covered by the questions above. A dissemination event will be organized during the second phase of the project. The main goals of this event will be to: - disseminate information on the ECMIN website - receive information on the work of the other networks - share information on the compliance with and enforcement of the applicable rules in relation to posted workers - establish and/or reinforce existing links with relevant stakeholders - develop structured initiatives to exchange information and establish mutual support. 16

24 VI. Cost/efficiency of the operation The SWIM application form contains the budget breakdown for the action by heading and by partner. This section is deemed to provide additional information on the way the costs are calculated and the proportionality of the resources used in comparison with the outputs and results expected. 1. To what extent is the proposed budget proportional to the project outputs and expected results and is the overall budget breakdown consistent with the proposed action? In terms of time, the project applicant requires an estimated 83 days (8 for project manager; 40 for coordination and implementation; 25 for administration; 10 for accounting). The Project partners have an estimated 20 days each (coordination and implementation). These days include the actual meeting days, supervision and contributing to the overall implementation of the project; contributing to the preparation of the seminars and meetings; supporting and facilitating contacts with existing networks working on posting of worker related issues; supporting the campaigning and dissemination of the project. The input by the campaign expert is estimated at 50 days. He/she will prepare and run a dissemination Europe wide campaign, in cooperation with the affiliated member organizations of the EFBWW. The use of traditional dissemination tools (such as gadgets and leaflets) will be accompanied by a social media/digital campaign which will reach a wider public. The input by the IT expert is estimated at 70 days for the following tasks: Project ICT management; Technical analysis; Testing; Development website for the additional 7 languages and 7 countries in 24 languages; Content management; Website upgrade; Creation of communication platform; Revision of translation system; Search engine optimization; Further development of the APP. The other main costs of the project consist of: Accommodation expenses for 4 steering groups, one dissemination event, one evaluation seminar and one training seminar. All of these meetings will tackle a specific part of the tasks foreseen in the proposed work packages. Travel and accommodation expenses are kept well below the accepted limits, as use will be made as much as possible of local support of the affiliates to find suitable locations; Travel expenses for 4 steering groups, one dissemination event, one evaluation seminar and one training seminar. Travel expenses will be reimbursed up to an average of 350 (the amount is based upon previous project experiences). 17

25 Costs for translation of information on newly added countries into 30 languages and translation of modified information into 23 languages (at average market prices); Interpretation at dissemination, evaluation and training events (at average market prices). The value of the project lies in the provision of a tools which is a simple and user friendly means to inform construction workers on wages and working conditions around Europe and to look and ask for support to relevant people if necessary in every country in Europe and in the native languages of the workers. The tasks have been precisely defined and given the considerable experience of the project partners in the field, the tasks can be performed within a limited amount of time. As the tasks are clearly defined, the project is not burdened by cost uncertainties. Considering the extensive nature of the target groups and possible impact of the project, translations costs are limited. Widespread dissemination of the results is ensured through both the project partners and the considerable networks involved. These factors guarantee value for money. 2. Describe and explain the breakdown of costs according to the participation of each partner to the action. The breakdown of costs between the project partners has been kept simple. As the project applicant is also the umbrella organisation of the co-applicants and as there is an excellent cooperation between the organisations involved, it was seen as beneficial to the project and more simple to keep the overall financial aspect mainly in the hands of the project applicant. However as to the activities foreseen, the co-applicants will have the same tasks and will contribute with their expertise and contacts to the successful implementation of the project. The work will be coordinated by the EFBWW project manager, who will involve the co-applicants in every step of the project, request specific support if needed (especially in the organizations of events and steering group meetings) and the decisions will be taken together. The co-applicant organizations will also be part of the steering group of the project. 18 *8k

Describe and explain the proportion between staff costs and other costs of the action in your proposal The staff costs are reduced to the minimum for the activities foreseen (actual meeting days and some days for preparation, evaluation and support) as the consortium will also draw upon the availability, expertise and personnel resources of the affiliated organisations. 4. 28 The project manager will revise, if necessary, the existing fiche to collect the information which will be uploaded on the website as per the revision of the Posting of Workers Directive3. The fiche will be distributed to the new countries with explanatory notes and, if applicable and necessary, to already mapped countries for an update. Month 2: 4. First steering group meeting: The first meeting will take place in Brussels. The main tasks will be to: - Discuss a strategy to include the new countries in the ECMIN network; - build stock of the results of the previous project based on the feedback received and the use of the website; - discuss on the methodology to implement the different phases of the project - discuss about the proposals of the IT experts to improve and upgrade the existing website and APP: a) translation system: improvement of the automatic translation of the changes in one country/languages in all the other languages and increase of the words available in the dictionary; b) communication platform: creation of a system to analyse website traffic, receive tips on how to use the content management system, be reminded to update information and to communicate among the members to exchange information with the aim of supporting workers looking for help;; c) search engine optimization: some analysis will have to be made and actions taken in order to make sure that the website will be found in the first results of search engines when typing key words, such as wages or construction, etc., in all the languages; d) analysis of use and functionality of the APP and possible improvements. Months 3-8: 5. Update of the already existing information The project manager, together with the network countries, will update if necessary the already existing information on the website. Particular attention will be reserved to updating the information provided via long sentences (text, not data which can be updated directly by the partner). The IT experts will receive the updated information by the project manager and will upload it on the website. 6. Collection of data from the new countries and upload on the website The project manager will revise the information collected via the country fiches to make sure that it is essential and standardized to the other countries. The IT experts will create new pages for the additional countries and will add the information collected via the fiche as soon as it is available. 7. Campaign expert: preparation of design and structure of the promotional campaign The campaign expert will finalize the proposal for the promotional campaign and s/he will propose and design promotional material. 8. IT experts: upgrade of the translation system and APP 3 If applicable, depending on the outcome of the Revision of the Posting of Workers Directive; in case the proposed Directive is not adapted the project will focus on changes as mentioned in the EUG case 396/13 Sähköalojen ammattiliitto. 21 sa

29 The IT experts will establish an easier mechanism for the automatic translation in all the languages of the information which will be uploaded by the partners in the different countries. Additional terms in the dictionary (translated in all the languages) will be included to allow more possibilities of updating text and not only data. Changes in the translation system will have consequences on the functioning of the APP as well and therefore an update of the APP system will also be necessary. Months 9-10: 9. Second steering group meeting: The second steering group meeting will be held in Serbia. The main tasks will be to: - approve the promotional campaign and plan its implementation - Plan the dissemination event where networks members, labour inspectors, authorities, civil society and members of other networks dealing with posted workers (e.g. REDER, EURODETACHMENT, FAIRE MOBILITÄT, etc.) will be invited to share information and plan for cooperation - assess the improvements of the translation system 10. Beginning of the promotional campaign The project manager will inform the network partners about the promotional campaign and ask for commitment. Promotional gadgets/leaflets will also be prepared and distributed to partners. One meeting is foreseen and the participation of the members to the two main events of this phase (dissemination and evaluation meeting). The dissemination and promotional campaign will be carried out in these months and a dissemination event will be organized. The co-applicant organizations will support the project manager in the organization of this meeting. The evaluation meeting will be organized with the support of the steering group members. - Proposed activities In addition to what is described below, the members oft íe network and the project manager will make sure to liaise with and participate in events of other netwo rks and promote the work of the ECMIN project (e.g. Reder, Faire mobiliät, Eurodetachement, etc.). This will ease communication among the partners and reaction in case of need of a worker. At the same time they will work on a search engine optimization system to make sure that the website will be found in the first results of search engines when typing key words, such as wages or construction, etc., in all the languages. 14. Continuation of the promotional campaign The network partner will continue with the implementation of the promotional campaign as designed by the campaign expert. Month 13: 15. Dissemination event The two-day event will take place in France. There will be up to 70 participants from the ECMIN network (trade unions and labour inspectors), public authorities, members of civil society and of existing networks (Reder, Eurodetachement, Faire Mobilität, etc). 32 18. Third Steering Group meeting ( month 15) The third steering group meeting will take place in Norway. The main tasks will be to: - assess the dissemination event - take stock of the promotional campaign - assess the newly designed communication system - organize the evaluation meeting Months 16-17: 19. Preparation of the evaluation meeting 20. Adaptation of the website as per feedback received The IT experts will make the necessary changes to the website as per feedback received by network members. Month 18: 21. Evaluation meeting This one-day meeting will be organized in Brussels. There will be 40 participants from the ECMIN network attending the meeting. Translation will be provided in 4 languages.
