1 Los Angeles County One Gateway Plaza 213; Metropolitan Transportation Authority Los Angeles, CA m ee Metro 53., OPERATIONS COMMITTEE OCTOBER 20,201 1 SUBJECT: LIGHT RAIL VEHICLE PARTS ACTION: AWARD CONTRACT FOR CENTER TRUCK BRAKE DISCS RECOMMENDATION Authorize the Chief Executive Officer to award a 36-month, firm fixed price contract under Bid Number to Wabtec Passenger Transit, the lowest responsive and responsible bidder for the center truck brake discs for the P2000 Siemens vehicles for an amount not to exceed $1,322,352, inclusive of a one year option. This procurement is for the acquisition of center truck brake discs replacements which are required for the safe operation of the Light Rail vehicles. DISCUSSION The center truck brake discs under this procurement are an integral part of the P2000 Siemens rail vehicle brake system and are changed out periodically in accordance with the manufacturer's preventive maintenance requirements. The contract to be awarded is a "requirements type" agreement in which we commit to order only from the awardee, up to the specified quantity for a specific duration of time, but there is no obligation or commitment for us to order any or all of the center truck brake discs that may be anticipated. The bid quantities are estimates only, with deliveries to be ordered and released as required. FINANCIAL IMPACT The funding of $430,704 for this product is included in the FYI2 budget under Cost Center 3943, Metro Green Line Maintenance under Project

2 Since this is a multi-year contract, the cost center manager and Chief Operations Officer will be accountable for budgeting the cost in future fiscal years including any option exercised. lm~act to Budget The FYI2 source of funds for this procurement is from Enterprise Funds such as fares, sales taxes and TDA4. The funds are eligible to be used for bus and rail operations or bus and rail capital projects. No other sources of funds were considered for this procurement because these are the designated funds available for bus and rail operations ALTERNATIVES CONSIDERED The alternative is to not award the contract and to instead procure the center truck brake discs on an as-needed basis at a higher cost. This approach is not recommended since it does not provide a commitment from the supplier to ensure availability and price stability. Procurement Background The solicitation for the Center Truck Brake Discs for the P2000 Siemens Rail Vehicle was advertised and issued as a formal sealed bid. Basis of award is to the lowest responsive, responsible bidder. B. Backaround on Recommended Contractor The responsive and responsible low bidder, Wabtec Passenger Transit, is located in Duncan, SC, and has been a supplier of brake subsystems and related products for locomotives, freight cars and passenger transit vehicles for 142 years. Wabtec has provided similar brake discs to other transit agencies, including New York City Transit, Utah Transit Authority, Dallas Area Rapid Transit (DART), Altamont Commuter Express (ACE) and others. In the past Wabtec has provided satisfactory service and products to Metro. Center Trudc Brake Disc

5 C. Evaluation of ProposalslBids Evaluation of the two bids received was based on compliance with our general terms and conditions and the technical specifications. CostlPrice Analysis Explanation of Variances The recommended bid price of $1,322,352 has been determined to be fair and reasonable based upon adequate price competition and selection of the lowest responsive and responsible bidder. Calculated price savings will be $214,228 based on the difference between historical price and the bid price. E. Small Business Participation The Diversity and Economic Opportunity Department recommended a 5% Disadvantaged Business Enterprise Anticipated Levels of Participation (DALP) for this procurement. The recommended awardee, Wabtec Passenger Transit, did not list any DBE subcontractor nor commit to any DBE participation. However, staff is working with Wabtec to utilize a DBE to transport the brake discs from their manufacturing facility in South Carolina.
