14 General Information 1. Terms Terms are 50% deposit due upon order, 40% due prior to shipping, and the remaining 10% due net 30 days of installation, on accounts with approved credit. All applicable taxes are extra. Overdue accounts will be charged interest at 2% per month (% annually) or the maximum legal rate. All prices are subject to change without prior notice. ORDERING INFORMATION 1. Sales Policy Co by dtank has the right to refuse any sales order. Possession of this price list does not constitute authority to sell products contained herein. All orders subject to approval by Co by dtank and cannot be changed or cancelled without Co by dtank s approval. 2. Ordering Co by dtank accepts phone or orders as a service to meet customer needs. A confirming written order clearly marked CONFIRMATION ONLY, DO NOT DUPLICATE must immediately support all phone orders. If confirming order is not received within 10 working days, Co by dtank s acknowledgement to the customer will be considered correct. Duplicate orders not marked CONFIRMATION ONLY, DO NOT DUPLICATE, are the responsibility of the customer. 3. Acknowledgements Orders will be manufactured and invoiced based upon the information on the acknowledgement. If there is a discrepancy, Co by dtank must be notified immediately or product will ship as acknowledged. Co by dtank accepts orders per terms in the acknowledgement. All acknowledgments contain an estimated shipping date. Your orders may actually ship earlier than the estimated shipping date, depending on production output at that time. If for some reason you do not want the merchandise earlier than a specified date, please specify Do Not Ship For Arrival Before, on your purchase order. All prices are subject to change without 14 written prior notice. All orders are accepted subject to prices prevailing at the time of shipment. Shipping weights given in pounds are approximate. 4. Title of Merchandise Buyer acknowledges that once Co by dtank delivers the goods to the carrier, title to the goods and risk of loss will pass to the buyer. If the carrier while in transit damages the goods, the buyer has the sole obligation of seeking any appropriate recourse against the carrier. 5. Re-Delivery of Merchandise When re-delivery of merchandise is required because customer is not ready to accept merchandise and no notification is given to the factory at least two weeks prior to the schedule ship date, the actual costs for freight, restocking, and re-handling, plus 10% of the order value, will be billed to the customer. 6. Shipment Damage Claims All merchandise is packed to comply with industry-accepted standards. To ensure satisfaction with goods received, Co by dtank recommends: A; Consignee to visually inspect the exterior of all packaging, B; Note any damage on the bill of lading, C; if exterior or packaging damage is found, the consignee must send a written intent to claim to delivering carrier within 5 days, D; Request inspection by the delivering carrier of the merchandise and retain packaging at point of receipt (if practical), E; To file a claim, the following documents are required: I) Copy of the billing of lading. II) Copy of the freight invoice, if available. III) Copy of the inspection report. IV) Copy of the invoice showing the the cost of the product lost or damaged. V Cover letter stating documents ) attached, referring to carrier bill of lading number so that the carrier can identify the shipment, and the specific amount that is being claimed for. We recommend that you request a written confirmation of receipt for your claim for the carrier, in your cover letter. This should be received within 5 days after the claim has been sent. 7. Unit Sizes Suggested list prices are for standard product sizes only. unit size pricing is available from Co by dtank s representative. Contact or info@coartbydtank.com for pricing. Standard list price terms apply to custom unit sizes. Special product pricing is quoted at net and is not subject to additional discounting. Quote may change if quantity and/or specification change. Extended lead times may apply. art or art provided by customer will be provided a PDF color proof for sign off. Upon customer s request, a physical printed x sample will be provided at a net charge of $50 per image. Please allow up to a 7 business day turnaround for samples. 8. Order Change and/or Cancellation Orders may not be cancelled or changed by the purchased without the consent of Co by dtank. A cancellation or restocking charge of up to the total value of the order may be applicable on orders cancelled or changed. 9. Returns Co by dtank will not permit returns due to each product being custom built.

Unopened Shipment Damage Claims Neither Co by dtank nor the carrier will be responsible for concealed damage claims if shipments are left unopened. Notification of concealed damages must be made to the delivering carrier within 5 days after delivery of merchandise. 3. Lost Shipments Co by dtank issues an invoice to the buyer on date of shipment. If merchandise is not received within 30 days, notify Co by dtank to obtain proof of shipment. Neither Co by dtank nor the carrier will assume obligation for lost or damaged shipment claims after 2 months beyond the shipping date. RIGHTS AND WARRANTIES 1. Specifications Specifications are subject to change without notice. Co by dtank reserves the right to modify and/or improve all products, which we offer for sale. Co by dtank warrants its products to be free from defects in material or workmanship, given normal use and care, for a period of 1 year from the manufacturing date as indicated on the product, subject to the limitations set forth: During this warranty period, Co by dtank will, at its option, repair or replace, free of charge to the original owner, any part or assembly found to be defective. This warranty is nontransferable and terminates when a third party becomes entitled to use the product during the warranty period. All claims must include the name, address, and telephone number of the purchase, unit model number, a general description of the product, a description of the defect(s) and documentation supporting the date of initial delivery. Co by dtank will contact the customer to arrange for the repair or replacement of the defective product covered by this warrant at Co by dtank s expense. This warranty does not apply to damages resulting from accidents, alterations to the product other than by Co by dtank or a Co by dtank authorized person, installation by other than Co by dtank or a Co by dtank person, or the product not being used in accordance with Co by dtank s installation and/or application guidelines. Upon the occurrence of any one or more of these events, this warranty becomes void. Because of natural variation over which Co by dtank has no control, the warranty does not extend to changes of color due to UV exposure. Co by dtank shall not be liable for consequential or incidental damages. The terms of this warranty provide the exclusive remedy available to any customer against Co by dtank for any defect in material or workmanship. No person, firm or corporation is authorized to assume for Co by dtank, any other liability in connection with Co by dtank s products. Except as stated above, Co by dtank makes no express or implied warranty as to any product and, in particular, makes no warranty of merchantability or fitness, for any particular purpose. ORDER CANCELLATION Cancellation requests must be ed at info@coartbydtank.com. A grace period of hours (2 working days) from the date of the Order Acknowledgement will apply at no charge. After the -hour grace period, a cancellation charge to cover costs incurred to be applied with a minimum of at least 10% of the net amount of the order.
