6 TERMS & CONDITIONS OF CONTRACT 1) The Earnest Money Deposit and tender fee should be paid through any of the Following online modes of e-payment as mentioned in e-procurement portal. i) Credit Card. ii) Direct Debit (ICICI Bank Account holder) iii) National Electronic Fund Transfer(NEFT)/Real Time Gross Settlement (RTGS). iv) Over-The_counter (OTC) remittance at ICICI Bank designated Branches. 2) GENERAL TERMS & CONDITIONS 1. The suppliers should provide detailed foundation and structural drawing of chimney soon after confirmation of order. 2. The suppliers should guide / supervise time to time, the progress of basement and other construction work undertaken by us for the installation of chimney. 3. The suppliers should manufacture & supply all structural steel and concrete components for the chimney. 4. The chimney will be constructed, fabricated, erected and painted by our associates only. 3) SCOPE OF BUYER 1. The foundation for the chimney will be constructed by us for which detailed foundation drawing has to be furnished by the successful bidder. 2. The supplier must supply base plate & anchor bolts required for basement & foundation for chimney. 3. The supplier should have consultation regarding space for chimney installation with DMU officials. 4. DMU will provide all co operations in storage of all precast materials brought for erection of chimney. 5. DMU will provide free power & water however tools & tackles, crane allied equipments consumables welding machine have to be brought by supplier. 4) PAYMENT TERMS 1. Payment will be made by means of Cheque 2. Payment : 40% along with Purchase order against bank guarantee. 50% after supply of materials. 10% after successful erection & commissioning against bank guarantee.

7 5) DISPATCH & DELIVERY OF MATERIALS 1. Materials has to be dispatched within 4 weeks from the date on receipt of advance payment. 2. It is the sole responsibility of supplier to maintain all documents of chimney items until the materials reach site. 3. All forms of transit insurance loading and unloading expenses shall be borne by the supplier. 6) ERECTION AND COMMISSIONING Erection and commissioning has to be commissioned within a week after the delivery of materials. 7) PROJECT DELAY & PENALTY Delays due to ordinary storm or inclement weather or other weather conditions or daemonic disasters which are may be reasonably expected by both ends. 8) WARRANTY 1. The supplier should provide 5 year warranty on the structure. The warranty includes the reliability of structures (steel and concrete) and its flawless operations for a period of 5 years from the date of commissioning. 2. It is the sole responsibility of supplier for any damages during erection & the same should be rectified by the supplier. 3. We will under take painting of chimney structure once in every three years. 9) JURISDICTION All disputes arising out of this work is subject to jurisdiction Law of Court at Dharwad city only. 10) Bidder E.M.D. amount will be released after satisfactory completion of work immediately. 11) D.M.U. has right to cancel the work order if the supplier found poor in progression of work & slow in supply schedules 12)The supplier shall pay compensation to workman working under him for any injury cause during the execution of work as Workmanship Compensation Act inforce; failing which the amount will be deducted from his bill & paid to the injured workmen. 13) As per rules statutory deductions will be made from the supplier bill. 14)The Managing Director Dharwad Milk Union Ltd., Dharwad reserves the Right to cancel the work order without assigning any reason.
