To permit the construction of a Home Depot store and retail building, as follows: 1. To permit a building height of 11.3 metres. 2. To permit a minimum of 3.5 parking spaces / 100m2 of gross floor area for all uses on the subject lands. 3. To permit loading and unloading between a building and Hwy To permit outdoor display and sales areas as shown on the attached sketch. 1. A maximum building height of 11.0 metres is permitted. 2. The Planning Department advises the applicant that it is standard procedure for this Department to request a deferral of a Committee of Adjustment Application until such time that this Department and Council have reviewed and approved the related Site Development Application. This is to ensure that an appropriate site-layout is confirmed and approved by Council, and that should additional variances be required to implement the final approved site plan that these variances are considered in the Variance Application. Comments: Variances No. 1, 3 and 4 respectively, do not appear to have any impact on the site servicing and grading plans with respect to related Development Application DA located on the subject lands. Note Development Application DA has not yet been issued site plan approval from the Development/Transportation Engineering Department. With respect to Variance No. 2, a Traffic Impact Study (TIS) prepared by BA Group, indicates an overall parking supply of 411 spaces or 3.67 spaces per 100m 2 was recently approved (380 spaces for Home Depot and 31 for retail building A ) for a total GFA of 11,212m 2. The BA Group report also estimates a parking supply of 365 parking spaces (3.25 spaces per 100m 2 ) on the basis of a parking survey conducted at various, similar types of facilities. As discussed with staff from the Transportation Planning Division, the Development/Transportation Engineering Department are satisfied that a rate of 3.5 spaces per 100m 2 will be more suitable, as it meets the parking demand of 95th percentile of the 30 surveyed locations as per the parking data provided in the TIS and it also meets the IBI Parking Study minimum recommendation rate of 3.5 spaces per 100m 2. Therefore on the basis of the above noted comments, the proposed parking supply of 3.5 spaces per 100m 2 is found to be satisfactory. Accordingly, the Development Transportation/Engineering Department has no further comments or objection to Minor Variance Application A170/09. Condition(s): none.

We have reviewed the proposed Variance Application and have no objections to its approval, subject to the following comments (attached below). We have reviewed the proposed Variance Application and have the following concerns (attached below). PowerStream has received and reviewed the proposed Variance Application. This review, however, does not imply any approval of the project or plan. All proposed billboards, signs, and other structures associated with the project or plan must maintain minimum clearances to the existing overhead or underground electrical distribution system as specified by the applicable standards, codes and acts referenced. In the event that construction commences, and the clearance between any component of the work/structure and the adjacent existing overhead and underground electrical distribution system violates the Occupational Health and Safety Act, the customer will be responsible for 100% of the costs associated with PowerStream making the work area safe. All construction work will be required to stop until the safe limits of approach can be established. In the event construction is completed, and the clearance between the constructed structure and the adjacent existing overhead and underground electrical distribution system violates the any of applicable standards, acts or codes referenced, the customer will be responsible for 100% of PowerStream s cost for any relocation work. The Ministry offers the following comments: The proponent is to obtain a building and land use permit and pay applicable fees from this Ministry prior to any construction or site servicing is to take place. No essential parking/services and/or amenities are permitted within the 14m setback requirement from the Ministry. The Ministry has no comments pertaining to the height of the proposed development.
