2 Kelly Kolb Vice President, Global Supply Chain Policy RILA Kelly Kolb joined the Retail Industry Leaders Association (RILA) as Vice President of Global Supply Chain Policy in March She currently manages RILA s supply chain committees and advocacy which includes supply chain security, transportation infrastructure, modal efficiency, energy, and customs and border issues. Ms. Kolb was most recently the Acting Assistant Secretary for Government Affairs at the U.S. Department of Transportation, a position she held after serving as the Deputy Assistant Secretary within the same office. In this position, she served as the secretary s primary advisor for all intergovernmental matters and was responsible for developing and advancing the department s governmental affairs strategy. Before joining the Department of Transportation in 2005, Ms. Kolb served as a Senate staffer, most recently for Senator George Allen (R-VA). 2

4 Rick Gabrielson Director, Import Transportation Target Corporation Rick Gabrielson is currently the Director of International Transportation for Target Corporation. His responsibilities include the management and movement of all imported product for Target Stores, Target.com and Target Commercial Interiors. He is responsible for the negotiation and management of all overseas consolidation operations, all ocean carrier contracts and relationships, port operations, and deconsolidation operations with 3 rd party providers. Rick is a founding member of the Waterfront Coalition and currently serves as President. He also serves as President of the Coalition for Responsible Transportation and is the Vice Chairman of the Marine Transportation System Advisory Council (MTSNAC). Rick has B.A. from Concordia University 4

5 James Jack Executive Director Coalition for Responsible Transportation (CRT) James Jack is the Executive Director of the Coalition for Responsible Transportation. In this role, he oversees the dayto-day operations of CRT and the development and implementation of CRT s strategic plans and goals. James also owns a California-based lobbying and consulting firm, Jack Advocacy Group, which specializes in legislative advocacy on behalf of corporations and trade associations. James has represented a number of national retailers in Sacramento on a wide variety of public policy issues including goods movement and international trade. James previously served as a chief of staff in the California State Senate and also worked under former California Governor Pete Wilson. James has a Masters degree in Public Administration from the University of Southern California and a B.S. in Finance from San Diego State University. 5

7 Sustainable Practices at Ports Take Center Stage In recent years, the retail industry has recognized the important role it must play in facilitating sustainable environmental practices across the supply chain This has been especially true in port communities around the nation, where environmental impacts created by goods movement activities have led to substantial industry environmental stewardship efforts 7

8 Ports Look to Clean Truck Programs In 2007, LA and Long Beach became the first ports in the country to draft a Clean Truck Program to address emissions issues related to maritime trade LA/LB adopted the nation s most stringent regulations for port trucking activity Registration of all port trucks through a concession program Dirty truck ban Employee driver mandate Port administered truck replacement program funded through container fees paid by BCOs. 8

9 New Opportunities for Industry Engagement The Clean Truck Programs proposed in Southern California created an opportunity for the retail industry and its service providers to partner with the ports in emission reductions Private sector solutions to port air quality become critical to meeting environmental needs in an efficient and cost effective manner The precedent set in Southern California would have a ripple effect in ports across the country 9

10 Industry Responds and CRT Emerges In 2007, a small group of BCOs, LMCs and Ocean Carriers create CRT, an industry organization dedicated to environmental stewardship within port activities Aims to enhance the profile of the shipping community by demonstrating our commitment to the environment Advocates a pro-active compliance attitude on air quality issues Develops a collaborative dialogue to facilitate the inclusion of industry perspective in port-related legislative and regulatory processes 10

12 CRT Principles CRT has developed a set of principles for air quality improvement at our nation s ports that focuses on four main goals: 1. Support hard targets for truck retirement to meet air quality goals 2. Provide commitments from BCOs, Ocean Carriers, and LMCs to privately fund the replacement of older, more polluting trucks 3. Work with ports to identify best practices and financing options to support their truck replacement goals 4. Help ports adopt clean truck programs that preserve their competitive position in the marketplace 12

13 The CRT Clean Truck Model SHIPPER Works With LMC to establish rates for transition to green fleet. TRUCKER Uses financing to retire high-polluting equipment. Moves for shipper now made with clean truck. LMC Works with Trucker to help secure financing and/or down payment assistance. 13

16 Proven Success in Southern California CRT s efforts are right on point, and CRT s members are committed to environmental programs. Port of Long Beach Harbor Commission President Jim Hankla Since the launch of the Clean Truck Program, more than 6,000 clean trucks have come into drayage service in Southern California 8,000 dirty trucks have been permanently retired 90 % of all trucks now meet the strict U.S. EPA 2007 emissions standards, for a pollution reduction of nearly 80 percent since the program began in These trucks have been privately financed and voluntarily deployed 2 years ahead of the port s deadlines 16

18 Regional Issue Takes on National Significance Port of Los Angeles is sued by the American Trucking Association over the employee mandate provision of its clean truck program ATA wins injunction against LA employee mandate in U.S. 9 th Circuit Court of Appeals, ruling the Port is preempted by federal law Port of LA and organized labor begin lobbying effort in Congress to eliminate federal preemption of local port truck regulations 18

19 New Opportunity for Industry to Engage at Federal Level As Congress now revisits federal law as it relates to goods movement activities, the shipping industry once again has a critical opportunity to help shape the direction of federal port policy. CRT is taking pro-active approach to the development of a national goods movement emissions policy based on the CRT model that allows industry to meet environmental needs in an efficient and cost effective manner. 19

20 CRT Initiatives CRT has formed a the U.S. EPA to develop a national SmartWay certification and rating system for port drayage activities Will provide a national framework to measure emissions levels of port trucking activities, set benchmarks for air quality improvement at our nation s ports, and certify emission reductions that are achieved through the deployment of clean port trucks Continue to increase visibility and enhance the profile of the shipping community by engaging with and educating policy makers Demonstrate industry commitment to the environment by publicizing the environmental accomplishments of our member companies to elected officials, the media, and the public Provide our member companies with the tools and resources they need to help transition to low-emissions, clean equipment 20
