1 Port of Vejle Tender for supply of a split hopper barge Tender conditions 1. Introduction 1.1 Purpose The port of Vejle have decided to invite tenders for the supply of a split hopper barge. The barge will be used together with a separate barge with a crane/excavator mounted. The barge will mainly be used for transportation of sild that is dredged from the harbor floor and shipping lane. 1.2 Scope The port of Vejle asks for tenders covering all of the following items: Supply of a split hopper barge as defined in the tender documents. Documentation of barge class-certification. 1.3 The Port of Vejle The port of Vejle is situated at the end of the Vejle Fjord, centrally located on the eastern shore of Jutland. The port supports Danish and foreign clientele. The port administration is located at Sydkajen 16, 7100 Vejle, Jutland, Denmark. 2. Tender Tenderers must ensure that they have received all the tender documents as listed in the tender material. If the tender includes reservations regarding the specifications in the tender material, such reservations must be stated clearly and unambiguously in the text of the actual tender in order to be valid, and reservations will be capitalized. Technical deviations of any kind, including deviations in the scope of the conditions specified in the tender documents, must be clearly and unambiguously indicated in the tender. Otherwise, the deviation cannot be invoked by the tenderer. The tender must be based on the existing conditions and must be submitted in electronic form via . The tender must include descriptions and drawings necessary to give the Port of Vejle a detailed understanding of the offered barge. The tender must include a general arrangement plan. Tenderers a hereby advised, that discrepancies and omissions, may lead to the tender being noncompliant. Attention must be focused on the reserved right to award the contract, without conducting negotiations. The tenders will not be opened in the presence of the tenderers. The Port of Vejle reserves the right to cancel the invitation to tender free of charge, including abandonment or postponement of the project and/or tender process. The Port of Vejle will not pay any of the tenderers costs regarding preparation of the tender. 1/7

2 2.1 Tender documents The following is to be included in the tender, as a minimum: 1. Offer letter stating Price 1 and Price 2, and that the offer is given in full compliance of the tender material including any addenda and Q/A. 2. Description of the offer in relation to the criteria Technical quality of barge, including, but not limited to: - Documentation of Class certification from a well-known register, such as e.g. Lloyds register, Bureau Veritas or DNVGL. 3. Description of the offer in relation to the criteria Technical quality of technical systems 4. Description of the offer in relation to the criteria Time schedule Everywhere in the tender, the International System of Units (SI) should be used with the following exceptions: Temperatures are to be stated in C (degrees Celsius) Pressure is to be given in bar Electrical energy is to be stated in kwh Number of revolutions is to be denoted in RPM Vibrations are to be stated in mm/s rms or µm pp. All indications of pressure are to be understood as absolute values unless expressly stated otherwise. 2.2 Evaluation Based on evaluation, the most economically advantageous tender will be identified on the basis of the best price-quality ratio, as follows: Deviations and/or reservations in relation to the tender documents will be priced if possible in accordance with EU procurement regulations. Subcriteria: 1) Tender price (50%) 2) Technical quality of barge (20%) 3) Technical quality of technical systems (20%) 4) Time schedule (10%) 1. Tender price (50%) Supplier must, on the basis of the tender documents, give the tender as follows: Price 1 - Delivery at Port of Vejle and/or Price 2 - Delivery at supplier site including cost of 35 EUR/NM (nautical miles) for the Port of Vejle to pick up the barge. 2/7

3 The lowest price will be awarded the highest score (10) as follows: Primary model: Score = 10 (10/25%) * (price lowest price) / lowest price. Secondary model: If the difference between the lowest price and the highest price received, is greater than 25%, the following model be applied instead: Score = 10 (10/50%) * (price lowest price) / lowest price. Tertiary model: If the difference between the lowest price and the highest price received, is greater than 50%, the following model be applied instead: Score = 10 (10/150%) * (price lowest price) / lowest price. Subcriteria 2)-4) are evaluated on a scale from 0-10 points as follows: Point Contents 10 Very convincing fulfillment of the requirements of the tender documents 8 Very good fulfillment of the requirements in the tender documents. Some requirements very convincingly fulfilled 6 Good fulfillment of the requirements of the tender documents 4 Acceptable fulfillment of the requirements of the tender documents. Some requirements well fulfilled. 2 Less acceptable fulfillment of the requirements of the tender documents 0 Not acceptable compliance with the specifications in the tender documents, but conditional. All full marks can be used: 0,1,2,3,4,5,6,7,8,9 and Technical quality of barge (20%) Suppliers description of the barge hull and construction (90%) Suppliers description of safety equipment (10%) It will be assessed positively: -, that the barge is constructed for heavy duty use and long lasting performance for use in transportation of sild with a density of appx. 2,67. 3/7

4 -, that the barge is equipped with all necessary safety equipment for sailing in Denmark (see paragraph 3, section 3.1 for further details) in contrast to the suppliers mounting of the necessary equipment before delivery. The tender will, in regard to this criteria, be evaluated (scored) in accordance with the above mentioned scale from Technical quality of technical systems (20%) Suppliers description of the hydraulics system, diesel engine and related connected technical system such as valves, tubing, pistons etc. It will be positively assessed: -, that the diesel engine is of a well-known, high quality manufacturer, that is generally known in the market and has a well-known ability to supply spare parts -, that the hydraulics system is in good working order and maintenance The tender will, in regard to this subcriteria, be evaluated (scored) in accordance with the above mentioned scale from Time schedule (10%) Suppliers time schedule for 1) Delivery at Port of Vejle no later than September and/or 2) Delivery at supplier site including the time it takes the Port of Vejle to sail to the suppliers site and back to Vejle, under the condition, that arrival in Vejle is no later than September The Port of Vejle sails at 8 NM/hour to the suppliers location and 7 NM/hour back to Vejle. It will be positively assessed the faster the delivery. It will be positively assessed, that fastest delivery is in the Port of Vejle. The tender will, in regard to this criterion, be evaluated (scored) in accordance with the above mentioned scale from Tender prices All prices are to be stated in EUR. 4/7

5 All prices must be fixed and include travel time, travel cost, daily allowances, transport, PPE (Personal Protective Equipment) and all other costs etc. The tendered prices must include all requirements and free delivery to the stated delivery location in the Port of Vejle, or at site of supplier including cost of pick-up as described in sub criteria 1. Prices above EUR excl. VAT will be deemed non-compliant. 2.4 Payment Payment is made according to contractual agreed schedule and when the full scope of supply has been accomplished, and all documentation has been received and approved by the Port of Vejle. All invoices with reference to the scope of supply must be sent to Port of Vejle, not later than one month after the full scope of supply has been accomplished, and all documentation has been received and approved by the Port of Vejle. Instalments, dates of payment are as follows: - 95% of contracted price, at delivery and primary acceptance of the delivery - 5% of contracted price, 12 months after acceptance of the delivery, at final acceptance. Terms of payment are current month + 15 days upon reception and acceptance of invoice. 2.5 Time Schedule Based on the main time schedules below, the supplier has to prepare a detailed time schedule for the delivery. The Port of Vejle must be informed immediately, in writing, if the supplier at any time finds any actual or expected deviations from the time schedule. If, during the project period, there is a need to change the main time schedule, the supplier shall actively cooperate with the Port of Vejle to organize the required changes to the time schedule in order to avoid delays. Scope of supply The supply includes all costs, only excluding the following: - Port calls in Port of Vejle 3.1 Technical scope Non-negotiable minimum requirements Barge complies with DR68 rules Load draught of max. 2,40 meters Class-certificate Length over all of maximum meters Breadth over all of maximum meters Negotiable requirements Barge must comply with these requirements: The barges must be designed, constructed and equipped in accordance with the provisions for a cargo or passenger ship of equivalent size and use where it is relevant to apply the relevant provisions. As a barge by definition is not equipped with propulsion machinery, propulsion machinery provisions are not applicable. The barge must be equipped with lanterns, audio signals, signal characters, etc. in accordance with international maritime regulations. The barge must be equipped with rescue equipment for a crew of two persons, placed on board in connection with the mooring of the barge, the establishment of a tow or similar. The barge must have a primary towing arrangement and a reserve towing arrangement of sufficient strength for the intended use. The reserve must be arranged so that it is always ready for use and so that a new towing arrangement can be established quickly., if the barge does not comply with these requirements, the offer letter must state which of the requirements are not met, so that the Port of Vejle can calculate a price for these requirements, which will then be added to Price 1 and 2 respectably. If Price 1 or 2 thereafter are above EUR, the offer will be non-compliant in respect of one or both of Price 1 and/or 2. Push construction constructed in a way, so that push-boat is not able to go in between the two ship halves during opening of the split barge. Safe area on deck to view the dumping process without moving parts. One man manual (no winch involved) operated mast with a height above deck of 5,5 meters Operation controls: 1 x radio controlled remote; 1 x on cable and 1 x on hydraulic valve in engine room. 7 Barge to be equipped with two towing brackets, including the spaces for the towing equipment in the bulwark forward. Summer load draught between 2.00 m- 2,40 meters Depth at side between 3.00 m 3.40 meters Hopper length incl. coaming between m meters Hopper size of appx m 3 Hopper hull appx. 16 mm thickness. Closed coaming and bulwark with a max height 5,50 meters. Bulwark and foot rail placed in an easy/safe position for stepping on to the barge Dirty oil tank, bigger than the content of the hydraulic system. Marpol connection on deck for emptying dirty oil tank. A fuel tank with a capacity of appx. 750 liters. Lifted bollards in walkways. Bollards with minimum SWL 20 tons. With SWL welded on all Bollards. Diesel engine of minimum 41 KW Freeing ports in the coaming with wing lock nut. Recognized classification of split hopper barge Non-negotiable requirements: Any discrepancy or omissions regarding these requirements will result in the offer being non-compliant. Negotiable requirements: These requirements can be met differently by the individual supplier. The specific offer details in regards to these requirements will be assessed under sub criteria 2) and 3). If the offer is identical to the stated requirements, it corresponds to the score 6: Good fulfillment of the requirements of the tender documents. 7/7
