5 RECALL PROGRAM Schreiber Foods Inc. has a well-developed and validated Recall Plan. Each manufacturing plant completes a minimum of two mock recall exercises a year with this practice verified through annual third party SQF Level 3 certification audits. Incident Notification and Recall Management: Schreiber Foods Inc. has Crisis Communication, Regulatory Inspection and Product Notification Policies and practices established that ensure that the Regulatory and Enterprise Quality and Food Safety functions are informed of all possible product concerns or Regulatory interest issues. These groups function to evaluate and escalate product concerns. The recall plan establishes Product Recovery Decisions and Action Groups that will administer recovery decisions, oversee recovery activities, and provide for proper investigation of potentially volatile or non-complying products. If a real product recovery is deemed necessary, the Action Group will locate all products, remove product from distribution, ensure the effectiveness of the recall is confirmed and communicate accurate information to the customer, regulatory agencies and media as necessary. Product Tracing: All products are labeled and specifically identified as unique stock number items with a defined visible lot code. Lot tracing for all ingredients and packaging is accomplished within 24 hours through an automated software based system. This provides complete one up and one down tracking from use to first point of finished product shipment. Customer Communication: Schreiber Foods Inc. will promptly notify customers of all recalls. For customer specific items, we will work jointly to address product concerns prior to a recall decision and provide notice of any Regulatory Agency interest which indicates a potential risk of the need for a recall, as appropriate. F.D.A: Schreiber Foods Inc. follows establish FDA regulations and guidance for risk analysis, 24 hour notification and recall management including utilizing the severity classifications for public announced recalls of Class 1, 2, 3.

That the article(s) comprising each shipment hereafter made by Schreiber to or on the order of, its parent and all subsidiaries, affiliates and divisions ( Customer or Distributor, as the case may be), which shipment is either made directly to Customer, directly to Distributor, or to Customer through Customer s authorized distributor, is hereby guaranteed, as of the date of transfer of title from Schreiber, to be, on such date, (a) not adulterated or misbranded within the meaning of the Federal Food, Drug, and Cosmetic Act (the FDCA ), as amended 21 U.S.C. 301 et seq., including the Food Additives Amendment of 1958; (b) not an article which may not, under the provisions of Section 404 or 505 of the FDCA, be introduced into interstate commerce; and (c) not adulterated or misbranded within the meaning of any state or municipal food and drug law, regulations, or ordinances, the adulteration and misbranding provisions of which are the same as those found in the FDCA. 2. In the event any article(s) referenced in Section 1, above, is shipped by or for Schreiber under a label or labeling furnished or designated by the Customer, the guarantee set forth in Section 1 shall not apply as against any misbranding resulting from the use of such label or labeling. In such event, Schreiber s responsibility shall be limited to that resulting from the failure of the article to conform to the ingredients and volume information contained on the label furnished or designated by the Customer. 3. Schreiber does not, with respect to Section 1, guarantee against any article(s) becoming adulterated or misbranded within the meaning of the FDCA after transfer of title from Schreiber by reason of any cause beyond Schreiber s control, or in any way by reason of the fault or negligence of Customer, Distributor, or Customer s authorized distributor, its affiliates or agents. 9 MSDS NOT REQUIRED In response to your request for a material safety data sheet, according to the OSHA Hazard Communication Standard (Right-to-Know), an MSDS is not required for cheese product(s). Products such as drugs, cosmetics, food, or alcoholic beverages, wood or wood products, and tobacco or tobacco products as defined in 29 CFR (b)(6), are exempt from the Hazard Communication Standard. Items that are considered articles as defined in 29 CFR are also exempt from this standard. The requested product is also not regulated as hazardous material for shipping in accordance with the U.S. Department of Transportation, and has no hazardous storage limitations as defined by the National Fire Protection Association.
