25 E-documents in road transport International Level In 2011, e-cmr Protocol adopted in addition to UN CMR Convention on consignment notes To provide legal framework to allow electronic consignment notes for international transport but Only 8 EU Member States + Switzerland ratified this international treaty, so it remains just theory Netherlands and Denmark adopted e-cmr, their logistics sector has developed tools (but only national) when will all MS (incl. Germany) do so?! Ship Train Compound Barge

26 E-documents in road transport A German case study In April 2013, German Commercial Code updated to allow electronic consignment notes, bills of lading and warehouse warrants But only permissible if authenticity and integrity are ensured (i.e. to ensure equivalence with paper) Ministry of Justice is entitled to regulate more in detail but has been dragging its feet Should private companies bare the risk of ending up in court without paper (as proof)?! 27 E-documents in road transport Proof of Delivery (PoD) No rules at national level (in Germany) or by CMR A receipt as PoD is common practice, it is legally possible to have it in electronic format Main uncertainty is its value during court proceedings (cf. paper proof, written signatures) Main obstacle is to ensure regular recordings and prevent manipulation by a file protection system No appropriate IT solutions yet on the market because of legal uncertainty? 28 E-documents in rail freight CIM (Uniform Rules concerning the Contract of International Carriage of Goods by Rail Appendix B to COTIF) rail freight document e-cim electronic consignment note Some countries accept CIM, yet not all Potential to have all rail freight documentation done electronically at least in Europe The operational side is willing, obstacles are from the legal and political (i.e. Member States) sides Ship Train Compound Barge

29 E-documents in rail freight Value of the e-cim: easy access to e-cim data e-cim cannot be lost or damaged saving time and costs in handling and storing CIM on paper Further potential values of e-cim: to be used in intermodal transport (multimodal development are ongoing) to be used by custom services (DG MOVE and DG TAXUD are in process of discussing) Ship Train Compound Barge

31 E-documents in rail freight Obstacles: not all EU Member States recognise e-cim (e.g. the Netherlands, Latvia, Sweden, Finland, etc.) electronic signatures on e-cim not recognised by insurance companies, courts, authorities, etc. e-cim is not accepted for transportation of dangerous goods (e.g. in Germany) ORFEUS project is an information system developed and operated by RAILDATA. It provides the electronic data exchange of e-cim data between the co-operating railway undertakings using its central database Ship Train Compound Barge

32 E-documents in rail freight What can be done by the Member States? e-cim needs to be accepted by all MS an electronic signature on e-cim needs to be recognised by national authorities (e.g. the insurance companies, courts, tax and audit authorities, etc.) to be recognised in transportation of dangerous goods Ship Train Compound Barge

33 E-documents in maritime transport The EU Reporting Formalities Directive (RFD) 2010/65/EU aims to simplify, harmonize, and rationalize administrative procedures and reporting requirements for maritime carriers calling at EU ports By 1 st June 2015 Member States should have implemented measures to allow the electronic submission and reception of reporting formalities concerning vessels, their crew and cargo via a national single window Ship Train Compound Barge

34 E-documents in maritime transport Deadline (mostly) missed current (paperbased) systems continue at port- or national level, sometimes in parallel with new system! No effort made by Member States to harmonize their national requirements Concept of a national single window has been seriously compromised (even differences in ports within the same Member State!) Each Member State is developing its own independent system Ship Train Compound Barge

35 E-documents in maritime transport the idea of an EU-wide single window is still far away! Associations such as World Shipping Council (WSC) and ECSA sent questionnaires so as to map the current patchwork while Member States and Commission discuss further in a specific working group (and the RFD itself might be reviewed in 2017) And what about an electronic seaway bill (which is also a tradable document)? Status of e-manifest? Ship Train Compound Barge

36 Digital Transport & Logistics Forum Set up in April 2015 by DG MOVE to assist the Commission in the exchange of electronic information in the field of transport and logistics 110 members, mandate up to 30 th June 2018, ECG accepted as full member of the plenary Challenges include the non-interoperability of standards; e-transport documents not recognised by the authorities and financial institutions; the lack of critical mass of stakeholders using data sharing systems, etc. Ship Train Compound Barge

37 Digital Transport & Logistics Forum ECG invited to contribute during 1 st plenary meeting on Recognition of e-transport documents (now a dedicated Working Group, headed by IRU) Problems in all modes of transport discussed by many stakeholders solutions lie clearly with the Member States! Conclusion of first Plenary: there is a clear need for a more robust legal framework as well as standardisation when it comes to digitalisation in the field of logistics when will this become reality?!
