1 TEXAS DEPARTMENT OF TRANSPORTATION GENERAL SERVICES DIVISION SPECIFICATION NO. * INSPECTION AND TESTING SERVICES OF CRANES PUBLICATION This specification is a product of the Texas Department of Transportation (TxDOT). It is the practice of TxDOT to support other entities by making this specification available through the National Institute of Governmental Purchasing (NIGP). This specification may not be sold for profit or monetary gain. If this specification is altered in any way, the header, and any and all references to TxDOT must be removed. TxDOT does not assume nor accept any liability when this specification is used in the procurement process by any other entity. 1. SCOPE: This solicitation is an Invitation for Bid (IFB); to provide inspection and testing services of TxDOT cranes statewide, including overhead and gantry cranes and mobile cranes (derrick, pneumatic tire and track crawler cranes). Each inspection and test shall be in full compliance with all manufacturer s recommendations and applicable American Society of Mechanical Engineers (ASME), American National Standards Institute (ANSI), and Occupational Safety and Health Administration (OSHA) standards, rules and regulations. NOTE: Maintenance and repair are not covered by this service. 2. CRANES TO BE INSPECTED: Type(s) and quantity of cranes to be inspected are listed in Attachment A Crane Descriptions and Locations. Due to the occasional transfer, purchase and surplus of cranes, the list of cranes shown is subject to change. TxDOT will delete cranes where appropriate. Upon mutual agreement with the vendor, TxDOT may add or substitute a similar crane. Any crane added or substituted will be subject to the bid price and terms and conditions as cranes of comparable size. 3. DEFINITION OF TERMS AND ACRONYMS 3.1. AM Account Manager 3.2. APPLICABLE LAWS AND STANDARDS: The vendor shall provide the specified service requirements in accordance with all federal, state and local applicable laws, standards and regulations necessary to perform the services, including, but not limited to the following: 4.1. ANSI/ASSE: A10.31 (Digger derrick without personal platforms) 4.2. ANSI/ASME: B30.10 (Hooks) 4.3. ASME: B30.2 (overhead and gantry cranes, top running bridge, single or multiple girder, top running trolley hoist) ASME: B30.5 (mobile and locomotive cranes) 4.5. ASTM E709: (Standard guide for magnetic particle testing) 4.6. ASTM E125-63: (Standard reference photos for magnetic particle indications) OSHA 29 CFR, Part (overhead, hoist and gantry cranes) 4.8. OSHA 29 CFR, Part (crawler locomotive and truck cranes), 4.9. OSHA 29 CFR, Part (platforms and skids) OSHA 29 CFR, Part (overhead and gantry cranes) OSHA 29 CFR, Part (crane proof test, every 4 yrs.) OSHA 29 CFR, Part (nondestructive examination) OSHA 29 CFR, Part (crane regulations, construction) 5. BACKGROUND: TxDOT is not mandated to follow OSHA standards, but has elected to follow these standards where possible. 6. RESPONDENT QUALIFICATIONS: The respondent shall: 6.1. Be a company engaged in the business of providing Inspecting and Testing all types of cranes (facility cranes, yard cranes and mobile cranes) for a minimum of five years within the last seven years. Recent start-up businesses do not meet the requirements of this solicitation. A start-up business is defined as a new company that has no previous operational history or expertise in the relevant business and is not affiliated with a company that has that history or expertise Be in good financial standing, current in payment of all taxes and fees such as state franchise fees. TxDOT reserves the right to request a copy of the respondent s audited or un-audited financial statement. When financial statements are requested, TxDOT will review the respondent's audited or un-audited financial statement to this solicitation in accordance with Texas Government Code, Title 10, Subtitle D, Section to evaluate the sufficiency of the respondent's financial resources and ability to perform the contract or provide the service required in the solicitation. TxDOT will be the sole judge in determining the sufficiency of the respondent's financial resources and ability to perform the contract or provide the service. Factors to be reviewed include: Balance sheets Net working capital Current asset ratio Liquidity ratio Auditor(s) notes Any notes to the financial statements. 2-12

3 7. REFERENCES: The respondent shall submit a minimum of three references to substantiate the qualifications and experience requirements for similar services completed within the past 24 months. References shall illustrate respondent s ability to provide the services outlined in the specification. References shall include name, point of contact, telephone number, and dates services were performed. The response may be disqualified if TxDOT is unable to verify qualification and experience requirements from the respondent s references. The response may be disqualified if TxDOT receives negative responses. TxDOT will be the sole judge of references (Ref. Schedule 1 Respondent References). 8. PERSONNEL QUALIFICATIONS: The respondent shall provide the following personnel ACCOUNT MANAGER: The respondent shall designate an AM with a minimum of two years experience within the last four years for similar services. This person shall be responsible for coordinating and scheduling all inspections with the TxDOT Contract Manager (CM) FIELD INSPECTORS: These inspectors shall be currently certified by Crane Institute of America, Inc. or by a crane inspection company that has been in business for a minimum of five years within the last seven years Lead Inspector: shall have a minimum of three years experience within the last five years. This inspector shall have the primary responsibility of the day-to-day operations of the service requirements specified in accordance with the purchase order. This lead may be a visual inspector or load test inspector or both Load Test Inspectors: shall have a minimum of three years experience within the last five years. Load Test Inspectors shall be certified according to the American Society for Nondestructive Testing (ASNT) guidelines (Ref. Para ) Visual Inspectors: shall have a minimum of two years experience within the last five years. Visual Inspectors shall only inspect cranes for which they are certified to inspect (Ref. Para ) All inspectors: shall hold all necessary current and valid licenses and certifications for city or state as required by all applicable ASME, ANSI, and OSHA standards, rules and regulations The AM and all Field Inspector(s) shall be English speaking and communicate effectively both in writing and orally. 9. VENDOR REQUIREMENTS: Conduct inspections and testing at TxDOT district s main facility and maintenance sections within the district, as directed. The vendor shall: 9.1. Adhere to the TxDOT Terms and Conditions identified on the solicitation Certify that all testing will be in full compliance with all applicable ASME and OSHA standards, rules and regulations. The vendor shall furnish inspections and testing to meet requirements of the specified services throughout the term of the purchase order Provide test equipment and other required equipment for inspection and testing cranes. All equipment shall be protected from the elements and available for use at any hour Certify in your field and annual reports (Ref. Paras. 12. and 13.) that all testing is in full compliance with all applicable ASME, ANSI, and OSHA standards, rules and regulations and manufacturer s recommendations shall be furnished to TxDOT upon completion of the testing. Inspection and testing procedures and reporting shall meet all requirements Ensure that all personnel have the required skills and knowledge to effectively and efficiently utilize all testing equipment Have access to the Internet, established electronic mail and other required equipment to perform the requirements of this specification. 3-12

4 9.7. Provide all lead inspectors with mobile phones, pagers or any other required equipment necessary to communicate with the CM at no additional cost to TxDOT Have equipment specifically designed for the inspection and testing of facility cranes (overhead & gantry cranes) and mobile cranes (derrick, pneumatic tire and track cranes) Inspect and test in accordance with the crane manufacturer s recommendation and the most current OSHA and ASME standards applicable to the crane being inspected and tested Hire and train additional Field Inspector(s) as required at no additional cost to TxDOT. 10. SERVICE REQUIREMENTS The vendor shall: Provide an annual monthly work schedule for inspection and testing cranes. This schedule should describe the number of staff proposed and their certification(s) for this service. Note if subcontractors will be used for this service. See Attachment A TxDOT Crane Description and Locations, for the monthly inspection dates Begin work on this contract within 10 working days after Post Award meeting or on an agreed upon date between the CM and the vendor Inspect crane within the same month of the previous annual crane inspection. See Attachment A TxDOT Crane Description and Locations for last crane inspection date. Any deviation from this time frame shall be approved in advance by the CM Contact the TxDOT designated district representative (DDR) a minimum of two weeks prior to the initial inspection to verify the inspection scheduling. The vendor shall supply a written schedule to the DDR a minimum of two weeks prior to the inspection date. The DDR shall approve any subsequent schedule changes When inspector(s) arrives at a TxDOT work location, the inspector shall work on all TXDOT cranes until all inspections for that location are completed. The vendor shall inspect and test TxDOT cranes during normal work hours, without interruption to perform any other duties at additional sites. Interruptions in the agreed upon schedule must be approved in writing by the DDR Have printed copies or electronic data files of test procedures with the mobile inspection and test vehicles, and furnish file copies including calibration and criteria for all inspections and tests to the DDR where the inspection or testing is performed Send a file copy to TxDOT, General Services Division, Attn.: Fleet Management, 125 E. 11 th Street, Austin, Texas Any subsequent revisions shall be furnished to the DDR and to the CM prior to any work being performed VISUAL INSPECTION: Shall be conducted every 12 months and include: Inspecting the integrity and operation of the complete crane unit, according to manufacturer s recommendation and all applicable OSHA, ASME and ANSI standards. This inspection shall include slings, and under chassis areas that affect stability, wherever applicable Magnetic particle testing, dry method and Dye Penetrate testing of all critical or suspect pins, welds and joints in accordance with the current ASTM E709 and E Ultrasonic testing on all critical pins in accordance with the current ASTM E Load test cranes every 48 months or on cranes that do not have inspection records on file. Ref. OSHA 29 CFR, Part RETEST (FOR VISUAL INSPECTION OR LOAD TEST) 4-12

5 DDR will contact vendor for retest of failed, repaired or originally missed cranes on an as-needed basis The vendor shall schedule the retest within two weeks of request Cost for retest shall be based on the type of service requested, plus mileage Service shall be dispatched from the vendor s facility that is closest to the crane in need of inspection and testing Mileage per trip shall not exceed 250 miles. Mileage reimbursement will be based on the vendor s bid. Mileage will be verified with the internet map software. Example: MapQuest Include digital color pictures to support comments made in the report All digital pictures in standard JPEG (JPG) format, with a minimum resolution of 6 megapixels The digital color pictures shall clearly show items needing correction and match the comments found in the report. The digital color pictures shall include the TxDOT Equipment number, where ever possible. 11. REPORT FORMAT REQUIREMENTS: All reports shall: Use Microsoft Word 2003 (or later) or compatible software approved by CM Be written in English, shall be grammatically and technically correct Be furnished on digital media using Microsoft Excel 2003 (or later) format Send the CM a USB flash drive, disk in CD-ROM or DVD format of approved reports, pictures and forms within five working days after completion of the district visual inspection and test (if performed). 12. FIELD REPORTING: The vendor shall provide TxDOT with a written report for each crane inspected. The report shall be completed and given to the TxDOT DDR where the inspection and testing was performed. A copy shall be sent to the CM within five working days after completion of the inspection and testing Each report shall contain a detailed summary of inspection findings. The findings shall cover items of concern found during the inspection. These items shall be separated into three categories: Category 1: Red Tagged units shall be taken out of service until the defect is corrected. Digital pictures shall be taken of the defective area and furnished with the report; Category 2: Cranes that are recommended for repairs, or parts replacement. These cranes are safe for service, but if left un-repaired will result in further cost or damage Category 3: Cranes free of defects and fit for service and meeting the applicable ASME, OSHA and manufacturers requirements In addition, each report shall contain: A Title: Crane Visual Inspection or Crane Load Test, or both TxDOT crane numbers, if available. The crane number shall be preceded by the district number designation, i. e., the Houston district number is 12-xxxxx, the Austin district number is 14-xxxxx, etc. The district numbers are listed in Attachment B TxDOT Districts. 5-12

6 Crane description: This description shall include, at a minimum, the crane make and model, and maximum rated capacity Manufacturer s serial number Date of visual inspection and date of load test (if test is done) Date of report Status of the crane according to Para Printed name and signature of inspector Test location, including district name and number Numbered pages (i.e., page of ) Signature of DDR Upon satisfactory completion of visual inspection and load test, a sticker shall be furnished to the TxDOT district where the inspection and test was performed For all cranes free of defects (Ref. Category 3) as described in Para , the vendor shall provide an inspection sticker recording the date of inspection, inspector s name, company name, company phone no. and the crane number. This inspection sticker shall be affixed prominently to the operator side door post of the truck or to the door of the control panel of the crane and shall remain legible until the next inspection. All previous inspection stickers shall be removed In the event that a crane is Red Tagged (Ref. Category 1) as described in Para , and cannot be returned to service, the vendor shall not provide an inspection sticker. 13. ANNUAL REPORT: The vendor shall provide an annual quantitative summary report of the inspection findings for the units tested which provides statistics, to be used as a management information tool. The report shall be furnished on digital media in Microsoft Excel format. A copy of this report shall be sent to TxDOT, General Services Division, and Attn.: Fleet Management Section, 125 E. 11th Street, Austin, Texas The report shall: Be composed of a spreadsheet with inspection information organized in individual cells as follows: District Equip. No.,(or Associat ed Truck) Inspection Date Make Model Serial No. of Crane Equip. Category Para 13.1 Description of All Defects Inspector Name Rec d Inspection Sticker A 01/02/03 Lift-a- Lot M127 DS150 I, II or III None found. John Doe 1/02/ Contain aggregate summaries for TxDOT s crane fleet. This report shall also contain detailed summaries organized by district number and inspection and or test location with descriptions of defects found on each crane. The vendor shall create an additional copy of each district s detailed summary and it to the respective RFM Differentiate between defects repaired at the inspection and defects repaired later. The report shall also note if a crane received an inspection sticker at the time of inspection Transmit or deliver all documentation electronically to TxDOT via , USB flash drive, CD-ROM or on DVDs The vendor shall retain copies of all records of reports for a minimum of seven years. 14. REPORT QUALITY: If TxDOT finds reports containing extraneous data or data that cannot be reconciled with TxDOT records (such as unidentifiable crane or serial number), the vendor shall 6-12

7 clarify data. If a return trip and or retest (Ref. Para ) of a crane with suspect data, is required it shall be completed at no cost to TxDOT. 15. UNSATISFACTORY PERFORMANCE: Unsatisfactory performance may result in cancellation of the purchase order. TxDOT may consider the following performance by the vendor as unsatisfactory performance. An unsatisfactory performance determination includes, but is not limited to: Three instances within one year of not contacting the district two weeks before start of the inspection (Ref. Para ) Three instances within one year of not sending Category 1 defect pictures to CM and to the DDR (Ref. Para ) Five instances of missing the deadline of inspecting the cranes within the same month as previous year s inspection (Ref. Para ) Five instances where vendor failed to respond and complete a retest within two weeks of notification (Ref. Para ). 16. PERSONNEL CONTINUITY AND REPLACEMENT TxDOT recognizes that events beyond the control of the vendor such as the death, physical or mental incapacity, long-term illness, or the voluntary termination of employment of the AM and Field Inspector(s) will require that the vendor propose a replacement. In the event that such a replacement is necessary, vendor agrees that no personnel shall begin work on the contract without prior written approval from TxDOT The vendor agrees that the AM and Field Inspector(s) assigned to the purchase order shall remain available throughout the term of the purchase order as long as that individual is employed by the vendor If TxDOT determines that the AM or Field Inspector(s) is unable to perform in accordance with the service requirements or to communicate effectively, the vendor shall immediately remove that person Proposed replacement personnel shall meet minimum qualifications and have experience comparable to the person(s) being replaced. Replacement personnel shall be provided at no additional cost to TxDOT. A profile and references will be requested for the proposed replacement(s) for review and approval prior to beginning on a project. TxDOT may reject any replacement if references or past working performance is questionable or unfavorable. TxDOT will be the sole judge of the qualifications of the proposed replacement personnel. 17. VENDOR PERSONNEL SAFETY: The vendor shall provide all required safety equipment and instruct personnel to observe all safety policies, rules and requirements at all times, including, but not limited to, wearing hard hats, safety shoes, goggles, etc. 18. WORK HOURS: TxDOT and vendor will agree on a work schedule. 19. SUBCONTRACTING Subcontractors providing service under the purchase order shall meet the same service requirements and provide the same quality of service required of the vendor No subcontract under the purchase order shall relieve the primary vendor of responsibility for the services The vendor shall be the primary contact for TxDOT and subcontractor(s) The vendor shall manage all quality and performance and schedules for subcontractors. The vendor shall be held solely responsible and accountable for the completion of all work for which the vendor has subcontracted. 7-12

8 19.5. TxDOT retains the right to check subcontractor's background and make a determination to approve or reject the use of submitted subcontractor(s). Any negative responses may result in disqualification of the subcontractor TxDOT reserves the right to request the removal of vendor s subcontractor staff deemed unsatisfactory by TxDOT Subcontracting shall be at the vendor s expense During the term of the purchase order, if the vendor determines a need for a subcontractor change, TxDOT shall be notified in writing by the vendor within 10 days of any proposed change. The vendor shall be required to provide references and work history for any proposed subcontractor to TxDOT. No change will be allowed without written authorization by TxDOT SOLICITATIONS OVER $100,000: TxDOT will make an initial determination of whether subcontracting is probable. It is the respondent s determination if they choose to subcontract any of the work under this purchase order with a Texas Certified Historically Underutilized Business (HUB) or other businesses If TxDOT has determined that subcontracting opportunities are probable, the class and items in which HUB s may be registered will be noted in the solicitation The respondent shall identify all proposed HUB and other subcontractors at the time of response submittal. The required forms with video instructions can be found at the following website: HUB SUBCONTRACTING PLAN (HSP) PRIME CONTRACTOR PROGRESS ASSESSMENT REPORT: After award of the purchase order, the vendor shall report all HUB and non-hub subcontractor information using the HSP Prime Contractor Progress Assessment Report form. The report shall be submitted to the TxDOT CM monthly. The report shall be submitted monthly even during the months the vendor is not invoicing TxDOT. All payments made to subcontractors shall be reported. TxDOT may verify the amounts being reported as paid by requesting copies of cancelled checks paid to subcontractors. 20. TRAVEL: All travel and per diem shall be included in the unit price, except for retests (Ref. Para ). 21. INVOICING INSTRUCTIONS: The vendor shall provide a comprehensive and detailed invoice with reference to the basis for each item charged. Original documentation that validates the charges shall be attached. The original invoice shall be sent to the address shown on the purchase order or ed to FIN_Invoices@dot.state.tx.us to ensure timely payment and shall include the following: Complete 16-digit purchase order number Vendor Employer Identification Number (EIN) Date and time of service Location of service List make and model of crane List equipment number of crane, if available List serial number of crane Technician s name Complete inspection report, signed by the DDR An invoice requiring correction shall be re-submitted with a new invoice date. 8-12

9 22. QUALITY ASSURANCE: TxDOT and the vendor will schedule progress review meetings at least once a year to review progress of vendor, and discuss inspection reports, comments, site visits from the field by local TxDOT representative(s). 23. TXDOT RESPONSIBILITIES: TxDOT will: Provide a Contract Manager (CM) and approval of all reports and format (Ref. Paras. 12. and 13.) Give written approval of the vendor s annual monthly work schedule after receipt by the CM (Ref. Paras and 10.1.) Designate a DDR at each district Provide a current up-dated copy of TxDOT region and district representatives Schedule periodic meetings with the vendor to monitor progress of work and to discuss content of reports (Ref. Para. 22.) Reserve the right for the CM to audit reports periodically and to ensure that all inspection and testing is being performed in accordance with specification requirements Provide copies of the schedule to each DDR prior to the date of scheduled inspection to allow the DDR adequate time to ensure cranes are available at the maintenance section for inspection (Ref. Para ) Ensure that all cranes are available for inspection and testing on the scheduled inspection date (Ref. Paras and 10.8.). 24. RESPONDENT SUBMISSION: The following shall be submitted with the response. Failure by the respondent to submit the documentation listed below will disqualify the respondent from further consideration GENERAL FORMAT: The respondent shall submit one signed and dated original (marked Original) and one copies (marked Copy). The submission shall be on one sided 8-1/2 x 11 inch paper. Include only the information specified for each section ORIGINAL RESPONSE: The original response shall include the following: Section 1 Invitation for Bid (IFB): Original signed, dated and completed IFB Section 2 Schedule 2 Company Profile and History Section 3 Financial Statement, if requested: Statement from the president, owner or financial officer on company letterhead certifying that the company is in good financial standing, current in payment of all taxes and fees (Ref. Para. 6.2.) Section 4 Schedule 3 Company Qualifications and Experience: The respondent shall demonstrate successful past performance through submission of documentation of relevant qualifications and experience: Name, address, phone number, and address of the person TxDOT should contact with any questions regarding the response submission Provide a brief description of related or similar services performed within the last seven years (Ref. Para. 6.1.) Managing related or similar services of comparable size and scope to the services within the solicitation Section 5 Annual Monthly Work Schedule (Ref. 10 25. AWARD SPECIFICATION NO Section 8 TxDOT HUB Subcontracting Plan or Self Performance Form (Ref. Para. 19) TxDOT reserves the right to award a single purchase order to the most responsive, responsible respondent meeting the specification. TxDOT may award to a single vendor, multiple vendors, or use any combination that best serves the interest of TxDOT TYPES OF AWARD Single Award: One purchase order awarded to a single vendor Multiple Award: A multiple award is the award of multiple purchase orders for the same line item(s) from a single solicitation to two or more vendors to provide the same or similar goods or services. 26. POST AWARD: Vendor(s) shall be required to attend a post award meeting in the Austin, TX with the TxDOT GSD purchasing and the CM responsible for the solicitation within 30 calendar days after the award of the purchase order. The purpose of the meeting is to review vendor(s) final work schedule and agree on report forms. Also to discuss the terms and conditions of the purchase order and to provide additional information regarding the purchase order. 27. CONTRACT ADMINISTRATION: Administration of the purchase order is a joint responsibility of the TxDOT Contract Administrator and TxDOT Purchasing. TxDOT Purchasing staff will be responsible for administering the contractual business relationship with the vendor Any proposed changes to work to be performed, whether initiated by TxDOT or the vendor, must receive final written approval in the form of a Purchase Order Change Notice signed by the authorized TxDOT purchasing agent Upon issuance of purchase order, TxDOT will designate an individual who will serve as the Contract Manager and point of contact between the agency and the vendor. The Contract Manager does not have any express or implied authority to vary the terms of the purchase order, amend the purchase order in any way or waive strict performance of the terms or conditions of the purchase order. This individual s contract management and contract administration responsibilities include, but are not limited to: Monitoring the vendor s progress and performance and ensuring services conform to established specification requirements Managing the financial aspects of the contract including approval of payments Meeting with the vendor as needed to review progress, discuss problems, and consider necessary action Identifying a breach of contract by assessing the difference between contract performance and non-performance Other areas as identified by the Comptroller of Public Accounts Contract Management Guide, latest edition

This person shall be responsible for coordinating and scheduling all inspections with the TxDOT Contract Manager (CM) (Ref. Para. 8.1). FIELD INSPECTORS: Shall be currently certified by Crane Institute of America, Inc. or by a crane inspection company that has been in business for a minimum of five years within the last seven years (Ref. Para. 8.2.). LEAD INSPECTOR: Shall have a minimum of three years experience within the last five years. This inspector shall have the primary responsibility of the day-to-day operations of the service requirements specified in accordance with the purchase order. This lead may be a visual inspector or load test inspector or both (Ref. Para ). LOAD TEST INSPECTORS: Shall have a minimum of three years experience within the last five years. Load Test Inspectors shall be certified according to the American Society for Nondestructive Testing (ASNT) guidelines (Ref. Para ). VISUAL INSPECTORS: Shall have a minimum of two years experience within the last five years. Visual Inspectors shall only inspect cranes for which they are certified to inspect (Ref. Para ). ALL INSPECTORS: Shall hold all necessary current and valid licenses and certifications for city or state as required by all applicable ASME, ANSI, and OSHA standards, rules and regulations (Ref.
