Ltd. a) under policy number HQ-ME b) issued at and dated Bangkok, Thailand, c) for the sum of EUR 89, N A R R A T I V E P A R T SUBJET OF INSPETION Based upon facts, documents and verbal information received from the applicant: Mrs. Hillcock of M/s W K Webster & o. Ltd., UK claim agent and representative of another party engaged: Mr. Korunka of M/s Hitachi able Europe s.r.o., zech Republic consignee, we are able to advise that the subject of our surveyor s inspection was a damaged shipment of 15 PALLETS OF AUTOMOTIVE PARTS sold by M/s Hitachi Metals (Thailand) Ltd., Thailand to M/s Hitachi able Europe s.r.o., zech Republic under 3 ommercial Invoices # , # and # and insured with M/s Sompo Insurance (Thailand) Public o. Ltd., who issued their Insurance Policy # HQ-ME covering the said cargo for the value of EUR 89, /BOR page 3

4 PAKING & STOWAGE The subject cargo was packed in the following manner: 75 products (electric cable) in a plastic bag; 1 bag in a cardboard carton; 20 cartons said to be on a wooden pallet with cardboard lid on top, equipped with cardboard edge reinforcements, tightened by plastic straps and shrink-foiled; 15 pallets loaded in 40 container # TRLU Handling marks This way up, Fragile, Keep dry. The mode of PAKING used and described above could be considered as USTOMARY AND SUFFIIENT for the said shipment assuming reasonable care is taken whilst handling. As no one was able to provide our surveyor with any details regarding the stowage and securing of the cargo in the container / truck and as our surveyor had no chance to inspect the goods therein, he is UNABLE TO PROVIDE ANY FURTHER OMMENTS ONERNING THE STOWAGE. TRANSIT The subject shipment was transported from Bangkok, Thailand to Hamburg, Germany on board of VESSEL NYK Olympus against Master Bill of Lading # BKKHAM and House Bill of Lading # HHE-BKK onsequently, the cargo was transported to Velemysleves, zech Republic by TRUK (license plate # 3AM 6592) resp. trailer (license plate # 9A2 3572) against MR Waybill # /BOR page 4

5 The goods were delivered to the consignee s warehouse in Velemysleves, zech Republic on The transportation chain was as follows: Forwarder: Ocean carrier: Road carrier: M/s Hankyu Hanshin Express (Thailand) o. Ltd. M/s EU Worldwide (Thailand) o. Ltd. M/s Kroop & o. NOTIFIATION During delivery operations at the consignee s warehouse in Velemysleves, zech Republic, mechanical damage to 1 pallet (out of 15 pcs in total) was noted. Therefore, EXEPTIONS were TAKEN on the relevant MR Waybill by the consignee. Also, his internal Damage Report dated was issued. The above stated ascertainment was the reason why the consignee contacted his supplier and, as a consequential step, our agency was on contacted by the claim agent with a request to conduct an inspection of the affected cargo. Accordingly has the consignee been instructed, by us, to reserve all rights of the underwriters against responsible third parties. As a result of this effort, NOTIFIATION LETTER dated and addressed to the forwarder was PRESENTED by the supplier. opy of this document forms an integral part of this report. Such being the case, our surveyor visited the consignee s warehouse in Velemysleves, zech Republic aiming to ascertain the nature, extent and eventually the cause of damage sustained. The inspection was executed on in the presence and kind assistance of: Mr. Korunka consignee s representative and Mr. Borkovec our surveyor /BOR page 5

6 FINDINGS After arrival of our surveyor to the consignee s warehouse, the following goods were presented for his inspection: Description of goods Quantity State part # HV00B part # HV00 part # HV00A TOTAL 450 pcs (6 cartons) 450 pcs (6 cartons) 600 pcs (8 cartons) 1,500 pcs (20 cartons) cardboard cartons to various extent crushed / pressed / deformed / torn executed 30% random check revealed the following: products visually intact, potential latent damage and/or malfunction cannot be excluded ILLUSTRATION PHOTOS The consignee claimed a total loss for the presented goods (1,500 pieces) and insisted on being fully (100%) indemnified /BOR page 6

7 During the inspection, our surveyor suggested to consider a possibility of sorting and detailed check / testing of the products, if possible and efficient. As per the consignee, he is not equipped with necessary devices, so the cargo would have to be transported back to the supplier in Thailand. Furthermore, even after successful testing operations, the products could not be used / installed into vehicles, as potential latent damages may be revealed during further usage. In view of the above stated, the consignee rejected any of the suggested operations. Our surveyor requested such statement incl. estimate of relevant costs in written form. On , our agency was informed by the claim agent that the supplier also rejected the suggested loss minimizing procedures and requested scrap of the claimed goods (1,500 pieces). At the same time, consignee s quality department statement was presented, which however did not contain the required information. The only available estimate of expenses were freight costs in amount of TBH 50, (= approx. EUR 1,430.00). Subsequently, the claim agent instructed our agency to close this case by issuing our final report on basis of available documents and information only. The claimed parts will be allegedly scrapped, however, our agency is not able to control the situation of this claim anymore and it is not in our power to further interfere. 8 For the purpose of determining the limit of the carrier s liability it can be stated that gross weight of the subject goods was kg or kg (there is a difference in weights mentioned in the relevant Packing Lists). AUSE AND TIME OF LOSS Due to the following facts: during delivery operations at the consignee s warehouse in Velemysleves, zech Republic, mechanical damage to 1 pallet (out of 15 pcs in total) was noted; exceptions were taken on the relevant MR Waybill by the consignee; consignee s internal Damage Report dated was issued; state of goods ascertained by our surveyor during inspection; the found nature and extent of loss and being not aware of any other casualty, we are able to state, that the cause of loss could be most probably attributed to: and/or ROUGH AND ARELESS MANIPULATION WITH THE ARGO IMPROPER STOWAGE OF THE ARGO DURING THE UNDERTAKEN TRANSPORTATION BETWEEN BANGKOK, THAILAND AND VELEMYSLEVES, ZEH REPUBLI.
