1 13 July GRINDROD TERMINALS (PTY) LIMITED: APPLICATION FOR WATER USE LICENCE AT THE NAVITRADE SITE, UMHLATHUZE LOCAL MUNICIPALITY, KWAZULU NATAL PROVINCE Notice issued in terms of sections 40 and 41(4) of the National Water Act, 1998 (Act 36 of 1998) (NWA) and the requirements of Government Notice (GN) 40713, Regulation R.267 Dear Stakeholder This letter serves to notify interested and affected parties (I&APs) of Grindrod Terminal s proposed application for a Water Use Licence as stipulated under section 21(c), (i), and (g) of the National Water Act (NWA) (Act 36 of 1998) to be supported by an Integrated Water and Waste Management Plan (IWWMP) for the operations at its Navitrade site, located in Richards Bay, Kwazulu Natal. Background Grindrod Terminals (Pty) Limited is a division of Grindrod SA. The Grindrod Terminals operations are an amalgamation of several smaller dry bulk logistics and bulk handling operations. These operations include Kusasa Logistics (Kusasa), Navitrade Bulk Transfer facility (Navitrade), Valley Terminals (Valley) and Seamunye Port Holdings (Seamunye) that are now all trading as Grindrod Terminals, situated in Richards Bay, which fall within the jurisdiction of the Mhlathuze Local Municipality, KwaZulu Natal. The primary function of the Grindrod Terminals facilities in Richards Bay is to act as storage and transfer facilities where certain bulk materials may be moved from their source into storage, stored for a certain time period and then transferred in differing quantities to an alternative or final destination, depending upon market demand. Navitrade operates a coal handling and storage facility that can accommodate up to tons at Navitrade. The coal is transported to the Navitrade sites from various coal mines in the northern KwaZulu Natal and Mpumalanga via Transnet Freight Rail (TFR). Furthermore, the Navitrade site falls within the quaternary catchment W12F in the Mhlathuze Water Management Area. The company intends to apply for a Water Use License to the Department of Water and Sanitation (DWS) in terms of section 21(c), (g) and (i) of the NWA. Grindrod Terminals (Pty) Limited has appointed Golder Associates Africa (Pty) Ltd (Golder), an independent environmental and engineering consultant, to compile the Water Use Licence Application (WULA) and conduct a public participation process. An Integrated Water and Waste Management Plan (IWWMP) will be included to support the licence application. Project location The Navitrade site is situated within 4km from the port of Richards Bay along the KwaZulu Natal north coast and it is visible from the R34 on the northern boundary. The site covers an area of approximately 14 ha and is located on Portion 95 of Erf 5333, Richards Bay Township (see locality map enclosed). 1

2 Project motivation Grindrod Terminals wish to apply for a Water Use License as the site falls within the 500m radius of wetlands and the existing coal stockpiles have the potential to trigger a Section 21 (c) (g) and (i) water uses. The applicable water uses include: Section 21(c): Impending or diverting the flow of water in a water course; Section 21(g): Disposing of waste in a manner which may detrimentally impact on a water resource; and Section 21(i): Altering the bed, banks, course or characteristics of a water course removing, An Integrated Water and Waste Management Plan (IWWMP) will be produced as a supporting document for the WULA. The IWWMP will include an identification of all relevant water and waste issues and define knowledge gaps with associated action plans for the Navitrade site. Your comment is important, please Golder would like to invite stakeholders to register as Interested and Affected Parties (I&APs) and to lodge written comments regarding the proposed WULA during the 60 (sixty) day comment period, which will commence on Friday,13 July 2018 and conclude on Monday,10 September In terms of the NWA, section 41, the purpose of the public comment period is to provide stakeholders with an opportunity to comment on the WULA and register as I&APs. Stakeholders may comment on the WULA in any of the following ways: By completing the comment and reply sheet enclosed with this letter; By writing a letter or providing additional written submissions; and By , fax or telephone to the Public Participation Office.
