2 Notice Inviting Tender (NIT) for DAP and DAP-Lite This is a Notice Inviting Tenders (NIT) from producers/manufacturers, suppliers/authorized traders for supply of Di-Ammonium Phosphate (DAP)/ DAP-Lite for quantity of 2,00,000 MT (+/-10%) in bulk, meeting the specifications as specified hereinafter as per the terms and conditions stated hereinafter: 1.00 Tender No : NFL/CMO/I&AP/IMPORT/DAP & DAP-Lite/ / Product and Packing :Di-Ammonium Phosphate (DAP) and/ or DAP Lite in loose bulk Specifications: Di-Ammonium Phosphate (DAP) FCO Grade Total Nitrogen : 18.00% Minimum by weight Nitrogen as Ammonical Nitrogen : 15.50% minimum by weight Total Nitrogen in the form of Urea : 02.50% maximum by weight Neutral Ammonium Citrate : 46.00% minimum by weight Soluble Phosphates(as P2O5) Water Soluble Phosphate(as P2O5) : 41.00% Minimum by weight Tolerance Limit in plant Nutrient : units for N & P contents As per FCO : Moisture : 01.50% Maximum by weight Particle Size : 90% should pass through 4 mm IS Sieve and be retained on 1 mm IS Sieve. Below 1 mm size should not be more than 5% Di-Ammonium Phosphate (DAP)-Lite FCO Grade Moisture : 03.00% Maximum by weight Total Nitrogen : 16.00% Minimum by weight Ammonical nitrogen : 14.00% Minimum by weight Total Nitrogen in the form of Urea : 02.00% maximum by weight Neutral Ammonium Citrate : 44.00% minimum by weight Soluble Phosphates(as P2O5) Water Soluble Phosphate(as P2O5) : 37.00% Minimum by weight Particle Size : 90% should pass through 4 mm IS Sieve and be retained on 1 mm IS Sieve. Below 1 mm size should not be more than 5% Physical condition: Material shall be free flowing and granular form only. DAP and DAP-Lite shall be Black/ Dark Brown in colour Scale of Penalties: i) Nutrient Losses: For deficiency in nutrients beyond the limit specified in FCO, the cargo will be rejected. The supplier shall refund the landed cost of the cargo found unfit as well as all the consequential handling and the distribution cost thereof immediately on NFL s first demand with value date being date of initial payment to the supplier, failing which 17.26% p.a. shall be payable up to the date of actual remittance by the supplier. ii) With regard to penalty or excess moisture contents, the penalty will be levied on prorata basis. The scale of penalty will be prescribed as two times the value of fertilizer equivalent to excess moisture content in entire shipment by weight. - Page 2 of 5 -

3 iii) The penalty on account of deviation in particle size which will be of two components: a) Penalty on account of deficiency in particle size b) Penalty on account of excess over size particle The net penalty on account of particle size deviation would be total of its two components (a + b) which will be determined as under: a) Deficiency in Particle Size: (Percentage of material below the lower sieve in the sample) (-) (Maximum permissible percentage of material below the lower sieve). The penalty on account of deficiency will be 30% of the value of material equivalent to deficiency in particle size (defined above) in entire shipment. b) Percentage of over-size material: (Percentage of material above upper sieve in the sample) (-) (Maximum permissible percentage above upper sieve) The penalty on account of over-size will be 15% of the value of fertilizer determined as over size in entire shipment Tender Quantity: : 2,00,000 MT (+/-10%) for DAP/ DAP-Lite (subject to clause No. : 1.07 of GTC) : 5.00 Earnest Money Deposit (EMD): Refer Clause 4.00 of GTC For Category (i) For Category (ii) For Category (iii) Nil US$ 1.00 PMT or equivalent Indian Rs. The Shipment Schedule/Delivery is as indicated in clause In case of FOB contracts, supplier shall confirm firm laycan and port of loading for chartering of suitable vessels. NFL shall require 15 clear working days in India for nomination of suitable vessels after confirmation of firm laycan and loading port by supplier. After nomination of vessel within this stipulated period, the supplier shall not be allowed to change port of loading and laycan period. Vessels chartered for discharge at Kandla, Kakinada Deep waters and Vishakapatnam ports shall be handled at jetty. While discharge of cargo, vessel should be self geared bulk carriers fitted with minimum four cranes of 25 MT SWL each with minimum outreach of 8.5 metres and suitable for Grab discharge (Crane should be able to serve all hatches & preferably having on board grabs). Use of shore crane is optional. The vessel should be able to supply sufficient power to operate all cranes & loaded grabs simultaneously Details Of Discharge Port: Kandla, Vishakapatnam, Rozi (Jamnagar) and Kakinada Deep Waters or any major port on the West Coast/East Coast of India, at the discretion of NFL. (i) Rate of Discharge:- As per Clause above. (ii) LOA (iii) Beam LOA/Beam/Draft as allowable/applicable for the particular port for which the vessel (iv) Draft will be nominated for discharging The contract will be operated on FOB basis and the vessels shall be chartered through Transchart. In case of non-availability of vessels through Transchart, the contract shall be operated on C&F basis after obtaining NOC by NFL from Transchart, on shipment-to-shipment basis.

5 - Page 4 of Sampling & Analysis: The sampling and analysis shall be carried out by internationally reputed independent inspection agency appointed by NFL at load port. The analysis report shall form a part of LC documents The representative composite samples for determining the quality and verification of the various constituents detailed under clause no 3.00 of NIT shall be drawn in customary manner during the loading operation by inspection agency appointed by NFL The supplier, if so desire, can nominate their representative to supervise the draft survey and drawl of samples at their own expenses Sample drawn by inspection agency during loading operation shall be sealed in glass jars, two of which shall be sent to NFL with the Master of vessel for delivery to NFL s nominees at port of discharge, two to be retained by NFL s representative appointed at load port and other two to be given to supplier for reference. A certificate of sampling detailing destination of the samples shall be made out and signed by both the parties to the sampling process NFL/ their agent shall draw samples for determining the quality of cargo at the port of discharge through any state /Central Fertilizer Quality Control Laboratory in India. The quality so determined at discharge port shall be final and binding Weighment: The draft survey shall be conducted through an independent internationally reputed surveyor/ inspection agency appointed by NFL at the port of loading and the B/L shall be drawn based on the draft survey. The Draft Survey report and the Certificate of Weight shall form a part of LC documents The Weighment shall be determined by draft survey conducted through an independent internationally reputed surveyor/ inspection agency appointed by NFL at the port of discharge. The material cost shall be based on B/L quantity NFL reserves the right to re-export the DAP and DAP-Lite procured, to any buyer in the neighboring countries at its sole discretion The other terms & conditions shall be as per the enclosed General Terms & Conditions (GTC) and the annexures thereto. Note: The Un-priced Commercial & Technical bid should be accompanied with the copy of price bid with the prices blanked. Criteria for Qualifying Technical Bid are as under: 1. Acceptance of terms & conditions of NIT & GTC by signing all the pages. 2. Bid Bond/ EMD as per category indicated above. 3. Cost of Tender Documents for Rs.500/-. 4.
